which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Workforce Innovation and Opportunity Act to expand the capacity of junior or community colleges and area career and technical education schools to conduct training services, education, and outreach activities for careers in the residential construction industry. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Opportunities for New Skills Training at Rural and Underserved Colleges and Trade Schools Act of 2024</short-title></quote> or the <quote><short-title>CONSTRUCTS Act of 2024</short-title></quote>.</text></section><section id="id17d5687eeca44295ae504f1da7a7d236"><enum>2.</enum><header>Education and training for careers in residential construction</header><subsection commented="no" display-inline="no-display-inline" id="idd7d127fc3a3848239e509929ad3b4bb2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0aef132dcbdd4b34a8d06c2af4588be6"><enum>(1)</enum><text>by redesignating section 172 as section 173; and</text></paragraph><paragraph id="idaef1dfbf9b4e444980cd3550a43a083a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting after section 171 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id795613D277BC4C8CBF9149DACB272F54"><section id="id62e44d8fc27749acb1dad706f845abf7"><enum>172.</enum><header>Education and training for careers in residential construction</header><subsection id="id1d4220e9d0d342c4a59a10c45a8d703b"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id969cfdd55e5448178b255c1e85a97773"><enum>(1)</enum><header>Incumbent worker</header><text>The term <term>incumbent worker</term> has the meaning given the term in section 680.780 of title 20, Code of Federal Regulations, or a successor regulation.</text></paragraph><paragraph id="id080fa4bd86784b7d8b1da8c5bd98b0d0"><enum>(2)</enum><header>Junior or community college</header><text>The term <term>junior or community college</term> has the meaning given the term in section 312 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1058">20 U.S.C. 1058</external-xref>).</text></paragraph><paragraph id="idfa7ba7c712634d23acaa1c25c30e3565"><enum>(3)</enum><header>Rural area</header><text>The term <term>rural area</term> means any—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7209b6a7356040f3b49b224a4114ad3c"><enum>(A)</enum><text display-inline="yes-display-inline">nonmetropolitan area; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcba6feb97de84e0093debd956f42ec4e"><enum>(B)</enum><text display-inline="yes-display-inline">rural area, as defined under section 520 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490">42 U.S.C. 1490</external-xref>).</text></subparagraph></paragraph><paragraph id="idd2103dc62ad849648e57e6ee495697e7"><enum>(4)</enum><header>Underserved population</header><text>The term <term>underserved population</term> means a group of individuals with a common demographic trait (such as individuals from the same gender, race, or ethnicity), the members of which—</text><subparagraph id="id3345268652ca4ffe929aabd7b7b0b1b4"><enum>(A)</enum><text>based on the most recent satisfactory data from the Bureau of the Census, comprise a percentage of individuals employed in the construction sector that is lower than the percentage of the total population of the United States comprised by such members;</text></subparagraph><subparagraph id="id1457136383e94a259232b85b1d36d8e7"><enum>(B)</enum><text>are low-income individuals; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50a4049c2c894c6a86f11b456d099ee7"><enum>(C)</enum><text display-inline="yes-display-inline">are individuals with barriers to employment; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26f2572a3c814e12b952828441a0e21d"><enum>(D)</enum><text>are veterans.</text></subparagraph></paragraph></subsection><subsection id="id0687a230432b4bb6b7211dcb6e4531b8"><enum>(b)</enum><header>Establishment of program</header><paragraph commented="no" display-inline="no-display-inline" id="id7c0af539f68a4c3798116c49b88f2ec0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Labor, in consultation with the Secretary of Education, shall establish a program, through which the Secretary of Labor shall award, on a competitive basis, grants to eligible entities to expand their capacity to provide training services, education, and outreach activities for careers in the residential construction industry.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65d8cfa1da154fe99487db60327dc17f"><enum>(2)</enum><header>Grant period</header><text>A grant awarded under this section shall be for a period of not more than 4 years.</text></paragraph></subsection><subsection id="id092fbfaf3e9c47e7b57b594356991e0b"><enum>(c)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be—</text><paragraph id="id36b10531bb3d4b10831a273ed7d90850"><enum>(1)</enum><text>a junior or community college; </text></paragraph><paragraph id="id0dfe0ae696454be6970e86be5f28150a"><enum>(2)</enum><text>an area career and technical education school; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id348fdc99a7c8419ea1b05e148a323d7d"><enum>(3)</enum><text display-inline="yes-display-inline">a provider of training services, as described in section 122(a)(2).</text></paragraph></subsection><subsection id="idd7910f64fe6446da9613f0d66b85ed3d"><enum>(d)</enum><header>Applications</header><text>An eligible entity that desires to receive a grant under this section shall submit an application to the Secretary of Labor at such time, in such manner, and containing such information as the Secretary may require, including the following information:</text><paragraph id="id319a77d43f7548c89e9bf396dc77d5c9"><enum>(1)</enum><text>A description of the new or expanded training services, education, or outreach activities supported by the grant, including a description of how the new training services, education, or outreach activities will align with existing programming related to careers in the residential construction industry at the eligible entity, and the relevant faculty or technical instructors employed by the eligible entity on the date of the submission of the application or who may be employed by the eligible entity to carry out the training services, education, or outreach activities supported by the grant.</text></paragraph><paragraph id="idc3ed5f1c7bcf44f19650f789b6025fb0"><enum>(2)</enum><text>A description of the populations that will be served through the training services, education, or outreach activities supported by the grant, including whether the participants in such training services, education, or outreach activities are—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide23e0b0297624ee7a34faa1dab07e989"><enum>(A)</enum><text display-inline="yes-display-inline">incumbent workers; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc88f393334e34e49bc7877cb15ab347d"><enum>(B)</enum><text display-inline="yes-display-inline">in-school youth; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5207d4109e024965a7f901ec0f9d74cf"><enum>(C)</enum><text display-inline="yes-display-inline">part of an underserved population. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f159524929c416fa2f133226c567244"><enum>(3)</enum><text>A description of the partnerships the eligible entity will facilitate through the grant, including the process by which the eligible entity will ensure that a partner provides fair wages and benefits that are commensurate with local pay and benefit packages, and a plan for sustaining activities and partnerships supported by the grant after the completion of the grant period. </text></paragraph><paragraph id="id00964332de774651b6bdb9194f9c2481"><enum>(4)</enum><text>A description of the anticipated outcomes of the training services, education, or outreach activities supported by the grant, including, at a minimum, the recognized postsecondary credential, postsecondary credit, or degree to be earned by participants, and a timetable showing how the eligible entity will meet the primary indicators of performance described in section 116(b)(2)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f71d773433f4a539cb0a750a0f395c7"><enum>(5)</enum><text>A description of the intended impact of the training services, education, or outreach activities on the local housing market, including a description of how the new training services, education, or outreach activities will increase the supply of affordable housing. </text></paragraph><paragraph id="id9fbb7c5988cf4a20baea35162783529b"><enum>(6)</enum><text>Such other information as the Secretary may require.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida053522ed13f4c909cf0f9c169078255"><enum>(e)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary of Labor shall give priority to eligible entities that serve rural areas or underserved populations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9604b7415d484f618c12d2c4de34e7d3"><enum>(f)</enum><header>Use of funds</header><paragraph commented="no" display-inline="no-display-inline" id="idb37d9d07e0f74b9fbc2c11b17660b32f"><enum>(1)</enum><header>Required uses</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use the grant funds—</text><subparagraph commented="no" display-inline="no-display-inline" id="idef1443d54baf41088aaf16a6818735a7"><enum>(A)</enum><text display-inline="yes-display-inline">to create or expand an evidence-based education or training program to provide skills needed in the residential construction industry, including skills related to—</text><clause commented="no" display-inline="no-display-inline" id="id55de0fa9184448fe9e7fbf4ddad40423"><enum>(i)</enum><text display-inline="yes-display-inline">carpentry;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb4e51451c08a4e41a8f3cc11b8bd464e"><enum>(ii)</enum><text display-inline="yes-display-inline">framing;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfe1b093391de4db19e34ab0d96c2aa2a"><enum>(iii)</enum><text>masonry;</text></clause><clause commented="no" display-inline="no-display-inline" id="id578df246799a49d5a880bc859bb3eab4"><enum>(iv)</enum><text display-inline="yes-display-inline">welding;</text></clause><clause commented="no" display-inline="no-display-inline" id="id60e34b19a56b4f4fbeacc7ce72c8f5e4"><enum>(v)</enum><text>plumbing;</text></clause><clause commented="no" display-inline="no-display-inline" id="idde92eae58127490e86a2580fb468b570"><enum>(vi)</enum><text>electrical work;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbfb2b354b3e74a079e75d44025373a9d"><enum>(vii)</enum><text>construction management;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9c0c53d9d7fc4166af454a62a350ed1d"><enum>(viii)</enum><text display-inline="yes-display-inline">architecture;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a3fac0fa06d40b1928f86bc2cc33d23"><enum>(ix)</enum><text>HVAC;</text></clause><clause commented="no" display-inline="no-display-inline" id="idccecaf70af5b4e97bc82785c5e75a667"><enum>(x)</enum><text display-inline="yes-display-inline">land surveying and geomatics</text></clause><clause commented="no" display-inline="no-display-inline" id="id4f0e6dee0178451787c7f1bb07647b07"><enum>(xi)</enum><text>construction mathematics; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id9906fcf9f21e4d6cbdc08bb6d12f51af"><enum>(xii)</enum><text display-inline="yes-display-inline">such other trades as identified by the Department of Labor;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e825c70253a467789e09eae403e8756"><enum>(B)</enum><text>to create or expand an education or training program focused on increasing the skills or financial well-being of incumbent workers who are residential construction workers;</text></subparagraph><subparagraph id="idcae3ae53f00844f2aa7c8fe91a7eedac"><enum>(C)</enum><text>to create a partnership with a local residential construction business or developer, nonprofit organization, labor organization, entity in the State or local workforce development system, sponsor of a pre-apprenticeship or apprenticeship program, YouthBuild program, or another community partner, with a focus on engaging with organizations that recruit employees or program participants from underserved populations;</text></subparagraph><subparagraph id="id2ff1b2298bde4b2ebc72d4c73b20a532"><enum>(D)</enum><text>to facilitate outreach to secondary school and elementary school students about the residential construction industry and education and training programs available under this section, which may include developing dual or concurrent enrollment programs (as defined under section 8101 of the Elementary and Secondary Education Act of 1965) for secondary students to participate in such education and training programs or integrating such programs in a relevant career and technical education program administered by an elementary school or secondary school; and</text></subparagraph><subparagraph id="id302e92f7993b48dd9858cc56b96a2099"><enum>(E)</enum><text>to incentivize student participation in training services, education, or outreach activities supported by the grant by providing stipends or other payments, including to purchase books and computers or to pay for tests or coursework related to certification.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a5db8e934894474bb00e72aeee6b38a"><enum>(2)</enum><header>Permissive uses</header><text>An eligible entity that receives a grant under this section may use the grant funds—</text><subparagraph id="id59f149a7c2db43e2a4a3eecf4475e783"><enum>(A)</enum><text>to hire technical instructors or other faculty with demonstrated experience and expertise in residential construction to lead education or training programs related to skills and recognized postsecondary credentials needed for a career in the residential construction industry; </text></subparagraph><subparagraph id="idbff0518dd5e24ac6b0cd0d313c7955b9"><enum>(B)</enum><text>to operate an education and training clinic in a rural area or area not otherwise served by an entity described in subsection (c), to the extent necessary and practicable; </text></subparagraph><subparagraph id="id46b57142eac94488935e6558f94a9177"><enum>(C)</enum><text>to develop promotion materials for the purpose of increasing awareness of the training services, education, or outreach activities; </text></subparagraph><subparagraph id="id7126923e20254cadbbceeb5b0f3cd366"><enum>(D)</enum><text>to provide supportive services, such as child care, transportation, tools, assistive technology, and other services to promote retention in, and completion of, an education or training program supported under this section; or </text></subparagraph><subparagraph id="id1e0294359a1d4bc5990cd5ee4e5a5164"><enum>(E)</enum><text>for other activities as approved by the Secretary of Labor. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id772933e3131744ba93f7ef529ae87bd8"><enum>(g)</enum><header>Assistance; flexible schedules</header><text>An eligible entity that receives a grant under this section shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id813ca3238b0d48a7b741fbe901369aba"><enum>(1)</enum><text display-inline="yes-display-inline">use flexible schedules in carrying out the education or training program, including night classes, part-time schedules, and online curricula, to accommodate individuals who work during the day; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6e3d87a177fe40faba95770791cd820e"><enum>(2)</enum><text>provide an individual, upon completion of the education or training program, supportive services for job search and placement to ensure the success of such individuals in achieving the education and career goals. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc8f75ccb24f540acb854a4280944a6b7"><enum>(h)</enum><header>Compliance with applicable laws</header><paragraph id="idfd2521e469494665836ab22a0adb27df"><enum>(1)</enum><header>In general</header><text>Each recipient of funds under this section, and any entity that enters into a partnership with such recipient for the purpose of this Act, shall attest to the Secretary of Labor that the recipient or entity—</text><subparagraph id="id39b7e4aa0fb6404d85d1de17bcb2c61f"><enum>(A)</enum><text>is in compliance with each Federal, State, and local labor law;</text></subparagraph><subparagraph id="id8f813cba99f7422f87d44df04357dd3b"><enum>(B)</enum><text>will remain in compliance with each Federal, State, and local labor law; and</text></subparagraph><subparagraph id="ide656e8fa42b747189bdc52faa226328f"><enum>(C)</enum><text>is not subject to a pending action or case relating to a violation of any law enforced by the Department of Labor, Federal Labor Relations Authority, Equal Employment Opportunity Commission, or National Labor Relations Board.</text></subparagraph></paragraph><paragraph id="ide1d31383e7db4b738c6554400d960bbf" commented="no"><enum>(2)</enum><header>Federal, state, and local labor law</header><text>In this subsection, the term <term>Federal, State, and local labor law</term> means any Federal, State, or local labor law that would be applicable to the recipient or entity described in paragraph (1), as determined by the Secretary of Labor.</text></paragraph></subsection><subsection id="id66fb3ce584754ea1af8ac918c272bb86"><enum>(i)</enum><header>Performance accountability</header><paragraph id="idd63b29bc171244b5b67d1344bfab5edb"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall, not later than 18 months after receiving such grant and annually thereafter for the duration of the grant period, submit to the Secretary of Labor a report containing the eligible entity’s outcomes with respect to the primary indicators of performance described in section 116(b)(2)(A).</text></paragraph><paragraph id="id8ad511d8e2ba44f5ace96834e1a6794a"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 6 months after receiving initial reports from each eligible entity receiving a grant under this section, the Secretary shall prepare and submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and the Workforce of the House of Representatives a report containing, at a minimum, the information described in paragraph (1) for each such eligible entity. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb2232acac7941edb8c26b1f990478b2"><enum>(j)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section for each of fiscal years 2025 through 2029.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id363baa7731ce4545b89c1017110b8b83" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of the Workforce Innovation and Opportunity Act is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idab40a5fd1acd46278cfdea62823a9fbe"><enum>(1)</enum><text>by striking the item relating to section 172; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7df55b0135d1403d8e6c29d0f8600481"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after the item relating to section 171 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8E318B4C7EB94CF3962F9866631EEA01"><toc><toc-entry level="section">Sec. 172.
