<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4985</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240801">August 1, 2024</action-date><action-desc><sponsor name-id="S378">Mr. Lankford</sponsor> (for himself, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, and <cosponsor name-id="S410">Ms. Lummis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform the process for listing a species as threatened or endangered under the Endangered Species Act of 1973, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Wildlife Enhancement and Partnership Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida39178837eda4e99bba81d3d54f49696"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="id5468826db74042e886701a92b9dd2d8e"><enum/><text>In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idbba04b5406e848259502b41cec730c0c"><enum>(1)</enum><header>Candidate Conservation Agreement</header><text>The term <term>Candidate Conservation Agreement</term> means a formal, voluntary agreement between the Service and 1 or more parties to address the conservation needs of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5616db41017d46e1b8995fa6cc10a797"><enum>(A)</enum><text display-inline="yes-display-inline">a candidate species; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id888602bde6e546a994b5a4ebc5095713"><enum>(B)</enum><text display-inline="yes-display-inline">a species that may become a candidate species in the near future.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b7ba679c23449f6ba8ea94af5eb9b81"><enum>(2)</enum><header>Candidate Conservation Agreement with Assurances</header><text>The term <term>Candidate Conservation Agreement with Assurances</term> means a Candidate Conservation Agreement that provides incentives for persons that are parties to the Candidate Conservation Agreement to engage in the voluntary conservation activities described in the Candidate Conservation Agreement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id673fc6fa384347c7baefc1798edbfdf0"><enum>(3)</enum><header>Candidate species</header><text>The term <term>candidate species</term> means a species that is under consideration for listing as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ca8d5fd2e6a4a58afa5a468855769db"><enum>(4)</enum><header>Conservation Benefit Agreement</header><text>The term <term>Conservation Benefit Agreement</term> means a conservation benefit agreement described in the final rule of the Service entitled <quote>Endangered and Threatened Wildlife and Plants; Enhancement of Survival and Incidental Take Permits</quote> (89 Fed. Reg. 26070 (April 12, 2024)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e25aa68bab04078bf01fd47ba17a456"><enum>(5)</enum><header display-inline="yes-display-inline">Established consortium</header><text>The term <term>established consortium</term> means a State-based or multi-State-based group of individuals or organizations that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf49f335e74a94b3c82062afd719efbcf"><enum>(A)</enum><text display-inline="yes-display-inline">is established as of the date of enactment of this Act;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1cfa3d2c48749c0821deba49ddc1cb1"><enum>(B)</enum><text display-inline="yes-display-inline">operates under a functioning, as determined by the individuals or organizations that are parties to that consortium—</text><clause commented="no" display-inline="no-display-inline" id="id0a805e00ba6742bd8a8b0273752a4c68"><enum>(i)</enum><text display-inline="yes-display-inline">conservation or recovery plan; or </text></clause><clause commented="no" display-inline="no-display-inline" id="ide786fc8bc2e54a33a7432603ed2c2565"><enum>(ii)</enum><text display-inline="yes-display-inline">conservation, recovery, or planning documents; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcf89bc1cdfa4aa5984a1aa71042e8e4"><enum>(C)</enum><text display-inline="yes-display-inline">is an ongoing partnership organized principally for the conservation of a species that is not listed, or a species that is proposed to be listed, under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="ide4285a14a20c4feabe99013cba8b3631"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id348645f5031049f98b2ed8d100dc3b5d"><enum>(7)</enum><header>Service</header><text>The term <term>Service</term> means the United States Fish and Wildlife Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08b8cd964bbf4a74b6222686586593b1"><enum>(8)</enum><header>Species</header><text>The term <term>species</term> has the meaning given the term in section 3 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63cacc5404c141f69a320b773747b076"><enum>(9)</enum><header>Third-party evaluator team</header><text>The term <term>third-party evaluator team</term> means an independent entity empaneled under section 3(a).</text></paragraph></subsection></section><section id="idc0b51175301e4a5cac1f554b31a2efed"><enum>3.</enum><header>Independent review of proposed listings</header><subsection commented="no" display-inline="no-display-inline" id="id88bc8948b4c4462aaedb5c4e237ff708"><enum>(a)</enum><header>Third-Party evaluator teams</header><paragraph commented="no" display-inline="no-display-inline" id="id56b1e4865ea54f25968fed057a3e81cc"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which an established consortium requests that a third-party evaluator team be empaneled under subsection (b)(1)(B), the Secretary shall empanel a third-party evaluator team to review, evaluate, and determine the sufficiency of a proposed listing as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) by the Service of a species that is managed by the established consortium that objects to that proposed listing.<italic></italic></text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2824db7180243b799f3cb13a44a1a6f"><enum>(2)</enum><header>Membership; structure</header><subparagraph commented="no" display-inline="no-display-inline" id="idc2794c4da94c4a018c58b7027bdfe1f4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The structure and membership of a third-party evaluator team shall be established by the Secretary, in consultation with Congress, subject to the condition that the Secretary shall have the final determination on the structure, membership, and scope of review of a third-party evaluator team.</text></subparagraph><subparagraph id="ide6c2f0232cf746488b3adf523ef1aa20"><enum>(B)</enum><header>Guidelines and requirements for membership</header><text>In establishing the membership of a third-party evaluator team under subparagraph (A), the Secretary shall adhere to the following requirements:</text><clause commented="no" display-inline="no-display-inline" id="id75ff800114724580a7c3012ae1d49b5f"><enum>(i)</enum><text>Not fewer than 5, but not greater than 9, individuals selected to serve on the third-party evaluator team shall have expertise in the following:</text><subclause commented="no" display-inline="no-display-inline" id="idaf687bf331ea4dd39c28663e1590a92d"><enum>(I)</enum><text>Science or academic background necessary to render an expert opinion on the scientific studies and related materials submitted for review under paragraphs (5) and (6)(C) of subsection (b).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1a5c0cf30f054c039f67a463ed12e8bb"><enum>(II)</enum><text>Ability to provide economic analysis and economic impacts of a threatened or endangered species listing on local and regional economies, with a particular expertise on impacts on private landowners and small businesses.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5e20db4c3cb646bbbd5ecb9fe0930931"><enum>(III)</enum><text display-inline="yes-display-inline">Voluntary conservation partnerships.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide6d39b2d20ae4be99f766538a61947a0"><enum>(IV)</enum><text display-inline="yes-display-inline">Natural resource-related industries, including oil and gas, mining, forestry, ranching, agriculture, and grazing.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id20a41004b63843088dc95b6ef6826fad"><enum>(ii)</enum><text>No current or former employee of the Service shall be eligible to serve on the third-party evaluator team.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id141312792a9e4646b758fce042bc6e31"><enum>(C)</enum><header>Chair</header><text>The Chair of a third-party evaluator team shall be determined by the members of the third-party evaluator team.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45c0191eed944a2783107a8781bf7eb8"><enum>(D)</enum><header>Publication</header><text>Not later than 10 days before the date on which a third-party evaluator team has its first meeting, the Secretary shall publish, by Secretarial Order in the Federal Register, the structure, membership, and scope of review of the third-party evaluator team.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ef93fa780f74cb8b9a844ab3f73214e"><enum>(3)</enum><header>Administration; voting</header><subparagraph commented="no" display-inline="no-display-inline" id="idf6878450f8f54c4d9b1ce886bc957d31"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A third-party evaluator team shall determine the process for reviewing documents, requesting information, drafting the final report under subsection (b)(7), and other related actions.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9eed01a8ca3b4fa5941dd9d161508160"><enum>(B)</enum><header>Voting</header><clause commented="no" display-inline="no-display-inline" id="id6fb50d818cf14f9db9e156347d490ab6"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Each member of a third-party evaluator team shall have an equal vote.</text></clause><clause commented="no" display-inline="no-display-inline" id="id77dea54cce9a489cb33d026a0aece576"><enum>(ii)</enum><header>Vote to proceed</header><subclause commented="no" display-inline="no-display-inline" id="id2938cdf384e1426db5cf0bc70a58835d"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A determination on proceeding by a third-party evaluator team shall be by majority vote. </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb2b3a7195e674515a81c9f73fd8f289d"><enum>(II)</enum><header>Tie</header><text display-inline="yes-display-inline">For purposes of preparing and submitting a final report and determination under subsection (b)(7), a vote of a third-party evaluator team that results in a tie shall result in the proposed listing that is the subject of that final report and determination to be terminated.</text></subclause></clause></subparagraph></paragraph><paragraph id="IDF9E4CF3EA6AC4F01B81923D97C022F5A" commented="no"><enum>(4)</enum><header>Compensation of members</header><text>A member of a third-party evaluator team who is not an officer or employee of the Federal Government shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for level IV of the Executive Schedule under section 5315 of title 5, United States Code, for each day (including travel time) during which the member is engaged in the performance of the duties of the third-party evaluator team.</text></paragraph><paragraph id="ID8AB9CAB7544542CBBCD32562861B7980" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Travel expenses</header><text>A member of a third-party evaluator team shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the third-party evaluator team.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1291ab00269948bab9c4b7f36e8c4bc0"><enum>(b)</enum><header>Process</header><paragraph commented="no" display-inline="no-display-inline" id="id287a9b54660048a8be769b8d2adf5636"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 21 days after the date on which the Secretary publishes a notice of a proposed listing of a species as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), an established consortium may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id957c9dc27e604a728557f4eba1b7b484"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Secretary a letter objecting to the proposed listing; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b40d617740547ceb4e884335f73cb46"><enum>(B)</enum><text>request that a third-party evaluator team be empaneled.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6dfad0609d2434da9fba0a53b78d020"><enum>(2)</enum><header>Cease of Federal action</header><text>On receipt of an objection letter from an established consortium under paragraph (1)(A), the Secretary shall cease all action with respect to the proposed listing.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id361e170e376b4c3e94d5712a2c7d7f3a"><enum>(3)</enum><header>Response by Secretary</header><text>Not later than 45 days after the date on which the Secretary receives an objection letter from an established consortium under paragraph (1)(A), the Secretary shall refer the matter to the third-party evaluator team.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c98cc8e31e5422faeea1e1d8db044cd"><enum>(4)</enum><header>First meeting</header><text>Not later than 14 days after the date on which the Secretary refers an objection to the third-party evaluator team under paragraph (3), the third-party evaluator shall hold its first meeting.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64077711ec7f44e89b7a0d78eac42f52"><enum>(5)</enum><header>Submission of information</header><text>At such time and in such manner as the third-party evaluator team determines appropriate, the Service and the established consortium shall submit to the third-party evaluator team the scientific data, or any other material, that the Service and the established consortium, respectively, believes supports its position in opposition to, or support for, the proposed listing.</text></paragraph><paragraph id="idd2c97f2e91da421194e1e41f24112134"><enum>(6)</enum><header>Review</header><subparagraph commented="no" display-inline="no-display-inline" id="id4080808ffa7241da8a73b60cd48a4648"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the third-party evaluator team receives the information submitted under paragraph (5), the third-party evaluator team—</text><clause commented="no" display-inline="no-display-inline" id="idfc992cd8d48a44c981d562a886156a67"><enum>(i)</enum><text display-inline="yes-display-inline">shall conduct an initial review of the assertions made by the Service and the established consortium; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id339426555ca642d1a8e1152b5f3b0b72"><enum>(ii)</enum><text>may, as applicable, request additional information from—</text><subclause commented="no" display-inline="no-display-inline" id="id6ffbdc0e6c5d44868265642385ebb4e8"><enum>(I)</enum><text display-inline="yes-display-inline">the Service or the established consortium; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf439488ea91e426ea217169e6d40a102"><enum>(II)</enum><text>outside parties, including the public, experts, or any other party, as determined by the third-party evaluator team.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide683cd21372d4096b09b2e10b1699c1e"><enum>(B)</enum><header>Considerations</header><text>In conducting an initial review under subparagraph (A)(i), the third-party evaluator team shall consider, in addition to the information submitted under paragraph (5)—</text><clause commented="no" display-inline="no-display-inline" id="id56e504be1316409bb956bcf7b7ff78e6"><enum>(i)</enum><text display-inline="yes-display-inline">the current management plans in place for the applicable candidate species;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd8ff3cb2de38418da77ac88a75018fc0"><enum>(ii)</enum><text>opportunities for achieving, or continuing, protection of the applicable species through the current, or enhanced, voluntary conservation actions;</text></clause><clause commented="no" display-inline="no-display-inline" id="id217c6db5aa93492386e9811843dbcc79"><enum>(iii)</enum><text>the economic impacts of the proposed listing; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5e430841ad04755afb5136042ae6921"><enum>(iv)</enum><text>such other factors, as determined by the third-party evaluator team.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idefeeb6ceffec493d8b688911b699a26f"><enum>(C)</enum><header>Response to request</header><text>If the third-party evaluator team requests additional information from the Service, the established consortium, or an outside party under subparagraph (A)(ii), the Service, established consortium, or outside party, as applicable, shall have 30 days to respond to that request.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03ea4f690b49428a9b56a6fbbe038a42"><enum>(7)</enum><header>Final decision and report</header><subparagraph commented="no" display-inline="no-display-inline" id="id66544c58b6d34a8191b8b62dd26c4ae5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the later of the date on which the third-party evaluator team conducts an initial review under subparagraph (A)(i) of paragraph (6) and the date on which the third-party evaluator team receives additional information under subparagraph (C) of that paragraph, the third-party evaluator team shall review the additional information, if applicable, and provide to the Secretary a final report that contains a binding determination describing whether the proposed listing shall—</text><clause commented="no" display-inline="no-display-inline" id="id0f7a1efbaacc45768b7d3de93c2e23f4"><enum>(i)</enum><text display-inline="yes-display-inline">proceed; </text></clause><clause commented="no" display-inline="no-display-inline" id="id677885bc07f747e5b3025003258ce136"><enum>(ii)</enum><text display-inline="yes-display-inline">be terminated; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id291af6a488f849429f583ded20b44093"><enum>(iii)</enum><text display-inline="yes-display-inline">be remanded back to the Service for further action, in accordance with that determination.</text></clause></subparagraph><subparagraph id="id46002f14600644cdab7e28a45abc1b16"><enum>(B)</enum><header>Requirement</header><text>A final report submitted under subparagraph (A) shall be made publicly available and of sufficient length and detail to provide members of the public with a clear and basic understanding of the decision and why the decision was rendered.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0bab6b09022c4b05b79eb99a15303671"><enum>(C)</enum><header>Dissents</header><text>Any member of the third-party evaluator team that disagrees with the final report submitted under subparagraph (A) may submit, to the Secretary in accordance with that subparagraph, a dissent.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2cbde6b045d3432d925b2bbfa18da151"><enum>(8)</enum><header>Final agency action</header><text display-inline="yes-display-inline">A determination made by the third-party evaluator team under paragraph (7)(A) shall constitute a final agency action (as defined in section 551 of title 5, United States Code).</text></paragraph></subsection></section><section id="iddcf3fcba6ef644ca8c9df105f19e1fe3"><enum>4.</enum><header>Enhancing the transparency of the listing process</header><subsection commented="no" display-inline="no-display-inline" id="id7ffb36e35adc4e45bd1e031dc17c3270"><enum>(a)</enum><header>In general</header><text>In accordance with subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), each Species Status Assessment<italic></italic> shall be subject to notice and comment.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd68908434c674de7be6fc8162a013949"><enum>(b)</enum><header>Requirements</header><text>Each Species Status Assessment shall include—</text><paragraph id="id5a251d40bcfd4f0f9a39f4ede76f7f4e"><enum>(1)</enum><text>the names of all peer reviewers;</text></paragraph><paragraph id="id4e1d4888ea6a4f63bd10ac7032f5f33f"><enum>(2)</enum><text>a biography of each peer reviewer;</text></paragraph><paragraph id="id446e77a7393a49348965ef3689bc2a77"><enum>(3)</enum><text>the selection process for the members of the peer review team;</text></paragraph><paragraph id="id6c440f69e62b483d84446f688cd16ae1"><enum>(4)</enum><text>a detailed description of all previous Species Status Assessments that the peer review team has reviewed and the role of each member of the peer review team in those reviews;</text></paragraph><paragraph id="id5afdfdcec4e24e6e902cc9ad6fcd729c"><enum>(5)</enum><text>a list of published papers the peer reviewers have produced, including the subject of the Species Status Assessment and methodologies and expertise related to information included the Species Status Assessment;</text></paragraph><paragraph id="id9a06f12fe29a4d2d9ef2f0cbd8b2bce3"><enum>(6)</enum><text>an annotated bibliography of all reports, academic papers, and related material considered but excluded from the final Species Status Assessment and an explanation of why that information was excluded;</text></paragraph><paragraph id="id6b35191a2b8c478fb1a6a3faf8f5932f"><enum>(7)</enum><text>an annotated bibliography of all reports, academic papers, and related material considered and included in the final Species Status Assessment and an explanation of why that information was included; and</text></paragraph><paragraph id="idc0e16890ac27441e8e595a6a02ea7acc"><enum>(8)</enum><text>an explanation of how the Service interpreted the genetic data and information in the Species Status Assessment and, to the extent the peer review team use data sets, the given assumptions in the interpretation of those data sets.</text></paragraph></subsection></section><section id="id6605bf39e09744d69c9878e3ad9b9f66"><enum>5.</enum><header>Codification of Partnerships</header><subsection id="idc454b0895c8b46a3a5036d795a309076"><enum>(a)</enum><header>Candidate conservation agreements; candidate conservation agreements with assurances</header><text>Each Candidate Conservation Agreement and Candidate Conservation Agreement with Assurances in effect as of the date of enactment of this Act shall have the force and effect of law beginning on the date of enactment of this Act until such time as the parties to the applicable Candidate Conservation Agreement or Candidate Conservation Agreement with Assurances mutually agree not to renew the Candidate Conservation Agreement or Candidate Conservation Agreement with Assurances, as applicable.</text></subsection><subsection id="idf98294bc975b42dda008716a222ce260"><enum>(b)</enum><header>Partners for fish and wildlife program</header><paragraph id="id4c3583eedf344035b7ed1fd6c99f5843"><enum>(1)</enum><header>In general</header><text>Pursuant to the Partners for Fish and Wildlife Program of the Service authorized by section 4 of the Partners for Fish and Wildlife Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3773">16 U.S.C. 3773</external-xref>) (referred to in this subsection as the <term>Program</term>), the Secretary shall enter into voluntary and customized partnerships with private landowners to improve conditions for wildlife.</text></paragraph><paragraph id="id025725e78b974c95bf1419e61591d6e9"><enum>(2)</enum><header>Duties</header><text>In carrying out the Program, the Secretary shall provide technical and financial assistance to private landowners who enter into a partnership with the Service under paragraph (1) to plan, design, supervise, and monitor customized habitat restoration projects.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id0e3bf34a8c784b1ea9d66b7fde2f1ee8"><enum>6.</enum><header>Conservation partnership options</header><subsection commented="no" display-inline="no-display-inline" id="idcd023f03c47546309bb603c6b5680dc3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law, it shall be at the sole discretion of a non-Federal property owner to determine which conservation agreement described in subsection (b) to enter into with the Service for the conservation of a species.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id97fb3fd07498444b9a00f0d3c1525e28"><enum>(b)</enum><header>Conservation agreements described</header><text>A conservation agreement referred to in subsection (a) is any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id684228fbcc9347eb8b6841e7e9334ee0"><enum>(1)</enum><text>A Conservation Benefit Agreement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19eecaeb97a540edb4b76f55f7e00e2a"><enum>(2)</enum><text display-inline="yes-display-inline">A Candidate Conservation Agreement.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7133b824215477d92926c6f4cacfc98"><enum>(3)</enum><text display-inline="yes-display-inline">A Candidate Conservation Agreement with Assurances.</text></paragraph></subsection></section><section id="id063da53ce77d4a998cca541372109c00" commented="no"><enum>7.</enum><header>Ensuring true critical habitat</header><subsection commented="no" display-inline="no-display-inline" id="idc8ca2fec6ecc447aa0f53c1c3fee09b0"><enum/><text>The final rule of the Service and the National Marine Fisheries Service entitled <quote>Endangered and Threatened Wildlife and Plants; Regulations for Listing Species and Designating Critical Habitat</quote> (84 Fed. Reg. 45020 (August 27, 2019)) is enacted into law.</text></subsection></section></legis-body></bill>
