which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require a report on the threats posed by control of strategic ports by the People's Republic of China.</official-title></form><legis-body><section id="id41dd963177be47ff98cdb766e0aede14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strategic Ports Reporting Act </short-title></quote>.</text></section><section id="id227e8d03e7fb4e219f823f5fac434c65"><enum>2.</enum><header>Report on threats posed by control of strategic ports by the People's Republic of China</header><subsection id="id8502df036e864515aebcf2a585a2d199"><enum>(a)</enum><header>Study required</header><text>The Secretary of Defense shall conduct a study of—</text><paragraph commented="no" display-inline="no-display-inline" id="id5cec944bb9d142f8918222a06c6f46be"><enum>(1)</enum><text display-inline="yes-display-inline">strategic ports; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1055ff973fd24caba75ca485ed7190bf"><enum>(2)</enum><text display-inline="yes-display-inline">the reasons such ports are of interest to the United States; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9865a5157efb46958ddd99e5f5cb3f45"><enum>(3)</enum><text display-inline="yes-display-inline">the activities and plans of the Government of the People's Republic of China to expand its control over strategic ports outside the People's Republic of China; </text></paragraph><paragraph id="ide2ba07cc889a42b3966a4bb5253fc872"><enum>(4)</enum><text>the public and private actors, such as China Ocean Shipping Company, that are executing and supporting the activities and plans of the Government of the People’s Republic of China to expand its control over strategic ports outside the People’s Republic of China;</text></paragraph><paragraph id="idf0b04679b64b4eb7bac5b80ff38ac553"><enum>(5)</enum><text>the activities and plans of the Government of the People’s Republic of China to expand its control over maritime logistics by promoting products, such as LOGINK, and setting industry standards outside the People’s Republic of China; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id732ce9970eb44c23ba8d42414342bc1e"><enum>(6)</enum><text display-inline="yes-display-inline">how the control by the Government of the People's Republic of China over strategic ports outside the People's Republic of China could harm the national security or economic interests of the United States and allies and partners of the United States; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ce4dae2f36b45368799a6b2d4a4d1a3"><enum>(7)</enum><text display-inline="yes-display-inline">measures the United States Government could take to ensure open access and security for strategic ports.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id975299c84e454f4896810ef43f3ccc03"><enum>(b)</enum><header>Conduct of study</header><text>The Secretary of Defense may enter into an arrangement with a federally funded research and development center under which the center shall conduct the study described in subsection (a). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbb3a8069c6cc43268a5dc6c854cd3292"><enum>(c)</enum><header display-inline="yes-display-inline">Report required</header><paragraph commented="no" display-inline="no-display-inline" id="id89691086d36f45bba12b9e1a1c425777"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall submit to the appropriate congressional committees a report on the findings of the study conducted under subsection (a).</text></paragraph><paragraph id="id5022fe3122b04f2985579a841ce74e48"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall include—</text><subparagraph id="id58bb424298194e5ea6d1ff8f17e687f5"><enum>(A)</enum><text>a detailed list of all known strategic ports operated, controlled, or owned, directly or indirectly, by the People's Republic of China and an assessment of the national security and economic interests relevant to each such port;</text></subparagraph><subparagraph id="id31fefd0d81bf41aa8af1b76099cecc44"><enum>(B)</enum><text>a detailed list of all known strategic ports operated, controlled, or owned, directly or indirectly, by the United States and an assessment of the national security and economic interests relevant to each such port;</text></subparagraph><subparagraph id="id7457399480e04254b614cd7746b258ad"><enum>(C)</enum><text>an assessment of vulnerabilities of—</text><clause commented="no" display-inline="no-display-inline" id="idc306bc6cec3649999f1f50248615a1f7"><enum>(i)</enum><text display-inline="yes-display-inline">ports operated, controlled, or owned, directly or indirectly, by the United States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id69b15336a1464bdfa982f96d3b32406a"><enum>(ii)</enum><text>strategic ports;</text></clause></subparagraph><subparagraph id="idb6020607e22a4708b0fe4b53d403db26"><enum>(D)</enum><text>an analysis of the activities and actions of the Government of the People's Republic of China to gain control or ownership over strategic ports, including promoting products, such as LOGINK, and setting industry standards;</text></subparagraph><subparagraph id="ide01f50b43a6f4cd8b42e9fdc608e3a6b"><enum>(E)</enum><text>an assessment of how the Government of the People's Republic of China plans to expand its control over strategic ports outside of the People's Republic of China;</text></subparagraph><subparagraph id="id0687b1e1052d44cb8a32b15688d1f889"><enum>(F)</enum><text>a suggested strategy, developed in consultation with the heads of the relevant United States Government offices, that suggests courses of action to secure trusted investment and ownership of strategic ports and maritime infrastructure, to protect such ports and infrastructure from the control of the Government of the People's Republic of China, and to ensure open access and security for such ports, that includes—</text><clause id="id820953f9af33497abd1c0b9a10e0a624"><enum>(i)</enum><text>a list of relevant existing authorities that can be used to carry out the strategy;</text></clause><clause id="id5755533f7cc14ab3818bea9d9804bfbc"><enum>(ii)</enum><text>a list of any additional authorities necessary to carry out the strategy; </text></clause><clause id="id790f923043e74d189abc5f7c2d075eae"><enum>(iii)</enum><text>an assessment of products owned by the Government of the People’s Republic of China or an entity affiliated with such government that are used in connection with strategic ports or maritime infrastructure;</text></clause><clause id="id1f991a3b910143f6be8d20e74af047f1"><enum>(iv)</enum><text>an assessment of costs to secure trusted investment and ownership of strategic ports and replace products owned by the Government of the People’s Republic of China or an entity affiliated with such government that are used in connection with such ports; and</text></clause><clause id="id7fae3269351948eba48a15d2a13ab28b"><enum>(v)</enum><text>a list of funding sources to secure trusted investment and ownership of strategic ports, which shall include—</text><subclause id="id2182266d3bd44b96a7df597376e5bba8"><enum>(I)</enum><text>an identification of private funding sources; and</text></subclause><subclause id="id6f7ea92accfe47c283f68f55f261c464"><enum>(II)</enum><text>an identification of public funding sources, including loans, loan guarantees, and tax incentives; and</text></subclause></clause></subparagraph><subparagraph id="id643e7ed93671429aaceddcd38944c1fc"><enum>(G)</enum><text>a suggested strategy for Federal agencies to maintain an up-to-date list of strategic ports. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d7f794b5e3b40f8a276cb97a19b196c"><enum>(3)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex if necessary.</text></paragraph></subsection><subsection id="id7aad8565214f4365b4e4c14ec1733980"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id04cd0b65c3054bacab206902e24ecda0"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="idf97d437923af483fbc275347a9daa84c"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation, the Committee on Armed Services, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="ida6ff679f30a444109350a1c8ed748c34"><enum>(B)</enum><text>the Committee on Transportation and Infrastructure, the Committee on Energy and Commerce, the Committee on Armed Services, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id6158399730a24e54a7747e8d8178ca37"><enum>(2)</enum><header>Relevant United States Government offices</header><text>The term <term>relevant United States Government offices</term> means—</text><subparagraph id="idafc263f127804c6ba97da67948713ae3"><enum>(A)</enum><text>the Unified Combatant Commands;</text></subparagraph><subparagraph id="id0fef142bba654a2db32f2e0600a427f5"><enum>(B)</enum><text>the Office of the Secretary of Defense;</text></subparagraph><subparagraph id="id4a07772aac5146919bbba959b6a534c9"><enum>(C)</enum><text>the United States International Development Finance Corporation;</text></subparagraph><subparagraph id="idde8685c35d4a42d19ecaeb149310886b"><enum>(D)</enum><text>the Export-Import Bank of the United States;</text></subparagraph><subparagraph id="id2bb6a5cac97e4c86b7c5b412f2edc58e"><enum>(E)</enum><text>the Office of the Director of National Intelligence; and</text></subparagraph><subparagraph id="id8034de2d4fa146db805ff4335b106fef"><enum>(F)</enum><text>the Maritime Administration of the Department of Transportation.</text></subparagraph></paragraph><paragraph id="id2c5eb1c759664355bd1f87ab721d3f94"><enum>(3)</enum><header>Strategic port</header><text>The term <term>strategic port</term> means an international port or waterway that the heads of the relevant United States Government offices determine is critical to the national security or economic prosperity of the United States. </text></paragraph></subsection></section></legis-body></bill>
