which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to establish the Patrick Leahy Lake Champlain Basin Program Foundation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title></quote>. </text></section><section id="idF8386AB1E9014E668F9A9F4D2228A89F"><enum>2.</enum><header>Patrick Leahy Lake Champlain Basin Program Foundation</header><text display-inline="no-display-inline">Section 120 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1270">33 U.S.C. 1270</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="idCDEB356F4B724F56A409F0B95EFF0286" act-name=""><section section-type="subsequent-section" id="idE877E361D7594112ACBED0A4289E004A"><enum>120.</enum><header>Patrick Leahy Lake Champlain Basin Program Foundation</header><subsection id="id7FCAADDBA4E14B8B91114E9AA6AA1204"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id75F20A8BCD364A77A94B9F991154CFB9"><enum>(1)</enum><header>Champlain Valley National Heritage Partnership</header><text>The term <term>Champlain Valley National Heritage Partnership</term> means the Champlain Valley National Heritage Partnership established by section 284(a) of the Champlain Valley National Heritage Partnership Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/54/320101">54 U.S.C. 320101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/338">Public Law 109–338</external-xref>). </text></paragraph><paragraph id="id16A76A50F59A4F6485CE5799DE6E06F6"><enum>(2)</enum><header>Education and Outreach Committee</header><subparagraph id="id76652F42CE0D41AFBB13B17881E5D7E6"><enum>(A)</enum><header>In general</header><text>The term <term>Education and Outreach Committee</term> means a committee established by the Steering Committee to provide objective information and funding recommendations to the Steering Committee upon request to be used in the decision making process of the Steering Committee, including—</text><clause id="id3FBA0625AB5347928738968AF38BC9F0"><enum>(i)</enum><text>funding recommendations relating to educational and outreach opportunities and issues; and</text></clause><clause id="id1F80376D4046481AB2DD39E0BA5236EC"><enum>(ii)</enum><text>programmatic actions needed to address those educational or outreach opportunities or issues.</text></clause></subparagraph><subparagraph commented="no" id="id2E8442E252A64F5E876392E26D72CEB1"><enum>(B)</enum><header>Treatment of existing committees</header><text>The term <term>Education and Outreach Advisory Committee</term> includes a committee described in subparagraph (A) established before the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaf07ef8322f5434d8a51436a22308bf8"><enum>(3)</enum><header>Executive Director</header><text>The term <term>Executive Director</term> means the Executive Director of the Foundation appointed under subsection (c)(5).</text></paragraph><paragraph id="id3B0274D370D9432791EF2657210E3987"><enum>(4)</enum><header>Fiscal agent</header><text>The term <term>fiscal agent</term> means an organization that is responsible for fiscal and administrative management of the Foundation under the direction of the Steering Committee, the Executive Director, and the Administrator.</text></paragraph><paragraph id="idD71ABD90D7904BB7BBFF42641A287F8F"><enum>(5)</enum><header>Foundation</header><text>The term <term>Foundation</term> means the Patrick Leahy Lake Champlain Basin Program Foundation established by subsection (c)(1)(A).</text></paragraph><paragraph id="id8045FCB4671047A9A2B2DCDB0AD15AB3"><enum>(6)</enum><header>Lake Champlain Basin</header><text>The term <term>Lake Champlain Basin</term> means Lake Champlain and the natural watershed of Lake Champlain, including all land, streams, rivers, lakes, and other bodies of water in the United States and Canada that naturally drain into Lake Champlain, including all or a portion of—</text><subparagraph id="idDF6DEB4B4BF547AB98783838C8C01A30"><enum>(A)</enum><text>the counties of Clinton, Franklin, Warren, Essex, and Washington in the State of New York; and</text></subparagraph><subparagraph id="idEBFF84B47D1B48C38778A7F8DF60FE56"><enum>(B)</enum><text>the counties of Franklin, Grand Isle, Chittenden, Addison, Rutland, Bennington, Lamoille, Orange, Washington, Orleans, and Caledonia in the State of Vermont.</text></subparagraph></paragraph><paragraph id="id3AF713EC6F31445899729D80B1C8D4F3"><enum>(7)</enum><header>Lake Champlain Citizens Advisory Committee</header><subparagraph id="idC7610EA31B744A5C90B7C85C7592C21C"><enum>(A)</enum><header>In general</header><text>The term <term>Lake Champlain Citizens Advisory Committee</term> means a committee in the State of Vermont, the State of New York, and, if the Province of Quebec elects to participate, the Province of Quebec, established by the Governor or executive officer of the State or province, as applicable, to advise on the protection and restoration of Lake Champlain.</text></subparagraph><subparagraph id="idA4204BE760794CA9BA0DF26BA8EC8C44"><enum>(B)</enum><header>Treatment of existing committees</header><text>The term <term>Lake Champlain Citizens Advisory Committee</term> includes a committee described in subparagraph (A) established before the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title>.</text></subparagraph></paragraph><paragraph id="ida582563cf15541988239ef96371c9789"><enum>(8)</enum><header>Plan</header><text>The term <term>Plan</term> means the comprehensive pollution prevention, ecosystem protection and restoration, and climate change response plan adopted and published under subsection (d), including any revisions to that plan.</text></paragraph><paragraph id="id6F4AEE890B94412EA2ACBEC35A53C924"><enum>(9)</enum><header>Steering committee</header><text>The term <term>Steering Committee</term> means the Steering Committee established and maintained under the most recent Memorandum of Understanding on Environmental Cooperation on the Management of Lake Champlain entered into between the State of New York, the State of Vermont, and, if the Province of Quebec elects to participate, the Province of Quebec, as modified pursuant to this section.</text></paragraph><paragraph id="id519AE50791564355AD6A6C393DC82E71"><enum>(10)</enum><header>Technical Advisory Committee</header><subparagraph id="idA10F0DB9262C4BC7B2299287E5DB777B"><enum>(A)</enum><header>In general</header><text>The term <term>Technical Advisory Committee</term> means a committee established by the Steering Committee to provide objective information and funding recommendations to the Steering Committee upon request to be used in the decisionmaking process of the Steering Committee, including—</text><clause id="id8FAC036C73F540ABAC2F05A9D0A7A18C"><enum>(i)</enum><text>funding recommendations relating to technical and scientific management issues; and</text></clause><clause id="id70CB15C9EE50481A95D0BFA8172CA345"><enum>(ii)</enum><text>research or actions needed to address those technical or scientific management issues.</text></clause></subparagraph><subparagraph commented="no" id="id2E3D5625D4374961AC1648A2D32817D1"><enum>(B)</enum><header>Treatment of existing committees</header><text>The term <term>Technical Advisory Committee</term> includes a committee described in subparagraph (A) established before the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title>.</text></subparagraph></paragraph></subsection><subsection id="idF8060A7938E24C3F8EC23D3FFC6BDADB"><enum>(b)</enum><header>Steering committee membership</header><paragraph id="id252D0BE7456D49F5B3E958D993EE982B"><enum>(1)</enum><header>In general</header><text>Each of the following shall be a member of the Steering Committee:</text><subparagraph id="id1A6EB97074D946B1A1E02A3085D89E5D"><enum>(A)</enum><text>The highest level official (or a designee of that official) of each of the following:</text><clause id="id81355D90BF7F4BB684AAB7A480225156"><enum>(i)</enum><text>The State environmental agency of the State of New York.</text></clause><clause id="id8A1D8CA1A85247418870832F6BCF4158"><enum>(ii)</enum><text>The State environmental agency of the State of Vermont.</text></clause><clause id="idABDE32A0FA9548D6880F1DEA00961B92"><enum>(iii)</enum><text>The Ministry for the Environment of the Province of Quebec, if that ministry elects to participate. </text></clause></subparagraph><subparagraph id="id92B0F9076D8B442284805DA905268DC2"><enum>(B)</enum><text>A representative of—</text><clause id="idC993CB9A13B04CD98559651C1F3EA80D"><enum>(i)</enum><text>the State agriculture agency of the State of New York;</text></clause><clause commented="no" display-inline="no-display-inline" id="idaa50b64641ab4a13a3a4d889b95c12ae"><enum>(ii)</enum><text>the State agriculture agency of the State of Vermont; and</text></clause><clause id="id57731C172C804975ACED16CDC34FBB6D"><enum>(iii)</enum><text>the Quebec Agricultural Ministry, if that ministry elects to participate.</text></clause></subparagraph><subparagraph id="id68CBE6A9FCB14C4CB4AE0749C0CD7945"><enum>(C)</enum><text>The State Historic Preservation Officer (or a designee of that officer) from each of the States of New York and Vermont.</text></subparagraph><subparagraph id="idDC3C3F0946A447F28D1720D7989637C4"><enum>(D)</enum><text>6 representatives of units of local government entirely within the Lake Champlain Basin, of which—</text><clause id="id8C4D7021127F4AB2A990C38E9012543C"><enum>(i)</enum><text>2 shall be representatives of units of local government in the State of New York;</text></clause><clause id="idF809DE9D6BF6436C9892100A50E79131"><enum>(ii)</enum><text>2 shall be representatives of units of local government in the State of Vermont; and</text></clause><clause commented="no" id="id85F30D460D9645E58060E83680BD774D"><enum>(iii)</enum><text>2 shall be representatives of units of local government in the Province of Quebec, if the Province of Quebec elects to send representatives.</text></clause></subparagraph><subparagraph id="idD391F3DFC90C4C6BB158A17164A59DE5"><enum>(E)</enum><text>The chairperson of—</text><clause id="id8BC3D935D52E4D0A803D9C60D748816B"><enum>(i)</enum><text>the Lake Champlain Citizens Advisory Committee of the State of New York;</text></clause><clause id="id9726A7303A5847B3BE9A110C15ACAA51"><enum>(ii)</enum><text>the Lake Champlain Citizens Advisory Committee of the State of Vermont; and</text></clause><clause id="idF2407ED62E6F4177BDEE1B240659F0A9"><enum>(iii)</enum><text>the Lake Champlain Citizens Advisory Committee of the Province of Quebec, if the Province of Quebec elects to participate.</text></clause></subparagraph><subparagraph id="id4BE78F17D8C4491986A8BA7D9E8B3A55"><enum>(F)</enum><text>The chairperson of the Technical Advisory Committee.</text></subparagraph><subparagraph id="id47CF80BBA84145F0898194D483F89868"><enum>(G)</enum><text>The chairperson of the Education and Outreach Committee.</text></subparagraph><subparagraph id="id0303A489089A46A4A3B2AC02533F69EA"><enum>(H)</enum><text>The chairperson of the advisory committee for the Champlain Valley National Heritage Partnership.</text></subparagraph><subparagraph id="id03C6A7B90A384E40B888BE4FDB64917F"><enum>(I)</enum><text>A representative from each of—</text><clause id="idC72D5A9B295F47CAA1CCB23E64B9549B"><enum>(i)</enum><text>the Region 1 office of the Environmental Protection Agency;</text></clause><clause id="id44C79EEEB358490FA87493A6268A950D"><enum>(ii)</enum><text>the Region 2 office of the Environmental Protection Agency;</text></clause><clause id="id710DC90D49854B2D98FB6412DB228A44"><enum>(iii)</enum><text>the Region 5 office of the United States Fish and Wildlife Service;</text></clause><clause id="id316AABF42D0E4153947C0D2ABC8749BF"><enum>(iv)</enum><text>the Natural Resources Conservation Service New York State office;</text></clause><clause id="id5AB50FB6C6D94B35A8B68348619B88C9"><enum>(v)</enum><text>the Natural Resources Conservation Service Vermont State office;</text></clause><clause id="idCDDB01CB90BB474AA8ED4FDE7B285773"><enum>(vi)</enum><text>the National Park Service; and</text></clause><clause id="idBE95F6E3241B45E1A79569B06740C6B1"><enum>(vii)</enum><text>the New York District of the Corps of Engineers.</text></clause></subparagraph><subparagraph id="idA2512AE0C58B43268B9D2EBAD2AD4D1F"><enum>(J)</enum><text>The Director of the Lake Champlain Sea Grant Institute.</text></subparagraph><subparagraph id="id508B483B40424C43B8D0BD37E7D21CB2"><enum>(K)</enum><text>A representative of the Great Lakes Fishery Commission.</text></subparagraph><subparagraph id="id0B391F304A9541D7BB18C250F8D7BBEB"><enum>(L)</enum><text>Such additional members as may be confirmed by the Steering Committee. </text></subparagraph></paragraph><paragraph id="idA2C6E4E2FB2940CAACED26CEF75CA628"><enum>(2)</enum><header>Chairperson</header><text>The position of chairperson of the Steering Committee shall regularly rotate among the members of the Steering Committee described in paragraph (1)(A). </text></paragraph><paragraph commented="no" id="id712B06E2EC114205B66A2D06C50CDA6C"><enum>(3)</enum><header>Ratification</header><text>Any actions of the Steering Committee taken before the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title> are ratified and confirmed.</text></paragraph></subsection><subsection id="idFD33E642F6A34E71BD53CAAF0924A56E"><enum>(c)</enum><header>Patrick Leahy Lake Champlain Basin Program Foundation</header><paragraph id="id10997ADF464644F7A0CA1F00391D5569"><enum>(1)</enum><header>Establishment</header><subparagraph commented="no" display-inline="no-display-inline" id="id2872badf9e45479eb521139e2db7706b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There is established a foundation, to be known as the <quote>Patrick Leahy Lake Champlain Basin Program Foundation</quote>, as a charitable and nonprofit corporation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc00e554022546fcafa0c4d2b5b64563"><enum>(B)</enum><header>Rights and obligations</header><text>The Foundation—</text><clause commented="no" display-inline="no-display-inline" id="id7be32dd7557844a6b12a812d3547a00f"><enum>(i)</enum><text display-inline="yes-display-inline">shall have perpetual succession;</text></clause><clause commented="no" display-inline="no-display-inline" id="id25b7eec34e1b4cb2afaef4a3e5bd7512"><enum>(ii)</enum><text>may conduct business throughout the Lake Champlain Basin; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0d8df5c71b9f4a11b9969d6fcc83083c"><enum>(iii)</enum><text>shall, at all times, maintain a designated agent authorized to accept service of process for the Foundation.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c1d546ad3514bcc979d1094ca21db9d"><enum>(C)</enum><header>Service of process</header><text>The serving of notice to, or service of process on, the agent required under subparagraph (B)(iii), or mailed to the business address of that agent, shall be deemed as service on or notice to the Foundation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca682d2ac3a54bc1a5539300bdd86b1b"><enum>(D)</enum><header>Principal office</header><text>The principal office of the Foundation shall be located in 1 of the following counties:</text><clause id="idE0BD2210393F431D8067662C19417AC0"><enum>(i)</enum><text>The county of Franklin, Grand Isle, Chittenden, Addison, Rutland, Bennington, Lamoille, Orange, Washington, Orleans, or Caledonia in the State of Vermont.</text></clause><clause id="idE84FBFFB1ED44760B2B1BAFF3E6FCED7"><enum>(ii)</enum><text>The county of Clinton, Franklin, Warren, Essex, or Washington in the State of New York.</text></clause></subparagraph></paragraph><paragraph id="idEAFA9A6FE712495D8F0EB2BBDA208B38"><enum>(2)</enum><header>Not an agency or establishment</header><text>The Foundation shall not be an agency or establishment of the United States.</text></paragraph><paragraph id="id907BCCE526D14DE7BA95247D7E033BF7"><enum>(3)</enum><header>Purposes</header><text>The purposes of the Foundation are—</text><subparagraph id="id394A3C145EC244CF9284A760D6A4EF84"><enum>(A)</enum><text>to undertake and conduct activities that support—</text><clause id="idC0B002013432419798841DF3CC1EDDC6"><enum>(i)</enum><text>the implementation and furtherance of the Plan, including work to support the goals, objectives, and strategies identified in the Plan; and</text></clause><clause id="id803E3E8E180A4FD4A2CCB7AB8DBD4C77"><enum>(ii)</enum><text>the purposes of this section;</text></clause></subparagraph><subparagraph id="id700C24F772374644A5E6E5835714DB4B"><enum>(B)</enum><text>to accept and manage funds of the Foundation for the implementation of the Plan, including—</text><clause id="id7DBCA5AE859842B9A86331F76B2E90C7"><enum>(i)</enum><text>amounts made available under subsection (i) for transfer to the Foundation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id88cdcb75086e4866864859a52729152c"><enum>(ii)</enum><text>amounts given, devised, or bequeathed by private organizations or persons; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide756389d41ed4d83aa8197068b00f68d"><enum>(iii)</enum><text>such other amounts as may be made available to the Foundation;</text></clause></subparagraph><subparagraph id="id18AACB8BBB2242EF8B36E92F62B98FCC"><enum>(C)</enum><text>to make grants and subgrants, enter into contracts and cooperative agreements, and administer funds of the Foundation to carry out activities described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3fba4f9863844ebaf15516eac3bd894"><enum>(D)</enum><text display-inline="yes-display-inline">to assist and coordinate efforts among the Federal Government, the government of the State of New York, the government of the State of Vermont, local governments, and other partners to adopt and implement the Plan; and</text></subparagraph><subparagraph id="id99E50E50A0EA4FB6A6202EFB8CE84A96"><enum>(E)</enum><text>to participate with, and otherwise assist, Canada and the Province of Quebec in undertaking and conducting activities that further the work of the Foundation in fulfilling the purposes of this section and implementing the Plan.</text></subparagraph></paragraph><paragraph id="idCAC4445715594EB486EF8F88C95576C2"><enum>(4)</enum><header>Board of Directors</header><subparagraph id="idD25DBEB857FE4B94944211BAF96C08A0"><enum>(A)</enum><header>In general</header><text>The Foundation shall be governed by a Board of Directors (referred to in this subsection as the <quote>Board</quote>), the members of which shall be appointed by the Steering Committee.</text></subparagraph><subparagraph id="idA71BB5826B114D62B6A74796B35AE18E"><enum>(B)</enum><header>Dual membership authorized</header><text>Members of the Steering Committee may simultaneously serve as members of the Board.</text></subparagraph><subparagraph id="idCFE67DD158674D6CB0402282F0ED5F09"><enum>(C)</enum><header>Recusal</header><text>Members of the Board, including members of the Steering Committee in their capacity as members of the Board, may recuse themselves from votes on the Board.</text></subparagraph><subparagraph id="id39946340B5F242499158EE9F8EEA97EA"><enum>(D)</enum><header>Withdrawal</header><text>Members of the Board, including members of the Steering Committee that serve as members of the Board, may withdraw from membership on the Board.</text></subparagraph><subparagraph id="idD5A30F4B18E14B9AB9C0A97B339565E1"><enum>(E)</enum><header>Removal</header><text>Members appointed to the Board, including members of the Steering Committee that are simultaneously serving as members of the Board, may be removed by the Steering Committee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44946a2ef044442a80d522433c4cb253"><enum>(F)</enum><header>Not Federal employees</header><text>Membership on the Board shall not constitute employment by, or the holding of an office of, the United States for the purpose of any Federal law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id614e8c19c9184190a0bd8ccf2149e286"><enum>(5)</enum><header>Executive Director</header><text>The Foundation shall have an Executive Director, who shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id969548dbed6e4831b2ca8532d6ef4c0f"><enum>(A)</enum><text display-inline="yes-display-inline">serve as the chief executive officer of the Foundation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide35b8ed8fd6941eebd31390b4cc7afbf"><enum>(B)</enum><text>be appointed by, and serve at the direction of, the Board.</text></subparagraph></paragraph><paragraph id="idAB8C86D167F5471DB022B7B1E4F45C75"><enum>(6)</enum><header>Powers of the Foundation</header><subparagraph commented="no" display-inline="no-display-inline" id="id708c40b1cda64a709b55058d82f68cce"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to any conditions imposed on the Foundation by the Steering Committee and subject to approval by the Board, the Foundation shall have, in addition to the powers otherwise granted the Foundation under this section, the usual powers of a corporation acting as a trustee in the State in which the principal office of the Foundation is located, and may—</text><clause id="id128793A852294B578D45D4C8B98DE1CF"><enum>(i)</enum><text>receive funds, including funds made available to the Environmental Protection Agency under subsection (i) for transfer to the Foundation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb905b8b2571946a6a36ac79f252f5c10"><enum>(ii)</enum><text display-inline="yes-display-inline">accept, receive, hold, administer, and use any gift, devise, or bequest, absolutely or in trust, of real or personal property or any income from that property or other interest;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6675ca6ad20840ae97cce4b984e0c730"><enum>(iii)</enum><text>deposit any funds provided to the Foundation by the Federal Government at 1 or more financial institutions that are members of the Federal Deposit Insurance Corporation or the Securities Investor Protection Corporation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb21acd917fec4534ab5d34e564a6920c"><enum>(iv)</enum><text>make use of any interest or other income that accrues as a consequence of actions taken under clause (iii) or (vi) to carry out the purposes of the Foundation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6c2022b66d9943588e4960dcab6650c4"><enum>(v)</enum><text>use Federal funds to make payments under cooperative agreements entered into with willing private landowners to provide substantial long-term benefits for the restoration of fish, wildlife, plants, and other natural resources on private land within the Lake Champlain Basin;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcac50e44f0e147aaa4ea5fdffb39994a"><enum>(vi)</enum><text>sell, donate, lease, retain, or otherwise dispose of any property or income from that property, unless otherwise required by the instrument of transfer;</text></clause><clause commented="no" display-inline="no-display-inline" id="id29b1187cfe014789bd66307e80ae2677"><enum>(vii)</enum><text>hire and retain staff;</text></clause><clause commented="no" display-inline="no-display-inline" id="id82c99969fd254bba954dbff40416ae2d"><enum>(viii)</enum><text>issue grants and subgrants;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6296964d1c864e75ada614b9f2fce3dc"><enum>(ix)</enum><text>enter into contracts or other arrangements with public agencies and private organizations and persons;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1ca0d6101e4b444ebbff9d9ed15b3fed"><enum>(x)</enum><text>sue and be sued, and complain and defend itself in any court of competent jurisdiction, except that members of the Board shall not be personally liable, except for gross negligence;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7a633197422e4fd9b8cea2a627561f9b"><enum>(xi)</enum><text>receive and administer restitution and community service payments, amounts for mitigation of impacts to natural resources, and other amounts arising from legal, regulatory, or administrative proceedings, subject to the condition that those amounts are received or administered for purposes that further the implementation of the Plan or the conservation and management of fish, wildlife, plants, and other natural resources within the Lake Champlain Basin;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7d35fb3b8a194b45a97136e2678eca95"><enum>(xii)</enum><text>acquire, by purchase or exchange, and own real or personal property, or an interest therein;</text></clause><clause commented="no" display-inline="no-display-inline" id="id211eb76cd99444a7ae7f2dfe4759aa92"><enum>(xiii)</enum><text>serve as its own fiscal agent, if selected to serve as the fiscal agent by the Administrator, the Executive Director, and the Steering Committee under subsection (e); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e569aad8f804416a17d4ee0b28b7700"><enum>(xiv)</enum><text>do any and all acts necessary to carry out the purposes of the Foundation.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0993cf339a3a4952b1b432e0b0f98af2"><enum>(B)</enum><header>Treatment of real property</header><clause commented="no" display-inline="no-display-inline" id="idf605a717319041a3ad5229558b1f70b1"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>For purposes of this subsection, an interest in real property shall be treated as including easements or other rights for preservation, conservation, protection, or enhancement by or for the public of natural, scenic, historic, scientific, educational, inspirational, or recreational resources.</text></clause><clause commented="no" display-inline="no-display-inline" id="idbc736f42d4204462a6e1e34a9d750ca6"><enum>(ii)</enum><header>Encumbered real property</header><text>A gift, devise, or bequest that is encumbered, restricted, or subject to beneficial interests of private persons may be accepted by the Foundation if any current or future interest in the gift, devise, or bequest is for the benefit of the Foundation.</text></clause><clause commented="no" display-inline="no-display-inline" id="id51821342825e4982bc852931bc478631"><enum>(iii)</enum><header>Savings clause</header><text>The acceptance and administration of amounts by the Foundation under subparagraph (A)(xi) does not alter, supersede, or limit any regulatory or statutory requirement associated with those amounts.</text></clause></subparagraph></paragraph><paragraph id="idA560F765D7B84640B91621ED345BEE20"><enum>(7)</enum><header>Dissolution</header><subparagraph id="id74616A679C964157A9CDD54E6307F3CC"><enum>(A)</enum><header>In general</header><text>The Administrator and the Steering Committee may jointly dissolve the Foundation.</text></subparagraph><subparagraph id="id8A6710971F1942EB931E66F7EB51F6FF"><enum>(B)</enum><header>Return of funds</header><text>If the Administrator and the Steering Committee jointly dissolve the Foundation under subparagraph (A), during the dissolution process, the Foundation shall return all unobligated or unexpended funds to each Federal agency that provided funds to the Foundation in a manner that is proportional to the amount of funds received from that Federal agency.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74d2335aaeff4089ab1931d162003edf"><enum>(8)</enum><header>United States release from liability</header><text>The United States shall not be liable for any debts, defaults, acts, or omissions of the Foundation, nor shall the full faith and credit of the United States extend to any obligation of the Foundation. </text></paragraph></subsection><subsection id="id43183B328DEA42749A588F196CF3D15F"><enum>(d)</enum><header>Pollution prevention, ecosystem protection and restoration, and climate change response plan</header><paragraph id="idAE8ADDD27D5C42A7AA6BC9C60C92A8D4"><enum>(1)</enum><header>Adoption</header><subparagraph id="id0C97305728344AFF8808E82E45602BEA"><enum>(A)</enum><header>In general</header><text>The Steering Committee shall adopt and publish a comprehensive pollution prevention, ecosystem protection and restoration, and climate change response plan for Lake Champlain that protects and benefits the water quality, fisheries, wetlands, wildlife, and cultural resources of Lake Champlain and within the Lake Champlain basin.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef9ea83f892f4a32b35b9d325e0c1690"><enum>(B)</enum><header>Public engagement</header><text>Prior to the final adoption and publication of the Plan, the Administrator, in cooperation with the Steering Committee, shall provide for public review and comment on the draft Plan, including, at a minimum, 1 public meeting in each of the States of New York and Vermont to hear comments on the draft Plan.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0008f601cadb490eab377f262ce82fd7"><enum>(C)</enum><header>Approval</header><text>Not earlier than 120 days after the date on which the Plan is published under subparagraph (A), the Administrator shall approve the Plan if—</text><clause commented="no" display-inline="no-display-inline" id="idc04be09986e9400e8eb829f9004615a4"><enum>(i)</enum><text display-inline="yes-display-inline">the Plan meets the requirements of this subsection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2184de9b4c36441fa7b48ce25c414e7b"><enum>(ii)</enum><text>the Governors of the States of New York and Vermont concur that the Plan meets the requirements of this subsection.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8561dd699b34636a9feb98e94ad6cc7"><enum>(D)</enum><header>Effect of approval</header><text>On approval of the Plan by the Administrator under subparagraph (C), the Plan shall be deemed to be—</text><clause commented="no" display-inline="no-display-inline" id="id22ef30df9f2b482e808c638c7b9dbeb3"><enum>(i)</enum><text display-inline="yes-display-inline">an approved management program for purposes of section 319(h); and</text></clause><clause id="id3fd651e5a53049c684dbc1320f6d3b93" commented="no"><enum>(ii)</enum><text>an approved comprehensive conservation and management plan pursuant to section 320.</text></clause></subparagraph><subparagraph id="id022bc101fa944ed9814d5f0ffbb4a0a7"><enum>(E)</enum><header>Effect of prior plan</header><text>Any comprehensive pollution prevention, control, and restoration plan approved by the Administrator and published before the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title> shall remain in effect and be considered the Plan under this subsection until the Plan is adopted pursuant to subparagraph (A).</text></subparagraph></paragraph><paragraph id="id7EFD6455227446D1B31B2F7F48AD8E95"><enum>(2)</enum><header>Inclusions</header><text>The Plan shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3e7752d57ba14c64a7ad772d09c2b3c4"><enum>(A)</enum><text display-inline="yes-display-inline">include strategies to advance, with respect to Lake Champlain—</text><clause commented="no" display-inline="no-display-inline" id="idc281b5b916f64e5da89199cb397f412e"><enum>(i)</enum><text display-inline="yes-display-inline">clean water;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida2c0679de5244d94a7daf212dc078812"><enum>(ii)</enum><text display-inline="yes-display-inline">healthy ecosystems;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7329535caa024d0aaabe9575d89991f4"><enum>(iii)</enum><text display-inline="yes-display-inline">thriving communities; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2f1129cae2841c7bba1668dd1611636"><enum>(iv)</enum><text display-inline="yes-display-inline"> an informed and involved public in the Lake Champlain Basin;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id851b1757708543a494072ef3e0994e96"><enum>(B)</enum><text display-inline="yes-display-inline">identify corrective actions addressing point and nonpoint sources of pollution that are necessary to restore and maintain the chemical, physical, and biological integrity of water quality, a balanced, indigenous population of shellfish, fish, and wildlife, and recreational and economic activities in and on Lake Champlain;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id404fde2290704698aef07bb1d5db003c"><enum>(C)</enum><text>identify—</text><clause commented="no" display-inline="no-display-inline" id="id0efe1bf37f134f28aaf3c80a14a0678b"><enum>(i)</enum><text display-inline="yes-display-inline">the potential impacts of climate change on the water quality, ecosystems, indigenous flora and fauna, recreation, and economic activities in and on Lake Champlain; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3546a972e9d24515af5799d3a2e699a0"><enum>(ii)</enum><text>strategies to mitigate and promote resilience against the impacts identified under clause (i);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id852d954d1fbc4b4a9ea7781e9bcce646"><enum>(D)</enum><text>include a strategy for pollution prevention and control that includes the promotion of pollution prevention and management practices to reduce the amount of pollution generated in the Lake Champlain Basin;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaba5dc17a676425e96e7c8b6ab58d075"><enum>(E)</enum><text display-inline="yes-display-inline">incorporate environmental management concepts and programs in State and Federal plans and programs in effect during the period in which the Plan is developed and adopted; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d98d5c05ca3472ea4e50e5928d2f2e0"><enum>(F)</enum><text>describe the methods and schedules for the funding of programs, activities, and projects identified in the Plan, including the use of Federal funds and other sources of funding.</text></subparagraph></paragraph><paragraph id="idB63DB4197AD54C0E84E90A3F80124C1E"><enum>(3)</enum><header>Revision</header><subparagraph id="idFF4C730ACC6341A1A90DEDAC57343565"><enum>(A)</enum><header>In general</header><text>The Steering Committee shall, as necessary but not less frequently than once every 5 years, review, revise, and readopt the Plan.</text></subparagraph><subparagraph id="id9579D53EE2334458AE8F80D49C8B0214"><enum>(B)</enum><header>Effect</header><text>A Plan adopted by the Steering Committee shall remain in effect until readopted by the Steering Committee pursuant to subparagraph (A).</text></subparagraph></paragraph><paragraph id="id0239A066D8024E6AAF4CBD68DE682735"><enum>(4)</enum><header>Use of plan</header><text>The Plan shall guide the work of the Foundation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1c9c2bdaed024275a04d33798873de20"><enum>(e)</enum><header>Fiscal agent</header><paragraph commented="no" display-inline="no-display-inline" id="ideaea337e46354ba6b6fb5e97a23e7f39"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Steering Committee, the Executive Director, and the Administrator shall jointly select a qualified entity to serve as the fiscal agent of the Foundation, which may include selecting the Foundation as the fiscal agent of the Foundation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc291d1e0c5a1471abfd1e1f3d499aed6"><enum>(2)</enum><header>Assessment</header><subparagraph commented="no" display-inline="no-display-inline" id="id1da29f402f7a4375b1ce956d65d5ae4d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning as soon as practicable after the date of enactment of the <short-title>Lake Champlain Basin Program Reauthorization Act of 2024</short-title>, and as necessary but not less frequently than once every 10 years thereafter, the Steering Committee, the Executive Director, and the Administrator shall jointly assess the effectiveness of the fiscal agent and, if appropriate, select a new qualified entity through a competitive process to serve as the fiscal agent.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5634a86a7e6e42559a10fb749181642e"><enum>(B)</enum><header>No competitive process</header><text>On selection of a fiscal agent, the Administrator may award funding to the fiscal agent without competition until such time as a new fiscal agent is selected.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5fc24e39a2d04fc2849ca13c698e92e8"><enum>(C)</enum><header>Transfer of funds</header><text>If the Steering Committee, the Executive Director, and the Administrator jointly select a new fiscal agent under subparagraph (A), the qualified entity that had served as fiscal agent shall transfer to the new fiscal agent all unobligated or unexpended funds awarded to the former fiscal agent under subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="idcf981137c59f4ec39874b30cd0967914"><enum>(f)</enum><header>Grant assistance</header><paragraph id="id07478b5a202344f4b434b44ead73b4be"><enum>(1)</enum><header>In general</header><text>The Administrator, in consultation with the Steering Committee and the Executive Director—</text><subparagraph commented="no" display-inline="no-display-inline" id="id108c4e9789c44a53bd1e8925ae5dfbdb"><enum>(A)</enum><text>shall make grants to the State of New York, the State of Vermont, and the fiscal agent; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd590af3690724b2aa0e38edf9b5fe135"><enum>(B)</enum><text display-inline="yes-display-inline">may make grants to State, interstate, and regional water pollution control agencies and public or nonprofit agencies, institutions, and organizations.</text></subparagraph></paragraph><paragraph id="idc3c44920d6404354b3045e318ff1eb83"><enum>(2)</enum><header>Purposes</header><text>Grants under this subsection shall be made for assisting the development and implementation of the Plan, including research, surveys, studies, implementation practices, and modeling and technical supporting work.</text></paragraph><paragraph id="id68767d8f3d074526a60137e43add16de"><enum>(3)</enum><header>Federal share</header><subparagraph id="idafc507100b414cd3be8c5c052dda180d"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amount of a grant under paragraph (1) shall not exceed 75 percent of the cost of the work carried out using grant funds.</text></subparagraph><subparagraph id="idef379fa48cc04226bc8b8f0c8f26e3cb"><enum>(B)</enum><header>Exception</header><clause id="id14f9656a7f864572b38ea1e79a2568fa"><enum>(i)</enum><header>In general</header><text>The Administrator may, on a case-by-case basis and in consultation with the Steering Committee, increase the Federal share under subparagraph (A) to 85 percent of the costs described in that subparagraph if the recipient of the grant demonstrates an inability to meet the cost-share requirement under that subparagraph.</text></clause><clause id="idc94f90afe1ad4fe887e0fd24428d0aa5"><enum>(ii)</enum><header>Requirement</header><text>In carrying out clause (i), the Administrator shall be guided by policy adopted by the Steering Committee.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2463259aa92e4916847b05aeadd6119f"><enum>(4)</enum><header>Administration</header><text>The Administrator may establish such requirements for the administration of grants under this subsection as the Administrator determines appropriate.</text></paragraph></subsection><subsection commented="no" id="idD311BDC7C52B48B6A360666A67876C55"><enum>(g)</enum><header>Great Lakes Fishery Commission</header><paragraph commented="no" id="idB51F6FBA289749CA85A59F4BEBB62216"><enum>(1)</enum><header>In general</header><text>The Great Lakes Fishery Commission may undertake, fund, and support work on Lake Champlain, in the Lake Champlain Basin, and other areas within the Saint Lawrence River basin in Vermont, including through—</text><subparagraph commented="no" id="id4FCCD4AEDF73474E9CE2ED23F4BD99B6"><enum>(A)</enum><text>fisheries and aquatic ecosystem research, monitoring, restoration, and management;</text></subparagraph><subparagraph commented="no" id="idA98BBB8D92DB49F9871EE363563AFA52"><enum>(B)</enum><text>sea lamprey control;</text></subparagraph><subparagraph commented="no" id="id25861C86DBC440948198C41159B259DD"><enum>(C)</enum><text>aquatic invasive species prevention and mitigation;</text></subparagraph><subparagraph commented="no" id="idD07739D6CBE74C34A4FDF9EDE408A365"><enum>(D)</enum><text>public engagement and education; and</text></subparagraph><subparagraph commented="no" id="id9F019888527E4399B301BDA819FB7FE2"><enum>(E)</enum><text>other work to implement the Plan.</text></subparagraph></paragraph><paragraph commented="no" id="id42AE1F37F5844185A6468C5FE232D7B6"><enum>(2)</enum><header>Authorization</header><text>In carrying out paragraph (1), the Great Lakes Fishery Commission may work with the Foundation, Federal and State agencies, institutions of higher education, nonprofit organizations, units of local government, and Canadian federal and Quebec provincial authorities. </text></paragraph></subsection><subsection id="idB5FD4B788DA641DF8F77B3025BE55214"><enum>(h)</enum><header>Savings provisions</header><paragraph id="idC0299A910D3A4D6283EEAFED1C400A44"><enum>(1)</enum><header>No effect on certain authority</header><text>Nothing in this section—</text><subparagraph commented="no" id="id1BECC7FFFDA64B7399037D9C897867E2"><enum>(A)</enum><text>affects the jurisdiction or powers of—</text><clause commented="no" id="id91E5DA1E9FB8405A8DE6AB175CB320C2"><enum>(i)</enum><text>any department or agency of the Federal Government or any State government; or</text></clause><clause commented="no" id="id43B2CE6DEA664653A71F96F8082A4BCE"><enum>(ii)</enum><text>except as provided in subsection (g), any international organization or entity related to Lake Champlain created by treaty or memorandum to which the United States is a signatory;</text></clause></subparagraph><subparagraph commented="no" id="id0B84AB7EFA75437A8F4D31AC510B9091"><enum>(B)</enum><text>provides new regulatory authority for the Environmental Protection Agency; or</text></subparagraph><subparagraph id="idEF968691A9024EAD87DC076143EDBDC8"><enum>(C)</enum><text>affects section 304 of the Great Lakes Critical Programs Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/1270">33 U.S.C. 1270</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/596">Public Law 101–596</external-xref>).</text></subparagraph></paragraph><paragraph id="idE998D2F15FE548389306018999753551"><enum>(2)</enum><header>No effect on obligations</header><text>Nothing in this section affects the obligations of Canada, the Province of Quebec, or any agencies or representatives of Canada or the Province of Quebec referenced in this section.</text></paragraph></subsection><subsection id="idc4dee0f5ac174fc4b3622a7cc4965013"><enum>(i)</enum><header>Authorization of appropriations</header><paragraph id="idc50b64f85eb646899b78ff051072c518"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Environmental Protection Agency for each of fiscal years 2025 through 2034 $45,000,000 for transfer to the Foundation, to remain available until expended.</text></paragraph><paragraph id="idd521c34fefbe42ff94b527f728903274"><enum>(2)</enum><header>Grant assistance</header><text>There is authorized to be appropriated to the Environmental Protection Agency to carry out this section $10,000,000 for each of fiscal years 2025 through 2034, to remain available until expended.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
