which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the establishment of a Water Project Navigators Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Project Navigators Act</short-title></quote>.</text></section><section id="idcb66c76a8dcd443abae0ceec1f54afcc"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id2d8eb9011f8744e5addc1799b158739e"><enum>(1)</enum><header>Disadvantaged community</header><text>Except as otherwise defined by the Secretary of the Interior (acting through the Commissioner of Reclamation) based on current methodologies, the term <term>disadvantaged community</term> means a community (including a city, town, county, or reasonably isolated and divisible segment of a larger municipality) with an annual median income that is less than the statewide annual median income for the State in which the community is located, according to the most recent decennial census.</text></paragraph><paragraph id="id75f3471c4a484c7e8a33285c45d0f31a"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="id9e4ef681ca2f478cb94f05ad9701d4cb"><enum>(A)</enum><text>a State, Indian Tribe, acequia, land grant-merced, local government, water supplier, or municipal water district located in an eligible State;</text></subparagraph><subparagraph id="id2bce85f1176144d8af935d2630e6017e"><enum>(B)</enum><text>any State, regional, or local authority located in an eligible State, the members of which include 1 or more organizations with water or power delivery authority;</text></subparagraph><subparagraph id="id33e941bc8157497e913cc2c7f3102459"><enum>(C)</enum><text>a nonprofit conservation organization located in an eligible State;</text></subparagraph><subparagraph id="id40da46f25ca44dc3afc9af2f523a219e"><enum>(D)</enum><text>an agency located in an eligible State that is established under State or Tribal law for the joint exercise of powers; or</text></subparagraph><subparagraph id="idf7d797e957c74e6d9d68a55a7ee2f96d"><enum>(E)</enum><text>a combination of entities described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="idf1c23c0959934f6e908838fba8c93622"><enum>(3)</enum><header>Eligible state</header><text>The term <term>eligible State</term> means—</text><subparagraph id="id7354f372c3e0455199ed29ee40f02b17"><enum>(A)</enum><text>a State or territory described in the first section of the Act of June 17, 1902 (<external-xref legal-doc="usc" parsable-cite="usc/43/391">43 U.S.C. 391</external-xref>; 32 Stat. 388, chapter 1093);</text></subparagraph><subparagraph id="id941e5b0604324281932a1f4453399ebe"><enum>(B)</enum><text>the State of Alaska;</text></subparagraph><subparagraph id="id932d636247d04df58af0160caa909cea"><enum>(C)</enum><text>the State of Hawaii; and</text></subparagraph><subparagraph id="id4adab8cb14cf49789128e9a2f528860b"><enum>(D)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph id="iddcf7d44d8c7b4918ab4f0d619e754b1d"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idf0204bbfca734ecea70bab6371792049"><enum>(5)</enum><header>Multi-benefit water project</header><text>The term <term>multi-benefit water project</term> means any project in an eligible State that—</text><subparagraph id="id0ace30ffe30845ceb293fa8d6c645adf"><enum>(A)</enum><text>enhances the overall resilience of water supplies to climate-related impacts, including through activities—</text><clause id="idb9f662d735444802aad667b15c307090"><enum>(i)</enum><text>to increase water use efficiency;</text></clause><clause id="id22488bf046114a148a0de56c2d83fd11"><enum>(ii)</enum><text>to reduce consumptive use of water;</text></clause><clause id="idf5233da756714d3baf0d33a11e8e8b12"><enum>(iii)</enum><text>to promote system conservation;</text></clause><clause id="id780d26f18444462fb0c666618c941c52"><enum>(iv)</enum><text>to reduce water supply-demand imbalances;</text></clause><clause id="id5abc14fc4a41455f8a23c13406667352"><enum>(v)</enum><text>to promote water recycling and other advanced water treatments to augment water supplies;</text></clause><clause id="idee75298b30c14f91b99884b0780df5be"><enum>(vi)</enum><text>to improve management or delivery of water resources; or</text></clause><clause id="id0b33420e97cc4846b3d3cb932679e140"><enum>(vii)</enum><text>to encourage sustainable surface water or groundwater management; and</text></clause></subparagraph><subparagraph id="idfbfd44f39cca4a729317328c141736c6"><enum>(B)</enum><text>provides benefits to communities and ecosystems, including through activities—</text><clause id="id24c14dcec95441f8acc5f0a9bb2cf025"><enum>(i)</enum><text>to conserve or enhance fish and wildlife habitat;</text></clause><clause id="idffae9f7512ec4b22b46954e888adc0a3"><enum>(ii)</enum><text>to improve water quality;</text></clause><clause id="iddd3837e98b9c4a7b8b7fe04a3e88fa2c"><enum>(iii)</enum><text>to improve watershed health and function;</text></clause><clause id="id22b5cfbd3d5f494a8589eebbdf87ae65"><enum>(iv)</enum><text>to enhance recreational opportunities;</text></clause><clause id="id555c8af1db94419ca933af225c868c75"><enum>(v)</enum><text>to promote rural economic development; or</text></clause><clause id="id36566f6b36d4402f8db7617975956727"><enum>(vi)</enum><text>to address risks to communities and infrastructure from climate change.</text></clause></subparagraph></paragraph><paragraph id="id771e18fce0ab4c199e7f43b7a5774abf"><enum>(6)</enum><header>Natural feature</header><text>The term <term>natural feature</term> means a feature that is created through the action of physical, geological, biological, and chemical processes over time.</text></paragraph><paragraph id="idaf835a3ddfb04805a882070e029881e1"><enum>(7)</enum><header>Nature-based feature</header><text>The term <term>nature-based feature</term> means a feature that is created by human design, engineering, and construction to provide a means to reduce water supply and demand imbalances or drought or flood risk by acting in concert with natural processes.</text></paragraph><paragraph id="id96571b62dc474b40a9a6cef0110a84a4"><enum>(8)</enum><header>Program</header><text>The term <term>Program</term> means the Water Project Navigators Program established under section 3(a).</text></paragraph></section><section id="idc3e2c79a6b0140e993d60d44030059ec"><enum>3.</enum><header>Water project navigators program</header><subsection id="id953902531c3941238a8b465103b1713f"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of the Interior (acting through the Commissioner of Reclamation) (referred to in this Act as the <quote>Secretary</quote>) shall establish a program to support the development and implementation of multi-benefit water projects within eligible States, to be known as the <quote>Water Project Navigators Program</quote>.</text></subsection><subsection id="idc92247abfdc04931af99f8a8630c79c7"><enum>(b)</enum><header>Authority</header><text>In carrying out the Program, the Secretary may award grants or cooperative agreements to eligible entities to support the creation or continuation of multi-benefit water project navigator positions.</text></subsection><subsection id="ida34c90219b8742eeadb321f6adcd245f"><enum>(c)</enum><header>Criteria and guidelines</header><paragraph id="id78116e70d8e84a6393852b068d01841b"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop criteria and guidelines for awarding grants and cooperative agreements under the Program that consider—</text><subparagraph id="id475121b804984d0384b3dcc5251b4948"><enum>(A)</enum><text>the potential of the eligible entity to accelerate development and implementation of multi-benefit water projects within—</text><clause id="ide54c9a85a7d24598a201c71d2a0b2ae5"><enum>(i)</enum><text>the jurisdiction or service area of the eligible entity; or</text></clause><clause id="id9312587fa2b643c5b74deca9a0458050"><enum>(ii)</enum><text>in the case of an eligible entity that is a nongovernmental applicant, an area in which the eligible entity has a demonstrated history of productive engagement with the community and stakeholders;</text></clause></subparagraph><subparagraph id="id8bccda2590b14f37b272602a2f345b5d"><enum>(B)</enum><text>any history of development of multi-benefit water projects by the eligible entity; and</text></subparagraph><subparagraph id="id352acc5a641345269c1ffc30a6e2d5c4"><enum>(C)</enum><text>any potential multi-benefit water projects the eligible entity has not yet implemented due to lack of capacity.</text></subparagraph></paragraph><paragraph id="id3d9ce2d96b4745e1b39c735ed31c019e"><enum>(2)</enum><header>Prioritization</header><text>The criteria and guidelines developed under paragraph (1) shall include prioritization criteria for awarding grants or cooperative agreements, which shall include prioritizing applications from eligible entities—</text><subparagraph id="ide27a3883050948168a86c193167de9a2"><enum>(A)</enum><text>that would provide benefits for Indian Tribes, disadvantaged communities, and other eligible entities with limited project development resources and capacity;</text></subparagraph><subparagraph id="id446b8c0afd164cb6bcdd796d8a1ca526"><enum>(B)</enum><text>that would provide support for local job creation and retention;</text></subparagraph><subparagraph id="idee44f6685b4041289fd6b6c8358542f7"><enum>(C)</enum><text>with a demonstrated intent and ability to incorporate improvements to the condition of a natural feature or nature-based feature in multi-benefit water projects designed under the Program;</text></subparagraph><subparagraph id="idffa7f44695dd43f2ab25cb81c17d588d"><enum>(D)</enum><text>with demonstrated support from multiple stakeholders, including Indian Tribes, representatives of irrigated agricultural production, hydroelectric production, municipal and industrial water users, local governments, community-based organizations, and nonprofit conservation organizations;</text></subparagraph><subparagraph id="id1383df013fbe4060800df01805a2c081"><enum>(E)</enum><text>that would provide benefits for areas experiencing severe long-term drought; and</text></subparagraph><subparagraph id="id5b7e22d2e955481fa49bc84081467f1f"><enum>(F)</enum><text>with the capability to work in coordination with other projects that have been funded under, or help advance the objectives of, other Department of Interior programs, including a program authorized under—</text><clause id="id5d43d37153784564ad622674bfe16f28"><enum>(i)</enum><text>section 9504 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10364">42 U.S.C. 10364</external-xref>);</text></clause><clause id="id82ca1e0315e04bc9ada750396ffb009c"><enum>(ii)</enum><text>section 6002 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/1015a">16 U.S.C. 1015a</external-xref>);</text></clause><clause id="id307734bc9915425eb550efcb1ce14441"><enum>(iii)</enum><text>section 1109 of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/33/2330c">33 U.S.C. 2330c</external-xref>);</text></clause><clause id="id097f6fabb33145469542429c9a600058"><enum>(iv)</enum><text>title IX of division D of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3201">43 U.S.C. 3201 et seq.</external-xref>); or</text></clause><clause id="idbc11f8e404124b609b5684a51424d649"><enum>(v)</enum><text>section 50233 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (136 Stat. 2053).</text></clause></subparagraph></paragraph><paragraph id="id55c2ce1905d04978bf4287f9ed6f119f"><enum>(3)</enum><header>Public comment</header><text>Before finalizing the criteria and guidelines developed under paragraph (1), the Secretary shall make the criteria and guidelines available for public comment.</text></paragraph><paragraph id="id4290665d21f3430b8035002762d5b897"><enum>(4)</enum><header>Prohibition</header><text>The Secretary may not award a grant or cooperative agreement under the Program that would fund activities to meet existing environmental mitigation or compliance obligations under Federal or State law.</text></paragraph></subsection><subsection id="idb64eefc7e2914763b0c7381f78158dd4"><enum>(d)</enum><header>Duties of navigators</header><text>A multi-benefit water project navigator funded under the Program shall assist the eligible entity in planning, developing, and implementing multi-benefit water projects, including—</text><paragraph id="idd0b0b7c4006248fd801fe25859eef224"><enum>(1)</enum><text>grant writing;</text></paragraph><paragraph id="idf49d3f88b2154b21b4fcc22637db6445"><enum>(2)</enum><text>project management;</text></paragraph><paragraph id="ida1b51d02b77c4dfaa1ae9fc7b753b05c"><enum>(3)</enum><text>technical assistance, such as feasibility, design, preliminary environmental review, and engineering; and</text></paragraph><paragraph id="id2d25197c4e914f5390cbd99a0f7a5a47"><enum>(4)</enum><text>any other necessary activities.</text></paragraph></subsection><subsection id="idcde2cb8803f74012bbfd24c4df24f52e"><enum>(e)</enum><header>Duration of grants and cooperative agreements</header><paragraph id="id52091f3508e54de09179171392441db6"><enum>(1)</enum><header>Limitation</header><text>Subject to paragraph (2), a grant or cooperative agreement under the Program shall be limited to a period of not more than 3 years.</text></paragraph><paragraph id="id632274ecc345489a83c9f639c080b37f"><enum>(2)</enum><header>Continuation and extension</header><text>At the discretion of the Secretary, the Secretary may issue a continuation grant or extend a cooperative agreement awarded under the Program for not more than 2 additional years, with additional funding to be awarded, as determined to be appropriate by the Secretary, if the recipient of the grant or cooperative agreement has demonstrated satisfactory performance with implementation of the proposal under the initial grant or cooperative agreement, as determined by the Secretary.</text></paragraph></subsection><subsection id="idb082c8e5c4c341448519f1df92785321"><enum>(f)</enum><header>Continuous enrollment</header><text>The Secretary shall—</text><paragraph id="id2ce7d74320bb499ca719793bbb4039d4"><enum>(1)</enum><text>make funding opportunities for the Program available on a regular basis; and</text></paragraph><paragraph id="id721af256002c4193bf53e0a8736732ab"><enum>(2)</enum><text>allow applications for grants or cooperative agreements under the Program to be submitted and evaluated multiple times per year.</text></paragraph></subsection><subsection id="id32d913951b07402195877a1f8b69f613"><enum>(g)</enum><header>Cost share</header><paragraph id="ida4a6ee6353dd486f912ffadf80688f5b"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Federal share of the cost of any activity awarded a grant or cooperative agreement under the Program shall not exceed 75 percent of the cost of the activity carried out under the grant or cooperative agreement.</text></paragraph><paragraph id="idb7aa39a5ec894970926df7e5436d2331"><enum>(2)</enum><header>Form of non-federal cost share</header><text>The non-Federal share of the cost of an activity awarded a grant or cooperative agreement under the Program may be in the form of cash or in-kind contributions.</text></paragraph><paragraph id="id44d8536f8b304b5e8e9fa1d231bd9ac0"><enum>(3)</enum><header>Reduction; waiver</header><text>With respect to a grant or cooperative agreement awarded to an Indian Tribe, acequia, land grant-merced, disadvantaged community, or any other eligible entity working in partnership with or on behalf of those entities, the Secretary may reduce or waive the non-Federal share of the cost of any activity that is the subject of the grant or cooperative agreement if the reduction or waiver would further a compelling Federal interest, as determined by the Secretary.</text></paragraph></subsection><subsection id="id87875ecd57cf445eb166367a9a012abb"><enum>(h)</enum><header>Coordination</header><text>In administering the Program, the Secretary shall coordinate with other Federal, Tribal, State, and local government technical assistance programs to enhance multi-benefit water project development.</text></subsection><subsection id="id56f3fee40c5f4ed198a99014a28ddf5d"><enum>(i)</enum><header>Compliance</header><text>A multi-benefit water project navigator funded under the Program shall comply with all applicable Federal and State laws in carrying out the duties of the multi-benefit water project navigator under the Program.</text></subsection><subsection id="id426628ae181f4e349bdf5d691bdaa7fd"><enum>(j)</enum><header>Report to congress</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report that describes—</text><paragraph id="id2ceb269db4ce4c8094ef034380e87f97"><enum>(1)</enum><text>the ways in which the Program assists the Secretary in—</text><subparagraph id="ida724ca948fe94a6281bd27c27996fc3d"><enum>(A)</enum><text>reducing basin-wide water supply-demand imbalances; and</text></subparagraph><subparagraph id="id1a385e790e1144a6b00c7d9baddc88e8"><enum>(B)</enum><text>enhancing drought and ecosystem resilience; and</text></subparagraph></paragraph><paragraph id="idbfa1af76cb03454cbef40d69a1d0f778"><enum>(2)</enum><text>the benefits that the Program provides, including, to the maximum extent practicable, a quantitative analysis of the multiple benefits advanced under the Program.</text></paragraph></subsection></section><section id="id95dda8373c3a4650ae3697d3613f4d0c"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $15,000,000 for each of fiscal years 2024 through 2029, to remain available until expended.</text></section></legis-body></bill>
