which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote the provision of exercise or fitness equipment, and exercise or fitness classes and instruction, that are accessible to individuals with disabilities.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEC17549762D84FEA81B685F1603B2AE9"><section section-type="section-one" id="H4B439CD3B7D949DD96BA70CBAADDFD5E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Exercise and Fitness for All Act of 2024</short-title></quote>.</text></section><section id="H8E00DF00893B40D48C2654B71767D4AE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id3ea0f5707cd94fb8b7ec203856b42122"><enum>(1)</enum><header>Access board</header><text>The term <term>Access Board</term> means the Architectural and Transportation Barriers Compliance Board established under section 502 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/792">29 U.S.C. 792</external-xref>).</text></paragraph><paragraph id="id7338b9ffd7864d6da8cf827d6d7bc123"><enum>(2)</enum><header>Accessible exercise machines and equipment</header><text>The term <term>accessible exercise machines and equipment</term>—</text><subparagraph id="id2963b1764d284956ba13540343470d5c"><enum>(A)</enum><text>means exercise machines and equipment that—</text><clause id="idD55EA3BC6D1C45ABA63C5176E9E0D35C"><enum>(i)</enum><text>are accessible to, and can be independently used and operated by, individuals with disabilities; and </text></clause><clause id="idD1A686B3341C4CF1BC825B150166B3FB"><enum>(ii)</enum><text>are considered a fixed or built-in element of a facility; and</text></clause></subparagraph><subparagraph id="idc4e72078c7774444b1c2cff19aca66cb"><enum>(B)</enum><text>includes equipment—</text><clause id="id60DC83D1215A4ACCB502455E18E491A4"><enum>(i)</enum><text>that complies with the American Society for Testing and Materials (referred to in this section as <quote>ASTM</quote>) Standard Specification for Universal Design of Fitness Equipment for Inclusive Use by Persons with Functional Limitations and Impairments, ASTM F3021–17 (or any corresponding similar ASTM standard); and</text></clause><clause id="id11ed9d43ec7c47e38aab48733b2439e2"><enum>(ii)</enum><text>that complies with other ASTM standards with specifications for inclusive use of specific exercise machines or equipment.</text></clause></subparagraph></paragraph><paragraph id="id7038a038ab9a4380bc8e6149b3fc090a"><enum>(3)</enum><header>Exercise machines and equipment</header><text>The term <term>exercise machines and equipment</term> means devices such as motorized treadmills, stair climbers or step machines, stationary bicycles, rowing machines, weight machines, circuit training equipment, cardiovascular equipment, strength equipment, or other similar equipment.</text></paragraph><paragraph id="idfbccccf458f34052851daf570c79fa9c"><enum>(4)</enum><header>Exercise or fitness service provider</header><text>The term <term>exercise or fitness service provider</term>—</text><subparagraph id="id6bebce8ab2fd4fa2997fdb1dd50ccad6"><enum>(A)</enum><text>means an entity that—</text><clause id="id3357556ced694959891d4e4f58cab737"><enum>(i)</enum><text>provides exercise machines and equipment, or exercise or fitness instruction, including in individual or group formats, such as personal training, nutrition coaching, exercise or fitness classes or clubs, for the use of patrons; and</text></clause><clause id="idfcabf04c0908460b8339014bf2a27643"><enum>(ii)</enum><text>is considered a public accommodation under section 301 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181</external-xref>) or is considered a public entity under section 201 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131</external-xref>); and</text></clause></subparagraph><subparagraph id="id8024f58979c1485f8cd2a4afdfed9b1d"><enum>(B)</enum><text>includes a stand-alone exercise or fitness center and an exercise or fitness center within an entity such as a hotel, retirement community, gymnasium, elementary or secondary school, or institution of higher education.</text></subparagraph></paragraph><paragraph id="id0c63637efcef42058ff886be53b78693"><enum>(5)</enum><header>Individual with a disability</header><text>The term <term>individual with a disability</term> means any person with a disability as defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph></section><section id="id619a1f77bec24cc8917e9f8de5270279"><enum>3.</enum><header>Exercise and fitness accessibility guidelines and regulations</header><subsection id="id0d7640e690284e6c8da24aa30eed3788"><enum>(a)</enum><header>Establishment of guidelines</header><text>Not later than 18 months after the date of enactment of this Act, the Access Board shall develop and publish guidelines for accessible exercise machines and equipment and for exercise or fitness service providers.</text></subsection><subsection id="idef4afb60f56d474cba0294d824d67771"><enum>(b)</enum><header>Contents of guidelines</header><text>The guidelines described in subsection (a) shall specify for accessible exercise machines and equipment provided by an exercise or fitness service provider—</text><paragraph id="idb35f5244832d44beb0d11cac68533f7c"><enum>(1)</enum><text>the scope of coverage of the guidelines; </text></paragraph><paragraph id="id79e3874c43df4e60b8296f645823df0c"><enum>(2)</enum><text>the appropriate number of items and types of accessible exercise machines and equipment;</text></paragraph><paragraph id="id228be8563ab642d99f31b0c82b4ee2a1"><enum>(3)</enum><text>the placement of such machines and equipment within a facility and among similar types of machines and equipment; and</text></paragraph><paragraph id="id7e426357d3be4c9987e7b8d90532bea9"><enum>(4)</enum><text>communications features, such as closed captioning on monitors, audible output of visual content for people who are blind or have low vision, visual indications of information conveyed audibly, and controls for people with limited dexterity or mobility.</text></paragraph></subsection><subsection id="id71101f1fde1e4cf8b4644720c2cbce86"><enum>(c)</enum><header>Review and amendment</header><text>The Access Board shall periodically review and, as appropriate, amend the guidelines, and shall issue the resulting guidelines as revised guidelines.</text></subsection><subsection id="id6fdcc47f1e6c4322bd77fc49f31d275c"><enum>(d)</enum><header>Regulations</header><paragraph id="idae0622ee690f4c75a20de8215f68ae78"><enum>(1)</enum><header>In general</header><text>Pursuant to titles II and III of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12131">42 U.S.C. 12131 et seq.</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181 et seq.</external-xref>) regarding the accessibility of public entities and public accommodations, respectively, not later than 18 months after the Access Board issues guidelines under this section, the Department of Justice shall issue regulations regarding the provision of accessible exercise machines and equipment and accessibility of exercise or fitness instruction.</text></paragraph><paragraph id="id177bbf4f5e1b4a0fa15c3f2066215d29"><enum>(2)</enum><header>Exercise machines and equipment</header><text>With respect to the provision of exercise machines and equipment, the regulations shall be consistent with the Access Board guidelines.</text></paragraph><paragraph id="id49650e62ea7d4d6a9b5bb36a63f3cf20"><enum>(3)</enum><header>Exercise or fitness instruction</header><text>The regulations shall—</text><subparagraph id="id28aec1f7b297497cbf2eed879fc3c73e"><enum>(A)</enum><text>ensure that exercise or fitness instruction offered by the exercise or fitness service provider are accessible to individuals with disabilities; </text></subparagraph><subparagraph id="ida204a33e5b794804b7d02ff796b83809"><enum>(B)</enum><text>ensure that the exercise or fitness service provider makes available during operating hours at least one employee trained to provide assistance to individuals with disabilities in their use of exercise machines and equipment, including accessible machines and equipment; and</text></subparagraph><subparagraph id="ida0a23af7440c4435985bbcac9107605d"><enum>(C)</enum><text>ensure that exercise or fitness service providers notify individuals with disabilities, in an appropriate and accessible manner, about the availability of such assistance specified in subparagraph (B), including providing information on how individuals with disabilities can request such assistance.</text></subparagraph></paragraph><paragraph id="id5ac055fe2ca4477c96ddec7c035c622c"><enum>(4)</enum><header>Considerations</header><text>In issuing the regulations, the Department of Justice shall take into consideration each of the following:</text><subparagraph id="id5f7c5c9e0eb24a4299e6c8bd7cde8967"><enum>(A)</enum><text>Whether the exercise or fitness service provider is providing exercise machines and equipment or instruction at a new or existing facility.</text></subparagraph><subparagraph id="ide32a3402a2bd4c2a868cf306908013df"><enum>(B)</enum><text>The physical size of the exercise or fitness facility, as well as the number of patrons served at the facility.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
