which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Care and Development Block Grant Act of 1990 to reauthorize and update the Act, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Care and Development Block Grant Reauthorization Act of 2024</short-title></quote>.</text></section><section id="id7aec312770294408a01b0c7a7e5afef6"><enum>2.</enum><header>Purposes</header><subsection id="idbe3c48de9f5a45adb1ec6303ba61b36c"><enum>(a)</enum><header>Redesignation</header><text>Section 658A of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857</external-xref>) is redesignated as section 658 of such Act.</text></subsection><subsection id="id0606322e6a5e45dd9e044451bb964546"><enum>(b)</enum><header>Amendment</header><text>Subsection (b) of that section 658 is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7c6b6530b631427cbe0f3aeb08e0e747"><subsection id="ide26dd289b5b6420f8f1a0e462a14120c"><enum>(b)</enum><header>Purposes</header><text>The purposes of this subchapter are—</text><paragraph id="ide25e12d100f4495294079cd960cc48ff"><enum>(1)</enum><text>to allow each State maximum flexibility in developing and implementing a mixed delivery system to provide child care that best suits the needs of children and working parents within that State;</text></paragraph><paragraph id="id8ae0644531f34e4f8b3ae0c7106cf43f"><enum>(2)</enum><text>to promote parental choice to empower working parents to make their own decisions regarding the child care services that best suit their family’s needs;</text></paragraph><paragraph id="id7c454c4306b14ddebd3359f602e50013"><enum>(3)</enum><text>to encourage States to provide consumer education information to help parents make informed choices about child care services and to promote involvement by parents and family members in the development of their children in child care settings;</text></paragraph><paragraph id="idcd40efba704e4c4daa9343640b2dce19"><enum>(4)</enum><text>to assist States in delivering high-quality, coordinated child care services to maximize parents’ options to cover the full workday and full work year, to support continuity of care for children, and to support parents trying to achieve independence from public assistance;</text></paragraph><paragraph id="id8305035a3e924619821f187b6c294575"><enum>(5)</enum><text>to assist States in improving the overall quality of child care by implementing the health, safety, licensing, early learning and development, professional, and oversight standards established in this subchapter and in State law (including State regulations);</text></paragraph><paragraph id="iddccc9a64453e46df83c799e963d0a407"><enum>(6)</enum><text>to assist States—</text><subparagraph id="id137b6de89f8948fdb634dad5dd772355"><enum>(A)</enum><text>in supporting the education and professional development of child care staff; and</text></subparagraph><subparagraph id="id04112f6dbe0c48e6a29821f233a37ee5"><enum>(B)</enum><text>in supporting child care providers in the recruitment of, professional development for, and retention of a qualified child care workforce; and</text></subparagraph></paragraph><paragraph id="id68e08c1063ce4f54bc7712eba0f6430c"><enum>(7)</enum><text>to increase the number and percentage of low-income children in high-quality child care settings.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2f95f542cc3146899b51523ef9501199"><enum>3.</enum><header>Definitions</header><subsection id="id0cc472022dad4b24a984e9ca9b4d783e"><enum>(a)</enum><header>In general</header><text>Section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>) is amended—</text><paragraph id="id4971e8dd1c1548f2ba00c9c07863aa74"><enum>(1)</enum><text>by redesignating paragraphs (5) through (7), (8) and (9), and (10) through (15), as paragraphs (6) through (8), (10) and (11), and (13) through (18), respectively;</text></paragraph><paragraph id="id241adc5586dd48218a0e256819014fa8"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="id3e4dc31223d2477fa7a0813f000acc0e"><enum>(A)</enum><text>in subparagraph (B), by inserting <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id15bb9ca80e964fa18355bbd190797729"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>; and</quote> at the end and inserting a period; and</text></subparagraph><subparagraph id="id75245997e8ef41c59ebe1256667348b6"><enum>(C)</enum><text>by striking subparagraph (D);</text></subparagraph></paragraph><paragraph id="id31373d5e081743f1921e9b1a00e1e056"><enum>(3)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id609be8d333ed4560b389a4711a5b4ad3"><paragraph id="ide9639d69775640bcb36699885a7a3978"><enum>(4)</enum><header>Eligible activity</header><text>The term <term>eligible activity</term>, means an activity consisting of—</text><subparagraph id="idb3ecf597c8814d8984580a85462f7202"><enum>(A)</enum><text>full-time or part-time employment;</text></subparagraph><subparagraph id="id944b9ec5331c434bac175214c2b789fe"><enum>(B)</enum><text>self-employment;</text></subparagraph><subparagraph id="id238b7660a01b44c8bd7ee1fc81a3ae5f"><enum>(C)</enum><text>job search activities;</text></subparagraph><subparagraph id="id5ea69afb3a154c6581c8d6a8ed3d861d"><enum>(D)</enum><text>job training;</text></subparagraph><subparagraph id="ide166224b3f774ad6bdf3c642bf220e05"><enum>(E)</enum><text>secondary, postsecondary, or adult education, including education through a program of high school classes, a course of study at an institution of higher education, classes towards an equivalent of a high school diploma recognized by State law, or English as a second language classes;</text></subparagraph><subparagraph id="id418f09c17f6a4930b2eef918a3ba4099"><enum>(F)</enum><text>health treatment (including mental health and substance use treatment) for a condition that prevents the parent involved from participating in other eligible activities;</text></subparagraph><subparagraph id="id7d4aed6dab9b4e44b38d55241401c270"><enum>(G)</enum><text>activities to prevent child abuse or neglect, or family violence prevention or intervention activities;</text></subparagraph><subparagraph id="id8618f19fa71f45df8f2805bccc097d3e"><enum>(H)</enum><text>employment and training activities under the employment and training program, of the supplemental nutrition assistance program, established under section 6(d)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(d)(4)</external-xref>);</text></subparagraph><subparagraph id="id46bca0e78a224db19ba8821090c0631f"><enum>(I)</enum><text>employment and training activities under the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101 et seq.</external-xref>); or</text></subparagraph><subparagraph id="idbfb2979c87524fea86f34f2a3bf82bd6"><enum>(J)</enum><text>a work activity described in subsection (d) of section 407 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/607">42 U.S.C. 607</external-xref>) for which, consistent with clauses (ii) and (iii) of section 402(a)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/602">42 U.S.C. 602(a)(1)(A)</external-xref>), a parent is treated as being engaged in work for a month in a fiscal year for purposes of the program of block grants to States for temporary assistance for needy families established under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="idfa838b80a1044ab4911610b466af7575"><enum>(5)</enum><header>Eligible child</header><text>The term <term>eligible child</term> means an individual—</text><subparagraph id="id7015f8a3b1814dc68a5d3f4ac3835ef6"><enum>(A)</enum><text>who is less than 13 years of age;</text></subparagraph><subparagraph id="id09d97acf1be44f3b9a292480b0b714a3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id3761e2ba3f2c4ec0a990468fcf55c7b1"><enum>(i)</enum><text>whose family income does not exceed— </text><subclause commented="no" display-inline="no-display-inline" id="idf0c54a6b53c4434d97932603b628d74d" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">85 percent of the State median income for a family of the same size; or </text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="id8f4a88594832477989a3498f4e413aa8"><enum>(II)</enum><text display-inline="yes-display-inline">a higher percentage of that income in a State with a waiver under section 658I(c)(1)(B); and</text></subclause></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="ida26511df606543edb45c1bf53b7c021a"><enum>(ii)</enum><text>whose family assets do not exceed $1,000,000 (as certified by a member of such family); and</text></clause></subparagraph><subparagraph id="idc7f11f5e35a64ac2a92ecda581a0c076"><enum>(C)</enum><text>who—</text><clause id="ide0065d9d067b40af98ea5a489e7ae75f"><enum>(i)</enum><text>resides with a parent or parents who are participating in an eligible activity;</text></clause><clause id="id883a57f0a4c84bcb80e92b06286289ad"><enum>(ii)</enum><text>is a child experiencing homelessness, a child in kinship care, or a child who is receiving, or needs to receive, child protective services; or</text></clause><clause id="id98cf43a0ee86490ca0824ef156b2b3a6"><enum>(iii)</enum><text>resides with a parent who is more than 65 years of age.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idc119b8de525f470d9db5fee7a94fc7d3"><enum>(4)</enum><text>in paragraph (7), as so redesignated—</text><subparagraph id="idc20b6c64f76940c782d1eb124fa973be"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id4a14b6b1c866452f9e8e88cc7e6b2af7"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id74752500c629476d8ff89d218c485c21"><enum>(i)</enum><text>by inserting <quote>the child (if the spouse of such provider is engaged in an eligible activity),</quote> after <quote>decree,</quote>; and</text></clause><clause id="id4651e22d476941d8a80cc80e5c6ff619"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; or</quote>; and</text></clause></subparagraph><subparagraph id="id1e1f8e6e12374994b74c1dd386446234"><enum>(C)</enum><text>by added at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id390edd2e496d4532aeef647ea5ba7aa9"><subparagraph id="idf26dd8fdf6af4cbea645a5fdaf6cb1ca"><enum>(C)</enum><text>notwithstanding section 645(a)(1)(B) of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9840">42 U.S.C. 9840(a)(1)(B)</external-xref>), a Head Start agency.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id87cef8ab35f6498989ffd48b4ef208a9"><enum>(5)</enum><text>by striking paragraph (8), as so redesignated, and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7a4f3416df624a929d558641c239e522"><paragraph id="ide5791318a326402c96adf73a8f9c7b52"><enum>(8)</enum><header>Family child care provider</header><text>The term <term>family child care provider</term> means an individual who provides child care services in a private residence—</text><subparagraph id="idc7c9ac8f0929454d89746c45e9fa6e81"><enum>(A)</enum><text>for fewer than 24 hours per day per child; or</text></subparagraph><subparagraph id="id1b8092a68eb34c4e8c32d3fa6c940fdc"><enum>(B)</enum><text>for 24 hours per day per child due to the nature of the work of the parent involved.</text></subparagraph></paragraph><paragraph id="id477fa2834212423c991c836641871429"><enum>(9)</enum><header>Homeless child</header><text>The term <term>homeless child</term> means an individual described in section 725(2) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a(2)</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ida17ba9b8d50149de97b00270a97ced1f"><enum>(6)</enum><text>in paragraph (10), as so redesignated, by striking <quote>(10)</quote> and all that follows through <quote>meaning</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id12ef15a6e4d34f458ab62270eb5b5cea"><paragraph id="idc4fc6a8f37b347038e3f421e66c02004"><enum>(10)</enum><header>Indian Tribe; Indian tribe</header><text>The term <term>Indian Tribe</term> or <term>Indian tribe</term> has the meaning</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ide37b5beca8e849479c7bdc15dc8969e1"><enum>(7)</enum><text>by inserting after paragraph (11), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0402d0feac8b4e7893321ea5a9d1d7e4"><paragraph id="idd14f291deb8143b3bf1e9c1c72a535f2"><enum>(12)</enum><header>Mixed delivery system</header><text>The term <term>mixed delivery system</term> means a system of child care services that—</text><subparagraph id="id619572dbe53d46e39561caa9064d11a5"><enum>(A)</enum><text>promotes parental choice to empower working parents to make their own decisions regarding the child care services that best suit their family’s needs;</text></subparagraph><subparagraph id="idf9b8c367557049caab7e95e530fc5106"><enum>(B)</enum><text>delivers services through a combination of programs offered by eligible child care providers (including faith-based and community-based child care providers) in a variety of settings (including family child care homes, child care centers, Head Start centers, and public and private schools); and</text></subparagraph><subparagraph id="id1ecd6a670bf64f1c8ae8509fbd2047bb"><enum>(C)</enum><text>is supported with a combination of public and private funds.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id2d74398336534bfca7bdb07f1f4c681d"><enum>(8)</enum><text>in paragraph (15), as so redesignated, by striking <quote>unless the context specifies otherwise</quote>and inserting <quote>except as otherwise specified</quote>; and</text></paragraph><paragraph id="id8462b0a5534647e7b450e03779e57c36"><enum>(9)</enum><text>in paragraph (18), as so redesignated, by striking <quote>(18)</quote> and all that follows through <quote>has the meaning</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3582f6c2e21249548f04e354e61b4831"><paragraph id="id860eb54a325d48449fca174c9f2d70a0"><enum>(18)</enum><header>Tribal organization; tribal organization</header><subparagraph id="iddc879e18a8f54b519c8680303068135f"><enum>(A)</enum><header>In general</header><text>The term <term>Tribal organization</term> or <term>tribal organization</term> has the meaning</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="iddded43537afc4b72afec0031e97cba4b"><enum>(b)</enum><header>Redesignation</header><text>The Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>) is amended—</text><paragraph id="id26a4bf1eab53411091ed6cd7663f7743"><enum>(1)</enum><text>by redesignating section 658P as section 658A; and</text></paragraph><paragraph id="id5eb072cc24de41caaabbc2dc37b6b034"><enum>(2)</enum><text>by moving section 658A, as so redesignated, to follow section 658, as redesignated by section 2.</text></paragraph></subsection></section><section id="ide494357fbcf7443a9480b4d7ccd82f5b"><enum>4.</enum><header>Authorization of appropriations</header><subsection id="id839adccc0044450788017e993d2cd9d2"><enum>(a)</enum><header>Part</header><text>The Child Care and Development Block Grant Act of 1990 is amended by inserting before section 658B the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8b98084cfedc4c868d030fecafaee598"><part id="id0297fd47c00840beb6c0b23ba6293487"><enum>I</enum><header>Child care services</header></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5694c6bcc5c54dd8a1cd9e52d2369432"><enum>(b)</enum><header>In general</header><text>Section 658B of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8229898b81a94da697d35cd200da5356"><section id="idc33af051a05b4f06b45f56cff815796f"><enum>658B.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this subchapter (other than section 658T) such sums as may be necessary for each of fiscal years 2025 through 2029.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ide50055a3ea0d4f38945162adc35f019a"><enum>5.</enum><header>Lead agency</header><text display-inline="no-display-inline">Section 658D(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858b">42 U.S.C. 9858b(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfb51018ca556465e84b5433906ba120f"><paragraph id="id2cd996dd57b84a4f8339513fb5bb6849"><enum>(2)</enum><header>Development of plan</header><text>The lead agency shall develop the State plan described in paragraph (1)(B) in meaningful consultation with—</text><subparagraph id="id27cc39de1e2247199589b9f3712a1134"><enum>(A)</enum><text>parents of children eligible for services under this subchapter, which shall include parents of children in a priority population described in section 658E(c)(2)(M);</text></subparagraph><subparagraph id="id2cf9e2125c15428c82ccafd445886bce"><enum>(B)</enum><text>eligible child care providers that represent the various geographic areas and types of providers in the State;</text></subparagraph><subparagraph id="idb8cffc565b364335b2a618e3e57fb038"><enum>(C)</enum><text>employers of various sizes and with various hours and days of operations whose employees rely on reliable and accessible child care to work; and</text></subparagraph><subparagraph id="idfed6855904b94c21b0657fffa1a4c190"><enum>(D)</enum><text>appropriate representatives of units of general purpose local government and, as appropriate, of Indian Tribes and Tribal organizations.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idcb17198b73884e7f925a674ebfe8c59b"><enum>6.</enum><header>Application and plan</header><text display-inline="no-display-inline">Section 658E(c) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(c)</external-xref>) is amended—</text><paragraph id="idba95979030b942e1a3e7cd4a26122460"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="id8f6e07846f3f455487bba7653528ce07"><enum>(A)</enum><text>in subparagraph (A)(i)(I), by striking <quote>a child</quote> and inserting <quote>an eligible child</quote>;</text></subparagraph><subparagraph id="idf0a63ea5df964a61b60812bd926aae8e"><enum>(B)</enum><text>in subparagraph (D), by striking <quote>, not later</quote> and all that follows through <quote>subparagraph (K)(i),</quote>;</text></subparagraph><subparagraph id="id0071046895084c90b782a5b894ee598c"><enum>(C)</enum><text>in subparagraph (E)(i)—</text><clause id="ida5ee064999064cb7b9df11f0e60c6f4a"><enum>(i)</enum><text>in the matter preceding subclause (I), by inserting <quote>, offered through a mixed delivery system,</quote> after <quote>full diversity of child care services</quote>;</text></clause><clause id="id067d368d67e94c21ab083d97926d9b34"><enum>(ii)</enum><text>in subclause (I), by inserting <quote>(including information on the hours and days of operation and ages served)</quote> after <quote>of child care services</quote>; and</text></clause><clause id="id1603e1d892eb49cdbec6825ae82d126c"><enum>(iii)</enum><text>in subclause (IV)—</text><subclause id="id77fc642000b644ad841deebb90f3721d"><enum>(I)</enum><text>by striking <quote>and</quote> before <quote>the Medicaid</quote>; and</text></subclause><subclause id="idd342676946934cccae395ecfbac3f34a"><enum>(II)</enum><text>by inserting before the semicolon the following: <quote>, and the Maternal, Infant, and Early Childhood Home Visiting Programs under section 511 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/711">42 U.S.C. 711</external-xref>)</quote>;</text></subclause></clause></subparagraph><subparagraph id="id6c41a77908644f45b4513fd53df0adec"><enum>(D)</enum><text>in subparagraph (G)—</text><clause id="id0df8c3e876054983bdeeebff52e2acf5"><enum>(i)</enum><text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">Training and professional</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">Professional</header-in-text></quote>;</text></clause><clause id="idcc31240fa1fe49ed9d5870313c8193f9"><enum>(ii)</enum><text>in clause (i) and clause (ii) (in the matter preceding subclause (I)), by striking <quote>training and</quote> before <quote>professional development</quote>;</text></clause><clause id="idea737c670cbd4aeaada27553cde4af1a"><enum>(iii)</enum><text>in clause (ii)(II), by striking <quote>, and may engage</quote> and all that follows through <quote>training framework</quote>; and</text></subclause><subclause id="id4edfe45b62914d2b98035010759f2075"><enum>(II)</enum><text>child care providers can easily identify, understand, and comply with applicable health and safety requirements.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ide4fcf40b76bd4d7b81b10fdece5cfbc9"><enum>(G)</enum><text>in subparagraph (K)(i)—</text><clause id="idf2a75b448f1847fc8a195bdeed6779a3"><enum>(i)</enum><text>in the matter preceding subclause (I), by striking <quote>, not later</quote> and all that follows through <quote>2014,</quote>; and</text></clause></subparagraph><subparagraph id="iddc26bb9f5e6e4fb380b6f2b339ab6039"><enum>(N)</enum><text>in subparagraph (V), by striking <quote>develop</quote> and all that follow through <quote>services.</quote> and inserting</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id71276af0e6ca49858d95666df4b3edc7"><text>support child care business technical assistance including supporting—</text><clause id="id5636e96b60324cefb5a9d333cf2dc1d7"><enum>(i)</enum><text>provision of strategies to support management coaching and the use of core best business practices;</text></clause><clause id="idfad03c3dccd644faaa105d09572295e5"><enum>(ii)</enum><text>development and use of shared services initiatives including initiatives involving provider networks such as child care center alliances and family child care provider networks; and</text></clause><clause id="idcbcae1639ebe4801b0109272ebaa1936"><enum>(iii)</enum><text>coordination of activities with programs of the Small Business Administration, programs of the Department of Agriculture, and other Federal, State, and local programs supporting child care businesses.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idc3b9a2a467b642b0897d502212db17f0"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph id="id016ed1d8d982442080a4d6be08baf1a8"><enum>(A)</enum><text>in subparagraph (B)(ii), by striking <quote>Not later</quote> and all that follows through <quote>shall prepare</quote> and inserting <quote>Not later than September 30 of each fiscal year, the Secretary shall prepare</quote>; and</text></clause><clause id="id2baf96daa5b44404af0402102447d652"><enum>(ii)</enum><text>by striking <quote>described in clause (i), (ii), (iii), or (iv) of</quote> and inserting <quote>in priority populations described in</quote>;</text></clause></subparagraph></paragraph><paragraph id="id414b17b5ec0d450d877019f457f38040"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="id7979df7ce0c8459098a27cefde86444e"><enum>(A)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id29E04548BE3743BBB2DC53D74CDC8F48"><subparagraph id="id2f69ba8bb6904b9585b369c8c5800e4e" commented="no"><enum>(A)</enum><header>In general</header><text>The State plan shall certify that, not later than the later of the date that is 5 years after the date of submission of the application, and September 30, 2030, payment rates for the provision of child care services for which assistance is provided in accordance with this subchapter—</text><clause commented="no" display-inline="no-display-inline" id="id723c97e4081a4fb3b64a3becbb833689"><enum>(i)</enum><text display-inline="yes-display-inline">will be sufficient to meet the cost of providing the child care services, including the fixed and operational costs of providing the child care services; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id2281abe6dcd84dc89eae97eac2e14eb3"><enum>(ii)</enum><text display-inline="yes-display-inline">will be set and paid in accordance with a cost estimation model described in subparagraph (B).</text></clause></subparagraph><subparagraph id="id5a6e4661af1e4b28a9a6723d17350bd4"><enum>(B)</enum><header>Cost estimation model</header><text>The State plan shall—</text><clause id="id50c4599f7d9b4819b891678a34fbd77b"><enum>(i)</enum><text>demonstrate that the State, after consulting with eligible child care providers that represent the various geographic areas of the State and types of providers within the State’s mixed delivery system, local child care program administrators, local child care resource and referral agencies, and other appropriate entities, has developed and uses (or if the State has not used such a model certify that the State, after such consultation but not later than the later of the date that is 5 years after the date of submission of the application described in subsection (a), and September 30, 2030, will develop and use) a statistically valid and reliable cost estimation model for the payment rates for providers of child care services in the State, that—</text><subclause id="id7d2b227f340a4a29923948952c2a6b34"><enum>(I)</enum><text>reflects the costs of service delivery, including fixed costs, operating expenses, and staff salaries and benefits necessary to recruit, train, and retain qualified staff;</text></subclause><subclause id="id311aa4c26e2b4d50b18d9823c9d83a10"><enum>(II)</enum><text>reflects variations in the costs of service delivery by submarket, type of provider, and children served, including by—</text><item id="ide7343f422fbf4a22830e8abf9d40261a"><enum>(aa)</enum><text>geographic area (such as location in a urban or rural area);</text></item><item id="idccebe45ece2b48f58eb444a4f84c8378"><enum>(bb)</enum><text>ages of children;</text></item><item id="id1146a87207594db78b5d0e482c85b592"><enum>(cc)</enum><text>whether the children have particular needs (such as needs of children with disabilities and children served by child protective services);</text></item><item id="idc50ac2a7f14944d7813c103ff9d5e787"><enum>(dd)</enum><text>whether the providers provide services during weekend and other nontraditional hours; and</text></item><item id="idde2fe6d09a7c4be08571aa0cd5449679"><enum>(ee)</enum><text>quality of child care provider as determined by the State; and</text></item></subclause><subclause id="ideb2ee3d2ced640f2adff066176ee6884"><enum>(III)</enum><text>is reviewed not less often than once every 2 years and adjusted as may be necessary to—</text><item id="id5225f67801af467288dc076eb015ca84"><enum>(aa)</enum><text>ensure payment rates remain sufficient to meet the requirements of this subchapter; and</text></item><item id="id77503e40ad35407f976169dacaecfd9f"><enum>(bb)</enum><text>provide a cost of living increase to maintain the level of services provided during the year prior to the review; and</text></item></subclause></clause><clause id="id653f1eefe6734f948cee0b5b2fc10a2e"><enum>(ii)</enum><text>describe how the State will provide for timely payments, set in accordance with the model described in clause (i), for child care services provided under this subchapter.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idcb13be02dba540d49ab2da4cbafe68fe"><enum>(B)</enum><text>in subparagraph (C)—</text><clause id="id2de22b33432c425bb927a20c8853ec8c"><enum>(i)</enum><text>by striking clause (ii); and</text></clause><clause id="id1d8e22703d014867b24fe19012960f61"><enum>(ii)</enum><text>by striking <quote>(C)</quote> and all that follows through <quote>Nothing</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2a0d70c24ea44bea885b2348036af012"><subparagraph id="id9640c1ee2ce1449aa3cd10a51641a316"><enum>(C)</enum><header>Construction</header><text>Nothing</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idbee0c45e119444aea219c5bc018c9b35"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida6af54226d4942f6807edaee79dc94e8"><subparagraph id="idf3e387b006874f40aa67f22a0ac66b4c"><enum>(D)</enum><header>No federal control</header><text>The Secretary may offer guidance to States on cost estimation models described in subparagraph (B), but shall not require a State to adopt a particular cost estimation model or element of a particular cost estimation model.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4f00889c21694e55aaa047c76b96941d"><enum>(4)</enum><text>by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7EAAD7A59C58411DB2D385CFCCB5394E"><paragraph id="id0f6ddab8b0bb446d9c52d652c919e7e8"><enum>(5)</enum><header>Sliding fee scale</header><subparagraph commented="no" display-inline="no-display-inline" id="id06416ab9dad24a2393faa7fc9e18e948"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The State plan shall provide that the State will establish and periodically revise by rule a sliding fee scale to determine a full copayment for a family receiving assistance under this subchapter (or, for a family receiving part-time care, a reduced copayment that is an appropriate amount of the full copayment) and that is not a barrier that restricts families from accessing child care services under this subchapter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc32bcb44c9834a1a9e80492d485481e6"><enum>(B)</enum><header>No federal control</header><text display-inline="yes-display-inline">The Secretary may offer guidance to States on sliding fee scales described in subparagraph (A), but shall not require a State to adopt a particular sliding fee scale or element of a particular sliding fee scale.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id3fd80f3dbdf64a139aba4d8f5a00e41e"><enum>7.</enum><header>Activities to improve the quality of child care</header><text display-inline="no-display-inline">Section 658G(a) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e(a)</external-xref>)—</text><paragraph commented="no" display-inline="no-display-inline" id="id994231539660460f9acf18ff398732b4"><enum>(1)</enum><text>in paragraph (1), by adding at the end the following: <quote>The State shall include, in the State's activities, developing and expanding initiatives to assist child care providers in their efforts to recruit, train, and retain qualified staff.</quote>; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb2d50fe431e448c1a90baa3c42545ebf"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="ida1f2ade82f864e138da03a71b24cde4f"><enum>(A)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38919730ad8643079ce82195d3b10e4e"><subparagraph id="id3fc3143fd64f40e2b6273ce675e58c32"><enum>(A)</enum><text>to carry out the activities described in paragraph (1), not less than 9 percent of the funds described in paragraph (1) for each fiscal year; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ida28778963ef74462b5bee0d98b471134"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>received not later</quote> and all that follows through <quote>succeeding full fiscal year</quote> and inserting <quote>received for each fiscal year</quote>.</text></subparagraph></paragraph></section><section id="id6ec3a72a02f94ff6b7f84e0cda88d828"><enum>8.</enum><header>Waivers of income requirement</header><text display-inline="no-display-inline">Section 658I(c) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858g">42 U.S.C. 9858g(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb68930a7776f4d46b879785cdf31e69b"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf9d36a7677114187b1580265540f0540"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>of not more than three years</quote> and inserting <quote>described in paragraph (5)</quote>; A State seeking that renewal shall inform the Secretary of this intent no later than 30 days prior to the expiration date of the waiver. The State shall re-certify in its renewal request the provisions in paragraph (2). On determining that the State has accurately re-certified those provision, the Secretary shall grant the renewal.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id85482e279f3c421099c6fd1ab2419365"><enum>(4)</enum><text>in paragraph (8), by inserting <quote>, other than paragraph (1)(B),</quote> after <quote>this subchapter</quote>.</text></paragraph></section><section id="id0c26d9e2ebf14d39bd99a2b6fbcd20cc"><enum> 9.</enum><header>Reports and audits</header><text display-inline="no-display-inline">Section 685K(a)(2) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858i">42 U.S.C. 9858i(a)(2)</external-xref>) is amended—</text><paragraph id="id13923466bf764a06819ec238607aa56e"><enum>(1)</enum><text>in the matter preceding subparagraph (A)—</text><subparagraph id="id1cb382b4472a42dbb5b28b7541453ce1"><enum>(A)</enum><text>by striking <quote>Not later than</quote> and all that follows through <quote>a State</quote> and inserting <quote>A State</quote>; and</text></paragraph><paragraph id="idbf6b3ee3c5884d5f84372b234aef3836"><enum>(3)</enum><text>in subparagraph (F), by striking <quote>section 658P(6)(B)</quote> and inserting <quote>section 658A(7)(B)</quote>.</text></paragraph></section><section id="id5c4f185dfc9b407f8d9139d4c386dc8e"><enum>10.</enum><header>Reports, hotline, and website</header><text display-inline="no-display-inline">Section 658L(a) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858j">42 U.S.C. 9858j(a)</external-xref>) is amended by striking <quote>Not later</quote> and all that follows through <quote>the Secretary shall</quote> and inserting <quote>The Secretary shall biennially</quote>.</text></section><section id="id4d5584fc227a4dbd8b9c4949d19569a9"><enum>11.</enum><header>Technical amendments</header><text display-inline="no-display-inline">Section 658O(a) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858m">42 U.S.C. 9858m(a)</external-xref>) is amended—</text><paragraph id="idcf4019fa06b14ad6b3fc1c7e736265b9"><enum>(1)</enum><text>in paragraphs (1), (3), and (4) by striking <quote>this subchapter</quote> and inserting <quote>section 658B</quote>; and</text></paragraph><paragraph id="id58cd55fa8d1c46ea933848655bb09668"><enum>(2)</enum><text>in paragraph (5) by striking <quote>this subchapter</quote> the first place it appears and inserting <quote>section 658B</quote>.</text></paragraph></section><section id="idff8697d10fce4988a0b2abb8dc7b5b4c"><enum>12.</enum><header>Child care supply and facilities grants</header><text display-inline="no-display-inline">The Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9857">42 U.S.C. 9857 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7e3488fd56d245d8982bf23bb0f36b78"><part id="id68743cca28394e3cae41cdb36d79b7c8"><enum>II</enum><header>Child care supply and facilities</header><section id="id773c4074e3e4495eb4a70a7a2deb68cc"><enum>658T.</enum><header>Child care supply and facilities grants</header><subsection id="id7e7fa8fc6f274253886e48a59d9c5e2e"><enum>(a)</enum><header>Purposes</header><text>The purposes of this section are to provide grants to States, territories described in section 658O(a)(1) (referred to individually in this part as a <quote>territory</quote>), Indian Tribes, and Tribal organization to—</text><paragraph id="idc8c2c7ea90e84c079d188078fcbe225b"><enum>(1)</enum><text>expand the supply and capacity of child care providers so that working parents have multiple high-quality child care options to choose from in making their own decisions regarding the child care services that best suit their family’s needs; and</text></paragraph><paragraph id="id2ab079aad2d843a59bdc5af2b07ec712"><enum>(2)</enum><text>ensure child care facilities are designed and equipped to keep children healthy and safe and to enhance children’s physical, cognitive, and behavioral development.</text></paragraph></subsection><subsection id="id5152911bb3854c47b05719dc9bc77f37"><enum>(b)</enum><header>Qualified child care provider</header><text>In this section, the term <term>qualified child care provider</term> means—</text><paragraph id="id56dd780b05be44a98e596c2a3fd54011"><enum>(1)</enum><text>an eligible child care provider as defined in section 658A(7)(A) that is providing, or seeking to provide, child care services to children eligible for services under this subchapter; or</text></paragraph><paragraph id="ida37b5b62397648e5adc36ccefdb469c8"><enum>(2)</enum><text>a child care provider that has applied under this subchapter to become an eligible child care provider as defined in section 658A(7)(A) and that commits to provide child care services to children eligible for services under this subchapter.</text></paragraph></subsection><subsection id="id3a5fd62098e748669b133707f273f0fd"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section such sums as may be necessary for each of fiscal years 2026 through 2028.</text></subsection><subsection id="id9c8f18b4a4f649fa849ad0aca8f2038a"><enum>(d)</enum><header>Grants authorized; allotments</header><paragraph id="id73639a69c0a24936ae58a3a61d2ac4d1"><enum>(1)</enum><header>In general</header><text>From funds made available under subsection (c), the Secretary shall make grants to States, territories, Indian Tribes, and Tribal organizations to carry out the activities described in subsection (f).</text></paragraph><paragraph id="idd2185d8d52a842c6b0a985a0d4fb5fd8"><enum>(2)</enum><header>Reservation</header><text>The Secretary shall reserve not more than 1 percent of the amount appropriated under subsection (c) for a fiscal year to carry out this section to pay for the costs of the Federal administration of this section.</text></paragraph><paragraph id="idba733ba72ba640c8a9dc131174242ccc"><enum>(3)</enum><header>Allotments</header><text>From the amount appropriated to carry out this section for a fiscal year that remains after the Secretary makes the reservation under paragraph (2), the Secretary shall award to each lead agency with an approved plan under subsection (e), a child care supply and facilities grant in accordance with paragraphs (1) and (2) of subsection (a), and subsection (b), of section 658O, for the grants authorized under paragraph (1). A grant made under this paragraph in accordance with paragraph (1) or (2) of that subsection shall be for the purpose of carrying out the program described in this section, consistent, to the extent practicable as determined by the Secretary, with the requirements applicable to States.</text></paragraph></subsection><subsection id="idde86cbcc6e1649bbac81cec527cfe9ea"><enum>(e)</enum><header>State plan</header><paragraph id="id4251151c2c0f444c9c905c3be812f50d"><enum>(1)</enum><header>In general</header><text>In order to receive a grant under this section, a State shall submit a plan to the Secretary, at such time and in such manner as the Secretary may reasonably require.</text></paragraph><paragraph id="idea0a63be6e2d4eef88fa40ea308cae09"><enum>(2)</enum><header>Contents</header><text>Each plan submitted by a State under this section shall include each of the following:</text><subparagraph id="idaa6cf54c7001479aa962c8806038349c"><enum>(A)</enum><text>A description of how the State will use funds received under this section for State-level activities under subsection (f)(1).</text></subparagraph><subparagraph id="id178cc99a7f15490588b67be9f75fabf6"><enum>(B)</enum><text>A description of how the State will ensure that qualified child care providers in rural, suburban, and urban areas can readily apply for and access funding under this section, which shall include providing technical assistance either directly or through a third party which may include a resource and referral agency or a staffed family child care provider network.</text></subparagraph><subparagraph id="idda9449b9f580483192abb288e531c9aa"><enum>(C)</enum><text>A description of how the State will determine the prioritization of subgrants to qualified child care providers in accordance with subsection (f)(5).</text></subparagraph><subparagraph id="idc0de100e4ad94694872c15eabdc9a11c"><enum>(D)</enum><text>An assurance that the State will make available to the public, which shall include, at a minimum, posting to an internet website of the lead agency—</text><clause id="id52a6c3c400634e11bab098978105b327"><enum>(i)</enum><text>a notice of funding availability through subgrants for qualified child care providers under this section; and</text></clause><clause id="idb06fb5e5b368423f835f1ae0a06f8d5a"><enum>(ii)</enum><text>the criteria for awarding subgrants for qualified child care providers, including the methodology the lead agency will use to determine the amounts of such subgrants for qualified child care providers.</text></clause></subparagraph></paragraph></subsection><subsection id="id241697cf35da49729b27f3ccf46e2ee4"><enum>(f)</enum><header>State use of funds</header><paragraph id="idc0b1a080b91d4084a2447ef0b1fe8861"><enum>(1)</enum><header>Reservation</header><text>A lead agency that receives a grant under subsection (d) shall reserve not more than 10 percent of the grant funds for State-level activities, consisting of administering subgrants and providing technical assistance and support, for activities supported under this section.</text></paragraph><paragraph id="id6b5149b975a2452cb724c0b58ff953e4"><enum>(2)</enum><header>Subgrants</header><text>The lead agency shall use the remainder of the grant funds awarded pursuant to subsection (d) to make subgrants as described in paragraphs (3) and (4).</text></paragraph><paragraph id="ide37fa5a7c89e4bb3b7c3f83fc8d674c2"><enum>(3)</enum><header>Startup and supply expansion subgrants</header><subparagraph id="id1f4a2bdac40a435fb6929ffed650d490"><enum>(A)</enum><header>In general</header><text>The lead agency shall make startup and supply expansion subgrants to qualified child care providers that are providing, or seeking to provide, child care services under this subchapter to eligible children, to—</text><clause id="id59989617a6be498285f955168dc8720c"><enum>(i)</enum><text>support the providers in paying for startup and expansion costs;</text></clause><clause id="ide64778549435429f9851e3818fc99516"><enum>(ii)</enum><text>assist such providers in meeting—</text><subclause id="id231eb6615dc1477488d7f50901364403"><enum>(I)</enum><text>the health and safety requirements (including the requirements referred to in section 658E(c)(2)(I)) of the State, territory, Indian Tribe, or local government involved, as the case may be;</text></subclause><subclause id="id27d03d71967d4ea1b994787ddeeb066f"><enum>(II)</enum><text>licensing and other regulatory standards of the State, territory, Indian Tribe, or local government involved, as the case may be, for child care providers; and</text></subclause><subclause id="idaf78279f8bf94100a70388699c4f8099"><enum>(III)</enum><text>as applicable, the requirements of a State’s tiered quality rating system for child care providers; and</text></subclause></clause><clause id="id744da16824814c90b8d8f39db2bd35dd"><enum>(iii)</enum><text>establishing or expanding the operation of community- or neighborhood-based family child care networks.</text></clause></subparagraph><subparagraph id="idc0c38a183d83434888c02cbd759bcd8f"><enum>(B)</enum><header>Requirement</header><text>As a condition of receiving a startup or supply expansion subgrant under this paragraph, a qualified child care provider shall commit to meeting the requirements for an eligible child care provider under this subchapter and to providing child care services under this subchapter to eligible children, on an ongoing basis.</text></subparagraph></paragraph><paragraph id="id26b8a15278a847818d30b9dcf355aa7c"><enum>(4)</enum><header>Facilities subgrants</header><subparagraph id="id08f748284d8249ea8b64e7bbf4cf0644"><enum>(A)</enum><header>In general</header><text>The lead agency shall make facilities subgrants to qualified child care providers that are providing, or seeking to provide, child care services under this subchapter to eligible children, for, notwithstanding section 658F(b)—</text><clause id="idceeb71e4ee784d6cb146bafab0fa8cc9"><enum>(i)</enum><text>remodeling, renovation, or repair of a building or facility used for providing direct child care services; and</text></clause><clause id="id42d8d1dd7bbb4fd0848a41765104284d"><enum>(ii)</enum><text>construction, permanent improvement, or major renovation of a building or facility used for providing direct child care services.</text></clause></subparagraph><subparagraph id="id35751cac60064ceba663cf7b3a477956"><enum>(B)</enum><header>Requirement</header><text>As a condition of receiving a facilities subgrant under this paragraph, a child care provider shall commit to meeting the requirements for an eligible child care provider under this subchapter and to providing child care services under this subchapter to eligible children on an ongoing basis.</text></subparagraph><subparagraph id="id76770d31e9c444ccbfea07ca0bc8cb89"><enum>(C)</enum><header>Federal interest</header><clause id="idd5c61e9c7b2742bcaad7074392973288"><enum>(i)</enum><header>Family child care homes</header><text>Federal law regarding a Federal interest in real property shall not apply to the renovation, remodeling, repair, or permanent improvement of privately owned family child care homes with funds provided under this paragraph, and the Secretary shall develop parameters for the use of such funds for family child care homes.</text></clause><clause id="id6b2650c2c7b34af5b79ef87536cec557"><enum>(ii)</enum><header>Retention</header><text>If the Secretary retains a Federal interest in any facility constructed, renovated, remodeled, repaired, or permanently improved with funds provided under this paragraph, the Secretary shall not retain the Federal interest for more than 10 years.</text></clause></subparagraph></paragraph><paragraph id="id95c1136fc9b548b288ab834bf374a1d5"><enum>(5)</enum><header>Priority</header><text>In awarding subgrants under paragraphs (3) and (4), the lead agency shall give priority to qualified child care providers providing or seeking to provide child care services to priority populations of children described in section 658E(c)(2)(M).</text></paragraph></subsection><subsection id="ide444742e5e884929bdcae877ffbc7bee"><enum>(g)</enum><header>Supplement not supplant</header><text>Amounts made available to carry out this section shall be used to supplement and not supplant other Federal, State, and local public funds expended to increase the supply of child care and to improve child care facilities.</text></subsection><subsection id="idffd72494dc3f4d17a7c4049ed0e9b9f3"><enum>(h)</enum><header>Documentation and reporting requirements</header><paragraph id="id9e64d22fa2ea40cc98bae1a87183b03c"><enum>(1)</enum><header>Documentation</header><text>A State receiving a grant under subsection (d) shall provide documentation of any State expenditures from grant funds received under subsection (d) in accordance with section 658K(b), to the independent entity described in that section.</text></paragraph><paragraph id="id5d13aff06a414d0a823fb3f2328cad9f"><enum>(2)</enum><header>Reports</header><subparagraph id="id631f7c051ee14a5b886bff6f64c43314"><enum>(A)</enum><header>Lead agency report</header><text>A lead agency receiving a grant under subsection (d) shall, not later than 12 months after receiving such grant, submit a report to the Secretary that includes, for the State involved, a description of each lead agency program of subgrants carried out to meet the objectives of this section, including—</text><clause id="id45c724a2475047a19bcf9105109eb578"><enum>(i)</enum><text>the number of eligible child care providers in operation at the start of the grant period, and the number of such providers 11 months later, disaggregated by age of children served, geographic region, and child care setting (including whether the provider was in a center-based or family child care setting);</text></clause><clause id="id0d40ffadc99947a3817e774276ecec41"><enum>(ii)</enum><text>the number of child care slots, in the capacity of eligible child care providers given applicable group size limits and staff-to-child ratios, that were open for attendance of children at the start of the grant period and the number of such slots 11 months later, disaggregated by age of children served, geographic region, and child care setting (including whether the slot was in a center-based or family child care setting), and each priority population of children described in section 658E(c)(2)(M);</text></clause><clause id="id250ae8b132ea45eb9270df696b61fa9f"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="ide0b77c5fa8fe4a97980d5d251fd5055b"><enum>(I)</enum><text>the number and percentage of qualified child care providers that received a subgrant under subsection (f)(3), disaggregated by age of children served, geographic region, and child care setting (including whether the provider was in a center-based or family child care setting), and the average and range of the amounts of the subgrants awarded; and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id2bed08399a064370aa633683335fc64b"><enum>(II)</enum><text>the number and percentage of qualified child care providers that received a subgrant under subsection (f)(4), disaggregated by age of children served, geographic region, and child care setting (including whether the provider was in a center-based or family child care setting), and the average and range of the amounts of the subgrants awarded; and</text></subclause></clause><clause id="idc8f08c2b5357484d8a21bd8407e01f3a"><enum>(iv)</enum><text>information concerning how qualified child care providers receiving subgrants under subsection (f)(3) or (f)(4) used the subgrant funding received.</text></clause></subparagraph><subparagraph id="ida1fa00e3eb1d4bffa89b92777416cb4c"><enum>(B)</enum><header>Report to Congress</header><text>The Secretary shall transmit annually to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and the Workforce of the House of Representatives a report that provides national and State-level data for the information collected under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id8d5fbc4744e44e018b8e6316f44a0a88"><enum>(i)</enum><header>Construction</header><text>No reference in part 1 to <quote>this subchapter</quote> shall be considered to refer to a provision of this part.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idac021f3d1f364b1dbcc0f50c5b429adf"><enum>13.</enum><header>Department of Agriculture loan restrictions</header><text display-inline="no-display-inline">The Secretary of Agriculture shall revise section 3555.102(c) of title 7, Code of Federal Regulations, as in effect on the date of enactment of this Act, to exclude a business that is licensed, regulated, or registered as a child care provider under State law. </text></section></legis-body></bill>
