Effective date.</toc-entry></toc></subsection></section><title id="idf6889c093923441789e39cb8cc0a4d3f"><enum>I</enum><header>Student eligibility for nutrition assistance programs</header><section id="id942a85aab3b54172a636b2a741448d0e"><enum>101.</enum><header>Eligibility of students to participate in supplemental nutrition assistance program</header><subsection id="id07bfd84314ea49acbdd744b3568a070e"><enum>(a)</enum><header>Definition of household</header><text>Section 3(m)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(m)(4)</external-xref>) is amended—</text><paragraph id="ida3264f45a57045a3a7a0dec37872d7ba"><enum>(1)</enum><text>by striking <quote>(4) In no event</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id91aac792e83d4ababae8840f018e693e"><paragraph id="idbfc864221d294421b143a51da5ffdf59"><enum>(4)</enum><header>Institution or boarding house</header><subparagraph id="id56be4ee7ce224e758aa046a12a6571f4"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), in no event</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id9ce1efe3be27474ca0552690f1814520"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11aa146a96ad4e6a83b99cb0a3e8e2d8"><subparagraph id="ide3556447ffba48219445ebed2f980078"><enum>(B)</enum><header>Students</header><text>An individual (including any dependents of the individual) may constitute a household if the individual is a student and resident of an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idff688108b70b447dadb0fd039065f07f"><enum>(b)</enum><header>Eligibility of students</header><text>Section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended—</text><paragraph id="id6c3d9bddf3e84e4f977a38d5d6b1e65a"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text style="OLC" level="section">qualifications and</header-in-text></quote> after <quote><header-in-text style="OLC" level="section">Eligibility</header-in-text></quote>;</text></paragraph><paragraph id="ide8551d87766c481980815b02cb957ac9"><enum>(2)</enum><text>in subsection (d)(2)(C)—</text><subparagraph id="id0ed2a3677bd841f4ae5897dcaba4248b"><enum>(A)</enum><text>by inserting <quote>who is</quote> after <quote>student</quote>;</text></subparagraph><subparagraph id="id4e90e867b88842119189947e01bfc170"><enum>(B)</enum><text>by striking <quote>half time</quote> and inserting <quote>half-time</quote>; and</text></subparagraph><subparagraph id="id2c80ff6253ff4a7d828f7f7d0e1f7939"><enum>(C)</enum><text>by striking <quote>(except</quote> and all that follows through <quote>section)</quote> and inserting <quote>(as determined by the school, training program, or institution of higher education, as applicable) and meets the requirements for eligibility under subsection (e)</quote>; and</text></subparagraph></paragraph><paragraph id="id9a65d9e3b551437590ee58cd8d69e332"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="idfe16bed932fc4a54bc2dfec9ca3e05a7"><enum>(A)</enum><text>in paragraph (3)—</text><clause id="id6ef9298f8da94217ab610cf075793797"><enum>(i)</enum><text>in subparagraph (B), by redesignating clauses (i) and (ii) as subclauses (I) and (II), respectively, and indenting appropriately; and</text></clause><clause id="id0abc37e530a844ac9a81e56a0be8a46f"><enum>(ii)</enum><text>by redesignating subparagraphs (A) through (D) as clauses (i) through (iv), respectively, and indenting appropriately;</text></clause></subparagraph><subparagraph id="id7dd9462e79f94e62be98dc8fd2cb51fc"><enum>(B)</enum><text>in paragraph (5), by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="id0e8295a2d89b4a6e9d521d642870fd94"><enum>(C)</enum><text>by redesignating paragraphs (1) through (8) as subparagraphs (A) through (H), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="ide8b9c9ee1ca248b19045850298ae69d4"><enum>(D)</enum><text>in subparagraph (D) (as so redesignated), by striking <quote>20</quote> and inserting <quote>10</quote>;</text></subparagraph><subparagraph id="idc5f62e74530e4432a862619a7c821688"><enum>(E)</enum><text>in subparagraph (E)(ii) (as so redesignated), by striking <quote>paragraph (4)</quote> and inserting <quote>subparagraph (D)</quote>;</text></subparagraph><subparagraph id="idc8bf6ec8a5a146379ef304435436012b"><enum>(F)</enum><text>in subparagraph (G) (as so redesignated), by striking <quote>or</quote> at the end after the semicolon;</text></subparagraph><subparagraph id="id72f8a90c2a974490bf3b88c169a2d4b4"><enum>(G)</enum><text>in subparagraph (H) (as so redesignated), by striking the period at the end and inserting a semicolon;</text></subparagraph><subparagraph id="id1023b82683614b308679b417dce0e14b"><enum>(H)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>(e) No individual</quote> and all that follows through <quote>individual—</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1a83094f35b543649dac3f53518b2ffa"><subsection id="idcc02d0d5522a494faaaec02281eddf17"><enum>(e)</enum><header>Qualifications for students</header><text>A student enrolled in any recognized school, training program, or institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) shall be eligible to participate in the supplemental nutrition assistance program if—</text><paragraph id="id9cdfabecf7e8448199905f697996ab4d"><enum>(1)</enum><text>the student satisfies the other requirements of this section; and</text></paragraph><paragraph id="idddac86ef347b41318d12dcb21dd0df78"><enum>(2)</enum><text>the student—</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id68d26af7a2b4406b99e56d43c09a82d1"><enum>(I)</enum><text>in paragraph (2) (as so designated), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id65cabdfc6eca4756b87e9fbe96f81070"><subparagraph id="id852f275d5eb54a53bdb94374966fa10f"><enum>(I)</enum><text>is eligible to participate in a State or federally financed work study program, including the program authorized under part C of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-51">20 U.S.C. 1087–51 et seq.</external-xref>);</text></subparagraph><subparagraph id="id14ab27e3e02948d6878faf7c87ce2f38"><enum>(J)</enum><clause commented="no" display-inline="yes-display-inline" id="id2e5961c1f9554630aaf7df92a5df5893"><enum>(i)</enum><text>is not an independent student (as defined in section 480(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(d)</external-xref>)); and</text></clause><clause id="id0ac905bf9c3a4dc58303262977b4a42a" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idef6ee76896e8456b9c749b53a3289b3c"><enum>(I)</enum><text>has a student aid index of not more than 0, as determined in accordance with part F of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk">20 U.S.C. 1087kk et seq.</external-xref>); or</text></subclause><subclause id="iddbdf24ac702e43a7acacf9f28f5cf480" indent="up1"><enum>(II)</enum><text>meets the financial eligibility criteria for receiving a maximum Federal Pell Grant under subpart 1 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>)—</text><item id="id425ccda44bc840d7a32d5ee7f746181e"><enum>(aa)</enum><text>regardless of whether the student has completed the Free Application for Federal Student Aid described in section 483 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>); and</text></item><item id="id1f733fac75c2411cbd08fa976e7aad46"><enum>(bb)</enum><text>which may be determined by a State using the income of the student, as determined under—</text><subitem id="id84c614411b3146ffa798e8bbd57b7260"><enum>(AA)</enum><text>the supplemental nutrition assistance program or another Federal or State means-tested program; or</text></subitem><subitem id="idcce63d2887c14fb4b843accf938edfe3"><enum>(BB)</enum><text>another reasonable simplifying assumption; or</text></subitem></item></subclause></clause></subparagraph><subparagraph id="ida891c7eebbd64614bd1fb86008ddb72a"><enum>(K)</enum><clause commented="no" display-inline="yes-display-inline" id="idd50cb75a6c894af087ec7cd81392fa4e"><enum>(i)</enum><text>is an independent student (as defined in section 480(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(d)</external-xref>)); and</text></clause><clause id="id074f92e791eb457eaaa6b4ad272abbcb" indent="up1"><enum>(ii)</enum><text>is a member of a household otherwise eligible to participate in the supplemental nutrition assistance program.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id2bac865e8dbf4b9a944d24b2a113abde"><enum>102.</enum><header>Communication of information on student eligibility for nutrition assistance programs</header><subsection id="id749cb9336ad04d9294a907f4ed096bc2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id489e439ac93a4739a1fbdf059d69a712"><enum>(1)</enum><header>College student</header><text>The term <term>college student</term> means a student enrolled in an institution of higher education.</text></paragraph><paragraph id="idac6fa3d9b87d402c99d8f5d37b701941"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="idfb10bddf83694d7680813ca42b2fe7c6"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></paragraph><paragraph id="id3f9650ff6aea4ba5ac9675115ddabd2e"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id1f051fb1705442799a98b667d4958ba2"><enum>(b)</enum><header>Strategies report</header><text>Not later than 180 days after the effective date of this title, the Secretary shall submit to Congress a report that describes the strategy to be used by the Secretary—</text><paragraph id="id2b80124fe90e47e096ec4bd7eb40e013"><enum>(1)</enum><text>to increase the awareness of State agencies and institutions of higher education about—</text><subparagraph id="id4af1e58fdda74fccbf2274f0dc9e0f6a"><enum>(A)</enum><text>college student food insecurity;</text></subparagraph><subparagraph id="id7b83c134f20d475588c496f294eb3bc2"><enum>(B)</enum><text>the eligibility of college students and their families for the program; and</text></subparagraph><subparagraph id="id8cf0efc3f8134a80ac41a7bdf00e1f51"><enum>(C)</enum><text>the procedures and resources available to college students who are not participating in the program to access benefits under the program;</text></subparagraph></paragraph><paragraph id="id3707d5e89b634e0fb3c16b7ddd378edf"><enum>(2)</enum><text>to identify—</text><subparagraph id="idd3a26a9574c74d5bb5d89965aee136c5"><enum>(A)</enum><text>existing or potential informational, educational, policy, and psychological barriers to enrolling in the program and barriers to complying with program requirements;</text></subparagraph><subparagraph id="id95c6e4dfd6cd48fd8553bde2bb8e5e2a"><enum>(B)</enum><text>mitigation strategies with respect to those barriers; and</text></subparagraph><subparagraph id="idb07ddd7fc2b34d74ab65fba66ea070c6"><enum>(C)</enum><text>opportunities for collaboration with the Department of Education, the Department of Housing and Urban Development, the Department of Health and Human Services, and other relevant Federal agencies; and</text></subparagraph></paragraph><paragraph id="ida241265c65b742598c44f9f6b9c8c218"><enum>(3)</enum><text>to update the State Outreach Plan Guidance under subsection (c).</text></paragraph></subsection><subsection id="idefdea072b9eb4335929db51fe72cfb89"><enum>(c)</enum><header>Updated State Outreach Plan Guidance</header><text>Not later than 90 days after the Secretary submits to Congress a report under subsection (b), the Secretary shall publish an updated State Outreach Plan Guidance that—</text><paragraph id="id66194764b040421b90bc4b566c00ec83"><enum>(1)</enum><text>describes existing data on college student food insecurity;</text></paragraph><paragraph id="id37a24113914b431e87d0c75463a10a8c"><enum>(2)</enum><text>describes the manner in which college students can access the supplemental nutrition assistance program;</text></paragraph><paragraph id="id2aaeb27086374fc0b3721fce7d4f0799"><enum>(3)</enum><text>recommends outreach activities to address college student food insecurity and encourages States to conduct those and other outreach activities;</text></paragraph><paragraph id="id3f511e070858404987615895c1610823"><enum>(4)</enum><text>provides a template for a State to submit information to the Secretary describing the outreach activities being carried out by the State to address college student food insecurity; and</text></paragraph><paragraph id="ida392820cfb99444d85731b4dfb6eb9f0"><enum>(5)</enum><text>contains updated guidance based on the contents of that report.</text></paragraph></subsection></section><section id="idbb2bec61657e47e5837ba417308b6ef6"><enum>103.</enum><header>Demonstration program</header><text display-inline="no-display-inline">Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id71ace78a35ef42c2aa487a06579b776d"><subsection id="idf0d11a2187d64027906b39b9b55b9ae8"><enum>(o)</enum><header>College student food insecurity demonstration program</header><paragraph id="id1103a122ceb94376822e56813840e19a"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id44298c839b8a484e952ca73974e6dbd1"><enum>(A)</enum><header>College student</header><text>The term <term>college student</term> means a student enrolled in an institution of higher education.</text></subparagraph><subparagraph id="id2369fa52509c4dedb50554881616bde7"><enum>(B)</enum><header>Demonstration program</header><text>The term <term>demonstration program</term> means the demonstration program established under paragraph (2).</text></subparagraph><subparagraph id="id667003b7e744430782809022125a7e94"><enum>(C)</enum><header>Institution of higher education</header><clause commented="no" display-inline="no-display-inline" id="id6003192515144f7aba9d809c8e54e037"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></clause><clause id="id68e1b9d32eb04415b555a18ee54c1f34"><enum>(ii)</enum><header>Inclusion</header><text>The term <term>institution of higher education</term> includes a postsecondary vocational institution (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)).</text></clause></subparagraph></paragraph><paragraph id="id713b053d8a0d42e0b0fcbf66150f6b09"><enum>(2)</enum><header>Demonstration program</header><text>Pursuant to subsection (b), the Secretary, in collaboration with the Secretary of Education, shall establish a demonstration program under which the Secretary shall carry out demonstration projects in accordance with paragraph (3)—</text><subparagraph id="id5373852984f242d397009142bff8a45c"><enum>(A)</enum><text>to decrease student food insecurity at institutions of higher education; and</text></subparagraph><subparagraph id="idcf73980dbc45433e9b4858498e37f57d"><enum>(B)</enum><text>to reduce barriers to college students fully utilizing supplemental nutrition assistance program benefits at institutions of higher education available to college students and their families.</text></subparagraph></paragraph><paragraph id="id1044b54b14244aaf955946a79353159e"><enum>(3)</enum><header>Demonstration projects</header><text>To carry out the demonstration program, the Secretary shall carry out demonstration projects that test the following new supplemental nutrition assistance program delivery methods:</text><subparagraph id="id005b7977546c4666a2625b845ce38a6f"><enum>(A)</enum><text>Allowing a college student receiving supplemental nutrition assistance program benefits—</text><clause id="idb9d47dd52d5f4c62a6aecf334b76560c"><enum>(i)</enum><text>to use those benefits to purchase prepared foods from a campus dining hall, on-campus store, or other on-campus merchant or provider that typically sells prepared meals and participates in the student meal program at the institution of higher education at which the student is enrolled; and</text></clause><clause id="id008b13cb311f4aabb4415e4ecd141eea"><enum>(ii)</enum><text>to be exempt from requirements to purchase a campus meal plan as part of the attendance of the college student at the institution of higher education.</text></clause></subparagraph><subparagraph id="id567764dae55547bb823de008254748fb"><enum>(B)</enum><text>Allowing a college student to use an EBT card or a campus-specific card at any of the locations described in subparagraph (A)(i) or a retailer authorized under section 9.</text></subparagraph></paragraph><paragraph id="idbea29458c5874ad4bae77428c3ddbc5c"><enum>(4)</enum><header>Project limit</header><subparagraph id="id8d1cc1c54a1640ae9ee520ebea071319"><enum>(A)</enum><header>In general</header><text>The Secretary shall carry out not more than 10 demonstration projects under the demonstration program simultaneously.</text></subparagraph><subparagraph id="idcde6b1fb88d7485fb6e0b05f7da2a1d0"><enum>(B)</enum><header>Institutions</header><text>The Secretary shall carry out not more than 1 demonstration project under the demonstration program at any single institution of higher education.</text></subparagraph></paragraph><paragraph id="ideb9942ec444c4bb8a139c84227428d6e"><enum>(5)</enum><header>Priority</header><text>In selecting an institution of higher education at which to carry out a demonstration project, the Secretary shall give priority to an institution of higher education—</text><subparagraph id="ida8c535a4f4ce4072944adedc2e4496a9"><enum>(A)</enum><text>at which not less than 25 percent of enrolled students are students that are eligible to receive a Federal Pell Grant under subpart 1 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a et seq.</external-xref>); or</text></subparagraph><subparagraph id="idb4a3abb2d1e742dfa182a6ec87647319"><enum>(B)</enum><text>that is described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></subparagraph></paragraph><paragraph id="idc66d1b96e29546ac850811d103d5a863"><enum>(6)</enum><header>Project administration</header><subparagraph id="idcd89d4cc4e784acbaf3567d429fca38c"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish criteria and parameters for selecting, operating, monitoring, and terminating each demonstration project under the demonstration program.</text></subparagraph><subparagraph id="id582feea4eac54656a536a4394867ef69"><enum>(B)</enum><header>Prices charged</header><text>The Secretary shall ensure that prices charged by food providers participating in a demonstration project under the demonstration program are comparable to prices charged by those food providers prior to participation.</text></subparagraph></paragraph><paragraph id="id18b936f78dae49f3ba515cddf0c1b4db"><enum>(7)</enum><header>Project termination</header><text>To the maximum extent practicable, the Secretary shall ensure that the termination of a demonstration project under the demonstration program shall not cause sudden adverse changes, including a reduction of institutional financial aid or the elimination of benefits under the supplemental nutrition assistance program, for students participating in the demonstration project.</text></paragraph><paragraph id="id9835bbc977fd48909d92cf5fc4144ab0"><enum>(8)</enum><header>Program termination</header><text>The demonstration program shall terminate on the date that is 10 years after the date on which the demonstration program is established.</text></paragraph><paragraph id="id34875db4938942cab889189365c7b1ca"><enum>(9)</enum><header>Evaluation</header><text>For the duration of the demonstration program, the Secretary shall, in collaboration with the Director of the Institute of Education Sciences, conduct an annual evaluation of each demonstration project carried out under the demonstration program during the year covered by the evaluation, including an analysis of the extent to which the project is meeting the desired outcomes, which include reduction in food insecurity and improved academic performance.</text></paragraph><paragraph id="id314402c7196d4339a386ca08ddcd5eb9"><enum>(10)</enum><header>Report</header><text>For the duration of the demonstration program, the Secretary shall submit to the Committees on Agriculture, Nutrition, and Forestry and Health, Education, Labor, and Pensions of the Senate and the Committees on Agriculture and Education and the Workforce of the House of Representatives an annual report that includes—</text><subparagraph id="id3f33fe099fd544e4b04091458a08035c"><enum>(A)</enum><text>a description of each demonstration project carried out under the demonstration program during the year covered by the report;</text></subparagraph><subparagraph id="id2f33ea6987a44dc38e2b566461c1498a"><enum>(B)</enum><text>the evaluation conducted under paragraph (9); and</text></subparagraph><subparagraph id="idba956027b3204f858851a7a001951847"><enum>(C)</enum><text>recommendations for legislation to improve the supplemental nutrition assistance program to better serve college students.</text></subparagraph></paragraph><paragraph id="id5eaf35f093c64c06b2bac5e0cfff4cba"><enum>(11)</enum><header>Waiver and modification authority</header><subparagraph id="id0dd59eb5bcad448397909d837d990211"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary may, as may be necessary solely to carry out the demonstration program—</text><clause id="id104cd4f0834e4c1491270d61cfd131f7"><enum>(i)</enum><text>waive any provision under this Act, including—</text><subclause id="id2fa87973826f43c7b3bd21ed99314c6d"><enum>(I)</enum><text>the requirement relating to local sales tax under section 4(a);</text></subclause><subclause id="id22c5d176c91c4c9e8c6b3f98ea043289"><enum>(II)</enum><text>requirements relating to the issuance and use of supplemental nutrition assistance program benefits under section 7; and</text></subclause><subclause id="id09811d1d240446fc98f915654f122d22"><enum>(III)</enum><text>requirements for approval of retail food stores under section 9; and</text></subclause></clause><clause id="idedadab6fd638457a9bcfa53bcdc8c113"><enum>(ii)</enum><text>modify the definitions under this Act for the purposes of the demonstration program, including the definitions of the terms <term>food</term>, <term>household</term>, and <term>retail food store</term> under section 3.</text></clause></subparagraph><subparagraph id="id6dc4b288996c4fdcbc3790d5a099e858"><enum>(B)</enum><header>Limitation</header><text>The Secretary may not waive a provision or modify a definition under subparagraph (A) if the waiver or modification will—</text><clause id="idbdd82471df6349cbab7e1e6946239e10"><enum>(i)</enum><text>cause increased difficulty for any household to apply for or access supplemental nutrition assistance program benefits; or</text></clause><clause id="id45cc39dd85804e41b5d7728aa7cd92f7"><enum>(ii)</enum><text>reduce the value of those benefits for any household.</text></clause></subparagraph></paragraph><paragraph id="id92cda232a2364dd9a505c9339f126fb8"><enum>(12)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="id5c2566c452fa4a8d890b377034cd4e8c"><enum>II</enum><header>Reducing student food insecurity</header><section id="id4419384ce21440dfb26bc8fc2742153a"><enum>201.</enum><header>Data sharing</header><subsection id="id230a765da6e84a35b7e11cfabb49952d"><enum>(a)</enum><header>Agreements</header><text>The Secretary of Education, in coordination with the Secretary of Agriculture, the Secretary of Housing and Urban Development, the Secretary of Health and Human Services, the Secretary of the Treasury, and the head of any other applicable Federal or State agency, shall maintain agreements—</text><paragraph id="id5c418d7b623540c18ee1d3888ac07099"><enum>(1)</enum><text>to securely share data among the respective Federal agencies of such Secretaries in order to identify students who have applied for Federal financial aid and who are enrolled at institutions of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) who may be eligible for federally funded programs to support basic needs through—</text><subparagraph id="id011e3a5ebba64ab6a56e9144073b2fa9"><enum>(A)</enum><text>the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>), a nutrition assistance program carried out under section 19 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028</external-xref>), or a nutrition assistance program carried out by the Secretary of Agriculture in the Northern Mariana Islands;</text></subparagraph><subparagraph id="idb18d5183a0bf4ae59acee0e8c004f038"><enum>(B)</enum><text>the supplemental security income program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></subparagraph><subparagraph id="id50261260af4f4d17a8fa1234c28e469c"><enum>(C)</enum><text>the program of block grants to States for temporary assistance for needy families under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></subparagraph><subparagraph id="ide1afc47ce0f2435e9df68270c155f2cf"><enum>(D)</enum><text>the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>);</text></subparagraph><subparagraph id="id2079d5d430214c92b7ccaad249513ee2"><enum>(E)</enum><text>the Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>);</text></subparagraph><subparagraph id="id4fba37457fca45a1b49c55d0d2a4eebd"><enum>(F)</enum><text>Federal housing assistance programs, including tenant-based assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), and public housing, as defined in section 3(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(1)</external-xref>);</text></subparagraph><subparagraph id="idbd50bd825d424792a2600b5d72910a90"><enum>(G)</enum><text>Federal child care assistance programs, including assistance under the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>) and the Child Care Access Means Parents in School Program under section 419N of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070e">20 U.S.C. 1070e</external-xref>);</text></subparagraph><subparagraph id="id00941881cc8643b19803f8fa0cc323df"><enum>(H)</enum><text>the free and reduced price school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>);</text></subparagraph><subparagraph id="idcca02709d84f46ce948a8d4cecc57dd9"><enum>(I)</enum><text>refundable credit for coverage under a qualified health plan under <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986;</text></subparagraph><subparagraph id="ide2225b1f2e454c5f83df7dc8786a6393"><enum>(J)</enum><text>the Earned Income Tax Credit under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986;</text></subparagraph><subparagraph id="id485dd2c3895541d9a48c6367d316aacf"><enum>(K)</enum><text>the Child Tax Credit under <external-xref legal-doc="usc" parsable-cite="usc/26/24">section 24</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph><subparagraph id="idaf7fba314ba94fc4ab91f4cba0094980"><enum>(L)</enum><text>any other federally funded program determined by the Secretary to be appropriate; and</text></subparagraph></paragraph><paragraph id="id61df3d27200c4168a070d3fa3c9ebac0"><enum>(2)</enum><text>to coordinate efforts to provide assistance to institutions of higher education to facilitate the enrollment of eligible students in the programs described in paragraph (1).</text></paragraph></subsection><subsection id="id62bbb4f395064e5292c06856da8b0261"><enum>(b)</enum><header>Information on federally funded programs To support basic needs</header><paragraph id="id6367308662e7440783316d8961b41b0d"><enum>(1)</enum><header>In general</header><text>Section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3187a485b4a44627ab9a2b37d95e0d28"><subsection id="id7ef96abf164744f9a67cedf9dfb7768b"><enum>(e)</enum><header>Information on federally funded programs To support basic needs</header><paragraph commented="no" display-inline="no-display-inline" id="idcc4246ca1db040da9174c22bbf8095ca"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="ide29e42d86e4a4333a58c9efc0072ecf9"><enum>(A)</enum><header>Benefit program</header><text>The term <term>benefit program</term> means a program described in any of subparagraphs (A) through (L) of section 201(a)(1) of the <short-title>Student Food Security Act of 2024</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbdf20d38c7f24b7e9feb6b9b0c940f5c"><enum>(B)</enum><header>Eligible student</header><text>The term <term>eligible student</term> means any student who, as a result of information submitted on the application for Federal student financial aid, has been determined by the Secretary (in consultation with the heads of applicable Federal agencies) to be potentially eligible for a benefit program.</text></subparagraph></paragraph><paragraph id="idf096f6304096487a8206207fb69cd30f"><enum>(2)</enum><header>Provision of information</header><text>For each year for which an eligible student submits an application for Federal student financial aid, the Secretary shall send, in written and electronic form, to the eligible student information regarding potential eligibility for assistance under, and application process for, benefit programs.</text></paragraph><paragraph id="id5243b193806b4d4987b24edb4148044c"><enum>(3)</enum><header>Inclusion</header><text>The information provided under paragraph (2) shall include a description of the appropriate State or Federal resources to which to apply for each benefit program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id03d10162d8d3481681f76e58855d5ccc"><enum>(2)</enum><header>Consultation</header><text>The Secretary of Education shall consult with the Secretary of Agriculture, the Secretary of Health and Human Services, the Secretary of Housing and Urban Development, the Secretary of the Treasury, and the head of any other applicable Federal or State agency, in designing the written and electronic communication regarding potential eligibility for assistance under, and application process for, the benefit programs (as defined in subsection (e)(1) of section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>)).</text></paragraph></subsection><subsection id="ide0522d6e0ea244f6bee6986da4980aad"><enum>(c)</enum><header>Further information on federally funded programs To support basic needs</header><text>Section 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>) is amended—</text><paragraph id="id7178e981fcc14e0589df6e668d9faad7"><enum>(1)</enum><text>in subsection (a)(2)(E)—</text><subparagraph id="id5609772eae8941679b008b09ce934390"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="id454eee8a59c749ddb5f82c7471363386"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idf3833d4f312b4f8b8822aa8c48709f48"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide5d349657eed427583e44b4550608d77"><clause id="idd03453be300a401796247795beb1f6b9"><enum>(iii)</enum><text>an authorization under subparagraph (D) and disclosing the information as described in clause (ii), the Secretary shall provide the applicant with notification of the appropriate Federal or State resources necessary to apply for Federal and State programs that support basic needs.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8a7b8543a8de4232b967102d11e5c85e"><enum>(2)</enum><text>in subsection (c)(3)—</text><subparagraph id="id45edcc9c87e748a1ba240c7aea85869a"><enum>(A)</enum><text>by striking <quote>may enter</quote> and inserting <quote>shall enter</quote>; and</text></subparagraph><subparagraph id="idefcbf96c32924724a2ba30020d690807"><enum>(B)</enum><text>by inserting <quote>, and shall consult with the heads of applicable Federal agencies in designing the written and electronic communication regarding potential eligibility for assistance under such programs</quote> after <quote>may be eligible</quote>.</text></subparagraph></paragraph></subsection><subsection id="id039a159319ba45f298f5420a3ca1db53"><enum>(d)</enum><header>Report</header><text>The Secretary of Education, in coordination with the Secretary of Agriculture, the Secretary of Housing and Urban Development, the Secretary of Health and Human Services, the Secretary of the Treasury, and the head of any other applicable Federal or State agency, shall prepare and submit to Congress a report that presents summary statistics on students who have applied for Federal financial aid and who are enrolled at institutions of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) and are experiencing student food insecurity and housing insecurity, disaggregated by race and ethnicity, income quintile, status as a first generation college student, Federal Pell Grant eligibility status, disability status, status as a student parent, sex (including sexual orientation and gender identity), and other subgroups, as determined by such heads of agencies.</text></subsection></section><section id="id44b877d8992045dd8792f1898040a0fd"><enum>202.</enum><header>Questions on basic needs in national postsecondary student aid study</header><text display-inline="no-display-inline">The Secretary of Education shall permanently add to the National Postsecondary Student Aid Study validated questions that measure food security, housing security, and homelessness.</text></section><section id="idfc7f5e16595b4943873d8db3db76127c"><enum>203.</enum><header>Grants to support the basic needs of students</header><text display-inline="no-display-inline">Title VIII of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1161a">20 U.S.C. 1161a et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd97008cc5c8b4037ab2712df72e35289"><part id="idc286193b05b646c892d58f7574ba9949"><enum>BB<?LEXA-Enum BB?></enum><header>Grants to support the basic needs of students</header><section id="id0ed8123df218423e91812fb62b693174"><enum>899.</enum><header>Grants to support the basic needs of students</header><subsection id="id9d9b47335e3646b2878078481962c9ae"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7104c2bd17da440c8355a0c17da9f1b2" commented="no"><enum>(1)</enum><header>Basic needs</header><text>The term <term>basic needs</term>, with respect to a student, means the physiological and safety necessities that are central conditions for the student to learn, including—</text><subparagraph id="id451ad9a6038a4642a1be63eb8b9bf517" commented="no"><enum>(A)</enum><text>nutritious and sufficient food;</text></subparagraph><subparagraph id="id5be72186976b4bce936fe8a056fcffc2" commented="no"><enum>(B)</enum><text>safe, secure, and adequate housing (including to sleep, to study, to cook, and to shower);</text></subparagraph><subparagraph id="id3f2506a52f6b4c42b555950cabfa561f" commented="no"><enum>(C)</enum><text>health care to promote sustained mental and physical well-being;</text></subparagraph><subparagraph id="id9a65ac540214460fb5c1b446531c18ce" commented="no"><enum>(D)</enum><text>high-quality and affordable childcare;</text></subparagraph><subparagraph id="id256d5a9bcae74d3db51d1b5630d73f49" commented="no"><enum>(E)</enum><text>affordable technology and internet access;</text></subparagraph><subparagraph id="idebe24e53ef31446ca1a3ca23171e56e4" commented="no"><enum>(F)</enum><text>accessible transportation;</text></subparagraph><subparagraph id="id9cfae4a60a094dbfa9f33f1e9b18fdb6" commented="no"><enum>(G)</enum><text>personal hygiene and clothing; and</text></subparagraph><subparagraph id="idbb39ef44163644e7842c49a0cd68d409"><enum>(H)</enum><text>other costs described in paragraphs (2) through (14) of section 472(a).</text></subparagraph></paragraph><paragraph id="id5f0e5614e27c4e29ad1c404caaafa29d" commented="no"><enum>(2)</enum><header>Community college</header><subparagraph id="id3205668b4f18408e80776d333f13d6c2" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>community college</term> means—</text><clause id="idd717c51859ee4192b5365084416a6d9e" commented="no"><enum>(i)</enum><text>a public institution of higher education at which—</text><subclause id="id5429a09b59b644958c7b317e7a3bbed8" commented="no"><enum>(I)</enum><text>the highest degree awarded is an associate degree; or</text></subclause><subclause id="idc9e0baf493b349c0a8cb239df91e6f8b" commented="no"><enum>(II)</enum><text>an associate degree is the most frequently awarded degree, including a 2-year Tribal College or University (as defined in section 316);</text></subclause></clause><clause id="idff12f61ba8ed444194ad4724fdc76488" commented="no"><enum>(ii)</enum><text>a public postsecondary vocational institution (as defined in section 102(c)); or</text></clause><clause id="id5b3333dda9474633be3fc389126bff5e" commented="no"><enum>(iii)</enum><text>at the designation of the Secretary, in the case of a State in which there is no community college operated or controlled by the State that meets a definition under clause (i) or (ii), a college or similarly defined and structured academic entity—</text><subclause id="ide9d25aa3975e4b7299798384abb3146e" commented="no"><enum>(I)</enum><text>that was in existence on July 1, 2023;</text></subclause><subclause id="iddc6ffa39bfe94de29c8b20fd1a1559e3" commented="no"><enum>(II)</enum><text>within a public 4-year institution of higher education; and</text></subclause><subclause id="idda0b3141907a466487d9c3d0fb143415" commented="no"><enum>(III)</enum><text>at which—</text><item id="id933af3b3015c407696166bf13bb9e597" commented="no"><enum>(aa)</enum><text>the highest degree awarded is an associate degree; or</text></item><item id="id3f4a9adae14b4def9057471bb9ce3a59" commented="no"><enum>(bb)</enum><text>an associate degree is the most frequently awarded degree.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="id58dc07eabbc441f48e105e21ee6c6f6c" commented="no"><enum>(3)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means an institution of higher education (as defined in section 101 or 102(a)(1)(B)). </text></paragraph></subsection><subsection id="id5e1b04609d964eb1a9d5105e4fa36555"><enum>(b)</enum><header>Planning grants</header><paragraph id="idcc69497247a14801a4cde3bd8f1b1beb"><enum>(1)</enum><header>In general</header><text>The Secretary shall award planning grants, on a competitive basis, to eligible institutions to enable the eligible institutions to conduct research and planning in accordance with paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd53d5e29c1004f59b97c32cbd9082d2b"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce incidences of—</text><clause commented="no" display-inline="no-display-inline" id="id30628381de484e1e9102d464374867b1"><enum>(i)</enum><text display-inline="yes-display-inline">student food insecurity;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida5929e3b19574e1bb0d20dcbe09ab94c"><enum>(ii)</enum><text display-inline="yes-display-inline">student housing insecurity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb7569bee8a7b4c77a30e6127482e7117"><enum>(iii)</enum><text display-inline="yes-display-inline">students experiencing homelessness; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcd8548c331e47c2a57c767dc504cea8"><enum>(B)</enum><text display-inline="yes-display-inline">to meet other basic needs of students.</text></subparagraph></paragraph><paragraph id="id67c76119862c4178a8c68287e7f4639e"><enum>(2)</enum><header>Activities</header><text>An eligible institution receiving a grant under this subsection shall use grant funds to carry out the following activities:</text><subparagraph id="idbe6313ce962148019d4c28d8b15bf00e"><enum>(A)</enum><text>Establish a basic needs steering committee that will be—</text><clause commented="no" display-inline="no-display-inline" id="iddd1b270c41914026910498f4b2b01e2b"><enum>(i)</enum><text display-inline="yes-display-inline">responsible for developing and approving the basic needs strategy described in subparagraph (C); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6b02500fe1ca43178d957f8126022dad"><enum>(ii)</enum><text display-inline="yes-display-inline">comprised of relevant campus stakeholders, such as—</text><subclause id="id785f2173f61540dbaa2ae9c0c342a26e"><enum>(I)</enum><text>students who have experienced challenges in meeting basic needs;</text></subclause><subclause id="idbe338845f7da43bdba3538c5ab2a2385"><enum>(II)</enum><text>student government representatives;</text></subclause><subclause id="id2bfd10e32fc24ba69e55dca503d4c82b"><enum>(III)</enum><text>staff of the eligible institution representing the areas of student financial aid, housing, dining, student affairs, academic advising, equity support services, accessibility services, campus security, legal services, and health and well-being services (including counseling or psychological services);</text></subclause><subclause id="id9f6d3544fb9345ffa9356cc79c47371d"><enum>(IV)</enum><text>faculty;</text></subclause><subclause id="id4294e029bdfb46d480f56073819774b9"><enum>(V)</enum><text>relevant administrators, including local human services administrators;</text></subclause><subclause id="id939700b40cde443c9e195d1c36e855da"><enum>(VI)</enum><text>community-based and other nonprofit organizations; and</text></subclause><subclause id="idf51404c9bdf94ca3ab10cba31ba474a2"><enum>(VII)</enum><text>representatives from local governmental agencies.</text></subclause></clause></subparagraph><subparagraph id="id6e18475413884425aceb637e61f583e7"><enum>(B)</enum><text>Conduct research regarding—</text><clause id="id7d2e0df0d821408ab521208a4a351b65"><enum>(i)</enum><text>the level of unmet basic needs at the eligible institution, disaggregated by race and ethnicity, income quintile, status as a first generation college student (as defined in section 402A(h)), Federal Pell Grant eligibility status, disability status, status as a student parent, sex (including sexual orientation and gender identity), or other subgroup as determined by the eligible institution;</text></clause><clause id="idcc0a0849869a429b96f3bf9cb1d2acbf"><enum>(ii)</enum><text>the presence of institutional barriers (such as award displacement) and current institutional interventions to address basic needs insecurity;</text></clause><clause id="ided4a45d51f984da69d1ffcad2c050a2e"><enum>(iii)</enum><text>the presence of administrative barriers for students in applying, certifying eligibility, and renewing applications for means-tested benefits, and interventions to address such barriers;</text></clause><clause id="ideb09484a4a5342a6a8d24aadc0558957"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="iddec570a75881477aa72bbe39e141bf85"><enum>(I)</enum><text>the resources and activities available to address basic needs of students, both on campus and off campus, as of the date of the research; and</text></subclause><subclause id="idbde7ac19833248c2aabb282b47b5fde1" indent="up1"><enum>(II)</enum><text>the impact of such resources and activities; and</text></subclause></clause><clause id="id3d4165914a8a4381b5fab9b0bfc9de86"><enum>(v)</enum><text>opportunities for coordination and collaboration between the eligible institution and government or community-based organizations, such as—</text><subclause id="id71151fc5c71942e5bb20dd3e15c4e492"><enum>(I)</enum><text>the local office that administers benefits under the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) and carries out employment and training programs under that Act, or the temporary assistance for needy families program and subsidized programs that meet the work requirements under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></subclause><subclause id="idb5853e0f0d8c4b17a6372770374a3454"><enum>(II)</enum><text>organizations that participate in the Federal work-study program under part C of title IV; or</text></subclause><subclause id="id916a986bccfa46cca4a8bcdd62605b57"><enum>(III)</enum><text>low-income housing assistance organizations, including such organizations assisting with tenant-based assistance under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), and public housing (as defined in section 3(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>)).</text></subclause></clause></subparagraph><subparagraph id="id7a956f64e6c74bf1926d22c05023fdf2"><enum>(C)</enum><text>Develop a basic needs strategy that describes the means by which the eligible institution will—</text><clause id="idae10a2c20cf84b1c94a1f5e90613f326"><enum>(i)</enum><text>seek to address or meet the basic needs of students through on-campus and off-campus providers; and</text></clause><clause id="id10bceb3897614b21991da4f42cf2c2e3"><enum>(ii)</enum><text>incorporate the research conducted under subparagraph (B), including with respect to the subgroups identified under clause (i) of that subparagraph, into the basic needs strategy.</text></clause></subparagraph><subparagraph id="id178b599712404962b519d06dad9cc8a9"><enum>(D)</enum><text>Implement the strategy described in subparagraph (C), including by—</text><clause id="id58e759f06301445d8d5c874af9b0ac90"><enum>(i)</enum><text>conducting outreach to encourage students to participate in programs that provide basic needs or reduce basic needs insecurity;</text></clause><clause id="id73b6522060384634bdfe7cb99420b463"><enum>(ii)</enum><text>educating students about Federal, State, local, and Tribal assistance programs, supporting student applications for those programs, and providing case management and training for students to maximize the assistance that students and their families receive to reduce basic needs insecurity;</text></clause><clause id="id921cc9935f6d4d8fa665f3b737818044"><enum>(iii)</enum><text>coordinating and collaborating with Federal, State, local, and Tribal agencies or community-based organizations;</text></clause><clause id="id0246efedb3a048e9b5402b6654e4e7f0"><enum>(iv)</enum><text>hiring and training personnel to build infrastructure and implement programming to reduce basic needs insecurity at the eligible institution; and</text></clause><clause id="id146c85ccefa740b993388c6e90bef734"><enum>(v)</enum><text>carrying out other matters determined to be appropriate by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="idd99d354993fe40ad97f14c98f2dd8f61"><enum>(3)</enum><header>Grant amounts; duration</header><subparagraph id="ide368f89af533453291848a6a7d0e331c"><enum>(A)</enum><header>Amount</header><text>The amount of a grant under this subsection shall be not more than $75,000.</text></subparagraph><subparagraph id="id46370020829b4056be7dd415586ca3c9"><enum>(B)</enum><header>Duration</header><text>A grant under this subsection shall be for a period of not more than 2 years.</text></subparagraph></paragraph><paragraph id="id87d802e49ba74af5b8218041d9d63969"><enum>(4)</enum><header>Report</header><text>Not later than 60 days after the end of the planning grant period under this subsection, each eligible institution that receives such a grant shall submit to the Secretary a report that describes the outcomes of the planning grant, regardless of whether the eligible institution intends to apply for an implementation grant.</text></paragraph></subsection><subsection id="id6eaa56f945704b0ab05ec3326a25e627"><enum>(c)</enum><header>Implementation grants</header><paragraph id="ide382891ddc5d498887954e9a82425a04"><enum>(1)</enum><header>Award</header><subparagraph commented="no" display-inline="no-display-inline" id="id0d4ac6186c0c4fb295cc9e1c493dadba"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall award implementation grants, on a competitive basis, to eligible institutions to enable the eligible institutions to develop infrastructure to meet the basic needs of students by—</text><clause commented="no" display-inline="no-display-inline" id="idda265e41deac4ff1b9132e1bdf3d5748"><enum>(i)</enum><text display-inline="yes-display-inline">implementing—</text><subclause commented="no" display-inline="no-display-inline" id="idf9638e0c1a1e485093c77837dd17baf3"><enum>(I)</enum><text display-inline="yes-display-inline">a basic needs strategy developed under subsection (b)(2)(C); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id95bd260014e24b67b652513d9a76cee1"><enum>(II)</enum><text display-inline="yes-display-inline">another existing basic needs plan approved by the Secretary; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf3e480ff72d8446cb3f9f2fd4e1a8fdf"><enum>(ii)</enum><text display-inline="yes-display-inline">carrying out the activities described in paragraph (2).</text></clause></subparagraph><subparagraph id="id4dca082e927f460ca6b2be83b70c1eff"><enum>(B)</enum><header>Ongoing external funding</header><text>To be eligible to receive an implementation grant under this paragraph, an eligible institution shall identify, in the application for the grant, an ongoing non-Federal funding mechanism to support the activities carried out using grant funds after the expiration of the grant period.</text></subparagraph></paragraph><paragraph id="id4150a2d9488c46f18720b94a3f94d508"><enum>(2)</enum><header>Activities</header><text>An eligible institution receiving a grant under this subsection shall use the grant funds to carry out at least 2 of the following activities:</text><subparagraph id="idb5dfc3653e3f4a228500c67abc0a7e7b"><enum>(A)</enum><text>Providing to eligible students free or subsidized food, secure sleeping arrangements, temporary housing, priority access to existing on-campus child care, and other basic needs.</text></subparagraph><subparagraph id="idfa1ccc272ef645c18817b45c62568e4c"><enum>(B)</enum><text>Conducting outreach to students to reduce stigma associated with, and educate and encourage students to participate in, programs and services (including programs and services provided through grant funding) to meet basic needs.</text></subparagraph><subparagraph id="idfa9bd9f0fc0349b68977660b380c035f"><enum>(C)</enum><text>Educating students about public assistance programs (including State and local public assistance programs, the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>), Federal housing assistance programs, and other income-based Federal assistance programs), supporting student applications for those programs, and providing case management and training for students to maximize the public assistance that students and their families receive to meet basic needs.</text></subparagraph><subparagraph id="id5281911b0e064a09b53099532d1fccac"><enum>(D)</enum><text>Coordination and collaboration between the eligible institution and government or community-based organizations, such as the local office that administers benefits through the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) or a low-income housing assistance organization.</text></subparagraph><subparagraph id="id2599e19e79df4b179505c595dda99a99"><enum>(E)</enum><text>Purchasing materials, equipment, transportation, or facilities to reduce incidences of food and housing insecurity and address the basic needs of students at the eligible institution.</text></subparagraph><subparagraph id="id25558a352820450383d40d3e67453b37"><enum>(F)</enum><text>Hiring and training personnel to build and improve basic needs infrastructure and implement programming to provide assistance in applying for, and accessing, direct support services, financial assistance, or means-tested benefits programs to meet the basic needs of students.</text></subparagraph><subparagraph id="idcf5acc1816264470a75cfdb6850455b5"><enum>(G)</enum><text>Other activities or services determined to be appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="id2548ece7424c4e79ba2de80f88d71c79"><enum>(3)</enum><header>Grant amounts; duration</header><subparagraph id="id9934CFFEA1234EA885D6061CFD12A740"><enum>(A)</enum><header>Amount</header><text>The amount of a grant under this subsection shall be not more than $1,000,000 for each 5-year period.</text></subparagraph><subparagraph id="idba583af792234e0192463bf3447ba55d"><enum>(B)</enum><header>Duration</header><text>A grant under this subsection shall be for a period of 5 years.</text></subparagraph></paragraph><paragraph id="idda36f0f027764ba98302b0af7977e957"><enum>(4)</enum><header>Report</header><text>The Secretary shall prepare and submit to Congress a report that describes—</text><subparagraph id="id0419b2fae6be454bb5e6fc460d244769"><enum>(A)</enum><text>the impact on eligible students of grants provided under this subsection;</text></subparagraph><subparagraph id="id0d8bff52ad9d45ddaff7ef92012bdb41"><enum>(B)</enum><text>the obstacles faced by recipients of grants under this subsection;</text></subparagraph><subparagraph id="id2604ca7f6f1c4267925106171572f9e1"><enum>(C)</enum><text>successful outcomes of grants under this subsection;</text></subparagraph><subparagraph id="id2665d63021264832a2f8ce2ccf726f42"><enum>(D)</enum><text>best practices for the provision of basic services to eligible students; and</text></subparagraph><subparagraph id="id033cf852f9604ceca2e6d4ee76178cdc"><enum>(E)</enum><text>Federal and State policy barriers to meeting the basic needs of students at institutions of higher education.</text></subparagraph></paragraph><paragraph id="id73359b375764450b904637be0f3aa1f2"><enum>(5)</enum><header>Best practices</header><text>The Secretary shall disseminate to eligible institutions information about best practices, as described in paragraph (4)(D).</text></paragraph><paragraph id="ide1ac82772efa4eec86a81a43795b3082"><enum>(6)</enum><header>Evaluation</header><text>For the purpose of evaluating the effectiveness of funds awarded under this subsection, the Secretary shall conduct an evaluation of each grant under this subsection to determine the impact on students, including improvements in retention, progression, transfer, attainment, and basic needs security, as applicable.</text></paragraph></subsection><subsection id="id794170e510bd477d8278c38bff5e4398"><enum>(d)</enum><header>Reservation; priority; equitable distribution</header><paragraph id="id60d4499d1d3a4add9794a69bf544a64c"><enum>(1)</enum><header>Reservation</header><text>In awarding grants under subsections (b) and (c), the Secretary shall reserve—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd8ba30f975d44c60a8828a83d95e556a"><enum>(A)</enum><text display-inline="yes-display-inline">an amount equal to not less than 25 percent of the total amount available for grants under those subsections for grant awards to community colleges; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8973ba4b796346328a3b3cc7defd046e"><enum>(B)</enum><text display-inline="yes-display-inline">an amount equal to not less than 25 percent of the total amount available for grants under those subsections for grant awards to historically Black colleges and universities, Tribal Colleges and Universities, and other minority-serving institutions.</text></subparagraph></paragraph><paragraph id="iddaf6cd3b92da4f10b07082b6fde8b68f"><enum>(2)</enum><header>Priority</header><text>In awarding grants under subsections (b) and (c), the Secretary shall give priority to the following:</text><subparagraph id="id84b45c322e8c49cf822fd432a54c307c"><enum>(A)</enum><text>Eligible institutions with respect to which not fewer than 25 percent of enrolled students are students that are eligible to receive a Federal Pell Grant under subpart 1 of part A of title IV.</text></subparagraph><subparagraph id="iddbb6aa6e94b6446aa5df8b714cd7e724"><enum>(B)</enum><text>Eligible institutions described in section 371(a).</text></subparagraph></paragraph><paragraph id="id68235a7362cd49c582f634a34d27cc40"><enum>(3)</enum><header>Equitable distribution</header><text>In awarding grants under subsections (b) and (c), the Secretary shall ensure an equitable distribution of grant awards to eligible institutions in States, based on State population.</text></paragraph></subsection><subsection id="id47cc56e8aac64520bc75f53f43f17cbe"><enum>(e)</enum><header>Personnel expenses limitations</header><paragraph commented="no" display-inline="no-display-inline" id="idde3347f47ccf4aecb43c58abb1744f82"><enum>(1)</enum><header display-inline="yes-display-inline">Planning grants</header><text>An eligible institution that receives a planning grant under subsection (b) may use not more than 50 percent of grant funds for personnel expenses.</text></paragraph><paragraph id="id692cc0b029834692b0e544cdf5a7d8a0"><enum>(2)</enum><header>Implementation grants</header><text>An eligible institution that receives an implementation grant under subsection (c) may use not more than 75 percent of grant funds for personnel expenses.</text></paragraph></subsection><subsection id="ida66436549cba412e94ce0d0e09b62f84"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $1,000,000,000 for each of fiscal years 2025 through 2031, of which—</text><paragraph id="id2d0613937c5b4ecf83cde6cd9ccf97ab"><enum>(1)</enum><text>$40,000,000 is authorized to be appropriated to provide planning grants under subsection (b); and</text></paragraph><paragraph id="id84f9414db02e4622a59d5d2ca7230419"><enum>(2)</enum><text>$960,000,000 is authorized to be appropriated to provide implementation grants under subsection (c).</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc652fe23db424a10bf2db67ffe74676c"><enum>204.</enum><header>Effective date</header><text display-inline="no-display-inline">This title and the amendments made by this title shall take effect on the date that is 180 days after the date of enactment of this Act.</text></section></title></legis-body></bill>
