<congress display="yes">118th CONGRESS</congress><session display="yes">1st Session</session><legis-num display="yes">S. 484</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Secretary of Commerce to provide training and guidance relating to human rights abuses, including such abuses perpetrated against the Uyghur population by the Government of the People's Republic of China, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Human Rights Abuses Act of 2023</short-title></quote>.</text></section><section id="id2cb1dd2450b14723ab601c4f9372c1d5" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Training for employees of the Department of Commerce relating to awareness of human rights abuses</header><subsection id="idcfc2237c392347b199d2b5c72e46e0e2" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Commerce shall provide training described in subsection (b) to such employees of the Department of Commerce who provide counseling services to businesses engaged in interstate commerce or foreign direct investment as the Secretary considers appropriate.</text></subsection><subsection id="idec094a02d51c43c3afbc4b2823351f24" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of training</header><text display-inline="yes-display-inline">The training required under subsection (a) shall be—</text><paragraph id="idf48350f1bac844e5bfce6be225aa0424" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">designed to raise awareness about emerging trends and issues with respect to human rights abuses perpetrated by the Government of the People’s Republic of China, including the use of forced labor, against Uyghurs and other ethnic minority populations in the Xinjiang Uyghur Autonomous Region; and</text></paragraph><paragraph id="id6cae104068504257afbe609ea2189d07" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">incorporated to the greatest extent possible into existing training provided by the Department of Commerce.</text></paragraph></subsection><subsection id="id52342acb96244543a606ce19982b9962" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">The training required under subsection (a) shall be offered and updated at such times as the Secretary considers appropriate.</text></subsection></section><section id="ida985806085c74a65abd22c0bbbfd0789" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Guidance for United States businesses relating to awareness of human rights abuses</header><subsection id="id6e8005874f294330bde24c5ee5de3606" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Commerce shall—</text><paragraph id="id895544A69D2341E28DAE50F17F507150" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">offer guidance for United States businesses engaged in interstate commerce or foreign direct investment, including such businesses that are, or are considering, conducting transactions with entities subject to the control or influence of jurisdictions where significant human rights abuses have occurred, such as the People’s Republic of China; and</text></paragraph><paragraph id="id2b97a67aba2544429d54131ae5da4489" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">incorporate the guidance required under paragraph (1) into any counseling services that the Department of Commerce provides to such businesses as the Secretary considers appropriate. </text></paragraph></subsection><subsection id="idcff776cb74994d4eb2700fadef40c132" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of guidance</header><text display-inline="yes-display-inline">The guidance required under subsection (a) shall—</text><paragraph id="idaf1796fbb71c44029c8d7aff2150151b" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">provide information about emerging trends and issues involving human rights abuses perpetrated by the Government of the People’s Republic of China, consisting of the use of forced labor against Uyghurs and other ethnic minority populations in the Xinjiang Uyghur Autonomous Region, including information about—</text><subparagraph id="idc30fb6c4495843009db551b52bb2b109" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">risk factors that may be used to identify entities subject to the influence or control of jurisdictions such as the People’s Republic of China that may be implicated in human rights abuses;</text></subparagraph><subparagraph id="idc343c4d83f264842926b954fab01a4b3" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">ways to avoid doing business with entities described in subparagraph (A); and</text></subparagraph><subparagraph id="id2a5250187b954cc8860013c274b54844" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">potential reputational, economic, legal, and other risks of conducting transactions with an entity described in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="id1b11b4e0dbdc4a578f5981a54917d94b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">make clear that the guidance is for advisory purposes only.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20231219" chamber="Senate">Passed the Senate December 19, 2023.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
