which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Center of Excellence for Dark and Quiet Skies, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dark and Quiet Skies Act of 2024</short-title></quote>.</text></section><section id="idaa13f91b116f4d8a92735885ff129596" commented="no"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to increase participation and collaboration between Federal agencies and the private sector to research, develop, and deploy mitigation techniques on a voluntary basis to protect the integrity of federally funded scientific research observing the sky and celestial bodies. </text></section><section id="id17f6fc2075da4730ac61e2e03f7aca4e"><enum>3.</enum><header>Center of Excellence for Dark and Quiet Skies</header><subsection id="idd558eb437ded4a4aa75b7bcd6ea76b77"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id78d26fa6fabf4d4396d88c5500eabc56"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id54325a3a47014f8ba436d4fb1bfd4b58"><enum>(A)</enum><text>the Committee on Appropriations, the Committee on Energy and Natural Resources, and the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="id27041f6c322040298cf089d01900c5a2"><enum>(B)</enum><text>the Committee on Appropriations, the Committee on Natural Resources, the Committee on Energy and Commerce, and the Committee on Space, Science, and Technology of the House of Representatives. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id363b77a5c9964212ad5e9f9520b6f0e4"><enum>(2)</enum><header>Center</header><text>The term <term>Center</term> means the Center of Excellence for Dark and Quiet Skies established under subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c69583fedb64ba5abf275f4922d44a8"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddd3170e013be42fe8d369e72ca2820d3"><enum>(A)</enum><text display-inline="yes-display-inline">a nonprofit organization;</text></subparagraph><subparagraph id="id254c99cf68a846e99ddb527c853276b5"><enum>(B)</enum><text>a Federal laboratory;</text></subparagraph><subparagraph id="idba9a97eac7e24f87a936d1241377e064"><enum>(C)</enum><text>an institution of higher education;</text></subparagraph><subparagraph id="id5f63f67b8ec94cda9e38092f4aecb093"><enum>(D)</enum><text>a Native entity;</text></subparagraph><subparagraph id="id3f757431a1ea43c2949d0136d0c11348"><enum>(E)</enum><text>an observatory participating in a federally funded research project; and</text></subparagraph><subparagraph id="id1f6b4050e8da46e483bff9ecdd3dad28"><enum>(F)</enum><text>a consortium of 1 or more entities described in subparagraphs (A) through (E), private entities, or astronomers.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddeed7f63634d452bb5331f18922f29ae"><enum>(4)</enum><header>Federal laboratory</header><text>The term <term>Federal laboratory</term> has the meaning given to the term in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39b5e47f092a48c2acaa76307df8947c"><enum>(5)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means an institution of higher education, as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="id4232ad7409244dcca84a0f2104c54d44"><enum>(6)</enum><header>Native entity</header><text>The term <term>Native entity</term> means—</text><subparagraph id="id218eca70acba49319138999cf7e9aa71"><enum>(A)</enum><text>a Tribal government;</text></subparagraph><subparagraph id="id42e53d47fa074411a4a4de54a1e3b35a"><enum>(B)</enum><text>an Alaska Native Village or Regional or Village Corporation, as defined in or established pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>); and</text></subparagraph><subparagraph id="idd30abbcd4f7d4f24a12f0a1377823278"><enum>(C)</enum><text>a Native Hawaiian organization, as that term is defined in section 7517 of title 20, United States Code. </text></subparagraph></paragraph><paragraph id="id454407efef404cefaa20cf52efb72b23"><enum>(7)</enum><header>Scientific activity</header><text>The term <term>scientific activity</term> means federally funded scientific activities observing the sky or celestial bodies using—</text><subparagraph id="ida4952ff8987e41d1a8c927e13c32ff72"><enum>(A)</enum><text>radio observations; or</text></subparagraph><subparagraph id="idc9772b7fc9a24d1b9f329f05bee3e8a0"><enum>(B)</enum><text>optical observations, including photometric or spectroscopic data. </text></subparagraph></paragraph><paragraph id="id1c8fb736cb314275a92089a16ef87c2c"><enum>(8)</enum><header>Under Secretary</header><text>The term <term>Under Secretary</term> means the Under Secretary of Commerce for Standards and Technology.</text></paragraph></subsection><subsection id="id55b65f53f77943fca6e8e20afe9229a8"><enum>(b)</enum><header>Establishment of Center</header><paragraph id="id64ff393bcfd3417586434a3ecbe7fb45"><enum>(1)</enum><header>In general</header><text>Subject to availability of appropriations, not later than 1 year after the date of enactment of this Act, and after convening a gaps analysis workshop with the Office of Space Commerce of the National Oceanic and Atmospheric Administration and the National Science Foundation to assess the present status of the objectives described in paragraph (2), the Under Secretary shall award a grant, on a competitive basis, to an eligible entity to establish and operate a Center of Excellence for Dark and Quiet Skies. </text></paragraph><paragraph id="idf22654da11bd430aaa1d03017070b8f9"><enum>(2)</enum><header>Objectives</header><text>Prior to awarding a grant under paragraph (1), the Under Secretary shall establish the objectives of the Center, including how the Center, to the maximum extent practicable, will—</text><subparagraph id="id2c130751504d4e479088f5a2441b194e"><enum>(A)</enum><text>work with the satellite industry and astronomical community to develop and disseminate best practices to limit optical and radio interference with scientific activity, including developing consistent optical brightness measurements;</text></subparagraph><subparagraph id="id7d027cf2590d47199c032cb3d4fbd276"><enum>(B)</enum><text>identify existing facilities within the United States (as of the date of establishment of the objectives) to be used for testing interference mitigation or suggest adaptations to existing facilities for such purpose;</text></subparagraph><subparagraph id="id6b3c5c1272794271ab6a619fdc84eff0"><enum>(C)</enum><text>conduct transdisciplinary research, development, and demonstration projects with an emphasis on tracking, identifying, modeling, characterizing, and minimizing potential interference with scientific activity, and shall include methods to—</text><clause id="idabc282253d2143989997a21db5417aaa"><enum>(i)</enum><text>reduce optical impact of satellites in photometric and spectroscopic observations;</text></clause><clause id="ide5aaf0c1e9414c20a566c5d60936e290"><enum>(ii)</enum><text>reduce radio frequency impact of satellites on radio observations;</text></clause><clause id="id400b639759a44c94993e7ccd5fd63539"><enum>(iii)</enum><text>quantify, assess, model, or predict potential interference with scientific activity;</text></clause><clause id="id35f8d01b9d904b988fda9d975ad27023"><enum>(iv)</enum><text>promote consistency, where applicable, with domestic and international efforts to protect scientific research; and</text></clause><clause id="id68514088c709445085f67ab2b30fd491"><enum>(v)</enum><text>assess methods and techniques astronomers can take to avoid receiving interference from satellite activity, such as hardware-related technological innovations;</text></clause></subparagraph><subparagraph id="idd57fa8183ff6458fb471d011b35d5db3"><enum>(D)</enum><text>publish the results of transdisciplinary research carried out by the Center in a publicly accessible repository with appropriate protections, as determined by the Under Secretary, to protect proprietary or confidential information;</text></subparagraph><subparagraph id="id14f08be02ed2424e91c431fb508392b0"><enum>(E)</enum><text>work with the satellite industry to develop and disseminate voluntary guidelines and evidence-based best practices to mitigate optical and radio interference with scientific research; and </text></subparagraph><subparagraph id="ida7f2c13102c844189b95fa7de2a39e53"><enum>(F)</enum><text>achieve any other goal that the Under Secretary determines necessary as a result of the workshop convened pursuant to paragraph (1).</text></subparagraph></paragraph><paragraph id="id2f51b77fc169403c87c41b01f0277f0c"><enum>(3)</enum><header>Consultation</header><text>In establishing the Center under paragraph (1) and determining the objectives of the Center under paragraph (2), the Under Secretary shall consult with—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida83e9f0793474973a13c6cfa2ee4a62d"><enum>(A)</enum><text>the Department of State;</text></subparagraph><subparagraph id="idc1ae6ef5284c4a5cb0b754d38f61b946"><enum>(B)</enum><text>the Federal Aviation Administration; </text></subparagraph><subparagraph id="id4201a337919342c7a452763933d37c6c"><enum>(C)</enum><text>the Federal Communications Commission; </text></subparagraph><subparagraph id="id2ba81c025dd545c4ac3508489302ec4f"><enum>(D)</enum><text>the National Aeronautics and Space Administration;</text></subparagraph><subparagraph id="idf081e960c65040b2b98ac894e86c4a23"><enum>(E)</enum><text>the National Oceanic and Atmospheric Administration;</text></subparagraph><subparagraph id="ided00078766ed4440b00cea783734e19c"><enum>(F)</enum><text>the National Science Foundation; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1a292f82bf24d2a807e868f1c3d7dd0"><enum>(G)</enum><text display-inline="yes-display-inline">the National Telecommunications and Information Administration;</text></subparagraph><subparagraph id="id12fd62c1017b48a0912e6c26c684d181"><enum>(H)</enum><text>the Office of Space Commerce; and </text></subparagraph><subparagraph id="idf97696b0adcd4607a0a7d342d6ad3d29"><enum>(I)</enum><text>private entities involved in in-space activities, space surveillance activities, or astronomy activities, including not less than 1 of each of the following: </text><clause id="id6122f80dfc064aa8b42f9c1a918380e8"><enum>(i)</enum><text>Satellite and spacecraft operators, including a diverse range of constellation sizes, missions, and purposes.</text></clause><clause id="id36528cab73b848c49547030c754b0828"><enum>(ii)</enum><text>A space situational awareness provider. </text></clause><clause id="id668ef2b584e844cc84c3657ba1102ecb"><enum>(iii)</enum><text>A nonprofit organization.</text></clause><clause id="ide2e42445ee0e45ecbbd0c9470ae55c2e"><enum>(iv)</enum><text>Federal laboratories and National observatories, including a diverse range of scientific purposes.</text></clause><clause id="idd8e91f808b6a4901a520133c5f88c808"><enum>(v)</enum><text>An institution of higher education. </text></clause><clause id="id2bc9870440e74ea8ae46824f86f5842c"><enum>(vi)</enum><text>A Native entity.</text></clause></subparagraph></paragraph></subsection><subsection id="id2ea3a86597204bb3b3fb6b651aba9c2f"><enum>(c)</enum><header>Application; award basis</header><paragraph id="idafb21721c28d419f812cf5b130009b09"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under subsection (b)(1) shall submit an application at such time, in such manner, and containing such information as the Under Secretary may require.</text></paragraph><paragraph id="id41a606c7bd1e40ce9b6ff79d6c9eaede"><enum>(2)</enum><header>Considerations</header><text>In reviewing applications under this subsection and awarding a grant under subsection (b)(1), the Under Secretary shall consider the degree to which—</text><subparagraph id="id3091a0eb13e442a69aaaab0e78555074"><enum>(A)</enum><text>the eligible entity submitting the application has a plan to financially sustain the activities of the Center after the conclusion of the grant period, including with matching funds for any Federal funding dedicated to the Center; and </text></subparagraph><subparagraph id="id7a29d671ea1145a185988f45ddce5dcb"><enum>(B)</enum><text>the degree to which the eligible entity proposes to engage small businesses in the activities of the Center.</text></subparagraph></paragraph></subsection><subsection id="id5beb6ae55094429faa43521167a5988a"><enum>(d)</enum><header>Coordination</header><text>The Under Secretary shall ensure the coordination, and avoid unnecessary duplication, of activities of the Center with the research, development, or demonstration activities of—</text><paragraph id="idf4a51132659e474aad4f50b75d211bb9"><enum>(1)</enum><text>the Department of Energy or Federal laboratories;</text></paragraph><paragraph id="id8e69d0343b624e61a1f089cc7096817f"><enum>(2)</enum><text>the National Aeronautics and Space Administration; </text></paragraph><paragraph id="idf9ffdb050fcf4105bf48e309e446248d"><enum>(3)</enum><text>the National Oceanic and Atmospheric Administration;</text></paragraph><paragraph id="id4cc53db7caa8480d96057c7036a63cde"><enum>(4)</enum><text>the National Science Foundation; and</text></paragraph><paragraph id="id6972a5ed1bbd482988344663b9b0b1f4"><enum>(5)</enum><text>The National Telecommunications and Information Administration.</text></paragraph></subsection><subsection id="idde1690a357d94c46b706a062f6ce5b9b"><enum>(e)</enum><header>Duration</header><paragraph id="id3b659f2c87db4c3ab9465b7d94dd9024"><enum>(1)</enum><header>In general</header><text>Subject to appropriations and paragraph (2), the Center is authorized to carry out activities for a period of 5 years.</text></paragraph><paragraph id="id1f4fb10d1a1e49bf8cdeeeba0da49c5e"><enum>(2)</enum><header>Termination</header><text>The Under Secretary may terminate the Center in the event the Under Secretary determines the Center is underperforming during the performance period described in paragraph (1).</text></paragraph></subsection><subsection id="id86b37d765e0e48f7b88bbadd6220e055"><enum>(f)</enum><header>Reports to Congress</header><text>Not later than 18 months after the date of enactment of this Act, and annually thereafter through fiscal year 2029, the Under Secretary shall prepare and submit a report to the appropriate committees of Congress—</text><paragraph id="id971e3508741f430780422a18858c59bc"><enum>(1)</enum><text>providing an evaluation of the Center’s effectiveness in achieving its objectives under subsection (b)(2); and</text></paragraph><paragraph id="id496cb470bdde415e873a8b93c296622e"><enum>(2)</enum><text>describing benchmarks the Center will seek to accomplish in the forthcoming year.</text></paragraph></subsection><subsection id="id5612e417903e48ce8bdeb6f6eacf1a00"><enum>(g)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="idff67df5c9d944a1a97e5ec7c4edb8d73"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $20,000,000 for the period of fiscal years 2025 through 2029.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc46d0d887eaa4c28bd01025dbb02ad8b"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to require the Under Secretary to carry out this section using amounts appropriated or otherwise made available to the Department of Commerce for other purposes.</text></paragraph></subsection></section></legis-body></bill>
