which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Credit Reporting Act to address the placement of security freezes for protected consumers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Credit Freeze for Newborns Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id9610a727bc82497d9f527525e0c08ab7"><enum>2.</enum><header>Security freezes for protected consumers</header><subsection id="id538dfb73c5bc458a80a2be75a1c8e7d7"><enum>(a)</enum><header>In general</header><text>Section 605A(j)(2)(A) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1(j)(2)(A)</external-xref>) is amended to read as follows:</text><quoted-block id="id095A23655E834D52AB71CB84512195F2" style="OLC" act-name=""><subparagraph id="id69D2EBB2327C4CF1963C9E7977294C01"><enum>(A)</enum><header>In general</header><text>Upon receiving a direct request from a protected consumer’s representative that a consumer reporting agency place a security freeze, and upon receiving sufficient proof of identification and sufficient proof of authority, the following shall apply:</text><clause commented="no" display-inline="no-display-inline" id="id6d6725e1d1cd4db6940557d72cfcde31"><enum>(i)</enum><text display-inline="yes-display-inline">The consumer reporting agency shall, free of charge—</text><subclause commented="no" display-inline="no-display-inline" id="idb3098b8cf61243f1967a120bcb1e8603"><enum>(I)</enum><text display-inline="yes-display-inline">place the security freeze not later than—</text><item commented="no" display-inline="no-display-inline" id="idd0d6a41a9a7e40b8a166282356df7d93"><enum>(aa)</enum><text display-inline="yes-display-inline">in the case of a request that is by toll-free telephone or secure electronic means, 1 business day after receiving the request directly from the protected consumer’s representative; or</text></item><item commented="no" display-inline="no-display-inline" id="idc64d9a19d94b4e13bb3750823239693c"><enum>(bb)</enum><text display-inline="yes-display-inline">in the case of a request that is by mail, 3 business days after receiving the request directly from the protected consumer’s representative; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ida7475cadaa2b4ab9bf5119d7a842077d"><enum>(II)</enum><text display-inline="yes-display-inline">not later than 3 business days after receiving the request directly from the protected consumer’s representative, notify each other consumer reporting agency regarding the request.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id96edef343b1a4aff9cd1b3e42acdb3ae"><enum>(ii)</enum><text display-inline="yes-display-inline">Upon being notified under subclause (II) of clause (i) regarding the request, the consumer reporting agency receiving the notification shall place the requested freeze in accordance with the requirements under items (aa) and (bb) of subclause (I) of that clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCEFD271954924ED9B1DBB35595303785"><enum>(b)</enum><header>Requiring the Social Security Administration To include information on placing a security freeze for a protected consumer under 16 years of age with issuance of social security number or replacement social security card</header><paragraph id="idDE9139DAC7BF4F6C89BE5E26E5A6CA76"><enum>(1)</enum><header>In general</header><text>Section 205(c)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(c)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block id="idA7719D9167AF43148A6D854D443ABD79" style="other" other-style="archaic" act-name=""><subparagraph indent="up2" id="id2CF6CBB42CAA4648B0662D474941A243"><enum>(I)</enum><clause commented="no" display-inline="yes-display-inline" id="id0c8f35c3fec54f0ab470e30d167984f3"><enum>(i) </enum><text>In this subparagraph, the terms <term>protected consumer</term>, <term>protected consumer’s representative</term>, and <term>security freeze</term> have the meanings given those terms in section 605A(j) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1(j)</external-xref>).</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="id158b4ade32bd434e8c328a68cf38b9ed"><enum>(ii)</enum><text display-inline="yes-display-inline">Whenever the Commissioner of Social Security issues a social security account number or a replacement social security card to a protected consumer who is under 16 years of age, the Commissioner shall include, with the social security card and any other information provided to the individual at the time such social security account number or replacement card is issued, information on how the protected consumer’s representative may submit a request for a security freeze on behalf of the protected consumer under section 605A(j) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1(j)</external-xref>). </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id23B702AA87D740D2B5936EA54BC72A55" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this subsection shall take effect on the date that is 12 months after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
