which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Patient Protection and Affordable Care Act to reduce fraudulent enrollments in qualified health plans, and for other purposes.</official-title></form><legis-body id="HCE2A1E7E92C6456E9D505B3DED1EC863"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Insurance Fraud Accountability Act</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" id="id79fd3b613f2d40d09821df571a3e95a9"><enum>2.</enum><header>Reduction of fraudulent enrollment in qualified health plans</header><subsection id="idaccdb942862046a5bc0ad110b7cb1149"><enum>(a)</enum><header>Penalties for agents and brokers</header><text>Section 1411(h)(1) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18081">42 U.S.C. 18081(h)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id145fb8ae6b934eabbbd65587c13b0756"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id11f75607065c406bb09f8bfbb1c4218c"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clause (ii) as clause (iv);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddae7105d330a46e2ac96f1eeb899aa52"><enum>(B)</enum><text>in clause (i)—</text><clause commented="no" display-inline="no-display-inline" id="id3f2d114b82a44d228754bad3ab9c7386"><enum>(i)</enum><text display-inline="yes-display-inline"> in the matter preceding subclause (I), by striking <quote>If—</quote> and all that follows through the <quote>such person</quote> in the matter following subclause (II) and inserting the following: <quote>If any person (other than an agent or broker) fails to provide correct information under subsection (b) and such failure is attributable to negligence or disregard of any rules or regulations of the Secretary, such person</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id337f8ea736224dbab6f12d67d4cd35af"><enum>(ii)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>For purposes</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id03A9CAC52930445CBEDD0FE197D5DE2B"><clause commented="no" display-inline="no-display-inline" id="id987ec2a457844f598887e05840c0b7a4"><enum>(iii)</enum><header>Definitions of negligence, disregard</header><text>For purposes</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8068dc9564864f67b9e93179c9efda39"><enum>(C)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id701CCAB1EAFB4F9B9D1FC5A9ED870639"><clause commented="no" display-inline="no-display-inline" id="ide2a675e3cd0b4a2698dbb8e77a89bfbc"><enum>(ii)</enum><header>Civil penalties for certain violations by agents or brokers</header><text display-inline="yes-display-inline">If any agent or broker fails to provide correct information under subsection (b) or section 1311(c)(8) or other information, as specified by the Secretary, and such failure is attributable to negligence or disregard of any rules or regulations of the Secretary, such agent or broker shall be subject, in addition to any other penalties that may be prescribed by law, including subparagraph (C), to a civil penalty of not less than $10,000 and not more than $50,000 with respect to each individual who is the subject of an application for which such incorrect information is provided. </text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfd7688966984215a467f5d7a660f7cc"><enum>(D)</enum><text>in clause (iv) (as so redesignated), by inserting <quote>or (ii)</quote> after <quote>clause (i)</quote>; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9916cc587b6f4dd99939223c2dfc011b"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7eca8895758a4885bf610f6ef44235a0"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>including subparagraph (C),</quote> after <quote>law,</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08e6945789564b60bb955df047799d9b"><enum>(B)</enum><text>by striking <quote>Any person</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id75B953ECF2ED4FD1ADD571400674661B"><clause commented="no" display-inline="no-display-inline" id="idf1a3f6a7f4784ae2983519c5e14925d4"><enum>(i)</enum><header>In general</header><text>Any person</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id2902f85a3d5b4888bdbfa48f92eb729a"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id945A9E9188D44973A23DEEFA46751DEB"><clause id="idab85263eaaa14266b39cc0626f2c2891"><enum>(ii)</enum><header>Civil penalties for knowing violations by agents or brokers</header><subclause commented="no" display-inline="no-display-inline" id="idca7da49dc26b47109d6bab12cccd15f7"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text>Any agent or broker who knowingly provides false or fraudulent information under subsection (b) or section 1311(c)(8), or other false or fraudulent information as part of an application for enrollment in a qualified health plan offered through an Exchange, as specified by the Secretary, shall be subject, in addition to any other penalties that may be prescribed by law, including subparagraph (C), to a civil penalty of not more than $200,000 with respect to each individual who is the subject of an application for which such false or fraudulent information is provided.</text></subclause><subclause id="id72e52fc7a3934d95a8791fced7a02414"><enum>(II)</enum><header>Procedure</header><text>The provisions of section 1128A of the Social Security Act (other than subsections (a) and (b) of such section) shall apply to a civil monetary penalty under subclause (I) in the same manner as such provisions apply to a penalty or proceeding under section 1128A of the Social Security Act.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida81f0ee0b9eb4705a32e94602a5740ca"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB4038C115DA94593B7B11224F28E1FEE"><subparagraph commented="no" display-inline="no-display-inline" id="id4ab079ba47074bb5825a18c865aa8561"><enum>(C)</enum><header display-inline="yes-display-inline">Criminal penalties</header><text display-inline="yes-display-inline">Any agent or broker who knowingly and willfully provides false or fraudulent information under subsection (b) or section 1311(c)(8), or other false or fraudulent information as part of an application for enrollment in a qualified health plan offered through an Exchange, as specified by the Secretary, shall be fined under title 18, United States Code, imprisoned for not more than 10 years, or both.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id008b6eafc94a4612a889e82c950ff7e7"><enum>(b)</enum><header>Consumer protections</header><paragraph commented="no" display-inline="no-display-inline" id="iddb3a438e43224b579d022241d7f2d765"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1311(c) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAAF6862EC5EF4A1ABB7D5F08BC87CD57"><paragraph id="id27fdd5d1408f4a2b9d817a7df4ed6cdb" commented="no"><enum>(8)</enum><header>Agent- or broker-assisted enrollment in qualified health plans in certain exchanges</header><subparagraph commented="no" display-inline="no-display-inline" id="id995bc281e03e470f8ca02affb6453caf"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For plan years beginning on or after such date specified by the Secretary, but not later than January 1, 2028, in the case of an Exchange that the Secretary operates pursuant to section 1321(c)(1), the Secretary shall establish a verification process for new enrollments of individuals in, and changes in coverage for individuals under, a qualified health plan offered through such Exchange, which are submitted by an agent or broker in accordance with section 1312(e) and for which the agent or broker is eligible to receive a commission. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b302cde6f6e4317af88eb4d98e1cd4f"><enum>(B)</enum><header>Requirements</header><text>The enrollment verification process under subparagraph (A) shall include—</text><clause id="id079367d8707c4d2b946901859bc05934"><enum>(i)</enum><text>a requirement that the agent or broker provide with the new enrollment or coverage change such documentation or evidence (such as a standardized consent form) or other sources as the Secretary determines necessary to establish that the agent or broker has the consent of the individual for the new enrollment or coverage change;</text></clause><clause id="idf2543d13ed6e401fb6899925d43d49a8"><enum>(ii)</enum><text>a requirement that any commissions due to a broker or agent for such new enrollment or coverage change are paid after the enrollee has resolved all inconsistencies in accordance with paragraphs (3) and (4) of section 1411(e);</text></clause><clause id="id6f68a7a4296c462aac895f4883dd0628"><enum>(iii)</enum><text>a requirement that the information required under clause (i) and, as applicable, the date on which inconsistencies are resolved as described in clause (ii), is accessible to the applicable qualified health plan through a database or other resource, as determined by the Secretary, so that any commissions due to a broker or agent for such enrollment can be effectuated at the appropriate time;</text></clause><clause id="iddb21cc05608b4ec2a545b51cf7e2a05c"><enum>(iv)</enum><text>a requirement that individuals are notified of any changes to enrollment, coverage, the agent of record, or premium tax credits in a timely manner and that such notice provides plain language instructions on how individuals can cancel unauthorized activity;</text></clause><clause id="idcc8420a3473a4228ae61557bb251db12" commented="no"><enum>(v)</enum><text>a requirement that individuals be able to access their account information on a website or other technology platform, as defined by the Secretary, when used to submit an enrollment or plan change, in lieu of the Exchange website described in subsection (d)(4)(C), including information on the agent of record, the qualified health plan, and when any changes are made to the agent of record or the qualified health plan, on a consumer-facing website or through a toll-free telephone hotline; and </text></clause><clause id="id074761100ccb4365bac71e58110e69ec"><enum>(vi)</enum><text>a requirement that the agent or broker report to the Secretary any third-party marketing organization or field marketing organization (as such terms are defined in section 1312(e)) involved in the chain of enrollment (as so defined) with respect to such new enrollment or coverage change.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1d3e6559c4e94d47a4c8986010861394"><enum>(C)</enum><header>Consumer protection</header><text display-inline="yes-display-inline">The Secretary shall ensure that the enrollment verification process under subparagraph (A) prioritizes continuity of coverage and care for individuals, including by not disenrolling individuals from a qualified health plan without the consent of the individual, regardless of whether the broker, agent, or qualified health plan is in violation of any requirement under this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13277118ee3c4410ac8a720fcf2083b0"><enum>(2)</enum><header>Required reporting</header><text>Section 1311(c)(1) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(c)(1)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida4d0e76398454dc787068edd462f12ca"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c6099d580d34435996059fadc5116cd"><enum>(B)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf96e0853206449bad7d806dc2d60f6e"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9F89FFFF44C549A49B46B5B73F13D0D1"><subparagraph commented="no" display-inline="no-display-inline" id="id08ded3bc90fc45508b714ce8bcf33e0e"><enum>(J)</enum><text>report to the Secretary the termination (as defined in section 1312(e)(4)(C)) of an issuer.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida809280ce4944448903194f364850710"><enum>(c)</enum><header>Authority to regulate field marketing organizations and third-Party marketing organizations</header><text>Section 1312(e) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18032">42 U.S.C. 18032(e)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcdeb6b0e53ed4656964410d38f422bbc"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subclauses (I) and (II), respectively, and adjusting the margins accordingly; </text></paragraph><paragraph id="id6509d7dfbae845b89ec02484376ece30"><enum>(2)</enum><text>in subclause (II) (as so redesignated), by striking the period at the end and inserting <quote>; and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd903d014c9dd470abb67733058cf81ac"><enum>(3)</enum><text>by striking the subsection designation and heading and all that follows through <quote>brokers—</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id08AAFE182BE54F2E92EEFF483CF8DBF1"><subsection commented="no" display-inline="no-display-inline" id="id8a52df4d850e47808e0bf721b434ecb3"><enum>(e)</enum><header>Regulation of agents, brokers, and certain marketing organizations</header><paragraph commented="no" display-inline="no-display-inline" id="id5bd09fe59df64517a233c6b4850c9e14"><enum>(1)</enum><header display-inline="yes-display-inline">Agents, brokers, and certain marketing organizations</header><subparagraph commented="no" display-inline="no-display-inline" id="idc421bef8d7b94f5d911c2472e87b18c9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall establish procedures under which a State may allow—</text><clause commented="no" display-inline="no-display-inline" id="ida420ca683c854653a7b533e9fd5febb3"><enum>(i)</enum><text display-inline="yes-display-inline">agents or brokers—</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49f63fbbdd7b475ba4b8db066282567c"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE80913D1DFD042638BA8A2B472DE53AA"><clause commented="no" display-inline="no-display-inline" id="ide637e9b59851427182a5b74d1c672bad"><enum>(ii)</enum><text>field marketing organizations and third-party marketing organizations to participate in the chain of enrollment for an individual with respect to qualified health plans offered through an Exchange.</text></clause><subparagraph commented="no" display-inline="no-display-inline" id="ida925f07eacf94372b8031710dc8a0440"><enum>(B)</enum><header>Criteria</header><text display-inline="yes-display-inline">For plan years beginning on or after such date specified by the Secretary, but not later than January 1, 2028, the Secretary, by regulation, shall establish criteria for States to use in determining whether to allow agents and brokers to enroll individuals and employers in qualified health plans as described in subclause (I) of subparagraph (A)(i) and to assist individuals as described in subclause (II) of such subparagraph and field marketing organizations and third-party marketing organizations to participate in the chain of enrollment as described in subparagraph (A)(ii). Such criteria shall, at a minimum, require that—</text><clause id="id8698a5381a994a54bedbff257aadd995"><enum>(i)</enum><text>an agent or broker act in accordance with a standard of conduct that includes a duty of such agent or broker to act in the best interests of the enrollee;</text></clause><clause commented="no" display-inline="no-display-inline" id="id822a7bcfcfa94cfa8045646b835adb63"><enum>(ii)</enum><text>a field marketing organization or third-party marketing organization agree to report the termination of an agent or broker to the applicable State and the Secretary, including the reason for termination; and</text></clause><clause id="idf77f815bb18d4047afcb37e7011c51f6"><enum>(iii)</enum><text>an agent, broker, field marketing organization, or third-party marketing organization—</text><subclause commented="no" display-inline="no-display-inline" id="id776cc7dae8b14e578447c18f3dda8c61"><enum>(I)</enum><text display-inline="yes-display-inline">meet such marketing requirements as are required by the Secretary; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbd298381bf864c78b036ad7bd240ac5f"><enum>(II)</enum><text display-inline="yes-display-inline">meet marketing requirements in accordance with other applicable Federal or State law;</text></subclause><subclause id="id3c9ad9f3a2054d4b8f862f1cd18cf88c"><enum>(III)</enum><text>does not employ practices that are confusing or misleading, as determined by the Secretary;</text></subclause><subclause id="id3201828385904e29afa995ca081ebad0"><enum>(IV)</enum><text>submit all marketing materials to the Secretary for, as determined appropriate by the Secretary, review and approval;</text></subclause><subclause id="id48232f1fc3a84602969dd8ec532b1f59"><enum>(V)</enum><text>is a licensed agent or broker or meets other licensure requirements, as required by the State;</text></subclause><subclause id="idfdad56c5795c442c8b61fc1f7ad6d038"><enum>(VI)</enum><text>register with the Secretary; and</text></subclause><subclause id="id61aa5d64fd1a470783c965642378c4ca"><enum>(VII)</enum><text>does not compensate any individual or organization for referrals or any other service relating to the sale of, marketing for, or enrollment in qualified health plans unless such individual or organization meets the criteria described in subclauses (I) through (VI). </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id200c258b3d044206937b2db50a1dafce"><enum>(C)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="idaaa65913f4364615b9d40c2b7b38308d"><enum>(i)</enum><header>Chain of enrollment</header><text>The term <term>chain of enrollment</term>, with respect to enrollment of an individual in a qualified health plan offered through an Exchange, means any steps taken from marketing to such individual, to such individual making an enrollment decision with respect to such a plan. </text></clause><clause commented="no" display-inline="no-display-inline" id="id16c972698b294cf1980b93b472fc5487"><enum>(ii)</enum><header>Field marketing organization</header><text>The term <term>field marketing organization</term> means an organization or individual that directly employs or contracts with agents and brokers, or contracts with carriers, to provide functions relating to enrollment of individuals in qualified health plans offered through an Exchange as part of the chain of enrollment.</text></clause><clause id="id8f2396972c224c9f90fb14fef624efe0"><enum>(iii)</enum><header>Marketing</header><text>The term <term>marketing</term> means the use of marketing materials to provide information to current and prospective enrollees in a qualified health plan offered through an Exchange.</text></clause><clause commented="no" display-inline="no-display-inline" id="idbb8fc3ca106e436184e6d7b2d89083f0"><enum>(iv)</enum><header>Marketing materials</header><text display-inline="yes-display-inline">The term <term>marketing materials</term> means materials relating to a qualified health plan offered through an Exchange or benefits offered through an Exchange that—</text><subclause commented="no" display-inline="no-display-inline" id="id82849a7c598c4bc1b85002a91231b723"><enum>(I)</enum><text display-inline="yes-display-inline">are intended—</text><item id="id211b39bde07848f682a87952dc5c4af9"><enum>(aa)</enum><text>to draw an individual’s attention to such plan or the premium tax credits or cost-sharing reductions for such plan or plans offered through an Exchange;</text></item><item id="id269ae592cddc4443b8de1179e1609c78"><enum>(bb)</enum><text>to influence an individual’s decision-making process when selecting a qualified health plan in which to enroll; or</text></item><item id="id02139053c6004000a8923a44aa9dc51f"><enum>(cc)</enum><text>to influence an enrollee’s decision to stay enrolled in such plan; and </text></item></subclause><subclause id="idb73156224f10498db67bed27409a4216"><enum>(II)</enum><text>include or address content regarding the benefits, benefit structure, premiums, or cost sharing of such plan.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id08880c40a8a94efb8b3d1defb0f6139d"><enum>(v)</enum><header>Termination</header><text display-inline="yes-display-inline">The term <term>termination</term>, with respect to a contract or business arrangement between an agent or broker and a field marketing organization, third-party marketing organization, or health insurance issuer, means—</text><subclause commented="no" display-inline="no-display-inline" id="idbcfc48caad324068b95ba8ebfe0a7083"><enum>(I)</enum><text display-inline="yes-display-inline">the ending of such contract or business arrangement, either unilaterally by one of the parties or on mutual agreement; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4841f9edde504f09a7edab8b55977de3"><enum>(II)</enum><text>the expiration of such contract or business arrangement that is not replaced by a substantially similar agreement. </text></subclause></clause><clause id="id021f61eaff614828838d97600347011b" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><header>Third-party marketing organization</header><text>The term <term>third-party marketing organization</term> means an organization or individual that is compensated to perform lead generation, marketing, or sales relating to enrollment of individuals in qualified health plans offered through an Exchange as part of the chain of enrollment.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb5e850d5227a4d9281acade913297b91"><enum>(d)</enum><header>Transparency</header><text display-inline="yes-display-inline">Section 1312(e) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18032">42 U.S.C. 18032(e)</external-xref>) (as amended by subsection (c)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC430FB4355BD41C4B8B603232A19255C"><paragraph id="idff90f5eca2e04455a78e7dcf61073c49"><enum>(2)</enum><header>Audits</header><subparagraph commented="no" display-inline="no-display-inline" id="idbf6bdc08d3d74b34adb8086cb76d8a57"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For plan years beginning on or after such date specified by the Secretary, but not later than January 1, 2028, the Secretary, in coordination with the States and in consultation with the National Association of Insurance Commissioners, shall implement a process for the oversight and enforcement of agent and broker compliance with this section and other applicable Federal and State law (including regulations) that shall include—</text><clause id="id3bd05353a572432c8c33ab9784379692"><enum>(i)</enum><text>periodic audits of agents and brokers based on—</text><subclause id="idbcd70dc50fce4d438a3a24594c795f11"><enum>(I)</enum><text>complaints filed with the Secretary by individuals enrolled by such an agent or broker in a qualified health plan offered through an Exchange; </text></subclause><subclause id="id427e9b0ecc2e4303b8ad8fd95e53e0d5"><enum>(II)</enum><text>an incident or enrollment pattern that suggests fraud; and</text></subclause><subclause id="iddd48ad69f8f74e7a95512ac9be5a4597"><enum>(III)</enum><text>other factors determined by the Secretary; and</text></subclause></clause><clause id="idbb20822f345d4cfb8375c5ae019a14f9"><enum>(ii)</enum><text>a process under which the Secretary shall share audit results and refer potential cases of fraud to the relevant State department of insurance.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27ef2390576f4b81996fbf37e3f197bf"><enum>(B)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this paragraph limits or restricts any referrals made under section 1311(i)(3) or any enforcement actions under section 1411(h)<italic>.</italic></text></subparagraph></paragraph><paragraph id="id83f1417b03534be68468d1326fcbbe50"><enum>(3)</enum><header>List</header><text>The Secretary shall develop a process to regularly provide to qualified health plans, Exchanges, and States a list of suspended and terminated agents and brokers.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section></legis-body></bill>
