understanding scale and scope of problematic research collaboration between China and recipients of Federal research funding</header><subsection commented="no" display-inline="no-display-inline" id="id04db20c7e5fb40e1b07be9540013cf83"><enum>(a)</enum><header>Requirement To convene working group</header><text display-inline="yes-display-inline">Pursuant to section 904(e)(7)(B) of the Counterintelligence Enhancement Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/50/3383">50 U.S.C. 3383(e)(7)(B)</external-xref>), the Director of the National Counterintelligence and Security Center shall convene a working group of officials and individuals in the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), Federal grant-making agencies, and outside experts to better understand the scale and scope of problematic research collaboration between the People's Republic of China and recipients of funds from the Federal Government.</text></subsection><subsection id="idbcec955db0d74d79a99b3a15e3cce28a"><enum>(b)</enum><header>Activities</header><text display-inline="yes-display-inline">The working group convened pursuant to subsection (a) shall—</text><paragraph id="ide75fec8471ae4d38be9bdbf198acaf7d"><enum>(1)</enum><text>expand the scope of previous counterintelligence efforts relating to research security threats, which focused primarily on foreign talent recruitment programs;</text></paragraph><paragraph id="id0b9f4c5824844e1cbbbf8a81e5378734"><enum>(2)</enum><text>conduct open-source research for counterintelligence efforts on published research, bibliometric data, and other publicly available data;</text></paragraph><paragraph id="id71a77a87f02d4180ae2584c44b523714"><enum>(3)</enum><text>identify the problematic research collaborations described in subsection (a) that pose the highest potential risk to the national security of the United States from entities within the defense industrial base of China and other entities the working group determines present a high-risk to the Federal Government; and</text></paragraph><paragraph id="id67a92836b43c4195bd984439fe6d2b84"><enum>(4)</enum><text>publish, on a semiannual basis, a database in accordance with subsection (c).</text></paragraph></subsection><subsection id="id258f826ec6e64f44a0119cd0066c9a01"><enum>(c)</enum><header>Threats to Research, Universities, Science, and Technology database</header><paragraph commented="no" display-inline="no-display-inline" id="idab4f833b426e4dc9a96a017dc10272db"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><subparagraph commented="no" display-inline="no-display-inline" id="idf03530541d7f4f6fb1a7f8239cdc189c"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The working group convened pursuant to subsection (a) shall establish an unclassified database to serve as a comprehensive resource for the Department of Defense, the intelligence community (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), and other Federal grant-making agencies for conducting due diligence and risk review determinations for fundamental, controlled, or classified research grant award approvals, denials, or revocations.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84c98320eca14055bae8e986ad903a9c"><enum>(B)</enum><header>Designation</header><text>The database established pursuant to subparagraph (A) shall be known as the <quote>Threats to Research, Universities, Science, and Technology</quote> database or the <quote>TRUST</quote> database (referred to in this subsection as the <quote>Database</quote>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02c4c64c61e84a1d87e5cd4876093658"><enum>(2)</enum><header>Contents</header><text>The Database shall include—</text><subparagraph id="id73d61a090f33459c9004b4f719f11143"><enum>(A)</enum><text>a catalog of entities, with supporting open-source documentation, that support the defense research, development, and industrial bases of China, including—</text><clause commented="no" display-inline="no-display-inline" id="idce2c99ddc14e4453b9acae8dcb6d6db1"><enum>(i)</enum><text display-inline="yes-display-inline">universities and their subdivisions; </text></clause><clause commented="no" display-inline="no-display-inline" id="idce1a709448d641d48a25c1e3e7e0610b"><enum>(ii)</enum><text display-inline="yes-display-inline">state and national defense key laboratories; </text></clause><clause commented="no" display-inline="no-display-inline" id="idd6568d559eca41c29424f1d9c38c3f7e"><enum>(iii)</enum><text display-inline="yes-display-inline">provincial-level key laboratories; </text></clause><clause commented="no" display-inline="no-display-inline" id="idde37fe18bb754169818ba739283751f2"><enum>(iv)</enum><text display-inline="yes-display-inline">research institutes subordinate to defense state-owned enterprises; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida027e01f02094bf8a22f7be5538ef72c"><enum>(v)</enum><text display-inline="yes-display-inline">other business enterprises involved in military-civil fusion programs that are partially or majority owned by universities or the Chinese Academy of Sciences;</text></clause></subparagraph><subparagraph id="idd28e2d4c671141d899fb1a1fe247f08e"><enum>(B)</enum><text>mapping of the People's Republic of China’s State Administration for Science and Technology Industry for National Defense, including a focus on developing defense-related academic disciplines, key laboratories, and research groups at the universities;</text></subparagraph><subparagraph id="idfd1aa0b2f6ee41ffb6869ed343fd3e8a"><enum>(C)</enum><text>identifying entities of the People's Republic of China engaging in critical technology research, including institutions, centers of excellence, laboratories, or personnel that conduct research in disciplines or subdisciplines of critical importance to the national and economic security of the United States;</text></subparagraph><subparagraph id="id3769a79b7d744a2c80ca70d39ea4c32b"><enum>(D)</enum><text>mapping research institution links to the defense industry of the People's Republic of China, including subsidiaries and research institutes subordinate to major People's Republic of China state-owned defense enterprises; and</text></subparagraph><subparagraph id="id1b27b2debb364498a36f83ef6372657e" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>identifying other research entities and programs of the People's Republic of China tied to defense, including civilian universities and government research organizations that engage in defense research projects through formal partnerships or research collaboration with People's Republic of China defense entities, state-owned enterprises, or receipt of People's Republic of China defense program funding. </text></subparagraph></paragraph></subsection><subsection id="id01ef8182e2c546b19534073f048e7c2a"><enum>(d)</enum><header>Annual report</header><text>The working group convened pursuant to subsection (a) shall submit an annual report to Congress containing a description of the progress and findings of the database.</text></subsection></section><section id="id20F8B5CAE318484CAC8441129EDA8B16"><enum>3.</enum><header>Research integrity and security</header><subsection commented="no" display-inline="no-display-inline" id="idb85407ba82624c22aff43cf3587e5b0d"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Research Integrity and Security Act of 2024</short-title></quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6595f329d7584fec88eef038123ebf9c"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8c6762ed9ba14be08a4d58104aae5804"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ida070fabea44749b28087f496e424e675"><enum>(A)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id857295bf1c6d4672bc53b826607849ac"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0686d3efb25b427d92922684ba29a358"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e87005a394e40709249874643b910ef"><enum>(D)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id313277064bc344ea955c65af1a918eb8"><enum>(E)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57643ffefd4c45d2866bb63d48ae060b"><enum>(F)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec5dd1e7cf0541aa942493e7af0bfe36"><enum>(G)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>;</text></subparagraph><subparagraph id="idd444bc17edfa48849fbec7e6d07b02bd"><enum>(H)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44c5574917464dbaadb7843e3a84981b"><enum>(I)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Education and the Workforce of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd1910fb3804a4a8d802d3bd089f890ff"><enum>(J)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcce946e3e85846c28f8473c2c7243f6d"><enum>(K)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Small Business of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c69d6abb70f49f99380cb4ee1b3d6fb"><enum>(L)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Science, Space, and Technology of the House of Representatives</committee-name>; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f3a5f838fd74776adf426c577424b8d"><enum>(M)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>. </text></subparagraph></paragraph><paragraph id="id2b0cc884ccec431ca140054b854c16a5"><enum>(2)</enum><header>Country of concern</header><text>The term <term>country of concern</term> means—</text><subparagraph id="ida630468d4199458ea3ea9373a08b566d"><enum>(A)</enum><text>any country (including any special administrative region of such country) identified as a threat to the national security of the United States in the most recent report submitted to Congress by the Director of National Intelligence pursuant to section 108B of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3043b">50 U.S.C. 3043b</external-xref>) (commonly referred to as the <quote>Annual Threat Assessment</quote>); or</text></subparagraph><subparagraph id="id94ddd5309abb48f3be644332751677e0"><enum>(B)</enum><text>any covered nation (as defined in section 4872(d)(2) of title 10, United State Code).</text></subparagraph></paragraph><paragraph id="id2ba0335977db400290a6ac137cab47ba"><enum>(3)</enum><header>Federal agency</header><text>The term <quote>Federal agency</quote> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code.</text></paragraph><paragraph id="id84417fc48cec405ea6d81d6adf558d80"><enum>(4)</enum><header>Federal grant</header><text>The term <term>Federal grant</term>—</text><subparagraph id="idfe5b402eb64e4066be34496586219da5"><enum>(A)</enum><text>means a grant awarded by a Federal agency; and</text></subparagraph><subparagraph id="id2de6f77fb39f40cdb4d67e5dafb40120"><enum>(B)</enum><text>includes a subgrant awarded by a non-Federal entity to carry out a Federal grant program.</text></subparagraph></paragraph><paragraph id="idbce42e617dc040e889c6d0d84f5f7c55"><enum>(5)</enum><header>Federal grant application</header><text>The term <term>Federal grant application</term> means an application for a Federal grant.</text></paragraph><paragraph id="id6846885847674da584bbb4adb96be594"><enum>(6)</enum><header>Foreign compensation</header><text>The term <term>foreign compensation</term> means a title, monetary compensation, access to a laboratory or other resource, or other benefit received from—</text><subparagraph id="idd06b73217e96417d93f0dcd8fb5dbb66"><enum>(A)</enum><text>a foreign government;</text></subparagraph><subparagraph id="id08f31e75f9414ca9a23e35b190908670"><enum>(B)</enum><text>a foreign government institution; or</text></subparagraph><subparagraph id="idd465f0daee984059930f25c529f4e0a1"><enum>(C)</enum><text>a foreign public enterprise.</text></subparagraph></paragraph><paragraph id="id43bb263f36bd40c993520d9c6dd2c28d"><enum>(7)</enum><header>Foreign government</header><text>The term <term>foreign government</term> includes a person acting or purporting to act on behalf of a faction, party, department, agency, bureau, subnational administrative entity, or military of a country of concern.</text></paragraph><paragraph id="id9602c256f8f944398e2dba5472a46734"><enum>(8)</enum><header>Foreign government institution</header><text>The term <term>foreign government institution</term> means any foreign entity owned by, subject to the control of, or subject to the laws or regulations of a country of concern.</text></paragraph><paragraph id="ida3dc05276704410dbeb62954197f29b9"><enum>(9)</enum><header>Foreign government enterprise</header><text>The term <term>foreign government enterprise</term> means an enterprise over which a foreign government directly or indirectly exercises a dominant influence.</text></paragraph><paragraph id="id3de0a3923ede4091b422cd61bd8c77dc"><enum>(10)</enum><header>Fundamental research</header><text>The term <term>fundamental research</term> means basic and applied research in science, engineering, or mathematics, the results of which ordinarily are published and shared broadly within the scientific community, and for which the researchers have not accepted restrictions for proprietary or national security concerns. </text></paragraph><paragraph id="idf6803128d45641ad87c4efe23dfc73ce"><enum>(11)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>). </text></paragraph><paragraph id="id796c4a0d106949e196d5e213328927cc"><enum>(12)</enum><header>Law enforcement agency</header><text>The term <term>law enforcement agency</term>—</text><subparagraph id="id3f86fe78766d46b4b0dfc6e8f60a605b"><enum>(A)</enum><text>means a Federal, State, local, or Tribal law enforcement agency; and</text></subparagraph><subparagraph id="ide594822efc7640448206e6ec43f8f929"><enum>(B)</enum><text>includes—</text><clause id="id927681f815294c05b4a49d00ac8a986b"><enum>(i)</enum><text>the Office of Inspector General of an establishment (as defined in section 401 of title 5, United States Code) or a designated Federal entity (as defined in section 415 of title 5, United States Code); and</text></clause><clause id="id5186eddb01444fad94a9968b2cc97dd0"><enum>(ii)</enum><text>the Office of Inspector General, or similar office, of a State or unit of local government.</text></clause></subparagraph></paragraph><paragraph id="ide57fbff193364d21a393ebdf0f03c2ad"><enum>(13)</enum><header>Outside compensation</header><text>The term <term>outside compensation</term> means any compensation, resource, or support (regardless of monetary value) made available to the applicant in support of, or related to, any research endeavor, including a title, research grant, cooperative agreement, contract, institutional award, access to a laboratory, or other resource, including materials, travel compensation, or work incentives.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idccf1495110e341d8854e562148d915e4"><enum>(c)</enum><header>Protection of federally funded research</header><paragraph id="id7738c6c04cef47e5bafa6734b2b329e1"><enum>(1)</enum><header>In general</header><text>The United States Government may not collaborate with a country of concern on fundamental research intended to support the military, intelligence, or security capabilities of the United States.</text></paragraph><paragraph id="id51c2be5509b040479c7ef1c7d3272bb0"><enum>(2)</enum><header>Prohibition</header><text>Neither the Secretary of Defense nor the Secretary of Energy may approve a Federal grant application for fundamental research that—</text><subparagraph id="id0bcd3704b41f4651aa3fce87272e9dbd"><enum>(A)</enum><text>is ultimately intended to further the military, security, or intelligence capabilities of the United States;</text></subparagraph><subparagraph id="idf4996659017042d580db1c62f5b216bd"><enum>(B)</enum><text>is used to support the defense industrial base of the United States; and</text></subparagraph><subparagraph id="id4af44421b9c24fc78a66d30350a827bf"><enum>(C)</enum><text>will be jointly reviewed by or conducted with—</text><clause commented="no" display-inline="no-display-inline" id="idf262cebb79cc40898f2a5c984e288b15"><enum>(i)</enum><text display-inline="yes-display-inline">a foreign government, foreign government institution, or foreign government enterprise from a country of concern; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id007daef6e69745838c288b7145c3983c"><enum>(ii)</enum><text display-inline="yes-display-inline">any person that is receiving foreign compensation or outside compensation from a country of concern.</text></clause></subparagraph></paragraph><paragraph id="id9c43aec08739489e9ea9099ef9aba153"><enum>(3)</enum><header>Exception</header><text>The prohibition under paragraph (2) shall not apply to an activity that is—</text><subparagraph id="ida3a62199d7a641e0a59dd7d12ce3b424"><enum>(A)</enum><text>carried out in connection with a lawfully authorized investigative, protective, or intelligence activity of—</text><clause id="idca051b3256eb4c7e8abab17563798e1d"><enum>(i)</enum><text>a law enforcement agency; or</text></clause><clause id="id41d72811a88b41a1835782e135d77078"><enum>(ii)</enum><text>a Federal intelligence agency; or</text></clause></subparagraph><subparagraph id="idbc4a1c3b56d244848392bf146f074f80"><enum>(B)</enum><text>authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/224">chapter 224</external-xref> of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="ide733eb2d8ba14a099234ba7033ae1d28"><enum>(4)</enum><header>National security waiver for research</header><text>The Secretary of Defense and the Secretary of Energy may waive the prohibition under paragraph (2) if either Secretary determines and certifies to the appropriate congressional committees that approving such Federal grant application—</text><subparagraph commented="no" display-inline="no-display-inline" id="idac332ea42ee34bd085e5af5741429fc9"><enum>(A)</enum><text display-inline="yes-display-inline">is in the national security interest of the United States; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7a96a0781eb4e8f8e68f40151967bde"><enum>(B)</enum><text display-inline="yes-display-inline">does not pose an intelligence or national security risk.</text></subparagraph></paragraph></subsection><subsection id="idd3b02e571e0f487dbe95d85bf420dcdf"><enum>(d)</enum><header>Penalties and reporting</header><paragraph id="id744d3c5b7612452681718b80a2e78b69"><enum>(1)</enum><header>Penalty on institutions</header><text>Any institution of higher education that has been awarded a Federal grant by the Department of Defense or the Department of Energy for research intended to support the military, security, or intelligence capabilities of the United States and is found by the Inspector General of the agency concerned to be collaborating with a foreign government, a foreign government institution, or a foreign government enterprise from a country of concern with respect to such research shall repay the full value of such grant to the Federal agency that originally approved the Federal grant application.</text></paragraph><paragraph id="id1e8d7ae0d99b4640862826a9340908fe"><enum>(2)</enum><header>Reports by inspectors general</header><text>Not later than 2 years after the date of the enactment of this Act, and annually thereafter, the Inspector General of the Department of Defense and the Inspector General of the Department of Energy shall each submit to the appropriate congressional committees a report, which shall include, with respect to the reporting period—</text><subparagraph id="id58faf2ffea2b4d0b98361757bb55f658"><enum>(A)</enum><text>a list of projects that have received a Federal grant from the Federal agency concerned; and</text></subparagraph><subparagraph id="id708d39d3813f4604b5e488ddeacdecc0"><enum>(B)</enum><text>a description of each project included in the list described in subparagraph (A) that indicates whether, in connection with such project—</text><clause commented="no" display-inline="no-display-inline" id="id53ffc6b257a04c9db6c4809b3934de1b"><enum>(i)</enum><text display-inline="yes-display-inline">a foreign government, foreign government institution, or foreign government enterprise from a country of concern has received a Federal grant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e30c4ae073d46ddad1b1cb77d61f649"><enum>(ii)</enum><text display-inline="yes-display-inline">a person receiving foreign compensation or outside compensation from a country of concern has received a Federal grant.</text></clause></subparagraph></paragraph><paragraph id="id033835c65c3c427dbf5e542276c16970"><enum>(3)</enum><header>GAO report</header><text>Not later than 3 years after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall—</text><subparagraph id="id9a39859a4fa846c096ea5ed41800d771"><enum>(A)</enum><text>review each report submitted for the calendar year pursuant to paragraph (2); and</text></subparagraph><subparagraph id="idca42ede9e3da4f04bf6de5064efb30e9"><enum>(B)</enum><text>determine if a foreign government, a foreign government institution, or a foreign government enterprise from a country of concern has received a Federal grant.</text></subparagraph></paragraph><paragraph id="id728909851edf4a5696a2ba8de0f301df" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Requests by chairperson and ranking member of appropriate congressional committees</header><text>The chairperson and ranking member of each appropriate congressional committee may jointly submit to the Comptroller General of the United States a written request to audit any Federal agency that has approved a Federal grant application for fundamental research ultimately intended to support the military, security, or intelligence capabilities of the United States.</text></paragraph></subsection></section><section id="id536f4e80007a458ea2281690ceb3fdf9"><enum>4.</enum><header>Study on United States research partnerships with the People's Republic of China</header><subsection commented="no" display-inline="no-display-inline" id="id7496c13bed4b4faa9e7bb83176d88b6a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Under Secretary of Defense for Research and Engineering shall complete a study concerning United States Government-funded research conducted by United States persons who conduct such research in the United States and in the People’s Republic of China. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id11b670dff4d04e4c8946a8875428455d"><enum>(b)</enum><header>Assessment</header><text display-inline="yes-display-inline">The study conducted pursuant to subsection (a) shall assess—</text><paragraph commented="no" display-inline="no-display-inline" id="id4809c42e70ca4fcfa03d65a4771f7b9c"><enum>(1)</enum><text display-inline="yes-display-inline">whether the United States Government has benefitted from similar research partnerships, publications, accommodations, or access to resources while conducting research in the People's Republic of China that is funded by the United States Government; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c58a03d043b41cebfa2494db5768737"><enum>(2)</enum><text display-inline="yes-display-inline">the principles of fundamental research and the open research enterprise by United States persons while conducting research in the United States and in the People's Republic of China. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id54ab766b862f419d9322d58b2d1afea4"><enum>(c)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 30 days after completing the study pursuant to this section, the Under Secretary of Defense for Research and Engineering shall brief the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>, the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>, the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>, and the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name> regarding the results of such study. </text></subsection></section><section id="id606e49bcd34d46beb4e99d0a6b6577bb"><enum>5.</enum><header>Federal grant application fraud</header><subsection id="ide399156c3777487db8d5c5796721b7a9"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id130ae89012634dfb94ef40400db99948"><section id="id085cfad49dac414e8b152627cde3c074"><enum>1041.</enum><header>Federal grant application fraud</header><subsection id="id04f792a5245048858dcd98837969fe6e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idb18df32968b644e69275023a7d5981ef"><enum>(1)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5.</text></paragraph><paragraph id="id8355e8a41738470c8e6b88bf087f7f34"><enum>(2)</enum><header>Federal grant</header><text>The term <term>Federal grant</term>—</text><subparagraph id="id7b80c07fc41345aa85853eb536beb24f"><enum>(A)</enum><text>means a grant awarded by a Federal agency;</text></subparagraph><subparagraph id="ide115178c6cd34aa5bd15f80aa4059186"><enum>(B)</enum><text>includes a subgrant awarded by a non-Federal entity to carry out a Federal grant program; and</text></subparagraph><subparagraph id="idc42a0f14b17f46a7892724f6fc615640"><enum>(C)</enum><text>does not include—</text><clause id="id7b05fa98a1f34d83aeab467dc5899138"><enum>(i)</enum><text>direct United States Government cash assistance to an individual;</text></clause><clause id="ida7467b51c2bf4dbfb56f634532cf656c"><enum>(ii)</enum><text>a subsidy;</text></clause><clause id="id43a6b31f2a984c3ebe6f8f2870b278bc"><enum>(iii)</enum><text>a loan;</text></clause><clause id="id4e92e6f7da1942a5a28bd976f6b612b1"><enum>(iv)</enum><text>a loan guarantee; or</text></clause><clause id="id4a03714b1e55416db4db9aaf7bc6c9fb"><enum>(v)</enum><text>insurance.</text></clause></subparagraph></paragraph><paragraph id="idad48952de36e42e7984632a4648865eb"><enum>(3)</enum><header>Federal grant application</header><text>The term <term>Federal grant application</term> means an application for a Federal grant.</text></paragraph><paragraph id="idf6a99d90b95e465092a62bfa500badd5"><enum>(4)</enum><header>Foreign compensation</header><text>The term <term>foreign compensation</term> means a title, monetary compensation, access to a laboratory or other resource, or other benefit received from—</text><subparagraph id="id60a0185826604524b3016dee5aedbf41"><enum>(A)</enum><text>a foreign government;</text></subparagraph><subparagraph id="idda6c4c47b47b45a886980da4e8da5bbc"><enum>(B)</enum><text>a foreign government institution; or</text></subparagraph><subparagraph id="id713fa92396e74986979cd9fc724aa282"><enum>(C)</enum><text>a foreign public enterprise.</text></subparagraph></paragraph><paragraph id="ide80e96f2a4054ee2bc58bd35fa029a52"><enum>(5)</enum><header>Foreign government</header><text>The term <term>foreign government</term> includes a person acting or purporting to act on behalf of—</text><subparagraph id="id6ef1acadd303431b930695ccda539574"><enum>(A)</enum><text>a faction, party, department, agency, bureau, subnational administrative entity, or military of a foreign country; or</text></subparagraph><subparagraph id="id988b1033ca78463b914ade1bc3552be3"><enum>(B)</enum><text>a foreign government or a person purporting to act as a foreign government, regardless of whether the United States recognizes the government.</text></subparagraph></paragraph><paragraph id="idd06accf370ee4428a0ed626815274c37"><enum>(6)</enum><header>Foreign government institution</header><text>The term <term>foreign government institution</term> means a foreign entity owned by, subject to the control of, or subject to regulation by a foreign government.</text></paragraph><paragraph id="idceb03efad7d94b409c7500aea0281349"><enum>(7)</enum><header>Foreign public enterprise</header><text>The term <term>foreign public enterprise</term> means an enterprise over which a foreign government directly or indirectly exercises a dominant influence.</text></paragraph><paragraph id="id26224f7705c542cb88eecdab53c1ea1d"><enum>(8)</enum><header>Law enforcement agency</header><text>The term <term>law enforcement agency</term>—</text><subparagraph id="iddaf88d08da884beb82c78b2c417b97ae"><enum>(A)</enum><text>means a Federal, State, local, or Tribal law enforcement agency; and</text></subparagraph><subparagraph id="id4277a63e13a64123aef164eeb6921eff"><enum>(B)</enum><text>includes—</text><clause id="id8042666f26bb45eb839c991f1c5f2a55"><enum>(i)</enum><text>the Office of Inspector General of an establishment (as defined in section 401 of title 5) or a designated Federal entity (as defined in section 415 of title 5); and</text></clause><clause id="id3a6108d343e34b0184a8a9abed8d149d"><enum>(ii)</enum><text>the Office of Inspector General, or similar office, of a State or unit of local government.</text></clause></subparagraph></paragraph><paragraph id="id5ace460f955a48dd9752b14136d2bab9"><enum>(9)</enum><header>Outside compensation</header><text>The term <term>outside compensation</term> means any compensation, resource, or support (regardless of monetary value) made available to the applicant in support of, or related to, any research endeavor, including a title, research grant, cooperative agreement, contract, institutional award, access to a laboratory, or other resource, including materials, travel compensation, or work incentives.</text></paragraph></subsection><subsection id="id7ee6200552a54529a84978b1d19ddbda"><enum>(b)</enum><header>Prohibition</header><text>Except as provided in subsection (c), it shall be unlawful for any individual to knowingly—</text><paragraph id="id12a968eb884f46b2a1e4d66667366794"><enum>(1)</enum><text>prepare or submit a Federal grant application that fails to disclose the receipt of any outside compensation, including foreign compensation, by the individual;</text></paragraph><paragraph id="idb1e49525c52a4c1d88922971f73fe80e"><enum>(2)</enum><text>forge, counterfeit, or otherwise falsify a document for the purpose of obtaining a Federal grant; or</text></paragraph><paragraph id="id7576e23a77f94c4ca6895fed62511c34"><enum>(3)</enum><text>prepare, submit, or assist in the preparation or submission of a Federal grant application or document in connection with a Federal grant application that—</text><subparagraph id="id754e9e6ffa3545048890e6e1632e3a55"><enum>(A)</enum><text>contains a false statement;</text></subparagraph><subparagraph id="ide521aeb1791d4a749edbe1fd4c3f0144"><enum>(B)</enum><text>contains a material misrepresentation;</text></subparagraph><subparagraph id="id5536ce3ede91411aaaa3441d42dceff3"><enum>(C)</enum><text>has no basis in law or fact; or</text></subparagraph><subparagraph id="id11b0e9e1c72a4b9a8a3e6c9eb0666bd4"><enum>(D)</enum><text>fails to disclose a material fact.</text></subparagraph></paragraph></subsection><subsection id="id6220f25958f443cab215b5e8fbe4e20c"><enum>(c)</enum><header>Exception</header><text>Subsection (b) shall not apply to an activity—</text><paragraph id="id634716a4220f42cc8a7b820e30c2d46e"><enum>(1)</enum><text>carried out in connection with a lawfully authorized investigative, protective, or intelligence activity of—</text><subparagraph id="id2a61c06276ea47eca5d6faffa7b74b8d"><enum>(A)</enum><text>a law enforcement agency; or</text></subparagraph><subparagraph id="ideceb54779892440e85be409dae3ed904"><enum>(B)</enum><text>a Federal intelligence agency; or</text></subparagraph></paragraph><paragraph id="idf94e81d8048e4f86b58d2b804a68c341"><enum>(2)</enum><text>authorized under chapter 224.</text></paragraph></subsection><subsection id="id91095dbac8a841448129690154b61633"><enum>(d)</enum><header>Penalty</header><text>Any individual who violates subsection (b)—</text><paragraph id="id76d908f8e2a540d1a11ba81f498dc65a"><enum>(1)</enum><text>shall be fined in accordance with this title, imprisoned for not more than 5 years, or both; and</text></paragraph><paragraph id="id890d28652e144a1bb4375c904f70a7d3"><enum>(2)</enum><text>shall be prohibited from receiving a Federal grant during the 5-year period beginning on the date on which a sentence is imposed on the individual pursuant to paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0720feba5fb54a38929d25ea7f8b120e"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><toc><toc-entry level="section" bold="off"><quote>1041. Federal grant application fraud.</quote>.</toc-entry></toc></subsection></section><section id="id8196afc7c7de4643b6e0c4ee2acca2e7"><enum>6.</enum><header>Restricting the acquisition of emerging technologies by certain aliens</header><subsection id="id7f691ddb89fc4f508f90f40971ffc29a"><enum>(a)</enum><header>Report</header><text>Not later than 3 months after the date of the enactment of this Act, and semiannually thereafter, the Secretary of State, in consultation with the Director of National Intelligence, and the heads of other relevant Federal agencies, shall submit a classified report to the congressional committees listed in subsection (d)(1) that identifies any alien that—</text><paragraph commented="no" display-inline="no-display-inline" id="id618c1669086449e2b2087697543e298f"><enum>(1)</enum><text display-inline="yes-display-inline">is employed by or collaborates with—</text><subparagraph id="id4abe5d4f577e492cbd03f6b036a95570"><enum>(A)</enum><text>a foreign military and security related organization that is adversarial to the United States;</text></subparagraph><subparagraph id="idc9893c6837874148a65549af9981fafa"><enum>(B)</enum><text>a foreign institution that is involved in the theft of United States research;</text></subparagraph><subparagraph id="id41a23ce82e2c4287bc5712b69d5ec0fc"><enum>(C)</enum><text>any entity involved in export control violations or the theft of intellectual property;</text></subparagraph><subparagraph id="id0b60d4f5c1dd40dbadeec842b9c9ad14"><enum>(D)</enum><text>a foreign government that seeks to undermine the integrity and security of the United States research community; or</text></subparagraph></paragraph><paragraph id="id35efea0ea36340cba88a1dee457a659f"><enum>(2)</enum><text>associates or collaborates with any entity that poses a national security threat based on intelligence assessments.</text></paragraph></subsection><subsection id="id5939cb7625e0413290074d9ff62b2c1b"><enum>(b)</enum><header>Designations of certain aliens seeking To acquire emerging technologies</header><paragraph id="ide3a51b9ec2d846e9bd2421409e70e87d"><enum>(1)</enum><header>In general</header><text>The Secretary of State, in coordination with other relevant Federal departments and agencies, shall identify persons identified pursuant to subsection (a) who are seeking to knowingly acquire sensitive or emerging technologies to undermine national security interests of the United States by benefitting an adversarial foreign government’s security or strategic capabilities.</text></paragraph><paragraph id="idb23e9da6c51349348d1a70822095cfba"><enum>(2)</enum><header>Relevant factors</header><text>To determine if an alien identified pursuant to subsection (a) is seeking to knowingly acquire sensitive or emerging technologies to undermine national security interests of the United States by benefitting an adversarial foreign government’s security or strategic capabilities, the Secretary of State shall— </text><subparagraph id="idd617aa228df34cd89e0e14459c3d9fdc"><enum>(A)</enum><text>consider information and analyses relevant to implementing subsection (a) from the Office of the Director of National Intelligence, the Department of Health and Human Services, the Department of Defense, the Department of Homeland Security, the Department of Energy, the Department of Commerce, and other appropriate Federal agencies; and</text></subparagraph><subparagraph id="id4b9e7ba9a8de4b838331a09a3f1f67db"><enum>(B)</enum><text>consider the continual expert assessments of evolving sensitive or emerging technologies that foreign adversaries are targeting.</text></subparagraph></paragraph></subsection><subsection id="iddbacbc1cceec4df7b094ce043984cc81"><enum>(c)</enum><header>Ineligibility for visas, admission, or parole</header><paragraph id="idb29c6a42bda04629be43e143deb627a2"><enum>(1)</enum><header>Visas, admission, and parole</header><text>Except as provided in subsection (f), any alien identified pursuant to subsection (b)(1) is—</text><subparagraph id="id5b7141f825b44604a589264c2ab7e8ab"><enum>(A)</enum><text>inadmissible to the United States;</text></subparagraph><subparagraph id="id056f74383137467cbb1954b05b0b8f8f"><enum>(B)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></subparagraph><subparagraph id="id186510220ff44e9b88fba5865c5ae6c9"><enum>(C)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="ideebbef357a4f425abd4696aa9a7ef18e"><enum>(2)</enum><header>Current visas revoked</header><subparagraph id="id0ea7ddc5509248dcb35fbf0eedaab603"><enum>(A)</enum><header>In general</header><text>Except as provided in subsection (f), any alien identified pursuant to subsection (b)(1) is subject to revocation of any visa or other entry documentation, regardless of when the visa or other entry documentation is or was issued.</text></subparagraph><subparagraph id="id4d3645daab0649c5ad8cc9f8b794c9f5"><enum>(B)</enum><header>Immediate effect</header><text>A revocation authorized under subparagraph (A)—</text><clause id="idd26700fbf58041638b8b603f04838fd9"><enum>(i)</enum><text>shall take effect immediately; and</text></clause><clause id="id92a03c40bdd34142a6e8cf7a16a5df34"><enum>(ii)</enum><text>shall automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text></clause></subparagraph><subparagraph id="id650a741d83ba4b3bbae61ff93cfeffd7"><enum>(C)</enum><header>Public availability of information</header><text>Information about the denial or revocation of a visa or other documentation under this paragraph shall be made available to the public. </text></subparagraph></paragraph></subsection><subsection id="id6c4f072754bd41808cae02a4d2a888db"><enum>(d)</enum><header>Reporting requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id55d1baf4df074218973c8e379d4e4846"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State, in coordination with the Director of National Intelligence, the Director of the Office of Science and Technology Policy, the Secretary of Homeland Security, the Secretary of Defense, the Secretary of Energy, the Secretary of Commerce, and the heads of other relevant Federal agencies, shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name> that identifies—</text><subparagraph id="idfc3c8b258e994c11a874f29f6655af0e"><enum>(A)</enum><text>any criteria, if relevant used to describe the aliens to which the grounds of inadmissibility described in subsection (c) may apply; and</text></subparagraph><subparagraph id="idae05fa93908546aeaf578505db571e88"><enum>(B)</enum><text>the number of individuals identified pursuant to subsection (b)(1), including the nationality of each such individual and the reasons for each such identification.</text></subparagraph></paragraph><paragraph id="id60031f8ab618419c937b3a226aa811d0"><enum>(2)</enum><header>Classification of report</header><text display-inline="yes-display-inline">Each report required under paragraph (1) shall be submitted, to the extent practicable, in an unclassified form, but may be accompanied by a classified annex.</text></paragraph></subsection><subsection id="id0b942b5e9d214ec3aad00dfa2b87887f"><enum>(e)</enum><header>Congressional nomination determination</header><text>Not later than 60 days after receiving a request from the chairman and ranking member of a congressional committee listed in subsection (d)(1) with respect to whether an alien is seeking to knowingly acquire sensitive or emerging technologies to undermine national security interests of the United States by benefitting an adversarial foreign government’s security or strategic capabilities, the President shall—</text><paragraph id="id1937444b63c54c08a6f9b5a495d10696"><enum>(1)</enum><text>determine if such alien meets such criteria; and</text></paragraph><paragraph id="id70147b8d34e84c8187505e93bdd4259b"><enum>(2)</enum><text>submit a classified or unclassified report to such chairman and ranking member with respect to such determination that includes a statement of whether or not the President imposed or intends to impose sanctions with respect to such alien.</text></paragraph></subsection><subsection id="id53c8fb01390147389dc708dd5517f5b8"><enum>(f)</enum><header>Waiver</header><paragraph id="id3c84bb4811f749bf80bea2f2036cdfb8"><enum>(1)</enum><header>In general</header><text>The President, on a case-by-case basis and for a period of not more than 180 days, may waive a requirement under subsection (c) to impose or maintain sanctions with respect to an alien if the President—</text><subparagraph id="id40407504fab841f78a776ec6d6968e40"><enum>(A)</enum><text>determines that such waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph id="iddd9910f410244886a92f03ec2a2e92b3"><enum>(B)</enum><text>not less than 30 days before such waiver takes effect, submits a report to the congressional committees listed in subsection (d)(1) that describes and justifies such waiver.</text></subparagraph></paragraph><paragraph id="id7878270b99f843a890f4d7cab5aea069"><enum>(2)</enum><header>Renewal of waiver</header><text>The President may, on a case-by-case basis, renew a waiver under paragraph (1) for additional periods of not more than 180 days if the President—</text><subparagraph id="id54e475f8ae034585930351bb1839e126"><enum>(A)</enum><text>determines that the renewal of the waiver is in the national security interest of the United States; and</text></subparagraph><subparagraph id="id1f1ce30d67994cb0a0333a0b2405a242"><enum>(B)</enum><text>not less than 15 days before the waiver expires, submits a report to the congressional committees listed in subsection (d)(1) that describes and justifies such renewal. </text></subparagraph></paragraph></subsection></section><section id="id09a49fc34eaf44419335f11cca7f65bd"><enum>7.</enum><header>Machine readable visa documents</header><subsection id="id29537188c00f45929987473d9ef89763"><enum>(a)</enum><header>Machine-Readable documents</header><text>Except as provided in subsection (b), not later than 1 year after the date of the enactment of this Act, the Secretary of State shall—</text><paragraph id="id28d4c7f091694ef18f72f193a437bd11"><enum>(1)</enum><text>require the use of a machine-readable visa application form; and</text></paragraph><paragraph id="id1e6ad3b3a85448daae173c0381d0e584"><enum>(2)</enum><text>make available documents submitted in support of a visa application in a machine readable format to assist in—</text><subparagraph id="id3684139f7c86443cb3ef311464a76bae"><enum>(A)</enum><text>identifying fraud;</text></subparagraph><subparagraph id="id1f2b0b589be94a8cac9a95c5d3516610"><enum>(B)</enum><text>conducting lawful law enforcement activities; and</text></subparagraph><subparagraph id="id563ffae3a8744a7bb7212fb3bde412f6"><enum>(C)</enum><text>determining the eligibility of applicants for a visa under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="id49ed7f344e3d46b0a4c0b5b08e85b57d"><enum>(b)</enum><header>Waiver</header><text>The Secretary of State may waive the requirement under subsection (a) by providing to Congress, not later than 30 days before the effective date of such waiver—</text><paragraph id="id1b47e5569d1a4f46a3c52469030e2bf1"><enum>(1)</enum><text>a detailed explanation for why such waiver is being issued; and</text></paragraph><paragraph id="id3440ab7c95f24303b917eb6ad364edf0"><enum>(2)</enum><text>a timeframe for the implementation of the requirement under subsection (a).</text></paragraph></subsection><subsection id="idd58ea3b81b8a483d929c684bcfcb5d95"><enum>(c)</enum><header>Report</header><text>Not later than 45 days after date of the enactment of this Act, the Secretary of State shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Oversight and Accountability of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that—</text><paragraph id="id11c6bce9140f4a9199a958b786c306ba"><enum>(1)</enum><text>describes how supplementary documents provided by a visa applicant in support of a visa application are stored and shared by the Department of State with authorized Federal agencies;</text></paragraph><paragraph id="id7c8c416ca3194f929955ea31738a0896"><enum>(2)</enum><text>identifies the sections of a visa application that are machine-readable and the sections that are not machine-readable;</text></paragraph><paragraph id="id606b576b490b43bc88086476de469360"><enum>(3)</enum><text>provides cost estimates, including personnel costs and a cost-benefit analysis for adopting different technologies, including optical character recognition, for—</text><subparagraph id="id5d0451c162bb4aeebce2572b6519639f"><enum>(A)</enum><text>making every element of a visa application, and documents submitted in support of a visa application, machine-readable; and</text></subparagraph><subparagraph id="ideb724b5560134c8bbc10834a189e4974"><enum>(B)</enum><text>ensuring that such system—</text><clause id="idc4e4bf5cd21a48eda57fd9be134b4749"><enum>(i)</enum><text>protects personally-identifiable information; and</text></clause><clause id="idaac843b73171488da077f8b3c1f91155"><enum>(ii)</enum><text>permits the sharing of visa information with Federal agencies in accordance with existing law; and</text></clause></subparagraph></paragraph><paragraph id="id5d27b5dcd1264c3f9b258672af67addb"><enum>(4)</enum><text>includes an estimated timeline for completing the implementation of subsection (a).</text></paragraph></subsection></section><section id="id1f47608806bb44118bfa7c5f482e5641"><enum>8.</enum><header>Certifications regarding access to export controlled technology in educational and cultural exchange programs</header><text display-inline="no-display-inline">Section 102(b)(5) of the Mutual Educational and Cultural Exchange Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2452">22 U.S.C. 2452(b)(5)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4547ffd9cad744118ce486b3e4c3743f"><paragraph id="id1f9feef2725143dc8322d4a1ba471c77"><enum>(5)</enum><text>promoting and supporting medical, scientific, cultural, and educational research and development—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida7730c0dad6243caa2c2f11d214a2814"><enum>(A)</enum><text display-inline="yes-display-inline">by developing exchange programs for foreign researchers and scientists, while protecting technologies regulated by export control laws important to the national security and economic interests of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id023a1cd83fa74964a9cb35f5bbb5b5f8"><enum>(B)</enum><text display-inline="yes-display-inline">by requiring the sponsor of an exchange visitor program—</text><clause commented="no" display-inline="no-display-inline" id="ida8bf75b7c07c4a5298198d839c7b9e69"><enum>(i)</enum><text display-inline="yes-display-inline">to certify to the Department of State that the sponsor, after reviewing all regulations related to the Export Controls Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4811">50 U.S.C. 4811 et seq.</external-xref>) and the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>), has determined that—</text><subclause id="id4845f3297bee49b4aa6fe50cce94541c"><enum>(I)</enum><text>a license is not required from the Department of Commerce or the Department of State to release such technology or technical data to the exchange visitor; or</text></subclause><subclause id="ida62af54796a9468ba721dcf5519476ec"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id3df720083812485dbc6d697a1bfc9d21"><enum>(aa)</enum><text>a license is required from the Department of Commerce or the Department of State to release such technology or technical data to the exchange visitor; and</text></item><item id="id1948228b004143beab5447c04520efef" indent="up1"><enum>(bb)</enum><text>the sponsor will prevent access to the controlled technology or technical data by the exchange visitor until the sponsor—</text><subitem id="idd536aba0053e4874beaf14b98da163de"><enum>(AA)</enum><text>has received the required license or other authorization to release it to the visitor; and</text></subitem><subitem id="id787a50dae0e24fa899d380f8f50b0e1f"><enum>(BB)</enum><text>has provided a copy of such license or authorization to the Department of State; and</text></subitem></item></subclause></clause><clause id="idd51fa7a9949b411988a7ab8e0276bf64"><enum>(ii)</enum><text>if the sponsor maintains export controlled technology or technical data, to submit to the Department of State the sponsor’s plan to prevent unauthorized export or transfer of any controlled items, materials, information, or technology at the sponsor organization or entities associated with a sponsor’s administration of the exchange visitor program.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id67dabe4222184842a48034bc1a9d2c8c"><enum>9.</enum><header>Mandatory placement of research and development applicants failing to disclose required information in the Federal Awardee Performance and Integrity Information System</header><text display-inline="no-display-inline">Section 223(c)(2) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/42/6605">42 U.S.C. 6605(c)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf8f41a935f764ad7b1696163b65bb751"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (A) through (G) as clauses (i) through (vii) and moving such clauses 2 ems to the right;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6bcda0047b274a17999c475b0543f72d"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), as redesignated, by striking <quote>may take</quote> and inserting the following: “—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id520F38333AF449CDADA2A997A38F395E"><subparagraph commented="no" display-inline="no-display-inline" id="id45b201de10874245820ff5552d41a3f7"><enum>(A)</enum><text display-inline="yes-display-inline">shall—</text><clause commented="no" display-inline="no-display-inline" id="id006b7721a6f443c789d87a6bd8623107"><enum>(i)</enum><text display-inline="yes-display-inline">indicate, in the Federal Awardee Performance and Integrity Information System, that such individual or entity is noncompliant to give notice to other Federal grant-making agencies; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id99b7053577014f13950fd5943d500eb4"><enum>(ii)</enum><text display-inline="yes-display-inline">disclose, in such system, any business relationship between such individual or entity and any foreign country of concern (as defined in section 9901(7) (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651(7)</external-xref>)), including any funding received by such individual or entity from any agent of such country; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida343c73fc45e4793afc5200a719f600a"><enum>(B)</enum><text display-inline="yes-display-inline">may take</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd80a5866a5244e0890de658b27f524e3"><enum>(3)</enum><text>in subparagraph (B), as redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3f77a4b0ef924e508e36f093306fae9d"><enum>(A)</enum><text display-inline="yes-display-inline">by striking clause (vi); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5393f46e6046409794a45fe3aec06bc5"><enum>(B)</enum><text>by redesignating clause (vii) as clause (vi).</text></subparagraph></paragraph></section><section id="id9d16b5ea2de4425198a9dee6a1a6eb4a"><enum>10.</enum><header>Privacy and confidentiality</header><text display-inline="no-display-inline">Nothing in this Act, or in any amendment made by this Act, may be construed as affecting the rights and requirements provided in—</text><paragraph commented="no" display-inline="no-display-inline" id="ideaa4f6d57a344b5fa32e899f7a5f55a1"><enum>(1)</enum><text display-inline="yes-display-inline">section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>); or </text></paragraph><paragraph id="idd3c871a18d214c618c713ff2e4d9d0b0" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Confidential Information Protection and Statistical Efficiency Act of 2018</quote>). </text></paragraph></section></legis-body></bill>
