Definitions. </toc-entry><toc-entry level="section">54402. Purpose. </toc-entry><toc-entry level="section">54403. Resilient waterfront communities designation. </toc-entry><toc-entry level="section">54404. Resilient waterfront communities network. </toc-entry></toc><section id="id6711b5f7336a452c93e9a9866b7de4cd"><enum>54401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text><paragraph id="id6d0d6fa0f6ed4964b7a03e30eac4e149"><enum>(1)</enum><header>Blue economy</header><text>The term <term>blue economy</term> means industries related to the Great Lakes, oceans, bays, estuaries, and coasts in the economy of the United States, including living resources, marine construction, marine transportation, offshore energy development and siting, including for renewable energy, offshore mineral production, ship- and boat-building, tourism, recreation, subsistence, commercial, recreational, and charter fishing, seafood processing, and other fishery-related businesses, aquaculture (such as kelp and shellfish), and other industries the Secretary of Commerce considers appropriate. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41cd336745534898b1b360918711578c"><enum>(2)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means the following: </text><subparagraph commented="no" display-inline="no-display-inline" id="idf0b9fd3c5fda4eba9fe41fc3c7e9859b"><enum>(A)</enum><text display-inline="yes-display-inline">A State. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0087b0d146604d74bed601fad3f540b1"><enum>(B)</enum><text display-inline="yes-display-inline">A political subdivision of a State, or a local government. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37494e644a674e55a4e99d762a5fe341"><enum>(C)</enum><text display-inline="yes-display-inline">A public agency or publicly chartered authority established by 1 or more States. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5bc2d5bed46f4cb3b8ddf2a54c47c3e8"><enum>(D)</enum><text display-inline="yes-display-inline">A special purpose district with a transportation function. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81f4ea59cea84934bb95c3d8098e49da"><enum>(E)</enum><text display-inline="yes-display-inline">An Indian Tribe or a Native Hawaiian organization. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea8905b631d0448ea419060bc5d06f6e"><enum>(F)</enum><text display-inline="yes-display-inline">A multistate or multijurisdictional group of entities described in subparagraphs (A) through (E). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id29ab600756a548f68c6c4de2cc7e71e4"><enum>(G)</enum><text>A lead entity described in subparagraphs (A) through (F), jointly with an additional entity or group of entities that may include—</text><clause commented="no" display-inline="no-display-inline" id="id460194d987004340a6fae7a11b3624dc"><enum>(i)</enum><text display-inline="yes-display-inline">a nonprofit organization with relevant expertise;</text></clause><clause commented="no" display-inline="no-display-inline" id="id621752ef83444ef6ac1a6bdcc759492b"><enum>(ii)</enum><text>an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id3eb3fe6fa4584510918a8c5438882486"><enum>(iii)</enum><text>a private entity.</text></clause></subparagraph></paragraph><paragraph id="iddb737026bf6b467bb4387aebbd851cd4"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id86f0882c68d34e01bc8feba097dd98d1"><enum>(4)</enum><header>Native hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> has the meaning given the term under section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>). </text></paragraph><paragraph id="id2183162baac14e84a063f7ee73eada5d"><enum>(5)</enum><header>Port</header><text>The term <term>port</term> means—</text><subparagraph id="idf68c07372ba44cf2a53e233302c4910f"><enum>(A)</enum><text>any port on the navigable waters of the United States; and</text></subparagraph><subparagraph id="id7d00e26e77224f66bb186fd3dd874a5a"><enum>(B)</enum><text>any harbor, marine terminal, or other shore side facility used principally for the movement of goods on inland waters. </text></subparagraph></paragraph><paragraph id="id27e93b566ead408499fad634eb67afd5"><enum>(6)</enum><header>Project</header><text>The term <term>project</term> means construction, reconstruction, environmental rehabilitation, acquisition of property, including land related to the project and improvements to the land, equipment acquisition, and operational improvements.</text></paragraph><paragraph id="id4c945f1fc38e48188cb1b8a4ab3cd087"><enum>(7)</enum><header>Resilient</header><text>The term <term>resilient</term> means the ability to anticipate, prepare for, adapt to, withstand, respond to, and recover from operational disruptions including disruptions caused by natural or manmade hazards or extreme weather events.</text></paragraph><paragraph id="id7702ede003d24f6eb65d99baa963e812"><enum>(8)</enum><header>Resilient waterfront community</header><text>The term <term>resilient waterfront community</term> means a resilient waterfront community designated under section 54403. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2BDAA06E8BFC4074A37CBFD772E866F5"><enum>(9)</enum><header display-inline="yes-display-inline">Working waterfront</header><text display-inline="yes-display-inline">The term <term>working waterfront</term> means real property (including support structures over water and other facilities) that provides access to coastal and Great Lakes waters to persons engaged in commercial and recreational fishing, recreational fishing and boating businesses, boatbuilding, aquaculture, or other water-dependent, coastal-related business and is used for, or that supports, commercial and recreational fishing, recreational fishing and boating businesses, boatbuilding, aquaculture, or other water-dependent, coastal-related business and recreation. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id550fdac1df8641e69b5f5ec952efe260"><enum>54402.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this chapter is to promote the recognition and support of resilient waterfront communities so that such communities may support working waterfronts, resilience, economic development, port infrastructure, natural infrastructure, coastal activities, public access, the associated blue economy, and related projects.</text></section><section commented="no" id="id3fa6e556a19d474ba70f49cf15dcb46a"><enum>54403.</enum><header>Resilient waterfront communities designation</header><subsection id="id2780f11f703a434ca64113dd0e1b19fd"><enum>(a)</enum><header>Designation as resilient waterfront communities</header><paragraph id="id4a070aa85ade4343a7753a1ec704b557"><enum>(1)</enum><header>In general</header><subparagraph commented="no" display-inline="no-display-inline" id="id840c9f62d358486181b6596c9b684059"><enum>(A)</enum><header>Designation</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), the Secretary of Commerce (referred to in this section as the <quote>Secretary</quote>), in coordination with the Secretary of Transportation, shall designate certain communities that submit a plan to the Secretary as <quote>resilient waterfront communities</quote>, based on the extent to which the community plan meets the criteria described in subsection (b). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id738589de01d64f819bfd0774acbbe544"><enum>(B)</enum><header>Eligible communities</header><text display-inline="yes-display-inline">A community shall be eligible to be designated under subparagraph (A) if it is a local government, an Indian Tribe, or a Native Hawaiian community that operates in an area with a working waterfront that is bound in part by—</text><clause commented="no" display-inline="no-display-inline" id="id64f02838869549c4a7991ed0cc49dcf0"><enum>(i)</enum><text>at least one of the Great Lakes; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id8c017864fd2a4475a9fef925efb0974d"><enum>(ii)</enum><text>the ocean. </text></clause></subparagraph></paragraph><paragraph id="id5981dddccf5b456c85b946714d93611e"><enum>(2)</enum><header>Collaboration</header><text>In carrying out this section, the Secretary shall work with the Secretary of Transportation and the heads of other Federal agencies, as the Secretary determines necessary.</text></paragraph><paragraph id="idf3912ecd035e4a9a8278a5f3bf78bf68"><enum>(3)</enum><header>Engagement</header><text>In carrying out this section, the Secretary shall engage with Indian Tribes and Native Hawaiian communities.</text></paragraph><paragraph id="id23ee1d73923645e7b5ec8b09fe9215d0"><enum>(4)</enum><header>Technical assistance</header><text>In carrying out this section, the Secretary shall provide technical assistance to communities seeking to be designated as a resilient waterfront community. Technical assistance shall include—</text><subparagraph id="id835224934d4245f59047c00e4fc862ba"><enum>(A)</enum><text>providing information about relevant programs under sections 25010 and 21205 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/49/102">49 U.S.C. 102</external-xref> note; 116 note; <external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f3eaaec307f4f1eac15b1dd807f5f4b"><enum>(B)</enum><text display-inline="yes-display-inline">providing information about relevant grants;</text></subparagraph><subparagraph id="id817f16d7aeba4ad3a6fc7db543d4d69b"><enum>(C)</enum><text>providing information about best practices; </text></subparagraph><subparagraph id="idbc6022ae7e4d4df99925b432491e1990"><enum>(D)</enum><text>providing copies of relevant studies and research; and</text></subparagraph><subparagraph id="idc8446ea85d674b3d87bc25f99f14c673"><enum>(E)</enum><text>other support, as determined by the Secretary. </text></subparagraph></paragraph></subsection><subsection id="id30bb7cdbe6724835950e7ef5ecd63868"><enum>(b)</enum><header>Resilient waterfront community plan</header><text>A community seeking to be designated as a resilient waterfront community shall submit a resilient waterfront community plan to the Secretary. Such plan shall be a community-driven vision and plan that is developed—</text><paragraph id="id4a3e70c6025a43c2aacc703df41806a3"><enum>(1)</enum><text>voluntarily at the discretion of the community—</text><subparagraph id="iddbf9a1beb24143e38e76708b4ae408d6"><enum>(A)</enum><text>to respond to local needs; or</text></subparagraph><subparagraph id="id0780f4b66d2a4db4ba7115550e15746a"><enum>(B)</enum><text>to take advantage of new water-oriented opportunities;</text></subparagraph></paragraph><paragraph id="id3b826e08c0ff4d758c12c6a543479e93"><enum>(2)</enum><text>with the leadership of the relevant governmental entity, Indian Tribe, or Native Hawaiian community, and with the active participation of—</text><subparagraph id="id140f84906ac744178d07c8c068fb3343"><enum>(A)</enum><text>community residents;</text></subparagraph><subparagraph id="ida6d9564eecd74db2b9ca2fc183514edc"><enum>(B)</enum><text>utilities; and</text></subparagraph><subparagraph id="idc6f61241172a4404bbc5605a139477d4"><enum>(C)</enum><text>interested business and nongovernmental stakeholders;</text></subparagraph></paragraph><paragraph id="ida26f778e37944409a90f97383b8cf365"><enum>(3)</enum><text>as a new document or by amending or compiling community planning documents, as necessary, at the discretion of the Secretary;</text></paragraph><paragraph id="ide0cac0fca43b484a9095fafbe13db53b"><enum>(4)</enum><text>to address economic competitive strengths; and</text></paragraph><paragraph id="id19b7d2e0b1cd44a29f5c2b1a481281ea"><enum>(5)</enum><text>to complement and incorporate the objectives and recommendations of applicable regional economic plans.</text></paragraph></subsection><subsection id="idb5ee0e0fe68840378c030716a05bda94"><enum>(c)</enum><header>Components of a resilient waterfront community plan</header><text>A resilient waterfront community plan shall—</text><paragraph id="id6a3a44c0af89431e9c66872fbca14e60"><enum>(1)</enum><text>consider all, or a portion of, the relevant waterfront area and adjacent land and water to which the waterfront is connected ecologically, economically, or through local governmental or Tribal boundaries; and </text></paragraph><paragraph id="id0e1ddd1ba25c46ef98c6abe5348ff431"><enum>(2)</enum><text>describe a vision and plan for the community to be developed or preserved as a vital and resilient waterfront community, integrating consideration of—</text><subparagraph id="idcceeb8ee67184ee1bb0053cd60fdcf1c"><enum>(A)</enum><text>the economic opportunities resulting from water proximity and access, including—</text><clause id="id32f4fbe4e1854ac0ae7a78289dd00b05"><enum>(i)</enum><text>water-dependent industries;</text></clause><clause id="id08e8b7c28a7c42159a4956705bd98023"><enum>(ii)</enum><text>water-oriented commerce; and</text></clause><clause id="idd229350dc5b24d6ca8eca6e56be2b375"><enum>(iii)</enum><text>recreation and tourism;</text></clause></subparagraph><subparagraph id="idc02e78d59c03408db33e3596c5a13bf2"><enum>(B)</enum><text>the community relationship to the water, including—</text><clause id="id336244cd2a9541f9ad490461503a0d92"><enum>(i)</enum><text>quality of life;</text></clause><clause id="idec1ecd50e045419b81647906b710a1d2"><enum>(ii)</enum><text>public health;</text></clause><clause id="id8c10b1df68e647deac45ad4657fd22c3"><enum>(iii)</enum><text>community and economic heritage, such as maritime and waterfront industries; and</text></clause><clause id="id20435f40666c4acfae6deb3a7eb1f90a"><enum>(iv)</enum><text>public access;</text></clause></subparagraph><subparagraph id="id1aa84a9d5a764854aab06c14a73fcd41"><enum>(C)</enum><text>the environment;</text></subparagraph><subparagraph id="idcfed5d398afd4d15a4806677e91c1d4e"><enum>(D)</enum><text>ecosystem challenges and projections, including—</text><clause id="id8af8c0383f644cebac1a37f55dccc692"><enum>(i)</enum><text>unresolved and emerging impacts to the health and safety of the applicable waterfront;</text></clause><clause id="id3b582733dcf44b16a178fa81a016267e"><enum>(ii)</enum><text>the impact of natural disasters and weather events on the physical and financial security of residents, based on forward-looking, long-term meteorological data; and</text></clause><clause id="id6dac46da51bc44d0b38cc2e407cad58f"><enum>(iii)</enum><text>projections for extreme weather and water conditions; </text></clause></subparagraph><subparagraph id="idf46a787eb70b4311a733179434fd0b9e"><enum>(E)</enum><text>infrastructure needs and opportunities, such as—</text><clause id="ide56c382fd7a44be4ac1042709d268070"><enum>(i)</enum><text>docks, piers, and harbor facilities;</text></clause><clause id="id4905eaf472974183a80ce7032aa85cf5"><enum>(ii)</enum><text>protection against storm surges, waves, and flooding; and</text></clause><clause id="id6303fdec9dfb46b78fdc682595cf8b09"><enum>(iii)</enum><text>natural infrastructure; and </text></clause></subparagraph><subparagraph id="id5334a18544ea4d08ba681ea4d1d4a488"><enum>(F)</enum><text>other community facilities and private development.</text></subparagraph></paragraph></subsection><subsection id="idaec8a16db0d246a69d765ba8f998976e"><enum>(d)</enum><header>Duration</header><text>After the designation of a community as a resilient waterfront community under subsection (a), a resilient waterfront community plan developed in accordance with this section shall have a duration effective for the 10-year period beginning on the date on which the Secretary approves the resilient waterfront community plan. </text></subsection><subsection id="idca3d8c28a57540e0bc7a4fdb6b2c212b"><enum>(e)</enum><header>Withdrawal of designation</header><text>A covered entity that represents a community that is designated as a resilient waterfront community under subsection (a) may submit a request at any time to the Secretary that such designation be withdrawn.</text></subsection><subsection id="id1f062e31fa514794814ec34f0377b464"><enum>(f)</enum><header>Updates</header><text>A resilient waterfront community plan under this section may be updated by a covered entity, and submitted to the Secretary for approval, before the expiration of the 10-year period described in subsection (d).</text></subsection><subsection id="id02e40ad7b2c44d6385987b82f54fa7ef"><enum>(g)</enum><header>Approval</header><text>The Secretary shall approve or disapprove a resilient waterfront community plan submitted under subsection (b), or an update to such plan submitted under subsection (f), by not later than 180 days after the date of receipt of the plan. </text></subsection></section><section id="id229aaac8437c4c97840d75f5c4b68790"><enum>54404.</enum><header>Resilient waterfront communities network</header><subsection id="ided7bcc22ce0c4647a72b6b164cd2e406"><enum>(a)</enum><header>In general</header><text>The Secretary shall develop and maintain a resilient waterfront communities network to facilitate the sharing of best practices among communities that have been designated as resilient waterfront communities under section 54403.</text></subsection><subsection id="id16486391edcf40d5a7e02be11891c628"><enum>(b)</enum><header>Public recognition</header><text>In consultation with designated resilient waterfront communities, the Secretary shall provide formal public recognition of the designated resilient waterfront communities to promote tourism, recreational activities, commercial investment, or other community benefits.</text></subsection><subsection id="id5b3bb85530dd4cd2923bf5fb07a2d5fa"><enum>(c)</enum><header>Website</header><text>The Secretary of Commerce shall establish, and update periodically, a publicly accessible website to provide information for communities—</text><paragraph commented="no" display-inline="no-display-inline" id="id3e3c210c6317487ebc0757ce79992835"><enum>(1)</enum><text display-inline="yes-display-inline">to access best practices in establishing a designation under section 54403, including—</text><subparagraph id="id431eca9a44a24c21bd01cc0c87c9e927"><enum>(A)</enum><text>the technological, economic, environmental, social, and cultural impacts of resiliency planning and investment;</text></subparagraph><subparagraph id="id3437c64702604698b1cc6c068b2b6e4f"><enum>(B)</enum><text>the barriers communities face to successfully planning, implementing, and achieving short, and long-term benefits from resiliency and revitalization activities, as well as solutions to diagnose, understand, and overcome those barriers; and</text></subparagraph><subparagraph id="id91864bc92b3a4a888d97b4f70f8465fa"><enum>(C)</enum><text>changing environmental and economic conditions and information on incorporating forward-looking projections into strategic community decision making; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide7b4d3bfc5ba4a4bbc01663c74c8c8e3"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA1F487E9A5864909B1DC897F676660BC"><paragraph commented="no" display-inline="no-display-inline" id="id0a708efb617747a5810c10b801626cf3"><enum>(3)</enum><header>Special grants for working waterfronts</header><subparagraph commented="no" display-inline="no-display-inline" id="id303ac407d21c4db8a0fca4c4705bf306"><enum>(A)</enum><header>In General</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, the Secretary may make special grants under this subsection to support covered entities (as defined in section 54401 of title 46, United States Code) for the purposes of—</text><clause id="id1b22f3bde7fe43aa9679184a1805df72"><enum>(i)</enum><text>development of the plan described under section 54403(b) of title 46, United States Code, including by—</text><subclause id="id9969cbadc7914d0e8f95113207e5dd74"><enum>(I)</enum><text>conducting economic and community development marketing and outreach;</text></subclause><subclause id="ida184026cced744349db9801369feea70"><enum>(II)</enum><text>updating zoning regulations;</text></subclause><subclause id="id431b0ab06cf04b3381bf3afbc084e679"><enum>(III)</enum><text>conducting environmental reviews;</text></subclause><subclause id="id789ec626e1944fc78b7e8d3f004607a8"><enum>(IV)</enum><text>completing engineering and landscape architecture design plans;</text></subclause><subclause id="id9159074ef94d422196d0fb31a72aa2d0"><enum>(V)</enum><text>collaborating across local agencies and regional, State, Tribal, and Federal agencies to identify, understand, and develop responses to changing ecosystems and economic circumstances; and</text></subclause><subclause id="id7b22f9d389504665825797a4e751f2c7"><enum>(VI)</enum><text>conducting such other planning activities as the Secretary considers to be necessary for the development of a resilient waterfront community plan that responds to revitalization and resiliency issues faced by such covered entity; </text></subclause></clause><clause id="id8739dc015e604b0e92d8ad06c9f18fca"><enum>(ii)</enum><text>carrying out projects that enable the execution of the plan described under section 54403(b) of title 46, United States Code, including—</text><subclause id="id239682378c4d490fb77ecb6fec78f2b7"><enum>(I)</enum><text>site preparation;</text></subclause><subclause id="id6785a1dcb7174057ba49d08411275744"><enum>(II)</enum><text>acquiring easements or land for uses such as green infrastructure, public amenities, or assembling development sites;</text></subclause><subclause id="id401a21f16fd74ca3872f1704445fc26a"><enum>(III)</enum><text>construction of—</text><item id="id1c9e4af6dead4616a05237756d3f5d1d"><enum>(aa)</enum><text>public waterfront or boating amenities; and</text></item><item id="idfafc83bff534467ba6e46d8ecf40cd8e"><enum>(bb)</enum><text>public spaces;</text></item></subclause><subclause id="id33555f0b88d0414ea0aaedee2a41c669"><enum>(IV)</enum><text>infrastructure upgrades to improve coastal resiliency, including green infrastructure; and</text></subclause><subclause id="id9186cb90ce2b438293960a7a0559aece"><enum>(V)</enum><text>other activities, at the discretion of the Secretary; and </text></subclause></clause><clause commented="no" id="id597cda7c4d1a435b888912d29d5caf17"><enum>(iii)</enum><text>executing other projects that are consistent with the plan described under section 54403(b) of title 46, United States Code.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee5a1d9144954b04b652534b70811628"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph: </text><clause commented="no" display-inline="no-display-inline" id="id9109f687f65b4254bb81dbb6d38c3dfa"><enum>(i)</enum><header>Title 46 terms</header><text display-inline="yes-display-inline">The terms <term>covered entity</term>, <term>resilient</term>, and <term>working waterfront</term> have the meanings given those terms in section 54401 of title 46, United States Code.</text></clause><clause commented="no" display-inline="no-display-inline" id="id8e0c3337d8704ec6a1b53b96e2e4c94c"><enum>(ii)</enum><header>Project</header><text>The term <term>project</term> has the meaning given that term in section 54401 of title 46, United States Code, except that such term shall only apply to activities—</text><subclause commented="no" display-inline="no-display-inline" id="id3CE84D1F92FE402EBA786E5EF8B4553D"><enum>(I)</enum><text display-inline="yes-display-inline">within the boundary of a working waterfront; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id603DAA02CB794AF0909CDC12F3477EA8"><enum>(II)</enum><text display-inline="yes-display-inline">outside the boundary of a working waterfront, if the projects are directly related to the working waterfront or such plan. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc3865830ff54b10adc68e2925f70fde"><enum>(C)</enum><header>Eligibility; terms and conditions</header><clause commented="no" display-inline="no-display-inline" id="id4d011c7a55b34230ac9e203301d86ef2"><enum>(i)</enum><header>Eligibility and procedure</header><text display-inline="yes-display-inline">The provisions of subsection (c) shall apply with respect to grants under this paragraph, except that only covered entities shall be eligible to receive a grant under this paragraph. Notwithstanding such subsection (c), the Secretary shall not be required to prescribe application requirements and procedures for grants under this paragraph by regulation.</text></clause><clause commented="no" display-inline="no-display-inline" id="id4c828aa0ac7c4f319e54117b23acf875"><enum>(ii)</enum><header>Terms and conditions</header><text display-inline="yes-display-inline">Paragraphs (1) through (3) of subsection (d) shall not apply with respect to grants under this paragraph.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id184d64d5de69407194152ecb58451d76"><enum>(D)</enum><header>Project selection criteria</header><clause commented="no" display-inline="no-display-inline" id="id5d1078cd6d864e9a9da727611ce14f8a"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may select a project described in this paragraph for funding under this subsection if the Secretary determines that—</text><subclause commented="no" display-inline="no-display-inline" id="id798206e94e6d4be3b383218a730a76bd"><enum>(I)</enum><text display-inline="yes-display-inline">the project is consistent with the plan under section 54403(b) of title 46, United States Code;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida22d0b12888e421b828d08b74fb450f0"><enum>(II)</enum><text display-inline="yes-display-inline">the covered entity has authority to carry out the project;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7372dd16ac46471fb5a0cc3cf4336ec3"><enum>(III)</enum><text display-inline="yes-display-inline">the covered entity has sufficient funding to execute the project or phase of the project;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1d5ca9fae4e84e609fe65cda3b6e5b2d"><enum>(IV)</enum><text display-inline="yes-display-inline">the project will be completed without unreasonable delay; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc84586e929fc4e1590a133aac0e2a947"><enum>(V)</enum><text display-inline="yes-display-inline">the project cannot be easily and efficiently completed without Federal funding or financial assistance available to the covered entity.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3ec2cb7a691d42179419a0eeb8262a72"><enum>(ii)</enum><header>Additional considerations</header><text display-inline="yes-display-inline">In selecting projects described in this paragraph for funding under this subsection, the Secretary shall give consideration to—</text><subclause commented="no" display-inline="no-display-inline" id="id3ef66151dafb4a1d9770f794890b9965"><enum>(I)</enum><text display-inline="yes-display-inline">the utilization of non-Federal contributions; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb89fe23167334664a9b80dd709ff252d"><enum>(II)</enum><text display-inline="yes-display-inline">the net benefits of the funds awarded under this subsection.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75cf3407a89b4cd28b338742362d0584"><enum>(E)</enum><header>Procedural safeguards</header><text display-inline="yes-display-inline">The Secretary shall issue guidelines to establish appropriate accounting, reporting, and review procedures for grants made under this paragraph to ensure that—</text><clause commented="no" display-inline="no-display-inline" id="id9285c8e887154a8fa6c779f6b92ec00a"><enum>(i)</enum><text display-inline="yes-display-inline">grant funds are used for the purposes for which those funds were made available; </text></clause><clause commented="no" display-inline="no-display-inline" id="idbbf95fae10914d189fe00ed416707760"><enum>(ii)</enum><text display-inline="yes-display-inline">each grantee properly accounts for all expenditures of grant funds; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id2331c502687247c99a3436f4321d352d"><enum>(iii)</enum><text display-inline="yes-display-inline">grant funds not used for such purposes and amounts not obligated or expended are returned.</text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida82a1c8f1e4a48cabfb21c9f7b273ff9"><enum>(d)</enum><header display-inline="yes-display-inline">Technical amendments</header><text>Section 205 of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1124">33 U.S.C. 1124</external-xref>) is further amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0f7a697b9e0b4b9c86f551bcbec1404d"><enum>(1)</enum><text>in subsection (c), by striking <quote>Any person</quote> and inserting <quote>Subject to subsection (b)(3), any person</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id295261a66e414cc798d1091408c9ac3e"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>Any grant</quote> and inserting <quote>Subject to subsection (b)(3), any grant</quote>.</text></paragraph></subsection></section><section id="ida5f9343b8b1c449b934912921d3cf213"><enum>3.</enum><header>Resilient waterfront communities report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report describing—</text><paragraph commented="no" display-inline="no-display-inline" id="id331863af650146389cd393c957a547e5"><enum>(1)</enum><text display-inline="yes-display-inline">the participation in the program of designating resilient waterfront communities under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/544">chapter 544</external-xref> of title 46, United States Code, the results of such program, and the Secretary's plans to improve outreach, implementation, and best practice guidance regarding such program; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d572feab7c04e2ab5f89b593162e287"><enum>(2)</enum><text display-inline="yes-display-inline">the participation in the program of special grants for working waterfronts described in paragraph (3) of section 205(b) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1124">33 U.S.C. 1124(b)</external-xref>), the results of such program, and the Secretary's plans to improve outreach, implementation, and best practice guidance regarding such program. </text></paragraph></section></legis-body></bill>
