which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Land Policy and Management Act of 1976 to clarify the nature of public involvement for purposes of certain rulemaking, and for other purposes.</official-title></form><legis-body><section id="iddd3196ca0b014961a0a931fe6a52b617" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Voices in Federal Lands Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id86953df4791f4f3ea07a427e79d92de0"><enum>2.</enum><header>Public involvement in certain public land rulemaking</header><subsection commented="no" display-inline="no-display-inline" id="id54771e2281614f29bc17002c3595d951"><enum>(a)</enum><header>Definition of public involvement</header><text>Section 103(d) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702(d)</external-xref>) is amended by striking <quote>citizens</quote> and inserting <quote>citizens of the United States, in accordance with section 310(d), as applicable,</quote>.</text></subsection><subsection id="id37062c89cea54f11ab42be5b5fb4807e"><enum>(b)</enum><header>Public involvement relating to certain rules and regulations</header><text>Section 310 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1740">43 U.S.C. 1740</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCCF3FB14741744E8B1C54A099FB5288F"><section id="ida383c30f6cf64b2b85d59745c82e6e3a"><enum>310.</enum><header>Rules and regulations</header><subsection commented="no" display-inline="no-display-inline" id="id9bd9a04d1cff4679a4042513c103f375"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization</header><paragraph commented="no" display-inline="no-display-inline" id="id3c15c287de824b79952ded887736e224"><enum>(1)</enum><header display-inline="yes-display-inline">Secretary</header><text>Subject to subsection (d), the Secretary, with respect to public lands, shall promulgate rules and regulations to carry out the purposes of—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddf3f3fd9d2e444858bd51408091184ed"><enum>(A)</enum><text display-inline="yes-display-inline">this Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34b9f14181b84b6782997f51d21660fb"><enum>(B)</enum><text display-inline="yes-display-inline">other laws applicable to public lands.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc1a352ee6704b0b82d9089fb3e57dac"><enum>(2)</enum><header>Secretary of Agriculture</header><text>The Secretary of Agriculture, with respect to land in the National Forest System, shall promulgate rules and regulations to carry out the purposes of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6ce675e0875e4796803f35b972c12386"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">The promulgation of rules and regulations pursuant to this section shall be in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, without regard to section 553(a)(2) of that title.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc382f648f30244f6be07526493305989"><enum>(c)</enum><header>Absence of regulation</header><text display-inline="yes-display-inline">Before the promulgation of a rule or regulation pursuant to this section with respect to public lands or land in the National Forest System, the applicable land shall be administered under existing rules and regulations concerning the land, to the maximum extent practicable.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id627f071ddb134551b5aa3fdab2d5fde5"><enum>(d)</enum><header>Public involvement relating to Bureau land</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to public lands managed by the Bureau, the Secretary—</text><paragraph commented="no" display-inline="no-display-inline" id="id478e9d1b7d6b452dadf588b626597438"><enum>(1)</enum><text display-inline="yes-display-inline">in promulgating any applicable regulations pursuant to this or any other Act, may take into consideration only public comments received from citizens of the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id295c7632ba7540e18c111f43df913c63"><enum>(2)</enum><text display-inline="yes-display-inline">in any public involvement under this Act or any other provision of law (including regulations), shall establish and implement a process commonly known as <quote>Completely Automated Public Test to tell Computers and Humans Apart (CAPTCHA)</quote> to deter attempts at public involvement via artificial intelligence.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
