which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Space National Guard.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H471C3527B7D44D2396014C121D74A560"><section section-type="section-one" id="H60822B400B4C46208B997DC3874361F1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space National Guard Establishment Act</short-title></quote>.</text></section><section id="H732D72A868CC434EB0708CDF611E8291"><enum>2.</enum><header>Establishment of Space National Guard</header><subsection id="H64B777116508403D8CC98C612D651B3D"><enum>(a)</enum><header>Establishment</header><paragraph id="H26B087F92F5B4795B702BADFA7DC2CB7"><enum>(1)</enum><header>In general</header><text>There is established a Space National Guard that is part of the organized militia of the several States and Territories, Puerto Rico, and the District of Columbia—</text><subparagraph id="HAD545A5F62E04C46A6D1776B60A1AE07"><enum>(A)</enum><text>in which the Space Force operates; and</text></subparagraph><subparagraph id="H980F39BD4D1A4E4C93AF9B188D119161"><enum>(B)</enum><text>active and inactive.</text></subparagraph></paragraph><paragraph id="HC715C5009E6D4126BF26F6A496B121A3"><enum>(2)</enum><header>Reserve component</header><text display-inline="yes-display-inline">There is established a Space National Guard of the United States that is the reserve component of the United States Space Force all of whose members are members of the Space National Guard.</text></paragraph></subsection><subsection id="HE185D56C548B40008DA19551AC6707EE"><enum>(b)</enum><header>Composition</header><text>The Space National Guard shall be composed of the Space National Guard forces of the several States and Territories, Puerto Rico, and the District of Columbia—</text><paragraph id="HDFBA3137D58E4815B543B5A4116EFC6C"><enum>(1)</enum><text>in which the Space Force operates; and</text></paragraph><paragraph id="HDF5BD60B838841989702CD9E3C8D0CB0"><enum>(2)</enum><text>active and inactive.</text></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H69E3B2D630334B22BC4D46A66B233129"><enum>3.</enum><header>No effect on military installations</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to authorize or require the relocation of any facility, infrastructure, or military installation of the Space National Guard or Air National Guard.</text></section><section id="H9843B8AE450340C68160591136795470"><enum>4.</enum><header>Implementation of Space National Guard</header><subsection id="H5016CA6A778045DE8FC274B4575165E3"><enum>(a)</enum><header>Requirement</header><text>Except as specifically provided by this Act, the Secretary of the Air Force and the Chief of the National Guard Bureau shall implement this Act, and the amendments made by this Act, not later than 18 months after the date of the enactment of this Act.</text></subsection><subsection id="H20B9DE0FEB4D49C1954C342614E5443B"><enum>(b)</enum><header>Briefing required</header><paragraph id="id88AE943046A44777B9835FCCC63C7629"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, and annually for the five subsequent years, the Secretary of the Air Force, the Chief of the Space Force, and the Chief of the National Guard Bureau shall jointly provide to the congressional defense committees a briefing on the status of the implementation of the Space National Guard pursuant to this Act and the amendments made by this Act. </text></paragraph><paragraph id="id84217033F44245038F71FC640D389D3D"><enum>(2)</enum><header>Elements</header><text>The briefing required by paragraph (1) shall address—</text><subparagraph id="idE7470B7021054A5CA683093546F990C7"><enum>(A)</enum><text>the current missions, operations and activities, personnel requirements and status, and budget and funding requirements and status of the Space National Guard; and </text></subparagraph><subparagraph id="id2FCBC7CAFD4D402BA7B1DB425BE5E356"><enum>(B)</enum><text>such other matters with respect to the implementation and operation of the Space National Guard as the Secretary and the Chiefs jointly determine appropriate to keep Congress fully and currently informed on the status of the implementation of the Space National Guard. </text></subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H81D49A83450F410882963450ADA48250"><enum>5.</enum><header>Conforming amendments and clarification of authorities</header><subsection id="HEDBFF7006134403D99C549491457807C"><enum>(a)</enum><header>Definitions</header><paragraph id="HD57C5B8D76B64F508D4D5F8E7E80B177"><enum>(1)</enum><header>Title 10, United States Code</header><text>Title 10, United States Code, is amended—</text><subparagraph id="H9873CEF8B24C4DC18627380A2B794773"><enum>(A)</enum><text display-inline="yes-display-inline">in section 101—</text><clause id="H3F6887D51C97463EA0E445DE98A941DC"><enum>(i)</enum><text>in subsection (c)—</text><subclause display-inline="no-display-inline" id="H34A775834CD141B7B95230D4CD4A714D"><enum>(I)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (8) and (9), respectively; and</text></subclause><subclause id="H1F453066DDF940069154C524BE4CD138"><enum>(II)</enum><text>by inserting after paragraph (5) the following new paragraphs:</text><quoted-block style="OLC" id="H93B0E545C8E24D2796D8C307435B4998"><paragraph id="H803BEE7AF9CE4F53BFD639E78B055899"><enum>(6)</enum><text>The term <quote>Space National Guard</quote> means that part of the organized militia of the several States and territories, Puerto Rico, and the District of Columbia, active and inactive, that—</text><subparagraph id="HBBE9CE7D27A549E5A6D458702066A70F"><enum>(A)</enum><text>is a space force;</text></subparagraph><subparagraph id="H204AE58E247247948C1A6AD89CDF2957"><enum>(B)</enum><text>is trained, and has its officers appointed under the sixteenth clause of section 8, article I of the Constitution;</text></subparagraph><subparagraph id="H4AF06DB8BAC443D9AE1B914D073A988A"><enum>(C)</enum><text>is organized, armed, and equipped wholly or partly at Federal expense; and</text></subparagraph><subparagraph id="HE3C837F94C684518A004508715A96A1E"><enum>(D)</enum><text>is federally recognized.</text></subparagraph></paragraph><paragraph id="H1B837A0881544A96A325D55281CC8090"><enum>(7)</enum><text display-inline="yes-display-inline">The term <quote>Space National Guard of the United States</quote> means the reserve component of the Space Force all of whose members are members of the Space National Guard.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph id="H7CC662AB2173462393BE74ADC9EA7F9F"><enum>(B)</enum><text>in section 10101—</text><clause id="H045A181D486D45C0938C4DDA5BC4CB0D"><enum>(i)</enum><text>in the matter preceding paragraph (1), by inserting <quote>the following</quote> before the colon; and</text></clause><clause id="H3AED7C158A1141A1BD64E363572612D4"><enum>(ii)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="H35413A9BD1F14A3184EB4F502294750B"><paragraph id="H51B6BC0C65BA4338969D295D5882CBC3"><enum>(8)</enum><text display-inline="yes-display-inline">The Space National Guard of the United States.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HDF7316EF5D9C4F938A74F9A0B2C78AB9"><enum>(2)</enum><header>Title 32, United States Code</header><text>Section 101 of title 32, United States Code is amended—</text><subparagraph id="H0DE5AF6108134AD5A397258198822AFC"><enum>(A)</enum><text>by redesignating paragraphs (8) through (19) as paragraphs (10) through (21), respectively; and</text></subparagraph><subparagraph id="H5D5E16297E3841319FD308B8B71B1411"><enum>(B)</enum><text>by inserting after paragraph (7) the following new paragraphs:</text><quoted-block style="OLC" id="HA6D1C3A8F4A641C2B7035DD0CF8BF3CB"><paragraph id="HFF44699B976D488EACE4099336DB5133"><enum>(8)</enum><text display-inline="yes-display-inline">The term <quote>Space National Guard</quote> means that part of the organized militia of the several States and territories, Puerto Rico, and the District of Columbia, in which the Space Force operates, active and inactive, that—</text><subparagraph id="H08E17C4477C34C1AAB454AAE065D05BB"><enum>(A)</enum><text>is a space force;</text></subparagraph><subparagraph id="H48ECD6B06062482CB13F4ED49C3B4536"><enum>(B)</enum><text>is trained, and has its officers appointed under the sixteenth clause of section 8, article I of the Constitution;</text></subparagraph><subparagraph id="H7A60025757BD43F78FC236401C8D2335"><enum>(C)</enum><text>is organized, armed, and equipped wholly or partly at Federal expense; and</text></subparagraph><subparagraph id="HA204B9BFB55448AA9A37091502E68D1F"><enum>(D)</enum><text>is federally recognized.</text></subparagraph></paragraph><paragraph id="HD0D9924EAA8740CC80A93D116CC6BD5B"><enum>(9)</enum><text display-inline="yes-display-inline">The term <quote>Space National Guard of the United States</quote> means the reserve component of the Space Force all of whose members are members of the Space National Guard.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HAF9B27FEB47E459EBC1F3FD1DBC85D48"><enum>(b)</enum><header>Reserve components</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1003">Chapter 1003</external-xref> of title 10, United States Code, is amended—</text><paragraph id="HAAA17C129A234AE28AD53032C977FB1F"><enum>(1)</enum><text>by adding at the end the following new sections:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC749BE66FF584B5DAF77ADED03838E61"><section id="H73F7AE832F16437F9182EC769B3CFCA7"><enum>10115.</enum><header>Space National Guard of the United States: composition</header><text display-inline="no-display-inline">The Space National Guard of the United States is the reserve component of the Space Force that consists of—</text><paragraph id="H1B64AB6A3A4E46569C3B0A139885D7D0"><enum>(1)</enum><text display-inline="yes-display-inline">federally recognized units and organizations of the Space National Guard; and</text></paragraph><paragraph id="H02548511B6874FBE84E1DFF43C798C1B"><enum>(2)</enum><text display-inline="yes-display-inline">members of the Space National Guard who are also Reserves of the Space Force.</text></paragraph></section><section id="HB41216AB3AFB4835B67FE466A0556D48"><enum>10116.</enum><header>Space National Guard: when a component of the Space Force</header><text display-inline="no-display-inline">The Space National Guard while in the service of the United States is a component of the Space Force.</text></section><section id="H35587979326846EB92A0B2EA5CBC3E63"><enum>10117.</enum><header>Space National Guard of the United States: status when not in Federal service</header><text display-inline="no-display-inline">When not on active duty, members of the Space National Guard of the United States shall be administered, armed, equipped, and trained in their status as members of the Space National Guard.</text></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H324706D9F59F4538B1383E7B58031CEC"><enum>(2)</enum><text>in the table of sections at the beginning of such chapter, by adding at the end the following new items:</text><quoted-block style="USC" display-inline="no-display-inline" id="H1290968A6AA942BDB9ED1B9505448C6F"><toc regeneration="no-regeneration"><toc-entry level="section">10115. Space National Guard of the United States: composition. </toc-entry><toc-entry level="section">10116. Space National Guard: when a component of the Space Force. </toc-entry><toc-entry level="section">10117.
