which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the Long-Term Care Ombudsman program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Advocacy for Long-Term Care Residents Act</short-title></quote>.</text></section><section id="idf681bc1943804cdbafcf0c41229928bd"><enum>2.</enum><header>Improving training of volunteers under the State Long-Term Care Ombudsman Program</header><text display-inline="no-display-inline">Section 712 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3058g">42 U.S.C. 3058g</external-xref>) is amended—</text><paragraph id="ideb2eb1c9c8c849369ae679eeadc14c34"><enum>(1)</enum><text>in subsection (h)(5)—</text><subparagraph id="id9137488cbe3c431c8d67c61528b2973e"><enum>(A)</enum><text>in the matter preceding subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id6e35c404b35a4f30bd5d20aeed1da4d0"><enum>(i)</enum><text>by striking <quote>the representatives</quote> and inserting <quote>each type of representative</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idaeaf4609c7004aa1905551e4d8551ac7"><enum>(ii)</enum><text>by inserting <quote>types of</quote> before <quote>unpaid volunteers</quote>; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4da97371b19e463b8235b1f348db0297"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>for each such type of representative</quote> before the semicolon at the end;</text></subparagraph><subparagraph id="id3be0f22676f247f0a5478fad962b633d"><enum>(C)</enum><text>in subparagraph (B)(iii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide96e5c7b7d9c4c87a6659844206b7073"><enum>(D)</enum><text>in subparagraph (C), by adding <quote>and</quote> at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60c0255178a646aba0c1a9e05b0a8976"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0DBCD445863843229FFB4F7F1FC2E1E6"><subparagraph id="idc54d59584cc845d99c24d85ec8dd5827"><enum>(D)</enum><text>with respect to representatives of the Office who are unpaid volunteers, take into consideration the degree to which each such type of unpaid volunteer performs activities requiring specialized training, with a goal of reducing unnecessary training requirements for prospective unpaid volunteers;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id461bf3baf5304db8800458a48321c34b"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDD7DFB7CFFBE4AFD8A8DC103A4A3EF84"><subsection id="ide7a442d6715f4913a7b5828eef4c05c2"><enum>(k)</enum><header>Training requirements for unpaid volunteers</header><paragraph commented="no" display-inline="no-display-inline" id="ida5e61faf2d3244749ed8b7a1b0e32634"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In providing the model standards described in subsection (h)(5), the Director of the Office of Long-Term Care Ombudsman Programs shall review and, as necessary, update such model standards on a regular basis to tailor such model standards to the individualized training needs of each type of representative of the Office, including each type of unpaid volunteer.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc884ed3625d64ecfa144124c4951121b"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Director of the Office of Long-Term Care Ombudsman Programs shall take into consideration the degree to which each type of representative of the Office performs activities that require specialized training, with a goal of reducing unnecessary training requirements for unpaid volunteers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id9aec7c3dc04f423dbb966af315366568"><enum>3.</enum><header>Director of the Office of Long-Term Care Ombudsman Programs</header><text display-inline="no-display-inline">Section 201(d)(2)(A) of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3011">42 U.S.C. 3011(d)(2)(A)</external-xref>) is amended in the second sentence by inserting <quote>serve on a full-time basis and</quote> after <quote>shall</quote>. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id355a9378bfd14e6384fc5c867d3fc06f"><enum>4.</enum><header>Study on State Long-Term Care Ombudsman Programs</header><subsection id="id5738c68a43604e0bbca09a61f99e2213"><enum>(a)</enum><header>In general</header><text>The Assistant Secretary for Aging shall seek to enter into a contract with the National Academies of Sciences, Engineering, and Medicine (referred to in this section as the <quote>National Academies</quote>) to conduct a study on the State Long-Term Care Ombudsman programs carried out under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>), including an assessment of the effectiveness of such programs and any related challenges, and recommendations. The study shall include an assessment of the current (as of the date on which the contract is entered into) recommended staff-to-bed ratio for such programs, as appropriate.</text></subsection><subsection id="ida6b8b6def41d4838a9e3fbdffc240a5f"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date on which a contract is entered into under subsection (a), the National Academies shall publicly issue a report on the findings of such study. </text></subsection></section></legis-body></bill>
