<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4751</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240723">July 23, 2024</action-date><action-desc><sponsor name-id="S337">Mr. Coons</sponsor> (for himself, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S422">Mr. Welch</cosponsor>, and <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to establish and clarify the applicable statute of limitations for seeking remedy for a legal wrong due to agency action, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agency Stability Restoration Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida8f2773a2b5f4610af90f54ed533c114"><enum>2.</enum><header>Right of review</header><subsection commented="no" display-inline="no-display-inline" id="id4cb3fc71e7ab4e41ab3a3f109b7144ab"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 702 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id65b949f5f75d454a8c59e40ae9b3e423"><enum>(1)</enum><text>in the first sentence, by striking <quote>A person</quote> and inserting the following:</text><quoted-block id="idDA203619CA434A1E98E2702AFD6DCEF1" style="OLC" act-name=""><subsection id="idB37AC1C1FADB40E1868F599BB45C5DA6"><enum>(a)</enum><header>In general</header><text>A person</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86b15ac0a1844fcd8b3007f49e06a5d0"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="idD2CADD50156443449DE33508C4540479" style="OLC" act-name=""><subsection id="idCB7BD76589B346CEADA0335E705E2710"><enum>(b)</enum><header>Statute of limitations</header><text>Except as otherwise expressly provided by law, a person bringing an action under this section shall bring that action not later than 6 years after the date of the final agency action with respect to which the person seeks judicial review.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="ide1f010ed276c4581823a6522eca6c04b"><enum>(b)</enum><header>Technical and conforming amendment</header><text>Section 2401(a) of title 28, United States Code, is amended, in the first sentence, by inserting <quote>or section 702(b) of title 5</quote> after <quote>title 41</quote>.</text></subsection></section></legis-body></bill>
