<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4939</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240801">August 1, 2024</action-date><action-desc><sponsor name-id="S341">Mr. Blumenthal</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that weighted sleep products for infants shall be considered banned hazardous products under section 8 of the Consumer Product Safety Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7140ED85991049078AE3FEE78DB5BFEC"><section section-type="section-one" id="HAA94E7D8F32A4D579500D197F7CEADE9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Infants from Dangerous Sleep Act</short-title></quote>.</text></section><section id="ida3145829bbd946288c5c1849f9f02b01"><enum>2.</enum><header>Banning of weighted sleep products for infants</header><subsection id="H39EEA8748AFA4B1AB9AE67E196A529A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A weighted sleep product for infants, regardless of the date of manufacture, shall be considered a banned hazardous product under section 8 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2057">15 U.S.C. 2057</external-xref>).</text></subsection><subsection id="H212740762A3348A3B55A580FA1445A47"><enum>(b)</enum><header>Weighted sleep product for infants defined</header><text>In this section, the term <term>weighted sleep product for infants</term> means a wearable blanket, sleep sack, swaddle, or similar product that is sold, offered for sale, manufactured for sale, distributed in commerce, or imported into the United States—</text><paragraph id="HD44DB5C752C7405DB802DBFFC08E4E67"><enum>(1)</enum><text>to be placed on or worn by an infant up to 1 year old; and</text></paragraph><paragraph id="HA4B764A882A946F69C55228CC3CFAABB"><enum>(2)</enum><text>that includes materials that add weight to the product for a purpose other than for insulation or decoration.</text></paragraph></subsection><subsection id="HC1CB0A1CC37D476E9ECBFCE30863F8E2"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Consumer Product Safety Commission may promulgate, under section 553 of title 5, United States Code, regulations to define, or modify the definitions of, terms used in this Act.</text></subsection><subsection id="H54CDD3DEACAF40F696FDBD6E2F299667"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This Act shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
