which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the Freedom of Information Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>First Opportunity for Information to Americans Act of 2023</short-title></quote> or the <quote><short-title>FOIA Fix Act of 2023</short-title></quote>.</text></section><section id="id1C872BF53A214199AB2687CDD521824A"><enum>2.</enum><header>FOIA requests</header><text display-inline="no-display-inline">Section 552 of title 5, United States Code, is amended—</text><paragraph id="id79720690188B4AE3A3E47D198B482D11"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id2D260F96070A4D88B29304DD697B96B2"><enum>(A)</enum><text>in paragraph (3)(A), by inserting <quote>or paragraph (9)</quote> after <quote>subparagraph (E)</quote>; and</text></subparagraph><subparagraph id="idCC350310FB5B4848AE9A72AF879C30FC"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF98B59DCEB95412E82F4AA189CF7424B"><paragraph id="idBF2EF50D0F014E37B4BA12C6715E2CBC" indent="up1"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9DE5110954914B7FA327DA9547AE9D9C"><enum>(A)</enum><text>Except as provided in subparagraph (D), an agency may not make any record available under this subsection to any requester that—</text><clause indent="up1" id="id5C247524013B45AA82CA0977947BF33A"><enum>(i)</enum><text>is an individual who is not a citizen of the United States or an alien lawfully admitted for permanent residence;</text></clause><clause indent="up1" id="id179661CC64A44ABBBAAAB4002F9A3BE5"><enum>(ii)</enum><text>is an entity that does not have a principal place of business or headquarters located in a State, the District of Columbia, or any territory or possession of the United States; or</text></clause><clause indent="up1" id="id089F35F146784193BD81CA267452A0C0"><enum>(iii)</enum><text>is an entity that is a subsidiary of an entity with a principal place of business or headquarters located in—</text><subclause id="id1B541EABF26045D98AC49B2C2C88689B"><enum>(I)</enum><text>the People’s Republic of China;</text></subclause><subclause id="id05B6FF72B04743B9A129165D6FFFB9A1"><enum>(II)</enum><text>the Russian Federation;</text></subclause><subclause id="id2DA5960BB1CD4690AA6635FB43628B9D"><enum>(III)</enum><text>the Democratic People’s Republic of Korea;</text></subclause><subclause id="id4AEB6711A0C1476E9382A451B4140C36"><enum>(IV)</enum><text>the Islamic Republic of Iran;</text></subclause><subclause id="idC2254C27F217476EA4A0897F14137085"><enum>(V)</enum><text>the Republic of Cuba;</text></subclause><subclause id="idfaf87a2cc3064abc847e1765c4c7e68b"><enum>(VI)</enum><text>the Syrian Arab Republic; or</text></subclause><subclause id="id7bc483c9197e463a90bf6e162309c3c8"><enum>(VII)</enum><text>the regime of Nicolás Maduro in Venezuela.</text></subclause></clause></subparagraph><subparagraph indent="up1" id="idD6BB894F1E1445F29F14AEAAB6BC028F"><enum>(B)</enum><text>Knowingly assisting, conspiring, or abetting a request for information under this section on behalf of an individual or entity that is prohibited from receiving the information under subparagraph (A) is punishable by a fine of up $10,000 per violation and not more than 1 year in prison.</text></subparagraph><subparagraph indent="up1" id="id103E0DC6D66C46F7806B81D447942D44"><enum>(C)</enum><text>Each agency shall promulgate regulations as necessary to carry out subparagraph (A).</text></subparagraph><subparagraph indent="up1" id="id67B70E1DC83341FE9FACF99DBB1A5841"><enum>(D)</enum><text>Subparagraph (A) shall not apply to a requester that is seeking official copies of the immigration court proceedings of the requester.</text></subparagraph></paragraph><paragraph indent="up1" id="id565CE1BE02F54D7AAEA8BD33872E5BC4"><enum>(10)</enum><text>Notwithstanding any other provision of this section, an agency may determine the manner in which a request is fulfilled under this subsection if the agency has a reasonable belief that fulfilling the request in the manner requested by the requester—</text><subparagraph id="idEEF6E057A4754F59912F879AFF04F27E"><enum>(A)</enum><text>is likely to result in the exposure of material or information that is not responsive to the request, including any data describing the structure, data elements, interrelationships, or other characteristics of electronic records otherwise responsive to the request; or </text></subparagraph><subparagraph id="idFC3F4B573E7B4A14B89649912CF4B91D"><enum>(B)</enum><text>poses a material security risk to the agency or another entity in the Federal Government.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA3EED6E181714DB0A20C5490B3B65096"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id22772B8592C3433F9BE3DD39AA9C6791"><enum>(A)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end; and</text></subparagraph><subparagraph id="id821EC8D4E6A84EFFA58B29AE1F625CE5"><enum>(B)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idECBEEE3560614F819DF1AC92C8C1277C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90D08616068B4AE2A24CCCF444E185C3"><paragraph id="idC30922ED5D93452E9A40A47C8AD084A5"><enum>(10)</enum><text>records or information, such as blueprints, schematics, formulae, technical expertise, or other similar information that is susceptible to reverse engineering— </text><subparagraph id="idDB76749E6C8F4743A62A5F2F3B7F9C37"><enum>(A)</enum><text>the disclosure of which is likely to damage the interests of the United States;</text></subparagraph><subparagraph id="id273BCC912F454FB4A1351A5C013877D2"><enum>(B)</enum><text>that is materially related to the study of an emerging or foundational technology identified by the Department of Commerce; and</text></subparagraph><subparagraph id="id4E48271BE13242539AEF791B5D34216E"><enum>(C)</enum><text>for which the interest of the public in disclosure does not outweigh the interests described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
