which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Education Sciences Reform Act of 2002 to establish a National Center for Advanced Development in Education at the Institute for Education Sciences, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H319B742FF45346E9A814191567919C56"><section section-type="section-one" id="H42F45D893EAA48A092A627641826ED1C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Essential Education Discoveries Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H7E02309C4BE44EF99276212486E81CCA"><enum>2.</enum><header>National Center for Advanced Development in Education</header><subsection id="H3333F5590C114014A32FCF64372DD3E6"><enum>(a)</enum><header>Organization</header><text display-inline="yes-display-inline">Section 111(c)(3) of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9511">20 U.S.C. 9511(c)(3)</external-xref>) is amended—</text><paragraph id="H8C61CBA8D54C453BABCDC5D8EC86C71D"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HF7537525E2274B2BBCE2ABDA915B44FA"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF2C2964BA15342119DFED24DA42DBB04"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4DF58B25CB7947948E3E28A9F9CEB210"><subparagraph id="HCE117BC083AF467CA65AD08ED0777E8C"><enum>(E)</enum><text display-inline="yes-display-inline">the National Center for Advanced Development in Education (as described in part G).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H667C9CD64648410C8CAA15C6415E088F"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 102 of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9501">20 U.S.C. 9501</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb99b0c62596f4cb48abe3c55658eca98"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (18) through (23) as paragraphs (19) through (24), respectively; and</text></paragraph><paragraph id="id3da3468ada64451e8e1afe8cb94f0bdc"><enum>(2)</enum><text>by inserting after paragraph (17) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H8CF96504969C4B9C808B4746B85314C5"><paragraph id="H8FD4333A3BD54443AC255B4FAA742683"><enum>(18)</enum><header>Science of learning and development</header><text display-inline="yes-display-inline">The term <term>science of learning and development</term> means the body of peer-reviewed knowledge from a variety of academic fields and disciplines that demonstrates how students best learn and develop.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE3D4ADC14FAE415A8FAAD4E91FB0D32C"><enum>(c)</enum><header>Establishment</header><text display-inline="yes-display-inline">Title I of the Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9501">20 U.S.C. 9501 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H54DDD7B2AA3E4154BA7042C23F7107F3"><part id="H86CF14EAAB1B4F62A48AB18927770765"><enum>G</enum><header>National Center for Advanced Development in Education</header><section id="HCCCEEE69D0F246199ABE7084AB9419A1"><enum>195.</enum><header>Establishment</header><subsection id="H97ABDA260EE94551BC25FA4C8CD73D22"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Institute a National Center for Advanced Development in Education (in this part referred to as the <quote>Advanced Development Center</quote>).</text></subsection><subsection id="H50BCFCCFD90E49048AA6C7F8077A8108"><enum>(b)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Advanced Development Center is to—</text><paragraph id="HF590DB0D02E14BD9A255FC5899F08B70"><enum>(1)</enum><text display-inline="yes-display-inline">identify, develop, and promote advances in and new solutions for teaching and learning, with an emphasis on breakthrough technologies, new pedagogical approaches, innovative learning models, and more efficient, reliable, and valid forms of assessments;</text></paragraph><paragraph id="H0A22286A587D45EE972ECC65DC3DAD27"><enum>(2)</enum><text>identify, develop, and promote transformative, community-informed solutions to address disparities in achievement and opportunity for students; </text></paragraph><paragraph id="H0FF614FAB9E44265AC02C3424231BE1A"><enum>(3)</enum><text display-inline="yes-display-inline">identify, develop, and promote community-informed advances in teaching and learning that have the potential to transform education practices across—</text><subparagraph id="HF7252210DC354B7AB03F8DCB9E292AF3"><enum>(A)</enum><text>early childhood education;</text></subparagraph><subparagraph id="HB90F2DEE0DB1415DA249592CC8DB00C7"><enum>(B)</enum><text>elementary and secondary education;</text></subparagraph><subparagraph id="H760E79ECB1C649DD9FBBF5D0AF3D77D0"><enum>(C)</enum><text>postsecondary education;</text></subparagraph><subparagraph id="H636F650197F54386BD565C26C686BEF6"><enum>(D)</enum><text>adult education;</text></subparagraph><subparagraph id="H3633916AF86841AC8F4D14130D6C0C22"><enum>(E)</enum><text>special education and services for students with disabilities; and</text></subparagraph><subparagraph id="H0E547C779D1D4F8BA13CFAF4C96F5EB2"><enum>(F)</enum><text display-inline="yes-display-inline">services for English learners;</text></subparagraph></paragraph><paragraph id="H6E6AEB65D04A40B097199A1774E19E68"><enum>(4)</enum><text display-inline="yes-display-inline">identify, develop, test, and promote strategies and interventions that support student relationships and skill-building consistent with the science of learning and development;</text></paragraph><paragraph id="H1BB68C44D97B49F38DC5E785FC0CEE06"><enum>(5)</enum><text display-inline="yes-display-inline">identify and provide community-informed recommendations and solutions that address additional factors that can improve student outcomes, including—</text><subparagraph id="H30DB3323CFF04706853ED49A6AE61AEA"><enum>(A)</enum><text>access to a diverse teaching workforce; and</text></subparagraph><subparagraph id="H0BD0AF492E2D4E308FEFC4CAE0E44A70"><enum>(B)</enum><text>institutional barriers, including with respect to students from underrepresented communities; and</text></subparagraph></paragraph><paragraph id="HFE48F0718E744BB3895E608207CF93DD"><enum>(6)</enum><text display-inline="yes-display-inline">investigate transformative research opportunities, including—</text><subparagraph id="HD1DD6BB10F4E4BAE83336DC2CE2F97F2"><enum>(A)</enum><text>technologies to analyze speech samples and identify speech and reading disorders;</text></subparagraph><subparagraph id="H142DAA93213B4D718296A7ADAD93C47E"><enum>(B)</enum><text>identifying tools to support skill acquisition outside of school (including tools for parents); and</text></subparagraph><subparagraph id="H1C4F020C569F46AF8DBEFB073E17ED0C"><enum>(C)</enum><text>developing tools to provide feedback directly to students on their competencies.</text></subparagraph></paragraph></subsection></section><section id="H7CCF4C9651C84BF691F1BD901A0D5F14"><enum>196.</enum><header>Commissioner for advanced education development</header><text display-inline="no-display-inline">The Advanced Development Center shall be headed by a Commissioner for Advanced Education Development (in this part referred to as the <quote>Advanced Development Commissioner</quote>) who shall be highly qualified and have substantial knowledge of the methodologies used and activities undertaken by the Advanced Development Center.</text></section><section id="H2C1E47A1D134471C9E38651D8C6FC546"><enum>197.</enum><header>Duties</header><subsection id="HB6425DA29399423EACEBEBF6EE35BEB9"><enum>(a)</enum><header>General duties</header><text display-inline="yes-display-inline">The Advanced Development Center shall—</text><paragraph id="HFA4C58B0465B4C1E8081856AC39BA317"><enum>(1)</enum><text>collect, report, analyze, and disseminate data related to transforming education in the United States;</text></paragraph><paragraph id="H1D7ADCB1FEAF431186141BA3BEE7B118"><enum>(2)</enum><text>approve and terminate projects in accordance with subsection (f)(2)(B);</text></paragraph><paragraph id="H22789927FA5940DA9272E7E87348CE63"><enum>(3)</enum><text display-inline="yes-display-inline">set priorities that align with the mission of the Advanced Development Center, including by identifying areas that can be furthered by research and development, including—</text><subparagraph commented="no" id="HC9CD7D883C734889BF9339853796DCD0"><enum>(A)</enum><text display-inline="yes-display-inline">interventions for learning recovery, with a particular focus on students who score below proficient on the academic assessments in mathematics or reading or language arts described in section 1111(b)(2) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)</external-xref>), including specific challenges due to the COVID–19 public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) and other disruptions to instruction;</text></subparagraph><subparagraph id="H8D1F75DC9D35499AAFDA3B86ABE1B6C8"><enum>(B)</enum><text display-inline="yes-display-inline">pedagogy; and</text></subparagraph><subparagraph id="H60FE110D535F48998B8382CCF6AC0C03"><enum>(C)</enum><text display-inline="yes-display-inline"> assessments administered to students, including such assessments that are summative, formative, competency-based, performance-based, administered throughout the school year to produce a single summative assessment score, or incorporated into an instructional sequence or lesson;</text></subparagraph></paragraph><paragraph commented="no" id="HC301A2AC588949B784AB154B6893617F"><enum>(4)</enum><text display-inline="yes-display-inline"> support the use of scientific discoveries and inventions to improve teaching and learning;</text></paragraph><paragraph id="HBD93DE195C7F43629E4F0925DF931742"><enum>(5)</enum><text>carry out the evaluation and dissemination requirements under subsection (e); and</text></paragraph><paragraph id="H3F5C23E7AA3E477CA8B0836889A1BB06"><enum>(6)</enum><text display-inline="yes-display-inline">convene and engage an advisory panel under section 198.</text></paragraph></subsection><subsection id="H1DCC72AE75B4492EBE628A40B74AC0F2"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this part, and every 3 years thereafter, the Advanced Development Commissioner shall submit to the Director a research plan that—</text><paragraph id="H18B6431B5A9646B6804BA4D4E2DC7B5F"><enum>(1)</enum><text display-inline="yes-display-inline">is consistent with the priorities and mission of the Institute and the mission of the Advanced Development Center; and</text></paragraph><paragraph id="HFE20350C66B448838897B10A227AE7C6"><enum>(2)</enum><text display-inline="yes-display-inline">describes how the Advanced Development Center will use the performance management system described in section 185 to assess and improve the activities of the Advanced Development Center.</text></paragraph></subsection><subsection id="HFC0E0D8E7C2748E89340B5BA3224B9A1"><enum>(c)</enum><header>Training program</header><text display-inline="yes-display-inline">The Advanced Development Commissioner may establish a program to train employees of public and private educational agencies, organizations, and institutions and may establish a fellowship program to appoint such employees as temporary fellows at the Advanced Development Center in order to assist the Advanced Development Center in carrying out its duties.</text></subsection><subsection commented="no" id="H3170C9DECA374876826B372269A19A0F"><enum>(d)</enum><header>Collaboration</header><paragraph commented="no" id="H1EB985C6DEDC488798205A76749CC699"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the duties under this section, the Advanced Development Commissioner may award grants and cash prizes, enter into contracts and cooperative agreements, and provide technical assistance.</text></paragraph><paragraph commented="no" id="HE9EC7E5B79594ADCB16343358B9E96CA"><enum>(2)</enum><header>Entities</header><text>In awarding grants and cash prizes and entering into contracts and cooperative agreements under paragraph (1), the Advanced Development Commissioner shall—</text><subparagraph commented="no" id="H60F84C7C232C412FAA35F68FB9F67B75"><enum>(A)</enum><text>solicit applications from public and private entities; and </text></subparagraph><subparagraph commented="no" id="H016AE75CCC9346F589AB1D6742C12939"><enum>(B)</enum><text display-inline="yes-display-inline">build research collaborations between a variety of stakeholders—</text><clause id="H8E5E9DAEC3294876A8429CE5E6F05A24"><enum>(i)</enum><text>from the private and public sectors; and</text></clause><clause id="H1041257282A44D39819FB109671918B4"><enum>(ii)</enum><text>with expertise in education practices, including teachers, principals and other school leaders, and local and State educational agency leaders.</text></clause></subparagraph></paragraph><paragraph id="HDBC513D99B884573B8DC65824AF269EE"><enum>(3)</enum><header>Applicable programs</header><text>For purposes of carrying out an applicable program under subsection (f)(2), a program manager may enter into contracts and cooperative agreements in the manner described in paragraph (2).</text></paragraph></subsection><subsection id="H5AFD3E55DE6F47F6981AAF04A61FDFC8"><enum>(e)</enum><header>Evaluation and dissemination</header><paragraph id="HF66F3AF9AFC2461083D0BFC6D5A497C0"><enum>(1)</enum><header>Evaluation</header><subparagraph id="HEA53A2C612BF4C709F140FA03DA5970C"><enum>(A)</enum><header>In general</header><text>The Advanced Development Commissioner shall obtain independent, periodic, and rigorous evaluation of—</text><clause id="HF7C18FAAB61447ACAF7B4A7EB0F2DCD9"><enum>(i)</enum><text display-inline="yes-display-inline">the effectiveness of the processes that the Advanced Development Center is using to achieve the mission described in section 195(b);</text></clause><clause id="HE760D0243D5B4016BF7323822440C251"><enum>(ii)</enum><text display-inline="yes-display-inline">the relevance, accessibility, and utility of the awards made and transactions entered into under subsection (d) to education practitioners; and</text></clause><clause id="H66391566F77540A8AA6FC060AD94B795"><enum>(iii)</enum><text display-inline="yes-display-inline">the effectiveness of the projects carried out through such awards and transactions, using evidence standards developed in consultation with the Institute of Education Sciences, and the suitability of such projects for further investment or increased scale.</text></clause></subparagraph><subparagraph id="H6B1364C4C67D4FD39A1ADB699ED2A961"><enum>(B)</enum><header>Best practices</header><text>The Advanced Development Commissioner shall assess the information obtained from the evaluation and identify best practices for the Advanced Development Center.</text></subparagraph></paragraph><paragraph id="H020B82B270FB45C29AE16C96338837C5"><enum>(2)</enum><header>Dissemination</header><subparagraph id="HFBC48F784AA640619C78D2EFCBFAB2CF"><enum>(A)</enum><header>In general</header><text>The Advanced Development Center shall disseminate, through the entities listed in subparagraph (B), information obtained from the evaluation under paragraph (1) and any other information determined to be relevant by the Advanced Development Commissioner with respect to effective practices and technologies developed under the Advanced Development Center, as appropriate, to—</text><clause id="H13DCF4BF485648679C3F445C33F669EE"><enum>(i)</enum><text display-inline="yes-display-inline">education professionals, including teachers, principals, and local and State superintendents; and</text></clause><clause id="HFDA7958727704C67BEB3DB3F5056D546"><enum>(ii)</enum><text>parents.</text></clause></subparagraph><subparagraph id="H58D2A3C5AF0245298D25607AEACD65D1"><enum>(B)</enum><header>Entities</header><text>The Advanced Development Center shall distribute the information described in subparagraph (A) through—</text><clause id="HCD01FEC359AC45FE8C99245DBEDFA5CE"><enum>(i)</enum><text display-inline="yes-display-inline">the comprehensive centers established under section 203 of the Educational Technical Assistance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9602">20 U.S.C. 9602</external-xref>);</text></clause><clause id="H90689101CED848D2B743C250FAE6B5F3"><enum>(ii)</enum><text display-inline="yes-display-inline">the regional laboratories system established under section 174; and</text></clause><clause id="HACAD20A02AD44FA1A78659377DB73520"><enum>(iii)</enum><text display-inline="yes-display-inline">such other means as the Advanced Development Commissioner, in consultation with the Director and the Secretary, determines to be appropriate.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HE29ADD07319A4CBD9C4E9A9102843C94"><enum>(3)</enum><header>Use and adoption</header><text display-inline="yes-display-inline">The Advanced Development Commissioner shall support the use and adoption of the best practices identified in paragraph (1)(B) at all levels of education and training.</text></paragraph></subsection><subsection commented="no" id="HB46374BA908042C6B460AD299C066E14"><enum>(f)</enum><header>Hiring</header><paragraph commented="no" id="H1CB30BD824454487B62E04ADCD7AB3C3"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 188, the Advanced Development Commissioner, with the approval of and in collaboration with the Director, shall—</text><subparagraph commented="no" id="HBA483B58D58C4F1C97761FC1C87AC0E6"><enum>(A)</enum><text display-inline="yes-display-inline">make appointments of scientific, engineering, and professional personnel, which may include temporary or time-limited appointments as determined by the Director to be necessary to carry out the mission described in section 195(b), without regard to the provisions of title 5, United States Code, governing appointment in the competitive service and fix the compensation of such personnel at a rate to be determined by the Director; </text></subparagraph><subparagraph commented="no" id="H533DB8857EEA4C259D4949399C05C9AD"><enum>(B)</enum><text display-inline="yes-display-inline">hire staff with sufficient qualifications and expertise (as determined by the Commissioner in consultation with the Director) to enable the Advanced Development Center to carry out the duties described in subsection (a) in conjunction with other operations of the Institute, without regard to the provisions of title 5, United States Code, governing appointment in the competitive service and fix the compensation of such staff at a rate to be determined by the Director; and</text></subparagraph><subparagraph commented="no" id="H26CEB8192C024EA48E596E3A1F3B3FCB"><enum>(C)</enum><text display-inline="yes-display-inline">use all existing authorities of the Director to hire administrative, financial, and clerical staff as necessary to carry out this subsection and pay such staff in accordance with the provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification and General Schedule pay rates.</text></subparagraph></paragraph><paragraph commented="no" id="H5BCE6FA5A6EA44D58D092D9832276928"><enum>(2)</enum><header>Program managers</header><subparagraph commented="no" id="H243AAD6033A9462E95EACBD152C67D23"><enum>(A)</enum><header>In general</header><text>The Advanced Development Commissioner, with the approval of and in collaboration with the Director, shall designate staff appointed or hired under subparagraphs (A) or (B) of paragraph (1), respectively, to serve as program managers for the Advanced Development Center.</text></subparagraph><subparagraph commented="no" id="H105AEB81DCE047779BA385C405C93D2B"><enum>(B)</enum><header>Duties</header><text display-inline="yes-display-inline">A program manager shall be responsible for—</text><clause commented="no" id="H5D364ABE993344C8A0F8DF607A9A0877"><enum>(i)</enum><text>establishing research and development goals for an applicable program, including by developing and hosting workshops and consulting with outside experts;</text></clause><clause commented="no" id="HD9C37FC3E3884FB08E40FCB4AFEF7F1A"><enum>(ii)</enum><text>publicizing such goals;</text></clause><clause commented="no" id="H38A280950E8F4E06BAE0E64654348A2B"><enum>(iii)</enum><text display-inline="yes-display-inline">soliciting applications from eligible entities for projects that advance such goals and contribute to making rapid advances in teaching and learning, to be submitted by such entities at such time, in such manner, and containing such information as the program manager, in conjunction with the Advanced Development Commissioner, may require;</text></clause><clause commented="no" id="H56B16AB5CFBB48A3921BC9FED5BFE5A1"><enum>(iv)</enum><text>selecting, on a competitive basis, such projects to be supported under an applicable program, taking into consideration—</text><subclause commented="no" id="H3702B476A2A249AC8D53309A0215A5DF"><enum>(I)</enum><text>the novelty and scientific and technical merit of a proposed project; </text></subclause><subclause commented="no" id="H9E6BDA6815DB43049A4784DE72AF7986"><enum>(II)</enum><text>the demonstrated capabilities of the eligible entity to successfully carry out such proposed project; </text></subclause><subclause commented="no" id="H72180AFB0B5141AC962FC1AD07E8F72B"><enum>(III)</enum><text>the extent to which the eligible entity considered, as part of the application submitted under clause (iii), future commercial applications of a proposed project to increase the likelihood of scalability of such project; and </text></subclause><subclause commented="no" id="H88B22F610DB94D4BA888E63AE147E9CA"><enum>(IV)</enum><text>such other criteria as the program manager, in conjunction with the Advanced Development Commissioner, may require;</text></subclause></clause><clause id="H13D2D6E3370A4C4F832DF37F1F83C63F"><enum>(v)</enum><text>terminating such projects, as applicable; and</text></clause><clause commented="no" id="HC3BA896B5E4C40EBA10EBF3E3A781911"><enum>(vi)</enum><text>establishing the research collaborations described in subsection (d)(3).</text></clause></subparagraph><subparagraph commented="no" id="HC1E449810A1248D28DCEAA597C802F21"><enum>(C)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text><clause id="H34DBA841DDB5427ABA5DB61D4E2FDDE6"><enum>(i)</enum><header>Applicable program</header><text>The term <term>applicable program</term> means a program—</text><subclause commented="no" id="H94945B6DFBB74298A328296D897F6DA8"><enum>(I)</enum><text>for which a project manager establishes research and development goals;</text></subclause><subclause id="H32D766070DC941B191EE0D2326792E2B"><enum>(II)</enum><text>that supports projects aligned with such goals; and</text></subclause><subclause commented="no" id="HA19674E407CF4AF4BE4112553E7C075A"><enum>(III)</enum><text>that receives funds from the Advanced Development Center.</text></subclause></clause><clause id="H39071F34FD494A4EAB602C9AC4078CF0"><enum>(ii)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subclause id="H7AE5E9035BFE48CAAFC288EC4E74FB70"><enum>(I)</enum><text>a State educational agency;</text></subclause><subclause id="HD6D4F749C1E6456A8548C25D2E9ADCDF"><enum>(II)</enum><text>a local educational agency;</text></subclause><subclause id="HD2F87859A6EC44319A3650C90A71C958"><enum>(III)</enum><text>a public or private nonprofit institution of higher education;</text></subclause><subclause id="H4C6304D439E844D094BE5B1D52F2D9CB"><enum>(IV)</enum><text>a nonprofit educational organization; and</text></subclause><subclause id="HF5286A14B7D44A2CAC049D743290371E"><enum>(V)</enum><text>a federally funded research and development center.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="H8BC52195F41E44C88197C4ECE33D7E1C"><enum>198.</enum><header>Advisory panel</header><subsection id="HACF239C3738A4AA58F49140B7A85FB3A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Advanced Development Commissioner is appointed, the Commissioner shall establish an advisory panel to identify, evaluate, and make recommendations with respect to improving education research in order to promote the mission of the Advanced Development Center.</text></subsection><subsection id="HD86CEE64D59F478CB9FF25A70C6161AB"><enum>(b)</enum><header>Duties</header><paragraph id="H9AA14927850F41FEA595582E4C84A36B"><enum>(1)</enum><header>Report</header><text>Not later than 2 years after the date on which the advisory panel is established, the advisory panel shall create and update on an annual basis a report that—</text><subparagraph id="H9CF533F9BF8041708C6B29CB06E214A1"><enum>(A)</enum><text>identifies, analyzes, and evaluates the state of—</text><clause id="H9A3BD69AEEA4480CBB0F455CB6351EBD"><enum>(i)</enum><text>education research and development; and</text></clause><clause id="HF7E39FFD7F2B42EA969CBA7B9981690A"><enum>(ii)</enum><text>education research priorities at the State and local levels;</text></clause></subparagraph><subparagraph id="H86118E73B11E4F14AC429DA62AA1B4B1"><enum>(B)</enum><text>identifies and promotes advances in teaching and learning; and</text></subparagraph><subparagraph id="H40914306C32047B592D777C228597C61"><enum>(C)</enum><text>highlights factors that can have an impact on student learning outcomes, with particular attention to opportunity and achievement disparities for students, including the factors addressed in section 195(b)(6).</text></subparagraph></paragraph><paragraph id="HA2C38414778A4C198E236844190E7035"><enum>(2)</enum><header>Submission and publication</header><text>Not later than 1 month after the date on which the report described in paragraph (1) is created and not later than 1 month after each subsequent update of such report, the advisory panel shall—</text><subparagraph id="HADD02E04E64944689CBB6458AF4EC5CE"><enum>(A)</enum><text>submit such report to—</text><clause id="H973C9F22B6DF4D2F861A507E1CB8CBEC"><enum>(i)</enum><text>the Advanced Development Commissioner;</text></clause><clause id="HE5F71A55307B474FAE94B084CFE2D0F4"><enum>(ii)</enum><text>the Director;</text></clause><clause id="H8AD6C75C1A9640E38BD468ACBDFA223B"><enum>(iii)</enum><text>the Secretary;</text></clause><clause id="H20270C15324C4EC5AE97AB4AEBF7AC0A"><enum>(iv)</enum><text>the Committee on Appropriations of the House of Representatives; </text></clause><clause id="HDBF969CF0CA440EA965CCA85EFC9D92A"><enum>(v)</enum><text>the Committee on Appropriations of the Senate; </text></clause><clause id="H4744759BAE25433E9B76EC1A63E48C4D"><enum>(vi)</enum><text>the Committee on Education and the Workforce of the House of Representatives; and</text></clause><clause id="HD874EF9691BC4DBD861E3D31E48ED20F"><enum>(vii)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></clause></subparagraph><subparagraph id="H56D4FFC200834F4B84E24894B31184AF"><enum>(B)</enum><text>make such report publicly available on the website of the Institute.</text></subparagraph></paragraph></subsection><subsection id="H0447FFE0F6834B3DA27E2F52D60CCCFE"><enum>(c)</enum><header>Membership</header><text>The advisory panel shall be composed of at least 8, but not more than 12, members appointed by the Advanced Development Commissioner as follows:</text><paragraph id="HA45351BA8A764DFF8E186BEFA232B6ED"><enum>(1)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be parents.</text></paragraph><paragraph id="HA29AC0E2DA1444829A29EECB81D9E89A"><enum>(2)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be education professionals.</text></paragraph><paragraph id="H99EEE6FC843E436FB7E665EC6676A0DA"><enum>(3)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be experts in technology.</text></paragraph><paragraph id="H89C16B5FEC104F9A881C2CBD131E068E"><enum>(4)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be specialists in rapid gains in student achievement and school improvement.</text></paragraph><paragraph id="HE5F5DDD0021844229DB215F3EC347730"><enum>(5)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be specialists in personalized learning.</text></paragraph><paragraph id="H55DC2864A58A42F6BF90BE1265FE91DE"><enum>(6)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be education and social science researchers.</text></paragraph><paragraph id="HAC864666693E417C954EF9EF29C966AE"><enum>(7)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be representatives from the Department or National Science Foundation.</text></paragraph><paragraph id="HDD1B089782C94CC898340147C95B6A57"><enum>(8)</enum><text display-inline="yes-display-inline">At least 1 but not more than 2 members shall be individuals with expertise in education issues not otherwise represented who will contribute to the overall rigor and quality of the Advanced Development Center.</text></paragraph></subsection><subsection id="H6A91FBD05A6A48D8A13E3709B4937EEF"><enum>(d)</enum><header>Advisory nature</header><text display-inline="yes-display-inline">The function of the advisory panel shall be advisory in nature. Nothing in this section shall be construed as giving the advisory panel authority over the activities authorized under this part.</text></subsection><subsection commented="no" id="HB46F4A1F5F06423B99BF98F26A81D724"><enum>(e)</enum><header>Termination</header><text>The advisory panel shall terminate 5 years after the date of establishment of such panel.</text></subsection></section><section id="H4413C764C73A4A5E86BF7EA6B3A44CD6"><enum>199.</enum><header>Community-informed defined</header><text display-inline="no-display-inline">In this part, the term <term>community-informed</term> means to be informed by input from State educational agencies, local educational agencies, parents, students, and education practitioners, including teachers, principals, and other school leaders within the community or regional area where activities planned and carried out by the Advanced Development Center will occur.</text></section><section id="H30EAE08025A24E67917327A0498AA7F4"><enum>200.</enum><header>Authorization of appropriations</header><subsection id="H757C51266C194E75B78D1D13D6E05050"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this part such sums as may be necessary for each of fiscal years 2025 through 2029.</text></subsection><subsection commented="no" id="H3708D624841F4999985F38957F9681E6"><enum>(b)</enum><header>Timing</header><text display-inline="yes-display-inline">Amounts made available for a fiscal year under subsection (a) shall remain available until expended.</text></subsection><subsection id="HB9E89EC94B8043D8A90C5F62171B395F"><enum>(c)</enum><header>Reservation</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 5 percent of the funds appropriated for a fiscal year under subsection (a) for administrative expenses and technical assistance.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H147F799D56D64B72BB2EA4B522185038"><enum>3.</enum><header>Improving Statewide longitudinal data systems</header><text display-inline="no-display-inline">Section 208 of the Education Sciences Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9607">20 U.S.C. 9607</external-xref>) is amended to read as follows:</text><quoted-block id="H4A117C09B51545A9B6EE1CA75BB6B5FF"><section id="HA16FB9537C0C4355A025854995A0C7E2"><enum>208.</enum><header>Grant program for statewide, longitudinal data systems</header><subsection id="H68FFF899B5904C7494B31F41914CB24F"><enum>(a)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">The Secretary shall award grants to eligible entities to design, develop, improve, and implement statewide longitudinal data systems (in this section referred to as <quote>SLDS</quote>) to—</text><paragraph id="H6FDD0B97B86C4E44AA40D162C27212F8"><enum>(1)</enum><text>produce more consistent and comprehensive data of individuals and on the pathways of such individuals from birth into the workforce; and</text></paragraph><paragraph id="HAD425DDC83564B829E065E83D0311B80"><enum>(2)</enum><text>efficiently and accurately manage, analyze, disaggregate, and use such data in a manner that protects the privacy of such individuals.</text></paragraph></subsection><subsection id="H7F0EAC261FF74DC9BFE45222C15EC42B"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking a grant under this section shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></subsection><subsection commented="no" id="H2A316E635AE044B9B79EC047305F684F"><enum>(c)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible entity shall use a grant awarded under this section to—</text><paragraph commented="no" id="H655890D23A41445B8E726FF8F42418BA"><enum>(1)</enum><text display-inline="yes-display-inline">modernize data infrastructure and analytics capacity to—</text><subparagraph id="HC02E89C18817493E8F2D6EF783F94CB4"><enum>(A)</enum><text>use and integrate data across education, workforce, nutrition, and other social service systems into SLDS, including—</text><clause commented="no" id="H6FA2F406ABC842B48329149A6B1EF5D6"><enum>(i)</enum><text>early childhood education;</text></clause><clause commented="no" id="H342FCE411B464022BE3410BE7B0E74B8"><enum>(ii)</enum><text>elementary and secondary education;</text></clause><clause commented="no" id="HDF3B48386A8E49CFBF160D70FBDAB908"><enum>(iii)</enum><text>career and technical education;</text></clause><clause commented="no" id="H59BD3D9C8FB940089FCC435539A90B3F"><enum>(iv)</enum><text>postsecondary education; and</text></clause><clause commented="no" id="H4288E781F79341CEAB695592D4695BC9"><enum>(v)</enum><text>workforce development programs supported by the—</text><subclause commented="no" id="HAC62314073374DACA0B68DAC691A4366"><enum>(I)</enum><text display-inline="yes-display-inline">Department of Education;</text></subclause><subclause commented="no" id="H1544C333EA2742DE80BDA21C20A468A1"><enum>(II)</enum><text display-inline="yes-display-inline">Department of Labor;</text></subclause><subclause commented="no" id="HEC8E5B5C2FF2430BBA08D2C9652C156F"><enum>(III)</enum><text display-inline="yes-display-inline">Department of Health and Human Services;</text></subclause><subclause commented="no" id="H2FF080F981F148ABB47A80126C868143"><enum>(IV)</enum><text display-inline="yes-display-inline">Department of Agriculture;</text></subclause><subclause commented="no" id="HAD1A5209C231471C95AD8AA8437AD9B7"><enum>(V)</enum><text display-inline="yes-display-inline">Department of Defense; and</text></subclause><subclause commented="no" id="H195D507D1C1348B8B4D746390D1CE138"><enum>(VI)</enum><text display-inline="yes-display-inline">Department of Commerce;</text></subclause></clause></subparagraph><subparagraph id="H3079B9288D60430BB78FF03DEF4BB1DB"><enum>(B)</enum><text>improve access to, and use of, data integrated across the systems described in subparagraph (A);</text></subparagraph></paragraph><paragraph id="H733D1A9003274CAB969B9A5277A03B32"><enum>(2)</enum><text>increase the capacity of staff at the eligible entity to oversee, maintain, support, and operate SLDS;</text></paragraph><paragraph commented="no" id="H6367CC3944144FB7B871634F0681238B"><enum>(3)</enum><text display-inline="yes-display-inline">ensure the technical quality, including validity and reliability, of the data described in paragraph (1);</text></paragraph><paragraph commented="no" id="HD3CF6A57B9434625BCA2B33F24DB561A"><enum>(4)</enum><text display-inline="yes-display-inline">promote linkages and use across States and systems, including with respect to—</text><subparagraph commented="no" id="H92E5CEB83D0D439DA4E0C983DCABF397"><enum>(A)</enum><text>early childhood education;</text></subparagraph><subparagraph commented="no" id="HB95F9388606047DDA81FCD82B904CB36"><enum>(B)</enum><text>elementary and secondary education;</text></subparagraph><subparagraph commented="no" id="HD18693ACE049443CB8EE8526F8C1968E"><enum>(C)</enum><text>postsecondary education; and</text></subparagraph><subparagraph commented="no" id="H7275E87F80AC4034B806DAF87BFD9C50"><enum>(D)</enum><text>workforce, including—</text><clause commented="no" id="H8A8BB53903B4468E9983ED5F2B8264D9"><enum>(i)</enum><text>employment;</text></clause><clause commented="no" id="HEB2FDFA13655446894C552F3E1DE2E20"><enum>(ii)</enum><text>healthcare; and</text></clause><clause commented="no" id="H1CA77B0CD737489B93F94A1448A21E62"><enum>(iii)</enum><text>social services, including nutrition;</text></clause></subparagraph></paragraph><paragraph commented="no" id="H54B9312860CB41DCBB5458AC4F710557"><enum>(5)</enum><text display-inline="yes-display-inline">meet Federal and State law requirements with respect to protecting the privacy of individuals, including student privacy rights guaranteed by section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>) (commonly referred to as the <quote>Family Educational Rights and Privacy Act of 1974</quote>);</text></paragraph><paragraph commented="no" id="HE7178695B49D4537B8E08EED234DC003"><enum>(6)</enum><text display-inline="yes-display-inline">provide, prior to beginning employment and on a regular basis thereafter, training to local and State employees, including school leaders and teachers, with respect to maintaining privacy of personally identifiable information and securely utilizing data from SLDS to improve education and workforce practice, policy, and outcomes;</text></paragraph><paragraph commented="no" id="H33732E962A954CF085BE7F0260FD74D1"><enum>(7)</enum><text display-inline="yes-display-inline">promote the creation and management of accurate data that are needed—</text><subparagraph commented="no" id="H62B21B477F17401EB7A2AFF47CE01299"><enum>(A)</enum><text display-inline="yes-display-inline">for State and local educational, labor, workforce, health, social services, and other relevant agencies to comply with Federal and State laws and reporting requirements; </text></subparagraph><subparagraph commented="no" id="HF9729DE36AD64BE5A95B5536F8FCEB76"><enum>(B)</enum><text>to better understand and address achievement and opportunity gaps in education, employment, health, and social services; and</text></subparagraph><subparagraph commented="no" id="H8C940E8C993B4CC98A7B6DA7BCABEB6D"><enum>(C)</enum><text>to enable, facilitate, and participate in research within a State and across States to improve student academic achievement, close education and employment gaps and gaps related to access to health care and social services, and improve student, worker, and family outcomes; and</text></subparagraph></paragraph><paragraph commented="no" id="H71A7669624EE40DA95AB813065A4547F"><enum>(8)</enum><text display-inline="yes-display-inline">support continual improvement of education, workforce, health, and social services programs and systems, including by better understanding whether such programs and systems are—</text><subparagraph commented="no" id="HBA4722BCF6B5440F9EA2CD91CE273093"><enum>(A)</enum><text display-inline="yes-display-inline">serving students, workers, and families, with a focus on underserved students, workers, and families;</text></subparagraph><subparagraph commented="no" id="HA90F922CA1FC44CAB71D9BBCA9363BA2"><enum>(B)</enum><text>supporting the attainment of key education, employment, health, social services, and other relevant outcomes, including sustained increases in wages;</text></subparagraph><subparagraph commented="no" id="HCA745695193D421BBA33DF5554E9F24F"><enum>(C)</enum><text>making data available, in a way that protects personally identifiable student information, to researchers and encouraging partnerships to make information actionable;</text></subparagraph><subparagraph id="H7F4CBC2AEAC248B8A537887500196707"><enum>(D)</enum><text display-inline="yes-display-inline">achieving positive outcomes for the students, workers, families, and other demographics that such programs and systems are intended to serve; and</text></subparagraph><subparagraph commented="no" id="HD0F674756DA14E1DA0275049AC8D4791"><enum>(E)</enum><text>engaging with diverse stakeholders to receive input and share information.</text></subparagraph></paragraph></subsection><subsection id="H825F1145DBA64CE6A026DFFB6FB6E495"><enum>(d)</enum><header>Funds</header><paragraph id="HE6983DD5E8594AAF910CE7757675B776"><enum>(1)</enum><header>Supplement, not supplant</header><text>Funds made available under this section shall be used to supplement, and not supplant, other Federal, State, or local funds used for developing statewide longitudinal data systems.</text></paragraph><paragraph id="H2702CCCC56C94BE7A50D701605AA3E5E"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary may reserve not more than 5 percent of the funds made available under this section for program administration and technical assistance.</text></paragraph></subsection><subsection commented="no" id="H38B78FDB43374A98A51B6FAF0D6CB992"><enum>(e)</enum><header>Report</header><paragraph commented="no" id="H45F9179D11CC4281864B5BC9D407010E"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the National Academies Committee on National Statistics, shall make publicly available a report on the implementation and effectiveness of the activities carried out by eligible entities with grant funds awarded under this section including by—</text><subparagraph commented="no" id="H23BDF357AE3644CFADACB34CFC5AD8B4"><enum>(A)</enum><text display-inline="yes-display-inline">identifying and analyzing State practices regarding the development and use of statewide longitudinal data systems; </text></subparagraph><subparagraph commented="no" id="HC876B028020C4C9492F29E882B04F47B"><enum>(B)</enum><text>evaluating the ability of such systems to manage individual student data consistent with the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>), promote linkages across States, and protect student privacy consistent with section 183; and </text></subparagraph><subparagraph commented="no" id="HF83E11B9D38D426A855814C311D910BA"><enum>(C)</enum><text>identifying best practices and areas for improvement.</text></subparagraph></paragraph><paragraph commented="no" id="H6F8A3AE195F94D858E3B510E2D971235"><enum>(2)</enum><header>Timing</header><text>The report required under paragraph (1) shall be submitted—</text><subparagraph commented="no" id="H6E4C7748095040A182AE5D2E3912A003"><enum>(A)</enum><text>not later than 1 year after the date of the enactment of this section; and</text></subparagraph><subparagraph commented="no" id="H1E22FFEBFCC945FEA65423A16E2F51AF"><enum>(B)</enum><text>not later than 4 years after the date of the enactment of this section.</text></subparagraph></paragraph></subsection><subsection id="H955F980D84724ECCB184159F900F4D89"><enum>(f)</enum><header>Eligible entity defined</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="H1BAE3418521041E88C92309B88F14D4F"><enum>(1)</enum><text>a State;</text></paragraph><paragraph id="HE97B54DA25134071BA26DEC8BC74BC92"><enum>(2)</enum><text>a State educational agency;</text></paragraph><paragraph commented="no" id="H407046852288482F9BD573A383BC8952"><enum>(3)</enum><text display-inline="yes-display-inline">a State workforce development board established under section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94c0416ad986411aaab311d60c528dd5"><enum>(4)</enum><text display-inline="yes-display-inline">a State higher education agency as defined under section 103 of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>); and</text></paragraph><paragraph commented="no" id="HAC683155F28E4723ADC9088AC8E215A8"><enum>(5)</enum><text>other statewide data governance bodies or organizations managing or overseeing the SLDS of a State, as determined and designated by the Governor.</text></paragraph></subsection><subsection commented="no" id="HF44B2F26DEEB476480206788EF76B739"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="H2F758399BA6A4F688C1919AE06A228E4"><enum>(1)</enum><text>such sums as may be necessary for fiscal year 2025; and</text></paragraph><paragraph id="H2EA464FB2F464792AD6416E27FDE3EAA"><enum>(2)</enum><text>for each fiscal year thereafter, not less than the amount appropriated for fiscal year 2024. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
