which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Summer for All program through summer enrichment expansion grants and summer programming State grants, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Summer for All Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ideda0fe66aec04e419396c67f718f5b6b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idfb9978fc6b2a4e48ad6c8d094146b711"><enum>(1)</enum><header>ESEA definitions</header><text>The terms <term>local educational agency</term> and <term>State educational agency</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaaa6771c4c3d4a25b2cd9adf3368e8f7"><enum>(2)</enum><header>Community-based organization</header><text display-inline="yes-display-inline">The term <term>community-based organization</term> means an organization (including a community action agency)—</text><subparagraph id="ID213EE913E38548DDB9E35F4B097A95F3"><enum>(A)</enum><text>for which no part of the net earnings of the organization inures to the benefit of any member, founder, contributor, or individual;</text></subparagraph><subparagraph id="ID06623C5C711543ADAB4BC24F93A365F7"><enum>(B)</enum><text>that has a voluntary board;</text></subparagraph><subparagraph id="IDB6AFAC0ACEBB4F5789A81257AB7F5897"><enum>(C)</enum><text>that has an accounting system, or has designated a fiscal agent in accordance with requirements established by the Secretary; and</text></subparagraph><subparagraph id="IDE0F288BBEFC04197B649334093D44869" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>that practices nondiscrimination in the provision of assistance.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5766f14385774bad95e4e2dd0d50f1b2"><enum>(3)</enum><header>English language learner</header><text>The term <term>English language learner</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), except such term shall include an individual who is age 22 and otherwise meet the requirements of such term.</text></paragraph><paragraph id="id6c2e17faeacc45d8bc3ef54c6e78a48f"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5633bdf8e5754d7db2df707399fbaf94"><enum>(5)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> means an institution of higher education, as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>), or a postsecondary vocational institution, as defined in section 102(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf51124d4145f4fd89594dfeea8fea8c1"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c19cc00631f457e9797a35b648eef10"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States of the United States, the District of Columbia, Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the United States Virgin Islands.</text></paragraph><paragraph id="id8714347b62be46eba0459bce048c9e56"><enum>(8)</enum><header>Summer for All program</header><text>The term <term>Summer for All program</term> means a program supported by a grant under section 3(b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80465bed06fe4ebfbdbda98c467db51f"><enum>(9)</enum><header>Youth</header><text>The term <term>youth</term> means an individual who is not younger than age 5 and not older than age 22.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9a0a1cc6db1e41439621a117824c73d3"><enum>(10)</enum><header>Youth with a disability</header><text>The term <term>youth with a disability</term> has the meaning given the term <term>child with a disability</term> in section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>), except such term includes an individual who is age 22 and otherwise meets the requirements of such term.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a4e5dd05134454c8f00cb9e5ec5407b"><enum>(11)</enum><header>Youth experiencing homelessness</header><text>The term <term>youth experiencing homelessness</term> has the meaning given the term <quote>homeless children and youths</quote> in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>).</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id95e32fda48d64b17be449a968ed652b9"><enum>3.</enum><header> Summer enrichment expansion grants</header><subsection commented="no" display-inline="no-display-inline" id="id7c505afcb350428b91ec128e8e1eee37"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="id4d0f7200a6574ce78e9db18b3c1c693a" commented="no"><enum>(1)</enum><text>a community-based organization;</text></paragraph><paragraph id="id9287852ef014485aa01e8695cf7cc73f"><enum>(2)</enum><text>an intermediary, or collaborative network, that supports local community-based organizations and has experience with, or relevant expertise in, supporting youth-serving programs or youth needs during out-of-school time; or</text></paragraph><paragraph id="id850a8523c2d14463bfab0722e20e0770" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>an institution of higher education. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida79e29e1663d481d871b570f8014b6cf"><enum>(b)</enum><header display-inline="yes-display-inline">Program authorized</header><paragraph commented="no" display-inline="no-display-inline" id="ide03990848fb946adb0f92abdd3bf0f9b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available to carry out this section, the Secretary shall make summer enrichment expansion grants, on a competitive basis, to eligible entities to enable the eligible entities to carry out Summer for All programs for the purposes of—</text><subparagraph id="id5e1bff0929af43a9bd33616f3d2aba5c"><enum>(A)</enum><text>providing high-quality, affordable summer programming for youth, especially for low-income youth and rural youth, including youth of color;</text></subparagraph><subparagraph id="id39810c3d396445b0b0bcc05dd278fc04"><enum>(B)</enum><text>ensuring that all youth have access to a safe, nurturing, and enriching environment during summer out-of-school time; and</text></subparagraph><subparagraph id="id99790dfa79af4067b63857a8955faade"><enum>(C)</enum><text>improving the quality of summer programming across the United States and reducing learning loss during summer out-of-school time.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id021a02c1b58047d1985e759f788b6c67"><enum>(2)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period of not more than 4 fiscal years.</text></paragraph></subsection><subsection id="id60c9c1ad9b79400d982fe02b914baabd"><enum>(c)</enum><header>Application</header><text>An eligible entity desiring a grant under this section shall submit an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="id2fc77206436d43988fb7d0e4ad9519dc" commented="no"><enum>(d)</enum><header>Priorities</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities—</text><paragraph commented="no" display-inline="no-display-inline" id="id2a0b9269a591466696423e631abcad3c"><enum>(1)</enum><text display-inline="yes-display-inline">with a history of effectively serving low-income youth and their families;</text></paragraph><paragraph id="id99078b2f083247c88285580c3df1db8f"><enum>(2)</enum><text>proposing a Summer for All program that will primarily serve— </text><subparagraph id="id4fa957d309954d9e886a0f16612ec54e"><enum>(A)</enum><text>low-income youth;</text></subparagraph><subparagraph id="id30ea482a6e7e420c8a11de6567bb0b57"><enum>(B)</enum><text>English language learners;</text></subparagraph><subparagraph id="idc01740ab80524c15bb8e91035ea5c565"><enum>(C)</enum><text>youth with disabilities;</text></subparagraph><subparagraph id="id67f6d1aa3f6d41b98cfb707062e454f5"><enum>(D)</enum><text>youth experiencing homelessness;</text></subparagraph><subparagraph id="idd66a9a92bc714d8aa26500dba3717b59"><enum>(E)</enum><text>youth experiencing food insecurity;</text></subparagraph><subparagraph id="id361d86baaaec46caaf94c5a73fb6448e"><enum>(F)</enum><text>youth involved in the justice system;</text></subparagraph><subparagraph id="id716388e19db54bf2879b5fa00307edfc"><enum>(G)</enum><text>youth in the foster care system;</text></subparagraph><subparagraph id="id39437c81429d4da48de5b4d6993d8292"><enum>(H)</enum><text>youth who have not reached proficiency for their grade level on English language arts, mathematics, science, or social studies content area assessments;</text></subparagraph><subparagraph id="id29d7ea70b69e46e3981a6e3a77ed56e2"><enum>(I)</enum><text>rural youth; or</text></subparagraph><subparagraph id="id614360930548488e98840a1cc5d7ad6f"><enum>(J)</enum><text>native or indigenous youth;</text></subparagraph></paragraph><paragraph id="iddae0e0067fe74b48925ae97780a95468"><enum>(3)</enum><text>that will partner or contract with local youth-serving government entities, such as local educational agencies, parks and recreation departments, or public libraries, to offer the Summer for All program; </text></paragraph><paragraph id="id67e0bea871c448a5bb0d4c4b04c2a514"><enum>(4)</enum><text>that will provide participants in the Summer for All program with safe, timely transportation services to and from summer programming, especially in rural or underserved areas; or </text></paragraph><paragraph id="id149fc335173d44faa5a2b0f5cd6773ce" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>will use grant funds to carry out a Summer for All program that provides 2 or more eligible activities described in subsection (e)(1)(C). </text></paragraph></subsection><subsection id="id2c20d787c30d429d8ffc6aae98025064"><enum>(e)</enum><header>Use of funds</header><paragraph commented="no" display-inline="no-display-inline" id="ideefc2cb71c464a9ca29a04af0be91a3d"><enum>(1)</enum><header>Required uses</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use grant funds to carry out a Summer for All program that—</text><subparagraph id="id306a65b34cc04de6a866de18ee341de4"><enum>(A)</enum><text>serves youth by providing programming—</text><clause id="idef64bb849b4f4b5baea2d349a0a47da0"><enum>(i)</enum><text>during the summer months when schools are closed;</text></clause><clause id="ide36c817bd3674bdc8b67ce9241b25bba"><enum>(ii)</enum><text>for not less than 5 days a week for a minimum of 5 weeks during the summer months;</text></clause><clause id="id0116c09a0c5a4f10845487d3db70ffbe"><enum>(iii)</enum><text>that requires participating youth to be physically present at a building or location designated by the eligible entity; and</text></clause><clause id="idd427cd72dccd47588ecc6b90798b3205"><enum>(iv)</enum><text>for participating youth whose household income would qualify the youth for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>), that is offered at no cost;</text></clause></subparagraph><subparagraph id="id342e3f29b125428895df1a0f88d80731"><enum>(B)</enum><text>provides food at no cost to participating youth whose household income would qualify for free or reduced price lunch under such Act; and</text></subparagraph><subparagraph id="id39570a495af948ea8d830bd267d116ff"><enum>(C)</enum><text>includes activities or programming that—</text><clause id="id99149a8381ae433da405e05dad450e0b"><enum>(i)</enum><text>fosters safe, healthy, supportive, and drug-free environments; </text></clause><clause id="idac16a962833d4076ad10c6e46c623b0c"><enum>(ii)</enum><text>supports youth academic enrichment;</text></clause><clause id="idd98a157753de4041a53badb41e6bfd93"><enum>(iii)</enum><text>provides social and emotional learning;</text></clause><clause id="idb5c06d6c11f9402fba134385a2bf38c5"><enum>(iv)</enum><text>promotes health and safety practices;</text></clause><clause id="id5a5a714009134266bd750a420d811529"><enum>(v)</enum><text>supports a healthy, active lifestyle, including nutritional education and regular, structured physical education activities and programs, that help maintain the mental and physical well-being of youth;</text></clause><clause id="id23514da8a99c4d52a1252267fd5f2bbf"><enum>(vi)</enum><text>promotes volunteerism, community involvement, or service-learning, in which students use academic and civic knowledge and skills to address genuine community needs;</text></clause><clause id="id8a42774da7ee4c858804cf64b5121bdc"><enum>(vii)</enum><text>helps prevent bullying and harassment;</text></clause><clause id="idfcaa17597ee8412ea5388018bb6e40ab"><enum>(viii)</enum><text>develops relationship-building skills, such as—</text><subclause commented="no" display-inline="no-display-inline" id="id94d329f4b16940f4932b154e4049ce85"><enum>(I)</enum><text display-inline="yes-display-inline">effective communication; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3df3b545375d4b38b51b1ee0d85aab89"><enum>(II)</enum><text display-inline="yes-display-inline">improving safety through the recognition and prevention of coercion, violence, or abuse, including—</text><item commented="no" display-inline="no-display-inline" id="id81d8022415784f2c8c2ebb578f707bbd"><enum>(aa)</enum><text display-inline="yes-display-inline">teen and dating violence;</text></item><item commented="no" display-inline="no-display-inline" id="id30fafbf0e81f4513a59f8b224ec02889"><enum>(bb)</enum><text display-inline="yes-display-inline">stalking;</text></item><item commented="no" display-inline="no-display-inline" id="id7f85d6608ad148afb1632361c4e55055"><enum>(cc)</enum><text display-inline="yes-display-inline">domestic abuse; and</text></item><item commented="no" display-inline="no-display-inline" id="id0e5ba0a088694faeb79f99efcfa73fe7"><enum>(dd)</enum><text display-inline="yes-display-inline">sexual violence and harassment;</text></item></subclause></clause><clause id="id8b65f8c30946440aaf37f0ed9cf4f228"><enum>(ix)</enum><text>provides mentoring and school counseling to participating youth, including youth who are at risk of—</text><subclause commented="no" display-inline="no-display-inline" id="id0e68e038c5be4738a0f473a1d5dbe3b7"><enum>(I)</enum><text display-inline="yes-display-inline">academic failure;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2fe237bd030f49d6829efb643f25121d"><enum>(II)</enum><text display-inline="yes-display-inline">dropping out of school; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc97365b8b5be4db4bd53096c481560a2"><enum>(III)</enum><text display-inline="yes-display-inline">involvement in criminal or delinquent activities; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8ecbc5bc4ed949f6b48e595522682fc4"><enum>(IV)</enum><text display-inline="yes-display-inline">drug use and abuse;</text></subclause></clause><clause id="idb0348b7e634446e998d483441ccd7154"><enum>(x)</enum><text>promotes career or workforce readiness or participation;</text></clause><clause id="id1dbcc0e815e24adda93bc9068eb24677"><enum>(xi)</enum><text>promotes readiness for postsecondary education; or</text></clause><clause id="idb31ecaa0c0e34a22aa68db30592e9722"><enum>(xii)</enum><text>provides other experiences that contribute to a well-rounded education.</text></clause></subparagraph></paragraph><paragraph id="id47c81ebb7250412c9ce5b55f627d2b12"><enum>(2)</enum><header>Allowable uses</header><text>In addition to the uses required under paragraph (1), an eligible entity receiving a grant under this section may use grant funds for—</text><subparagraph id="idce1cda57bcaf432680998fd8624aa2a4"><enum>(A)</enum><text>the recruitment, training, and retention of qualified staff members for the Summer for All program supported under the grant;</text></subparagraph><subparagraph id="idde336425e36e4122ae82b69de2ad4387"><enum>(B)</enum><text>raising awareness about the Summer for All program in order to recruit and enroll program participants; and </text></subparagraph><subparagraph id="ida3d61a70eb9949849b9829be0bdfff0b"><enum>(C)</enum><text>other reasonable administrative costs of the Summer for All program.</text></subparagraph></paragraph></subsection><subsection id="id8c2578acaa0c4edaa6d49a61458b696d"><enum>(f)</enum><header>Additional requirements</header><paragraph commented="no" display-inline="no-display-inline" id="ideb2a2f3eb8d94466984b017806f67948"><enum>(1)</enum><header display-inline="yes-display-inline">Subgrants and contracts</header><text>Each recipient of a grant under this section shall provide the services and activities provided under the Summer for All program directly or through subgrants, contracts, or other arrangements with State educational agencies, local educational agencies, institutions of higher education, other public agencies including agencies of Indian Tribes, or private entities.</text></paragraph><paragraph id="id7f58df1a5f7b42248170ba2e0c204a4c" commented="no"><enum>(2)</enum><header>Nondiscrimination requirements</header><text>An eligible entity receiving a grant under this section may not discriminate against any individual, including an employee, volunteer, participant, or other individual involved in the Summer for All program, who is receiving Federal financial assistance through the Summer for All program on the basis of that individual's actual or perceived race, color, national origin, sex (including sexual orientation and gender identity), or disability.</text></paragraph></subsection><subsection id="id319cd08f1dbb4ece95fd11938bb7ff8b"><enum>(g)</enum><header>Reporting requirements</header><text>Each eligible entity receiving a grant under this section shall, on an annual basis, prepare and submit a report to the Secretary containing information about—</text><paragraph id="id0ce219154ed948f0adfc893ccce13be8"><enum>(1)</enum><text>how the grant funds were used;</text></paragraph><paragraph id="id40e717b48b5245b0b5abec045baa54f2"><enum>(2)</enum><text>how many youth were served by activities supported by grant funds; and</text></paragraph><paragraph id="idb68c29b26e8a4d3c8e03d0b045030330"><enum>(3)</enum><text>how remaining unobligated grant funds will be used. </text></paragraph></subsection></section><section id="idcb6ca32b1a7140fbb673fbbd143def25"><enum>4.</enum><header>Summer programming State grants</header><subsection id="id6379342d9b8e4a9abfde1134933fe83d"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="id5d114819d7fd402aae28f23ee1908a12" commented="no"><enum>(1)</enum><text>The Governor or other chief executive officer of a State.</text></paragraph><paragraph id="idb6ef69a4ed9746f990c4cc7ce4049b02" commented="no"><enum>(2)</enum><text>A State educational agency.</text></paragraph><paragraph id="idc69e17f16ee14e2a918d1314aa7b17bc" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>The governing body of an Indian Tribe. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf1d08c8efa054af39451dd032ad57355"><enum>(b)</enum><header display-inline="yes-display-inline">Grants authorized</header><paragraph commented="no" display-inline="no-display-inline" id="idb2a96b5cdb6b489bab2ff45807fd81aa"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From amounts made available to carry out this section, the Secretary, in consultation with the Secretary of Education, shall award summer programming State grants, on a competitive basis, to eligible entities to enable the eligible entities to— </text><subparagraph id="id472190d95c3f4b4fa3c88eba0ed1f517"><enum>(A)</enum><text>plan and implement sustainable strategies that address gaps in access to high-quality summer enrichment programs for youth;</text></subparagraph><subparagraph id="idcb078c45e6a0453881fe9443a8f6cf75"><enum>(B)</enum><text>build partnerships between local educational agencies, local governments, and community-based organizations to maximize the impact and availability of summer enrichment programs; and</text></subparagraph><subparagraph id="id2131bb66042b4554afc6bc5200e198d5"><enum>(C)</enum><text>establish summer programming opportunities for kids and their families that may exist outside of the traditional summer camp or enrichment experience.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id424b6c1bafb248c18b2005e58502c271"><enum>(2)</enum><header>Duration</header><text>A grant under this section shall be awarded for a period of not more than 4 fiscal years. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5d45ea1dc7f84574a484bb60ffe5f429"><enum>(c)</enum><header>Application; award basis</header><paragraph commented="no" display-inline="no-display-inline" id="idfa3167994433432490820b62d5723d45"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="id8f433e47cd1042f2a89f4deb918fcf43"><enum>(2)</enum><header>Award basis</header><text>In awarding grants under this section, the Secretary shall give priority to eligible entities that—</text><subparagraph id="id97643dd695354fffb0782ff49741ad70"><enum>(A)</enum><text>demonstrate that activities funded by the grant will be sustainable beyond the term of the grant;</text></subparagraph><subparagraph id="id3df1de74cf7c4bd0881e23f13a73e342"><enum>(B)</enum><text>establish an organization or mechanism to solicit and incorporate feedback from stakeholders, including representatives of community-based organizations, educators, municipal representatives, and parents, in the implementation of activities supported under the grant; or</text></subparagraph><subparagraph id="id9758b12fb7d644bfb4a066002d73eb46" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>plan to use funds for a variety of programs and strategies to expand summer enrichment programming for underserved communities and at-risk youth. </text></subparagraph></paragraph></subsection><subsection id="ida7aa1283f16c49608d0ea013a8b4fe9c"><enum>(d)</enum><header>Eligible activities</header><text>An eligible entity that receives a grant under this section shall use grant funds to—</text><paragraph id="id44b863d9cfd94c728f92c188cc1af01e"><enum>(1)</enum><text>expand access to summer enrichment programs in underserved communities;</text></paragraph><paragraph id="idf56092c2aef84b94a8fcc0f8ff16e5ed"><enum>(2)</enum><text>improve the safety and quality of summer enrichment programs primarily serving underserved communities;</text></paragraph><paragraph id="idb0a082801b8c46f5852c8d2f59048520"><enum>(3)</enum><text>organize a diverse group of stakeholders to determine gaps in access to summer enrichment programming and developing plans to address these gaps in a long-term, sustainable way; </text></paragraph><paragraph id="idaa41bcd8061f471f9750618958fdac3d"><enum>(4)</enum><text>expand access to enrichment activities at libraries, parks and recreation departments, museums, and other nonprofit entities that serve families during the summer months when schools are closed; or</text></paragraph><paragraph id="id8860e37f59db49d18e5f81b42567bcc2"><enum>(5)</enum><text>address barriers to partnerships between local educational agencies, local governments, and community-based organizations in providing summer enrichment programs.</text></paragraph></subsection><subsection id="id6989114df30a40ccae50fb5a2ead41f4"><enum>(e)</enum><header>Additional requirements</header><paragraph id="id03015139c3bc49c880dd7b7028eddf04"><enum>(1)</enum><header>Transfer authority</header><text>An eligible entity receiving a grant under this section may transfer grant funds to a community-based organization, a Tribal organization (as that term is defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), a public benefit corporation involved in the transportation of passengers or cargo, or a special-purpose unit of State or local government, in order to carry out activities described in subsection (d).</text></paragraph><paragraph id="idffd8b3ee53454ccf851a815c823f41de" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Contracts and grants</header><text>An eligible entity receiving a grant under this section may carry out the activities described in subsection (d) directly or through subgrants, contracts, or cooperative agreements.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbce4ce35b6f04975b5c731a789bf13b6"><enum>(3)</enum><header display-inline="yes-display-inline">Nondiscrimination requirements</header><text>An eligible entity receiving a grant under this section may not discriminate against any employee, volunteer, participant, or other individual otherwise involved in programming receiving Federal financial assistance under this section on the basis of that individual's actual or perceived race, color, national origin, sex (including sexual orientation and gender identity), or disability.</text></paragraph></subsection><subsection id="id056b7c19a4b54506bd1dd2c0602adc94"><enum>(f)</enum><header>Reporting requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id66ae052e24e240f18e44ed95829fb88a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant under this section shall, on an annual basis, prepare and submit a report to the Secretary containing information about—</text><subparagraph id="id6db729ec1636480a8272ac3fe929ee13"><enum>(A)</enum><text>how the grant funds were used;</text></subparagraph><subparagraph id="idc9ace1a6db844907898005913c732a81"><enum>(B)</enum><text>how the eligible entity solicited feedback from stakeholders in the use of funds;</text></subparagraph><subparagraph id="id28884a4a1f3f4678b3956de4e959d7a7"><enum>(C)</enum><text>how many youth have been served by activities supported by grant funds;</text></subparagraph><subparagraph id="idd17fa08aa93047609568ed7de2ccda3e"><enum>(D)</enum><text>how the entity improved access to summer enrichment programs for underserved communities and at-risk youth; and</text></subparagraph><subparagraph id="id6688b1e78c5d4f08a115d96f6c44f73e"><enum>(E)</enum><text>how the entity improved the quality of summer enrichment programs for underserved communities and at-risk youth.</text></subparagraph></paragraph><paragraph id="id920000277d904348b9d57e95c9364192"><enum>(2)</enum><header>Public availability</header><text>The Secretary shall, on an annual basis, make public the reports received under paragraph (1).</text></paragraph></subsection></section><section id="idb37f86aa699942b2aed1d9ec9b364093"><enum>5.</enum><header>Data collection program</header><text display-inline="no-display-inline">The Secretary may reserve not more than 5 percent of the amounts made available to carry out this Act to conduct, directly or through grants to public or nonprofit private entities or contracts with public or private entities or individuals, projects for research and data collection to—</text><paragraph id="idbc5935fb8eef4c30819768c29b1d39c7"><enum>(1)</enum><text>understand the scope of the need for safe, healthy, and enriching summer programs for youth; and</text></paragraph><paragraph id="id288d54e632a34349aadbb7dc97370cab"><enum>(2)</enum><text> track the progress of the Summer for All grant programs.</text></paragraph></section><section id="idd93b11acb8ea4c398a590edac9504154"><enum>6.</enum><header>Authorization of appropriations; funding distribution</header><subsection commented="no" display-inline="no-display-inline" id="idc9430f11be5a4d0ba46213640d501918"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id14491776c22746f09a80c52b79331366"><enum>(1)</enum><text display-inline="yes-display-inline">a total of $4,000,000,000 for fiscal years 2025 through 2028; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce2daff0d4794a8788cb41e350ed20a4"><enum>(2)</enum><text display-inline="yes-display-inline">$1,000,000,000 for each subsequent fiscal year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5aa89d7ad49040d685cb6b95350a1a1a"><enum>(b)</enum><header>Funding distribution</header><text>From the amount made available under subsection (a) for a fiscal year, the Secretary shall—</text><paragraph id="idadd7838cc6264f1a94c38266477874af"><enum>(1)</enum><text>use not less than 47.5 percent of such amounts to carry out section 3;</text></paragraph><paragraph id="id23f547e23a9a439497d91b7c36d9b5b6"><enum>(2)</enum><text>use not more than 47.5 percent to carry out section 4; and</text></paragraph><paragraph id="idba2546bc90e04e8c941013ad4e41e7fc"><enum>(3)</enum><text>use not more than 5 percent to carry out section 5. </text></paragraph></subsection></section></legis-body></bill>
