which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XXXIII of the Public Health Service Act with respect to flexibility and funding for the World Trade Center Health Program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title></quote>.</text></section><section id="id23F87F2741EF46238155E8DC7DBF0928"><enum>2.</enum><header>Flexibility for mental health condition certifications under the World Trade Center Health Program</header><subsection id="id1285d6655e0c4a6a9db0f9131616597d"><enum>(a)</enum><header>In general</header><text>Section 3305(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)</external-xref>) is amended—</text><paragraph id="id49A2367EE922404492E9C68C5D75DD71"><enum>(1)</enum><text>in paragraph (1)(A), by inserting <quote>subject to paragraph (6),</quote> before <quote>for</quote>; and</text></paragraph><paragraph id="idC7DA76E779994F87944A31AE914F1907"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77a086428a3649728110d64d17feb1c9"><paragraph id="id521711bfb493434a9f908d11914078b2"><enum>(6)</enum><header>Licensed mental health provider flexibility for mental health condition certifications</header><subparagraph id="idE230983B915C4802957C89B7AFA2A1EC"><enum>(A)</enum><header>In general</header><text>For purposes of an initial health evaluation described in paragraph (1)(A) with respect to a mental health condition (including any such evaluation provided under section 3321(b) or through the nationwide network under section 3313), such evaluation may be conducted by a physician or any other licensed mental health provider in a category of mental health care providers determined by the WTC Program Administrator under subparagraph (B).</text></subparagraph><subparagraph id="idBDFAC62DB33646D48232650A71B0816F"><enum>(B)</enum><header>Categories of licensed mental health providers</header><text>Not later than 180 days after the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title>, the WTC Program Administrator shall issue regulations for the categories of licensed mental health providers who, in addition to licensed physicians, may conduct evaluations under subparagraph (A) with respect to a mental health condition and make determinations under section 3312(b) with respect to such a condition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAB3C6389FA674E3CB20A736B548031A3"><enum>(b)</enum><header>Flexibility for WTC responders</header><text display-inline="yes-display-inline">Section 3312(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(b)</external-xref>) is amended—</text><paragraph id="idB5ADA9E5BD3842D99D3DD836AB54FE33"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf3142c031c24fdeb4897bc53e5a9e56"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>physician</quote> and inserting <quote>physician (or, in the case of a mental health condition, a physician or any other qualified mental health provider)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3707de42f4948978fa79a1995f5a746"><enum>(B)</enum><text>in clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other qualified mental health provider</quote>; </text></subparagraph></paragraph><paragraph id="id1C406C917662465E9688360BB205351C"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="idCC894A22B2DE40FABE35C76137F5DB51"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id7AC4832AD0E84747A3EA42E41AEA83DA"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician</quote> and inserting <quote>physician (or, in the case of a mental health condition, a physician or any other qualified mental health provider)</quote>;</text></clause><clause id="id4B8231C7FC7D49468304E6DF3F51DA8B"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other qualified mental health provider</quote>; and</text></clause><clause id="idE168FE1B5AD94483B6263D9B91DA929C"><enum>(iii)</enum><text>in clause (ii), by striking <quote>such physician's determination</quote> and inserting <quote>the determination of such physician or other qualified mental health provider</quote>; and</text></clause></subparagraph><subparagraph id="id61A63A11F3F444D18098CBF2D8BF8378"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id8DBEE81E8E1D42929322B49D8C564454"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician determinations</quote> and inserting <quote>determinations by physicians (or, in the case of a mental health condition, physicians or other qualified mental health providers)</quote>; and</text></clause><clause id="idC839F6B7C70542AC8D73CFCCD1555681"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician panel</quote> and inserting <quote>panel of physicians (or, in the case of a mental health condition, physicians or other qualified mental health providers)</quote>; </text></clause></subparagraph></paragraph><paragraph id="id9906C25A6A9D410BA62CA0EC27D110B5"><enum>(3)</enum><text>in paragraph (5), by striking <quote>examining physician</quote> and inserting <quote>examining physician (or, in the case of a mental health condition, examining physician or other qualified mental health provider)</quote>; and</text></paragraph><paragraph id="id501e8ddc9b134faf8fc18b3c2f71a7c6"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id63551254a64a41209146fcc3dfb062a0"><paragraph id="id854895bd049a4bbc9bf574879f7ab519"><enum>(6)</enum><header>Definition of <quote>qualified mental health provider</quote></header><text>For purposes of this subsection, the term <term>qualified mental health provider</term> means a licensed mental health provider in a category determined by the WTC Program Administrator under section 3305(a)(6)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idC65F6162788242209D6C30F399B02254"><enum>3.</enum><header>Criteria for credentialing health care providers participating in the nationwide network</header><text display-inline="no-display-inline">Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended—</text><paragraph id="idCE40F8CA113F4E2B9EF6953DF95B7AE8"><enum>(1)</enum><text>in section 3305(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)(2)</external-xref>)—</text><subparagraph id="id900EA5D2D92F4556BFB5C20641124183"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><clause id="id63FC97D888CA450F8F750E739FC59325"><enum>(i)</enum><text display-inline="yes-display-inline">by striking clause (iv); and</text></clause><clause id="id606BDFDECD1240F181FADFD1E587AA81"><enum>(ii)</enum><text>by redesignating clauses (v) and (vi) as clauses (iv) and (v), respectively;</text></clause></subparagraph><subparagraph id="id2E881BCCB9DA4FE3A376DE90CD83AEB9"><enum>(B)</enum><text>by striking subparagraph (B); and</text></subparagraph><subparagraph id="idA55CC1C3DF0C46BD8697D498DC6832FD"><enum>(C)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (B) and (C), respectively; and</text></subparagraph></paragraph><paragraph id="id467BEE9F9F1F41C081B87DEC7DDCEA15"><enum>(2)</enum><text>in section 3313(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-23">42 U.S.C. 300mm–23(b)(1)</external-xref>), by striking <quote>Data Centers</quote> and inserting <quote>WTC Program Administrator</quote>.</text></paragraph></section><section id="id4f0ba58619494bf29c41b0762356f7ba"><enum>4.</enum><header>Clarifying calculation of enrollment</header><subsection id="id011c2e9ed3d74803b9953d259f872b8a"><enum>(a)</enum><header>Responders</header><text>Section 3311(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-21">42 U.S.C. 300mm–21(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4176C9731460442B9AB1E2E742191FC9"><paragraph id="id3c5b4de268ca40b8bf0d8ffdb7e062d3"><enum>(6)</enum><header>Deceased WTC responders</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of enrollees under this subsection or section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6649413f3bad42fc8c3da69330c4e436"><enum>(b)</enum><header>Survivors</header><text>Section 3321(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-31">42 U.S.C. 300mm–31(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id478019E0DD7A43249F8FEA0235F386A6"><paragraph id="id6bdc5b82fe3f454397ecc9ee8c6e51b6"><enum>(5)</enum><header>Deceased WTC survivors</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of certified-eligible survivors under this section or in any count of enrollees under section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1CBFED935B0B459DBF24E8D32AF8C419"><enum>5.</enum><header>Time period for adding health conditions to list for WTC responders</header><text display-inline="no-display-inline">Section 3312(a)(6) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(a)(6)</external-xref>) is amended—</text><paragraph id="idD235E2103F144B55B0C2744C81C3C5F8"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>90</quote> and inserting <quote>180</quote>; and</text></paragraph><paragraph id="id3FD2D5239E774A91A3FBE1D3960397FB"><enum>(2)</enum><text>in subparagraph (C), in the second sentence, by striking <quote>90</quote> and inserting <quote>180</quote>.</text></paragraph></section><section id="id174CADB861964A58A24275EAE1DCE6CB"><enum>6.</enum><header>Funding for the World Trade Center Health Program</header><subsection id="idF6F1C74E2A904CA39053026BA826FFF7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-61">42 U.S.C. 300mm–61</external-xref>) is amended—</text><paragraph id="idA26C4270703D4753A6F5CA02260CEF32"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2)(A)—</text><subparagraph id="id9A5B4F9233E64D0991819EBC928464CB"><enum>(A)</enum><text>in clause (x), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="id564DB1BA6998476B8B30EB95E446A89F"><enum>(B)</enum><text>in clause (xi)—</text><clause id="idF93AFE39FA444D22BE95FC0B241D01F7"><enum>(i)</enum><text>by striking <quote>subsequent fiscal year through fiscal year 2090</quote> and inserting <quote>of fiscal years 2026 through 2034</quote>; and</text></clause><clause id="id571697FFA0C14E28B8A8154487A9704B"><enum>(ii)</enum><text>by striking <quote>plus</quote> and inserting <quote>and</quote>; and</text></clause></subparagraph><subparagraph id="id7B2E3502C305448D9043D8373EB2561A"><enum>(C)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id847EE0E8011840A681E8B132492A0D3E"><clause id="id4B333FE6737B4C7FAF550A4E33C80F8D"><enum>(xii)</enum><text>for each of fiscal years 2035 through 2090— </text><subclause id="id37FAB8B0B8E745C9B896526C183865E9"><enum>(I)</enum><text>the amount determined under this subparagraph for the previous fiscal year (plus any amount expended from the Fund in the previous fiscal year that was carried over from any fiscal year prior to the previous fiscal year including as carried over pursuant to a deposit into such Fund under section 3352(d), 3353(d), or 3354(d)) multiplied by 1.05; multiplied by</text></subclause><subclause id="id9E057D169CD14A94A0C860CE75B43806"><enum>(II)</enum><text>the ratio of—</text><item id="idCC35920E493440A6BB9BA7BAC821F66B"><enum>(aa)</enum><text>the total number of individuals enrolled in the WTC Program on July 1 of such previous fiscal year; to </text></item><item id="idCF64AA2223444BF7A6727C3EF10E3421"><enum>(bb)</enum><text>the total number of individuals so enrolled on July 1 of the fiscal year prior to such previous fiscal year; plus</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0C89529455FE471CA9FBD9CED9055E5D"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idF9E02662A2C44B6A8FFF7FACCDF45386"><enum>(A)</enum><text>in paragraph (4)—</text><clause id="idF9B206C0D369491AB4E2A462DAE8440F"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89CD3FD188E74FDA93D570CE81432DC8"><subparagraph id="id96E59F7E9BBC41DCBF1FD563EEA8CBCA"><enum>(A)</enum><text>for fiscal year 2024, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title>;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id0044F898D36C49DFAD68165D7CCB21AD"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows: </text><quoted-block id="idE9379E79620A41AC9368C41582C97589" display-inline="no-display-inline" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id5d5117548f4345e1a52e6e2f9887cfc4"><enum>(B)</enum><text>for fiscal year 2025, the greater of—</text><clause id="idEB294B8E49DE48DFB945335AE69C7E82"><enum>(i)</enum><text>the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title>; or</text></clause><clause id="id701A9D817D8847A592079F72221BD017" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>$20,000,000; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idFEA71597D95A4BCAB8128BA957F24186"><enum>(B)</enum><text>in paragraph (5)—</text><clause id="id147711251A1B4DC99DD3D796DE0BADBA"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD9521804C4AD4265B9A7AA101D38C708"><subparagraph id="id0035A652ED024DE3A177E6A1500D7388"><enum>(A)</enum><text>for fiscal year 2024, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title>;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idC7109A4B970C43D18907DCB6EE295F6D"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></clause><clause id="id7E90270151934FBCAB85D1E73156A026"><enum>(iii)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88EB192252DF47788385A56C28E1F6D8"><subparagraph id="id453E18D0276D448283C38CD0F293CE54"><enum>(B)</enum><text>for fiscal year 2025, the greater of—</text><clause id="id489856FAFD914267AFFD33CB031CF45C"><enum>(i)</enum><text>the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2024</short-title>; or</text></clause><clause id="idD07850EFB2AA4051BF022876E763B51B"><enum>(ii)</enum><text>$20,000,000; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="id81C74222A5914865861FEC96E4589344"><enum>(b)</enum><header>Additional amounts for the World Trade Center Health Program Special Fund</header><text display-inline="yes-display-inline">Section 3353(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-63">42 U.S.C. 300mm–63(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id83d5f81e130044d3bffd00254f04b0ec"><enum>(1)</enum><text>by striking <quote>Out</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7AA89CEAD843487FBE6F36C710813AE8"><paragraph commented="no" display-inline="no-display-inline" id="id4a4af100797d4eaab41c1cf0c50d24df"><enum>(1)</enum><header>Initial deposit</header><text>Out</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90a0c926b92c4d88aedfdf9eee34e6eb"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEB5D309F85BE44159A57C8EFEA527630"><paragraph commented="no" display-inline="no-display-inline" id="id9dc6618a008d4b0092bca44cb5b270fb"><enum>(2)</enum><header>Additional deposit</header><text>Out of any money in the Treasury not otherwise appropriated, there is appropriated for fiscal year 2024 $2,970,406,593 for deposit into the Special Fund, which amounts shall remain available in such Fund through fiscal year 2033.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb8fc26be4826492a9768eb6cb07c4c33"><enum>(c)</enum><header>Reallocation of any remaining amounts in separate funds</header><paragraph commented="no" display-inline="no-display-inline" id="idf41469bf277c4302bb9adfcccfa09859"><enum>(1)</enum><header>Supplemental fund</header><text>Section 3352(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-62">42 U.S.C. 300mm–62(d)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9a78e32811ce49a0b0eda51574ec3e10"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Return of Funds</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Remaining amounts</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1746779a1e641c699a53cef56e49fc3"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the Treasury as miscellaneous receipts</quote> and inserting <quote>the World Trade Center Health Program Fund under section 3351 for fiscal year 2033 and, notwithstanding subsections (b) and (c), remain available, for the purposes described in this title, through fiscal year 2090 in accordance with subsection (a)(5) of section 3351 and subject to the spending limitations under subsection (c) of such section</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8b75e28b3054a189fcaf42929ccdf9e"><enum>(2)</enum><header>Special fund</header><text>Section 3353(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-63">42 U.S.C. 300mm–63(d)</external-xref>) is amended by striking <quote>the Treasury as miscellaneous receipts</quote> and inserting <quote>the World Trade Center Health Program Fund under section 3351 for fiscal year 2034 and, notwithstanding subsections (b) and (c), remain available, for the purposes described in this title, through fiscal year 2090 in accordance with subsection (a)(5) of section 3351 and subject to the spending limitations under subsection (c) of such section</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60e6c56f6332415cbc5ab3aa1f2bd4f4"><enum>(3)</enum><header>Pentagon/shanksville fund</header><text>Section 3354(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-64">42 U.S.C. 300mm–64(d)</external-xref>) is amended by striking <quote>the Treasury as miscellaneous receipts</quote> and inserting <quote>the World Trade Center Health Program Fund under section 3351 for fiscal year 2034 and, notwithstanding subsections (b) and (c), remain available, for the purposes described in this title, through fiscal year 2090 in accordance with subsection (a)(5) of section 3351 and subject to the spending limitations under subsection (c) of such section</quote>.</text></paragraph><paragraph id="ideb373da3c62048d8b0f23508a9c5cc05" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Availability</header><text>Section 3351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-61">42 U.S.C. 300mm–61</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf9f4b2d0051f46c2995bbc8d51b69411"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(5), by inserting <quote>or deposited into the Fund under any other section in this title,</quote> before <quote>for a fiscal year</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82acce0bc01d41e4b718aef19ea6902a"><enum>(B)</enum><text>in subsection (b)(1), by inserting <quote>or any other section in this title</quote> after <quote>subsection (a)(2)</quote>.</text></subparagraph></paragraph></subsection></section><section id="idC5AFF0EBF7FE4E0F87EAA22AF03554EE"><enum>7.</enum><header>Offset</header><subsection id="id177FB7FE626D4E2A81CB9260F73D6263"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 251A(6)(D) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/901a">2 U.S.C. 901a(6)(D)</external-xref>) is amended—</text><paragraph id="id5A8C0991881A4F3CB404699CF951F634"><enum>(1)</enum><text>in clause (i), by striking <quote>8 months</quote> and inserting <quote>10 months</quote>; and</text></paragraph><paragraph id="id1CC964766712491488923EBBB24BF01F"><enum>(2)</enum><text>in clause (ii), by striking <quote>4 months</quote> and inserting <quote>2 months</quote>.</text></paragraph></subsection><subsection id="idF23EBFD2DBD24AD8A03072A528EB68C0" commented="no"><enum>(b)</enum><header>Deposit of excess savings in the Medicare Improvement Fund</header><paragraph id="id6BF1E2A390BC4760917845CFABD10FCE" commented="no"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>excess savings</term> means the difference obtained by subtracting—</text><subparagraph id="id0067B23F72BE422E829AB96374287CF2" commented="no"><enum>(A)</enum><text>the amount of the budgetary effects (as determined in accordance with the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/931">2 U.S.C. 931 et seq.</external-xref>)) of sections 2 through 6 of this Act; from </text></subparagraph><subparagraph commented="no" id="id05B6C40723D8452AB40AC23AACF9676C"><enum>(B)</enum><text>the amount of the budgetary effects (as determined in accordance with the Statutory Pay-As-You-Go Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/2/931">2 U.S.C. 931 et seq.</external-xref>)) of the amendment made by subsection (a) of this section.</text></subparagraph></paragraph><paragraph commented="no" id="id5DEC4E5C2DF84187B91736639945BDBB"><enum>(2)</enum><header>Deposit</header><text>The amount of any excess savings shall be transferred to and merged with amounts in the Medicare Improvement Fund established under section 1898 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395iii">42 U.S.C. 1395iii</external-xref>). Amounts transferred under this paragraph shall remain available until expended.</text></paragraph></subsection></section></legis-body></bill>
