<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4833</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240730">July 30, 2024</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exclude locality adjustments from average pay for purposes of computing the amount of retirement annuities of new employees. </official-title></form><legis-body><section id="idca0f3f97be954539b15007ba413bb70a" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Employee Locality Accountability in Retirement Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idC4DDB55E9F464A959B003D8D57F73218"><enum>2.</enum><header>Exclusion of locality adjustments from retirement annuities</header><text display-inline="no-display-inline">Section 8401 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9b3cfdd6bbfa4e009a927acc92689cf0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by inserting <quote>, which for a revised average pay employee shall exclude any locality-based comparability payments under section 5304 or 5304a,</quote> after <quote>rates of basic pay</quote>; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idead4ec5b27d5436ca4ba84589505adcb"><enum>(2)</enum><text>in paragraph (38)(B), by striking <quote>and</quote> at the end; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00cdc710880247bd8c1ae0533e3a1466"><enum>(3)</enum><text>in paragraph (39), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6240f911f18341f7af924ac6a0547806"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id41009AD864CB42BEAF2EF5BC39E4FB49"><paragraph commented="no" display-inline="no-display-inline" id="id24f9c91882e1408b9b73d96a1dbe4a5b"><enum>(40)</enum><text>the term <term>revised average pay employee</term> means an individual who—</text><subparagraph id="id24ccdf8c7c6748a4b1c2f5130205fa14"><enum>(A)</enum><text>on the date of enactment of this paragraph—</text><clause id="id6273cb774f304ef7b6ef6071d1c6e098"><enum>(i)</enum><text>is not an employee or Member covered under this chapter;</text></clause><clause id="id532e3b21952e41fc87e88d94f19aa978"><enum>(ii)</enum><text>is not performing civilian service which is creditable service under section 8411; and</text></clause><clause id="ida2bf2205eb2a473388ebe6c4d633bf0c"><enum>(iii)</enum><text>has not performed any civilian service which is creditable service under section 8411; and</text></clause></subparagraph><subparagraph id="id9883766079bc4978bee418d37f50ffb7"><enum>(B)</enum><text>after the date of enactment of this paragraph, becomes employed as an employee or becomes a Member covered under this chapter performing service which is creditable service under section 8411.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
