<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4959</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240801">August 1, 2024</action-date><action-desc><sponsor name-id="S410">Ms. Lummis</sponsor> (for herself, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, and <cosponsor name-id="S381">Mr. Rounds</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit Federal agencies from implementing environmental justice standards when issuing rules, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reducing Environmental Gamesmanship Act</short-title></quote> or the <quote><short-title>REG Act</short-title></quote>.</text></section><section id="id205bfa3a4d254c5fba4a49304356a0f5"><enum>2.</enum><header>Limitation on agency rule making</header><subsection commented="no" display-inline="no-display-inline" id="id4faeb7e233ce448aaf3fe8240b035369"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section, the terms <term>agency</term> and <term>rule</term> have the meanings given those terms in section 551 of title 5, United States Code.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7ea7c371be154a44ae12aea96d1c13d5"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">In issuing a rule, or otherwise administering a duly enacted law of the United States, an agency may not consider environmental justice unless the agency is required to do so by law.</text></subsection></section><section id="ida81031c4ebc441788df9856a67976cbf"><enum>3.</enum><header>Repeal of Executive Orders</header><text display-inline="no-display-inline">Effective beginning on the date of enactment of this Act, the following Executive orders shall have no force or effect:</text><paragraph commented="no" display-inline="no-display-inline" id="ide29cc3c8cd59410682cba8f933446956"><enum>(1)</enum><text>Executive Order 12898 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to Federal actions to address environmental justice in minority populations and low-income populations).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae5be74aa17d4a63b686fb57ba91954c"><enum>(2)</enum><text>Executive Order 14096 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to revitalizing our Nation's commitment to environmental justice for all). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id887994eb37bd448c9b4efe2191308741"><enum>(3)</enum><text>Executive Order 14008 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to tackling the climate crisis at home and abroad).</text></paragraph></section></legis-body></bill>
