Workforce development initiative.</toc-entry></toc></subsection></section><section id="idc11bdcdfc32543859a61f77d04d6d8da"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4c0c51f58d9c46e7998a95a34361c9fe"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idb4ab9f702dfa468dbe9a4d65a1e834be"><enum>(A)</enum><text>the Select Committee on Intelligence, the Committee on Energy and Natural Resources, the Committee on Commerce, Science, and Transportation, the Committee on Foreign Relations, the Committee on Armed Services, the Committee on Appropriations, the Committee on Banking, Housing, and Urban Affairs, the Committee on Homeland Security and Governmental Affairs, and the Committee on Finance of the Senate; and</text></subparagraph><subparagraph id="id30ee99be99424046959d137f725a3365"><enum>(B)</enum><text>the Permanent Select Committee on Intelligence, the Committee on Energy and Commerce, the Committee on Foreign Affairs, the Committee on Armed Services, the Committee on Science, Space, and Technology, the Committee on Appropriations, the Committee on Financial Services, the Committee on Homeland Security, and the Committee on Ways and Means of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id1c75ea3e7330437d9fda6d682d190365"><enum>(2)</enum><header>Critical material</header><text>The term <term>critical material</term> means a strategic or critical material, including a rare earth element, that is necessary to meet national defense or national security requirements, including requirements relating to supply chain resiliency, or for the economic security of the United States.</text></paragraph><paragraph id="id717ccbc61eba4eaeb2f6bf7a35629923"><enum>(3)</enum><header>Foreign entity</header><subparagraph id="id3f8bc078b5124160b7678a7b4bdaad3b"><enum>(A)</enum><header>In general</header><text>The term <term>foreign entity</term> means—</text><clause id="id49fde5db302c41248d4d27e314ae4d72"><enum>(i)</enum><text>a government of a foreign country;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9317dffb71644b1ba038a7559013bb9d"><enum>(ii)</enum><text display-inline="yes-display-inline">a foreign political party;</text></clause><clause id="idd41dbdd4730243d983187469c6b8d649"><enum>(iii)</enum><text>an individual who is not—</text><subclause id="id73e10000a44b466aa89cf29dd03d8fd1"><enum>(I)</enum><text>a citizen or national of the United States;</text></subclause><subclause id="idbae186368a5b4c17b645ceaa13b3db9a"><enum>(II)</enum><text>an alien lawfully admitted for permanent residence to the United States; or </text></subclause><subclause id="idde6d2880a39f4fe090da9fec23438dc7"><enum>(III)</enum><text>any other protected individual (as defined in section 274B(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324b">8 U.S.C. 1324b(a)(3)</external-xref>)); and</text></subclause></clause><clause id="id9d4d96efb4cc449f8bd4c5770bfd4905"><enum>(iv)</enum><text>a partnership, association, corporation, organization, or other combination of entities organized under the laws of or having its principal place of business in a foreign country.</text></clause></subparagraph><subparagraph id="id1c1c097301ee4781aec3d1975d0b1fd3"><enum>(B)</enum><header>Inclusions</header><text>The term <term>foreign entity</term> includes—</text><clause id="idc894ad184efa4bd99bea3b2131743bfd"><enum>(i)</enum><text>any person owned by, controlled by, or subject to the jurisdiction or direction of an entity described in subparagraph (A);</text></clause><clause id="idcd3a528426b74bbfb9fdf20f84f71626"><enum>(ii)</enum><text>any person, wherever located, who acts as an agent, representative, or employee of an entity described in subparagraph (A);</text></clause><clause id="id717da32686f848388518f8820c001425"><enum>(iii)</enum><text>any person who acts in any other capacity at the order, request, or under the influence, direction, or control, of—</text><subclause id="id0bd717fc88f14a608f5569185ef6dd42"><enum>(I)</enum><text>an entity described in subparagraph (A); or</text></subclause><subclause id="id4479c47209af41a58d718d246068a785"><enum>(II)</enum><text>a person the activities of which are directly or indirectly supervised, directed, controlled, financed, or subsidized in whole or in majority part by an entity described in subparagraph (A);</text></subclause></clause><clause id="id867604e469cd4e4292021c8d8075e136"><enum>(iv)</enum><text>any person who directly or indirectly through any contract, arrangement, understanding, relationship, or otherwise, owns 25 percent or more of the equity interests of an entity described in subparagraph (A);</text></clause><clause id="id0e7ffd2a119b471d9bc7a61796d0178d"><enum>(v)</enum><text>any person with significant responsibility to control, manage, or direct an entity described in subparagraph (A);</text></clause><clause id="idf7d7b04f18f74a39b0cc634d63857696"><enum>(vi)</enum><text>any person, wherever located, who is a citizen or resident of a country controlled by an entity described in subparagraph (A); and</text></clause><clause id="id5706f3262b6e49d394b0e4e49583973b"><enum>(vii)</enum><text>any corporation, partnership, association, or other organization organized under the laws of a country controlled by an entity described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="ide97f8cb861c647d7b701365daa589346"><enum>(4)</enum><header>Foreign entity of concern</header><subparagraph id="id6a90349a032b48f28777a3de1c7866f7"><enum>(A)</enum><header>In general</header><text>The term <term>foreign entity of concern</term> means any foreign entity that is—</text><clause id="id1ac24bb99f6641e7a75ecff2aba0f063"><enum>(i)</enum><text>designated as a foreign terrorist organization by the Secretary of State under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></clause><clause id="id5670bfd09b564b4f9606f4e4a2f36005"><enum>(ii)</enum><text>included on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Assets Control of the Department of the Treasury;</text></clause><clause id="id5cdddbb05b5b4e94af648119b99ad736"><enum>(iii)</enum><text>owned by, controlled by, or subject to the jurisdiction, direction, or otherwise under the undue influence of a government of a covered nation (as defined in section 4872(d) of title 10, United States Code);</text></clause><clause id="idf5e83784949049cf85bf8f7c3fb829c1"><enum>(iv)</enum><text>alleged by the Attorney General to have been involved in activities for which a conviction was obtained under—</text><subclause id="id4978328fb18a48428d9d2e93313dbb2f"><enum>(I)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/37">chapter 37</external-xref> of title 18, United States Code (commonly known as the <quote>Espionage Act</quote>);</text></subclause><subclause id="id211cc9ceb4c644018b112e617fdbe09b"><enum>(II)</enum><text>section 951 or 1030 of title 18, United States Code;</text></subclause><subclause id="id3e4b07c94bb144099a3a52e59f6077a0"><enum>(III)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/90">chapter 90</external-xref> of title 18, United States Code (commonly known as the <quote>Economic Espionage Act of 1996</quote>);</text></subclause><subclause id="id606f982b69544d2bb253e61fc0cf1b03"><enum>(IV)</enum><text>the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>);</text></subclause><subclause id="id0cd3705723cc4c23aa61d541fe2750ff"><enum>(V)</enum><text>section 224, 225, 226, 227, or 236 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2274">42 U.S.C. 2274</external-xref>, 2275, 2276, 2277, and 2284);</text></subclause><subclause id="idbed0b49dc2a640739d30316c70dbfd49"><enum>(VI)</enum><text>the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>); or</text></subclause><subclause id="ida25f64c8528e41139c5f48d0274734fe"><enum>(VII)</enum><text>the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or</text></subclause></clause><clause id="id9339cf7740514744b417a6ec1c0f7fe0"><enum>(v)</enum><text>determined by the Secretary, in consultation with the Secretary of Defense and the Director of National Intelligence, to be engaged in unauthorized conduct that is detrimental to the national security or foreign policy of the United States under this Act.</text></clause></subparagraph><subparagraph id="id531df31b38554ad79e90d7d4cacbf88c"><enum>(B)</enum><header>Exclusion</header><text>The term <term>foreign entity of concern</term> does not include any entity with respect to which 1 or more foreign entities described in subparagraph (A) owns less than 10 percent of the equity interest.</text></subparagraph></paragraph><paragraph id="id163c9479cd1c4d7d99375ff09dabe508"><enum>(5)</enum><header>Intelligence community</header><text>The term <term>intelligence community</term> has the meaning given the term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph><paragraph id="id695ef6157c1a4414870acaf2907c2c64"><enum>(6)</enum><header>Metallurgy</header><text>The term <term>metallurgy</term> means the process of producing finished critical material products from critical materials.</text></paragraph><paragraph id="idbc5ce49c5f234b7b93e1eb2b2e1fac66"><enum>(7)</enum><header>Person</header><text>The term <term>person</term> includes an individual, partnership, association, corporation, organization, or any other combination of individuals.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1ad721b57e9433aa8587cf7691008a2"><enum>(8)</enum><header>United States entity</header><text>The term <term>United States entity</term> means an entity organized under the laws of the United States or any jurisdiction within the United States.</text></paragraph></section><title id="id9d8ebe5f4e9b4861b2240371798e0948"><enum>I</enum><header>Enhancing United States diplomatic support of critical material projects</header><section id="id239a4dea195343e39135299c4ee1aa8a"><enum>101.</enum><header>Streamlining diplomatic efforts relating to critical materials</header><subsection id="id4d5627baa7ed4371a72288087f64abdc"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in consultation with the heads of other relevant Federal agencies, shall submit to the appropriate committees of Congress a report outlining United States offices and positions responsible for securing the supply chains of a diverse set of critical materials.</text></subsection><subsection id="id484b8c895d9f41dc8a0035391ad20be9"><enum>(b)</enum><header>Elements</header><text>The report required by subsection (a) shall—</text><paragraph id="idd2270ff2ffe24f139f3f18a8b3263fed"><enum>(1)</enum><text>review the roles and responsibilities of offices and positions within the Department of State engaged, as of the date of the enactment of this Act, in efforts to secure critical material supply chains and develop processes to ensure that those offices coordinate and deconflict such efforts; and</text></paragraph><paragraph id="idd146e44dc00e4e48890ea09071454373"><enum>(2)</enum><text>describe how those offices in the Department of State are responsible for coordinating with other elements of the United States Government, the intelligence community, the private sector, and countries that are allies and partners of the United States.</text></paragraph></subsection><subsection id="id5ca7174c35534921aa009e38797e9b78"><enum>(c)</enum><header>Briefing required</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall brief the appropriate committees of Congress on the report required by subsection (a).</text></subsection></section><section id="ida27de2b216134a39b614e7f12241d8e2"><enum>102.</enum><header>Codifying the Partnership for Global Infrastructure and Investment</header><text display-inline="no-display-inline">The Secretary of State shall seek to establish the Partnership for Global Infrastructure and Investment to coordinate the efforts of the United States Government in priority infrastructure sectors, including energy and biological supply chains, to ensure there is a whole-of-government approach to securing supply chain inputs, technologies, and infrastructure investments.</text></section><section id="id3fd7610b2eed42fa857f1999cbd1fcba"><enum>103.</enum><header>Establishment of diplomatic tool to support United States private sector critical material projects abroad</header><text display-inline="no-display-inline">The Secretary of State shall identify an appropriate official or office of the Department of State to establish a mechanism and process for certifying if critical material projects carried out by United States entities have the support of the United States Government, which—</text><paragraph id="id7cfd211c4fa4456fbbdab74ff7d378c0"><enum>(1)</enum><text>may include using the Blue Dot Network or another mechanism in existence as of the date of the enactment of this Act, as appropriate; and</text></paragraph><paragraph id="id95a579b29200453dbcb54afd45f1ec4d"><enum>(2)</enum><text>shall include a process for ensuring that United States entities can engage with United States embassies in foreign countries to utilize the mechanism and process to secure support for pursing critical material projects in such countries.</text></paragraph></section></title><title id="id9c87d970910e476faf9977d197750214"><enum>II</enum><header>Increasing financial tools to support onshoring of critical materials</header><section id="id673a032bfca04b79a1dacbb445f5b474"><enum>201.</enum><header>Support for critical materials projects by United States International Development Finance Corporation</header><text display-inline="no-display-inline">Section 1412 of the Better Utilization of Investments Leading to Development Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/22/9612">22 U.S.C. 9612</external-xref>) is amended—</text><paragraph id="idc0dbbda9551147c1859a35bf2ed45933"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idf9be3d07c6b74d5299102f0739708a43"><enum>(A)</enum><text>by striking <quote>The purpose</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51423150f991455f9e2d512ccdaf73d9"><paragraph id="idcb583a249fdc4d419eeee90c33bc77a4"><enum>(1)</enum><header>In general</header><text>The purpose</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id080cf129dc27433e94be6b31d2802dc0"><enum>(B)</enum><text>by striking <quote>shall be to</quote> and inserting the following: “shall be—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd5efb4704f634bb2b9e06b5b4ce4bc2a"><subparagraph id="idc959cc8422e14a1f8e1b8e7cf4c168d5"><enum>(A)</enum><text>to</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3a36e04b211c4ec9bc06b9e87bb1ec8e"><enum>(C)</enum><text>by striking <quote>the United States.</quote> and inserting the following: “the United States; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc8c1dca432c642e398cf5a1a651476fb"><subparagraph id="idb506035d16e1423496bc7d74c33367a5"><enum>(B)</enum><text>to provide support under title II in high-income economy countries for projects involving development, processing, or recycling of critical materials if such support furthers the national security interests of the United States.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id329ea62c110e49fb9b4f657799dfb8e9"><enum>(D)</enum><text>by striking <quote>In carrying out</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idef629efef9e042479110a17dd4ad3599"><paragraph id="id83e73e47a56345e887db7636069d28b6"><enum>(2)</enum><header>Consideration of certain criteria</header><text>In carrying out</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id30bf02113eb441d7bea68e170fead71a"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbcfe29175f3e49919829c93c55f7b950"><paragraph id="idd50e1d482b7f4cb5b036c04a7327cbd8"><enum>(3)</enum><header>Definitions</header><text>For the purposes of paragraph (1)(B):</text><subparagraph id="idC5EDD938D7DF4044ACD9D8306CCE07E2"><enum>(A)</enum><header>Critical material</header><text>The term <term>critical material</term> has the meaning given that term in section 2 of the <short-title>Global Strategy for Securing Critical Minerals Act of 2024</short-title>.</text></subparagraph><subparagraph id="id0087276d7dc242e98ddacd1fb91c419f"><enum>(B)</enum><header>High-income economy country</header><text>The term <term>high-income economy country</term> means a country with a high-income economy, as defined by the International Bank for Reconstruction and Development and the International Development Association (collectively referred to as the <quote>World Bank</quote>).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idf1f0415b20e54b13ae642afe9204b1d1"><enum>(2)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5537fdc007c1428ea0b90cfff2ae8a88"><paragraph id="id5c2d91a62a784973918ac2a6f1846261"><enum>(3)</enum><header>Support for Freely Associated States</header><text>Notwithstanding the income classification of the country with which the geopolitical entity is associated, the Corporation may provide support under title II to a geopolitical entity that is included, as of the date on which the support is provided, on the list of dependencies and areas of special sovereignty prepared by the Department of State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idb1d95cd05fb2441ea66567fbbb092afb"><enum>202.</enum><header>Authorization of support for critical material projects for which offtake is purchased by a United States entity</header><subsection id="id2736e551c6d44fa0a2d479ba50a2b40b"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="ide5ee7ae519774beea75e5901406b3e18"><enum>(1)</enum><text>allies of the United States, such as Japan, South Korea, and European countries, provide financial support for the importation of commodities essential for national security; and</text></paragraph><paragraph id="ide402e24896f140278b1320d8f90deaaa"><enum>(2)</enum><text>given the locations of critical materials and the lack of existing mining, processing, refining, or recycling facilities for those materials, the United States must ensure that United States entities can compete for the offtake of critical materials in projects being carried out abroad, whether or not the project is operated by a United States entity.</text></paragraph></subsection><subsection id="id43df60f722e84cdc806ebe4403d5a9de"><enum>(b)</enum><header>Strategy required</header><paragraph id="ided91a4828417448587c6d81204b0caaa"><enum>(1)</enum><header>In general</header><text>The President of the Export-Import Bank of the United States shall develop a strategy for the issuance of guaranties, insurance, or extensions of credit, or the participation in the extension of credit, in connection with a project carried out outside the United States if the offtake of the project is critical for a United States entity.</text></paragraph><paragraph id="idcb7a16e9ddeb423ab34c44d066761aa7"><enum>(2)</enum><header>Outreach</header><text>In developing the strategy required by paragraph (1), the President of the Bank shall conduct outreach to United States entities, including automotive companies, to ensure that the United States private sector can adequately compete to secure critical material supply chains abroad, including in the production of batteries necessary for the electric grid, transportation, and weapons and other defenses in the United States.</text></paragraph></subsection></section><section id="id9cb0f583f118443581cd79f18b6c77a4"><enum>203.</enum><header>Inclusion of critical materials in program on China and transformational exports</header><text display-inline="no-display-inline">Section 2(l)(1)(B) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635">12 U.S.C. 635(l)(1)(B)</external-xref>) is amended—</text><paragraph id="ide98c0898e1f04ad3a0690cd60cc34bd7"><enum>(1)</enum><text>by redesignating clause (xi) as clause (xii); and</text></paragraph><paragraph id="ide50c661d00c940dc9d889830c4a63553"><enum>(2)</enum><text>by inserting after clause (x) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7934644fa76e43098af1908a50b74604"><clause id="id8e725e6c03be40359fc9762036e4ff8f"><enum>(xi)</enum><text>Critical materials (as defined in section 2 of the <short-title>Global Strategy for Securing Critical Minerals Act of 2024</short-title>) and permanent magnets.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id26d2a7915adf47dbbeffecda8291ad42"><enum>204.</enum><header>Critical material metallurgy financing</header><subsection id="id57b781ddb28a4c7ca978e9c05b9307fb"><enum>(a)</enum><header>Financial assistance program</header><paragraph id="id6d40be07e3b5498ca808b931ab7e5e3c"><enum>(1)</enum><header>In general</header><text>The Secretary of Energy shall establish in the Department of Energy a program to provide Federal financial assistance to covered entities to incentivize investment in covered facilities, subject to the availability of appropriations for that purpose.</text></paragraph><paragraph id="ide1085ed0b11b40fdabd4ad121d6c1d61"><enum>(2)</enum><header>Procedure</header><subparagraph id="idb0c17b219a1449709df6b67df83f7102"><enum>(A)</enum><header>In general</header><text>A covered entity seeking financial assistance under this subsection shall submit to the Secretary an application that describes the project for which the covered entity is seeking financial assistance.</text></subparagraph><subparagraph id="idc24ef912a678420ebb73afd082e11bc9"><enum>(B)</enum><header>Eligibility</header><text>In order for a covered entity to qualify for financial assistance under this subsection, the covered entity shall demonstrate to the Secretary, in the application submitted by the covered entity under subparagraph (A), that—</text><clause id="idd2d794b485a94ee5ba5df8e39c83d0f1"><enum>(i)</enum><text>the covered entity has a documented interest in—</text><subclause id="id12230bb7e444460db9cb71c013aa4e5a"><enum>(I)</enum><text>constructing a covered facility; or</text></subclause><subclause id="idb99cd634cc2c4b2bb685c19749820f55"><enum>(II)</enum><text>expanding or technologically upgrading a facility owned by the covered entity to be a covered facility; and</text></subclause></clause><clause id="id49dca990721342dfba68aa859f8fa6fd"><enum>(ii)</enum><text>with respect to the project for which the covered entity is seeking financial assistance, the covered entity has—</text><subclause id="id2fbc76646e2e4333a9364dd626602380"><enum>(I)</enum><text>been offered a covered incentive;</text></subclause><subclause id="idb7ab5e08f46848a693e0540f5d7f096b"><enum>(II)</enum><text>made commitments to worker and community investment, including through—</text><item id="id72622138d0a94043841240fe09146b6d"><enum>(aa)</enum><text>training and education benefits paid by the covered entity; and</text></item><item id="id2d9eb75d664a434cb9afcefa3772eaa1"><enum>(bb)</enum><text>programs to expand employment opportunity for economically disadvantaged individuals;</text></item></subclause><subclause id="id86ac4738e7de4ff0acd2f5e991ac9c01"><enum>(III)</enum><text>secured commitments from regional educational and training entities and institutions of higher education to provide workforce training, including programming for training and job placement of economically disadvantaged individuals; and</text></subclause><subclause id="id5ef8fdcb221f4291b3dcd6d64c828f6f"><enum>(IV)</enum><text>an executable plan to sustain a covered facility without additional Federal financial assistance under this subsection for facility support.</text></subclause></clause></subparagraph><subparagraph id="idf2819ed678f947a987c4060d40b3f685"><enum>(C)</enum><header>Application review</header><clause id="id453f49f38ff94fe282ae33f54606590a"><enum>(i)</enum><header>In general</header><text>The Secretary may not approve an application submitted by a covered entity under subparagraph (A)—</text><subclause id="ida1efbfff967b483fa37074e1deb89dd2"><enum>(I)</enum><text>unless the Secretary—</text><item id="ide3d9045dca7143bdaa01b50ed4dbad84"><enum>(aa)</enum><text>confirms that the covered entity has satisfied the eligibility criteria under subparagraph (B);</text></item><item id="id14cc344010c94fb29c770222a0110919"><enum>(bb)</enum><text>determines that the project for which the covered entity is seeking financial assistance is in the interest of the United States; and</text></item><item id="id5c2b18182e9d4e4781fe178d2c1c0e72"><enum>(cc)</enum><text>has notified the appropriate committees of Congress not later than 15 days before making any commitment to provide an award of financial assistance to any covered entity in an amount that exceeds $10,000,000; or</text></item></subclause><subclause id="id07e75afff410459ca734f7062e75586b"><enum>(II)</enum><text>if the Secretary determines, in consultation with the Director of National Intelligence, that the covered entity is a foreign entity of concern.</text></subclause></clause><clause id="id6514d21a7d744ab6bb868df8de3649d1"><enum>(ii)</enum><header>Consideration</header><text>In reviewing an application submitted by a covered entity under subparagraph (A), the Secretary may consider whether—</text><subclause id="id8f7f26e3e84b4f068840b2afb0ac297e"><enum>(I)</enum><text>the covered entity has previously received financial assistance under this subsection;</text></subclause><subclause id="ida07d2f7b6caa4fb89265e76cd5d22b06"><enum>(II)</enum><text>the governmental entity offering the applicable covered incentive has benefitted from financial assistance previously provided under this subsection;</text></subclause><subclause id="idbe35b48b73464449a75486de67fa57ae"><enum>(III)</enum><text>the covered entity has demonstrated that the covered entity is responsive to the national security needs or requirements established by the intelligence community (or an agency thereof), the National Nuclear Security Administration, or the Department of Defense;</text></subclause><subclause id="id00a0f9567da0414eb39af389450b7a1b"><enum>(IV)</enum><text>if practicable, a consortium that is considered a covered entity includes a small business concern (as defined under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)), notwithstanding section 121.103 of title 13, Code of Federal Regulations (or successor regulations); and</text></subclause><subclause id="id9dca4a9ceb9a414e837deefa2f80c6f8"><enum>(V)</enum><text>the covered entity intends to produce finished products for use by the Department of Defense, the defense industry of the United States, or critical energy infrastructure.</text></subclause></clause><clause id="id3f9cf323966f4515bec68f4e0b2ba58a"><enum>(iii)</enum><header>Prioritization</header><text>To the maximum extent practicable, the Secretary shall prioritize awarding financial assistance under this subsection to a covered entity that intends to make finished products available for use by the Department of Defense, the defense industry of the United States, or critical energy infrastructure.</text></clause></subparagraph><subparagraph id="ideb8ad8895c594dc7bf3b89a439998236"><enum>(D)</enum><header>Records</header><clause id="id80a4886e92c8490397af8b87b3421226"><enum>(i)</enum><header>In general</header><text>The Secretary may request records and information from a covered entity that submitted an application under subparagraph (A) to review the status of a covered entity.</text></clause><clause id="id0ae375f771a4418b82f7f3f245cc0032"><enum>(ii)</enum><header>Requirement</header><text>As a condition of receiving assistance under this subsection, a covered entity shall provide the records and information requested by the Secretary under clause (i).</text></clause></subparagraph></paragraph><paragraph id="id3f2c892d10d04dc491ae63ad4b2d23bf"><enum>(3)</enum><header>Amount</header><subparagraph id="id8ddabeab8d9244cdb072279075425a93"><enum>(A)</enum><header>In general</header><text>The Secretary shall determine the appropriate amount and funding type for each financial assistance award provided to a covered entity under this subsection.</text></subparagraph><subparagraph id="idc430b5dd8be446d3ba1251e211372970"><enum>(B)</enum><header>Cost-sharing requirement</header><text>The total amount of financial assistance that may be guaranteed by the Secretary under this subsection shall be not more than 100 percent of the private capital investment available to a covered entity for any individual project.</text></subparagraph><subparagraph id="idbb0451946b2d4594996a163a64dd607f"><enum>(C)</enum><header>Minimum investment</header><text>The total Federal investment in any individual project receiving a financial assistance award under this subsection shall be not less than $20,000,000.</text></subparagraph><subparagraph id="id78762cc2858d411b873d7874eaedaf35"><enum>(D)</enum><header>Larger investment</header><text>The total Federal investment in any individual project receiving a financial assistance award under this subsection shall not exceed $500,000,000, unless the Secretary, in consultation with the Secretary of Defense and the Director of National Intelligence, recommends to the President, and the President certifies and reports to the appropriate committees of Congress, that a larger investment is necessary—</text><clause id="id9d3ef68254ba418d92af57c718ca32f2"><enum>(i)</enum><text>to significantly increase the proportion of reliable domestic supply of finished critical material products relevant for national security and economic competitiveness that can be met through domestic production; and</text></clause><clause id="id33833b1453d04e8eb402756244e64fcd"><enum>(ii)</enum><text>to meet the needs of national security.</text></clause></subparagraph></paragraph><paragraph id="id2e4a6e1da812404db1460429d0ac9dec"><enum>(4)</enum><header>Use of funds</header><text>A covered entity that receives a financial assistance award under this subsection may only use the financial assistance award amounts—</text><subparagraph id="id93b1ec3e09314310a0011e25cbbb25fd"><enum>(A)</enum><text>to finance the construction of a covered facility (including equipment) or the expansion or technological upgrade of a facility (including equipment) of the covered entity to be a covered facility, as documented in the application submitted by the covered entity under paragraph (2)(A), as determined necessary by the Secretary for purposes relating to the national security and economic competitiveness of the United States;</text></subparagraph><subparagraph id="id9086cbeded474b2e9eb3f219ff85c6e6"><enum>(B)</enum><text>to support workforce development for a covered facility; and</text></subparagraph><subparagraph id="idefb804b00a40418da815a195654bbfd5"><enum>(C)</enum><text>to support site development and technological upgrade for a covered facility.</text></subparagraph></paragraph><paragraph id="id300956d383654874b526ccc27cd63968"><enum>(5)</enum><header>Clawback</header><subparagraph id="id8cbf7aabf9894550998ff176e22d9f57"><enum>(A)</enum><header>Major awards</header><clause id="idc360f4b0beef4baf886bf57669619d5f"><enum>(i)</enum><header>In general</header><text>For all financial assistance awards provided to covered entities under this subsection, the Secretary shall, at the time of making the award, determine the target dates by which a covered entity shall commence and complete the applicable project.</text></clause><clause id="id9ec16ba978d14835a435846ffc9dcaed"><enum>(ii)</enum><header>Progressive recovery for delays</header><text>If the covered entity receiving a financial assistance award under this subsection does not complete the applicable project by the applicable target date determined under clause (i), the Secretary shall progressively recover up to the full amount of the award.</text></clause><clause id="id464eeafd3e394b3eb84e33f821215f31"><enum>(iii)</enum><header>Waiver</header><text>In the case of projects that do not meet the applicable target date determined under clause (i), the Secretary may waive the requirement to recover the financial award provided for the project under clause (ii) after making a formal determination that circumstances beyond the ability of the covered entity to foresee or control are responsible for the delay.</text></clause><clause id="id3965e94d979e4dad8475f26166c6acff"><enum>(iv)</enum><header>Congressional notification</header><subclause id="id07e96ba0fb794a9a85c2001a9e15f068"><enum>(I)</enum><header>In general</header><text>Not later than 15 days after making a determination to recover an award under clause (ii), the Secretary shall notify the appropriate committees of Congress of the intent of the Secretary to recover the award.</text></subclause><subclause id="idde009cdbb15746c696d924f7d124f0c9"><enum>(II)</enum><header>Waivers</header><text>Not later than 15 days after the date on which the Secretary provides a waiver under clause (iii), the Secretary shall notify the appropriate committees of Congress of the waiver.</text></subclause></clause></subparagraph><subparagraph id="id1f42e0d57eb44cf49f93bb22e8dc1f47"><enum>(B)</enum><header>Joint research, technology licensing, and intellectual property reporting</header><clause id="idcb240d998eda469f90ca7d23cb9fe15a"><enum>(i)</enum><header>In general</header><text>Before entering into an agreement with a foreign entity to conduct joint research or technology licensing, or to share intellectual property, a covered entity that has received a financial assistance award under this subsection—</text><subclause id="id6201de4d05984db4b946af1d8a1aed47"><enum>(I)</enum><text>shall notify the Secretary of the intent to enter into such an agreement; and</text></subclause><subclause id="id2ab7a4a16b0e455486504d5105efbabd"><enum>(II)</enum><text>may only enter into such an agreement if the Secretary determines the foreign entity is not a foreign entity of concern.</text></subclause></clause><clause id="ida225d3deeffc4b308c2d47fd1823ca70"><enum>(ii)</enum><header>Determination</header><text>On receiving a notification under clause (i), the Secretary, in consultation with the Director of National Intelligence, the Director of the National Counterintelligence and Security Center, and the Director of the Federal Bureau of Investigation, shall make a determination of whether the applicable foreign entity is a foreign entity of concern.</text></clause><clause id="id1b799dde1ef941568e719354bb9fff85"><enum>(iii)</enum><header>Technology clawback</header><text>The Secretary shall recover the full amount of a financial assistance award provided to a covered entity under this subsection if, during the applicable term of the award, the covered entity knowingly engages in any joint research, technology licensing, intellectual property sharing effort, or joint venture with a foreign entity of concern that relates to a technology or product that raises national security concerns, as determined by the Secretary, in consultation with the Director of National Intelligence, the Director of the National Counterintelligence and Security Center, and the Director of the Federal Bureau of Investigation, on the condition that the determination of the Secretary shall have been communicated to the covered entity before the covered entity engaged in the joint research, technology licensing, or intellectual property sharing.</text></clause></subparagraph></paragraph><paragraph id="idf5fedcad11a142c8af190ffa127895e1"><enum>(6)</enum><header>Condition of receipt</header><text>A covered entity to which the Secretary awards Federal financial assistance under this subsection shall enter into an agreement that specifies that, during the 5-year period immediately following the award of the Federal financial assistance, the covered entity will not make shareholder distributions in excess of profits.</text></paragraph></subsection><subsection id="id7b5e600ae44948fca1863346e119ce1c"><enum>(b)</enum><header>Coordination required</header><text>In carrying out the program established under subsection (a), the Secretary shall coordinate with the Secretary of State, the Secretary of Defense, the Secretary of Homeland Security, and the Director of National Intelligence.</text></subsection><subsection id="id9fe4eed7020243c8939510a35113f27d"><enum>(c)</enum><header>GAO reviews</header><text>The Comptroller General of the United States shall—</text><paragraph id="id9f7438bf7a864e66a82edaaf239618b9"><enum>(1)</enum><text>not later than 2 years after the date of disbursement of the first financial award under the program established under subsection (a), and biennially thereafter for 10 years, conduct a review of the program, which shall include, at a minimum—</text><subparagraph id="id772ba4147c0042829e209bda91d65aa0"><enum>(A)</enum><text>a determination of the number of financial assistance awards provided under the program during the period covered by the review;</text></subparagraph><subparagraph id="idc07382f56e8947efa079a5ea7ab643fb"><enum>(B)</enum><text>an evaluation of how—</text><clause id="id757b362523e143ea978a977f1ac9280b"><enum>(i)</enum><text>the program is being carried out, including how recipients of financial assistance awards are being selected under the program; and</text></clause><clause id="idb7f552d61eb64fb3a0427e2bbf410bdf"><enum>(ii)</enum><text>other Federal programs are leveraged for manufacturing, research, and training to complement the financial assistance awards provided under the program; and</text></clause></subparagraph><subparagraph id="idc20c8c09adcc4102947b2f101566a015"><enum>(C)</enum><text>a description of the outcomes of projects supported by financial assistance awards provided under the program, including a description of—</text><clause id="id996c0be6fe894a19802f731cb1cf6ad2"><enum>(i)</enum><text>covered facilities that were constructed or facilities that were expanded or technologically upgraded to be covered facilities as a result of financial assistance awards provided under the program;</text></clause><clause id="iddf60f5351bcf4cca9350cb774aee028f"><enum>(ii)</enum><text>workforce training programs carried out with financial assistance awards provided under the program, including efforts to hire individuals from disadvantaged populations; and</text></clause><clause id="idc216f9d95b424460ad3d0dac6ac06916"><enum>(iii)</enum><text>the impact of projects receiving financial assistance awards under the program on the United States share of global finished critical material product production; and</text></clause></subparagraph></paragraph><paragraph id="idf80b5466c5064387a3091ca006d9915c"><enum>(2)</enum><text>submit to the appropriate committees of Congress the results of each review conducted under paragraph (1).</text></paragraph></subsection><subsection id="id4311349cc7454df59bbf94744c9d3978"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text><paragraph id="id9b34806f60b546ffa3242bf238875424"><enum>(1)</enum><text>$750,000,000 for each of fiscal years 2025 and 2026; and</text></paragraph><paragraph id="idd5cade9e45324505a8a87193d262a678"><enum>(2)</enum><text>$200,000,000 for each of fiscal years 2027 through 2029.</text></paragraph></subsection><subsection id="id9253c713fc2c4d90b26995820f30dba7"><enum>(e)</enum><header>Definitions</header><text>In this section: </text><paragraph id="idd9d64a6d6f0d4640944e02cb68294e24"><enum>(1)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means a private entity, a consortium of private entities, or a consortium of public and private entities, with a demonstrated ability to substantially finance, construct, expand, or technologically upgrade a covered facility.</text></paragraph><paragraph id="idd4d6d3489cf34fc08fd6c3390dcebc2e"><enum>(2)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means a facility located in a State that carries out the metallurgy or recycling of critical materials for the production of critical material products.</text></paragraph><paragraph id="id38e1df26f35f4692ae8236aa52810c18"><enum>(3)</enum><header>Covered incentive</header><text>The term <term>covered incentive</term> means—</text><subparagraph id="ide988319c1e0148e8b2b6ba09f9d04c30"><enum>(A)</enum><text>an incentive offered by a Federal, State, local, or Tribal governmental entity to a covered entity for the purposes of—</text><clause id="idf012cbf57b6d4d288f0c39ea3d401347"><enum>(i)</enum><text>constructing within the jurisdiction of the governmental entity a covered facility; or</text></clause><clause id="id2792acc72cba45b9b4bee5613b627cb1"><enum>(ii)</enum><text>expanding or technologically upgrading an existing facility within that jurisdiction to be a covered facility; and</text></clause></subparagraph><subparagraph id="id48822f9d906b47218e0e493478081db9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>a workforce-related incentive (including a grant agreement relating to workforce training or vocational education), any concession with respect to real property, funding for research and development with respect to critical materials and finished critical material products, and any other incentive determined appropriate by the Secretary, in consultation with the Secretary of State. </text></subparagraph></paragraph><paragraph id="id85a3b3194ad240f088d52ba1eddf32bc"><enum>(4)</enum><header>Finished critical material product</header><text>The term <term>finished critical material product</term> means a product composed of significant quantities of critical materials, including—</text><subparagraph id="ida5053ec4e6b94605967fb1017c8fbd72"><enum>(A)</enum><text>metals;</text></subparagraph><subparagraph id="id545724ddb8714d5ea84410c723e52f47"><enum>(B)</enum><text>alloys; and</text></subparagraph><subparagraph id="id024953d157424d31b09c7b2deb63be62" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text>the United States Virgin Islands. </text></subparagraph></paragraph></subsection></section></title><title id="idbdd7ed8a25494770908c2215cc249602"><enum>III</enum><header>Increasing support for allied partnerships for critical material mapping, mining, and technology research</header><section id="id1efa2760e537463ba9ca3497a254f9db"><enum>301.</enum><header>Expanding collaboration with allies and partners on critical materials technologies and projects</header><subsection commented="no" display-inline="no-display-inline" id="idfbb9926bd320442a9c82538b44bd6d6e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of the Interior shall increase collaboration and information sharing between the geoscience organizations of Australia, Canada, South Korea, Japan, member countries of the North Atlantic Treaty Organization and non-NATO allies and partners, as the Secretary of the Interior determines to be appropriate, and the United States to include knowledge sharing on critical materials processing and recycling techniques and equipment. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id15bf3ea81aee474baf077aa72f94053b"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Collaboration and information under subsection (a) shall extend to—</text><paragraph id="id4b4ae538e8d64be6bbc6b4f71ced3152"><enum>(1)</enum><text>the Earth Mapping Resources Initiative established by section 40201 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/31l">43 U.S.C. 31l</external-xref>); and</text></paragraph><paragraph id="id49eb2f45ef9249e287a11e5633e21a4d"><enum>(2)</enum><text>the National Cooperative Geologic Mapping Program under section 4 of the National Geologic Mapping Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/43/31c">43 U.S.C. 31c</external-xref>).</text></paragraph></subsection></section><section id="id8884471477ac403da6bccd0d239fa8ad"><enum>302.</enum><header>Expanding authorities for critical material projects to include allies and partners</header><subsection id="idcf7e881acb474309b59187bb71fc8ce7"><enum>(a)</enum><header>Critical minerals mining and recycling research</header><text>Section 40210 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18743">42 U.S.C. 18743</external-xref>) is amended—</text><paragraph id="id937c78f3e59644709ef18cd170c86cf1"><enum>(1)</enum><text>in subsection (b), by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id887EA48BECCE42F68F2F3B74298B547D"><paragraph id="idd15e8e18c841420f81b469dc55031001"><enum>(1)</enum><header>In general</header><text>In order to support supply chain resiliency, the Secretary, in coordination with the Director, and in collaboration with countries that are allies and partners of the United States, as the Secretary of State determines to be appropriate, shall issue awards, on a competitive basis, to eligible entities described in paragraph (2) to support basic research that will accelerate innovation to advance critical minerals mining, recycling, and reclamation strategies and technologies for the purposes of—</text><subparagraph id="ide38fdf001bc24cd8bfcb0aefee65f9d2"><enum>(A)</enum><text>making better use of domestic resources; and</text></subparagraph><subparagraph id="ida1faaac7836c4c28a22724ead9ea91f5"><enum>(B)</enum><text>eliminating national reliance on minerals and mineral materials that are subject to supply disruptions.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ide6655075004746fe9afc316dd42f19a8"><enum>(2)</enum><text>in subsection (c)(1), by inserting <quote>, in collaboration with allied and partner countries, as the Secretary of State determines to be appropriate,</quote> after <quote>National Science and Technology Council (referred to in this subsection as the <quote>Subcommittee</quote>)</quote>.</text></paragraph></subsection><subsection id="idd04e94ef74ad4aa6b058a8240ecd5fed"><enum>(b)</enum><header>USGS energy and minerals research facility</header><text>Section 40204 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/50e">43 U.S.C. 50e</external-xref>) is amended—</text><paragraph id="id898a8207892b4b9cad60a55bc8e41413"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="id6a4aad9b627f440ba5b3ec25e26991ff"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2c38fb37fd3c4813a87e19b1a1cb6a41"><subsection id="id0b4b32eaed1c48b5b17e1715519d695f"><enum>(f)</enum><header>Collaboration</header><text>The United States Geological Survey may collaborate with Australia and Canada on the energy and minerals research carried out at the facility described in subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idc79cdf3557b74860b7777e74b520d4b9"><enum>(c)</enum><header>Rare earth demonstration facility</header><text>Section 7001(c)(1) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/13344">42 U.S.C. 13344(c)(1)</external-xref>) is amended inserting <quote>and in coordination with academic communities in countries that are allies and partners of the United States, as the Secretary determines to be appropriate,</quote> after <quote>academic partner,</quote>.</text></subsection></section></title><title id="idf371fabab555477b94c06b500b0bcccc"><enum>IV</enum><header>Public-private collaboration on critical materials</header><section id="id2096d8e3bad4428ab4d3e61b8841b085"><enum>401.</enum><header>Enhancing public-private sharing on manipulative adversary practices in critical material projects</header><subsection id="id9113408c441c4c7ab7e52fc1a6755377"><enum>(a)</enum><header>Strategy required</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall, in consultation with the heads of such other Federal agencies as the Director considers appropriate, develop a strategy to improve the sharing between the Federal Government and private entities of information to mitigate the threat that illicit activities and tactics of foreign adversaries pose to United States entities involved in projects outside the United States relating to energy generation and storage, including with respect to critical materials inputs for those projects.</text></subsection><subsection id="id91fb0f06b39741d1904f645a0a3431a7"><enum>(b)</enum><header>Elements</header><text>The strategy required by subsection (a) shall address—</text><paragraph id="iddf1df43eb1ac45248d0105d444b07123"><enum>(1)</enum><text>how best to assemble and transmit information to United States entities—</text><subparagraph id="id4e121d358bbd489c8cdcec843cc935a3"><enum>(A)</enum><text>to protect against illicit tactics and activities of foreign adversaries relating to critical material projects outside the United States, including efforts by foreign adversaries to undermine those projects;</text></subparagraph><subparagraph id="idf21f9cae6579455698fa13aa9ebfbb45"><enum>(B)</enum><text>to mitigate the risk that the involvement of governments of foreign adversaries in the ownership and control of entities engaging in deceptive or illicit activities pose to the interests of the United States; and</text></subparagraph><subparagraph id="id2e40635034ce4cac96e5c3aec7f4c96c"><enum>(C)</enum><text>to inform on economic espionage and other threats from foreign adversaries to the rights of owners of intellectual property, including owners of patents, trademarks, copyrights, trade secrets, and other sensitive information, with respect to such property; and</text></subparagraph></paragraph><paragraph id="id63d3e31acfec42fc91b894535c650466"><enum>(2)</enum><text>how best to receive information from United States entities with respect to threats to United States interests relating to critical materials, including disinformation campaigns abroad or other suspicious malicious activity.</text></paragraph></subsection><subsection id="id149e9222b84645ee9f72dfebb6426664"><enum>(c)</enum><header>Implementation plan required</header><text>Not later than 30 days after the date on which the Director completes developing the strategy required by subsection (a), the Director shall submit to the congressional intelligence committees (as defined in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>)), or provide such committees a briefing on, a plan for implementing the strategy.</text></subsection></section><section id="id84442a48d1ec4a54b61523073da627a8"><enum>402.</enum><header>Coordinating government financial tools for public-private collaboration on critical material investments</header><subsection id="iddf60434a157946f1bb17476e71c05d56"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall, in coordination with the Chief Executive Officer of the United States International Development Finance Corporation, the President of the Export-Import Bank of the United States, and the Secretary of Energy, establish a mechanism to share information with the private sector on government financing tools available for investment in projects outside the United States relating to critical materials.</text></subsection><subsection id="idcad1bf1bec244d888cb482d79953ab21"><enum>(b)</enum><header>Elements</header><text>The mechanism developed under subsection (a) shall include—</text><paragraph id="idc4894f104cf1445cbab796a7e409babc"><enum>(1)</enum><text>a single point person or office to lead the effort to share information as described in that subsection;</text></paragraph><paragraph id="ida84ee46d5562446d80eedf21bfe6bc92"><enum>(2)</enum><text>a publicly accessible website that details the tools each relevant Federal agency has available to support private sector investment in projects described in that subsection, including for each such tool at each such agency—</text><subparagraph id="idcedf6c3ef309451ab9a5b123d989cdc7"><enum>(A)</enum><text>the criteria required to receive support pursuant to the relevant agency tool;</text></subparagraph><subparagraph id="id6a618252acac4a34a4284a6ddec83f26"><enum>(B)</enum><text>a point of contact to coordinate and advice on applying for that support;</text></subparagraph><subparagraph id="idfe8647b3948f47fe930305e9c61bc5e6"><enum>(C)</enum><text>how applications can be submitted;</text></subparagraph><subparagraph id="idc201d7019bc740da92065db42e35449f"><enum>(D)</enum><text>the amount of funding available; and</text></subparagraph><subparagraph id="idecff0050947345f7a154fc370092fd89"><enum>(E)</enum><text>a list of projects carried out with that support;</text></subparagraph></paragraph><paragraph id="id465f7a07e8244ac9ad1daa6822bf4275"><enum>(3)</enum><text>policies to ensure that, in cases in which due diligence and project vetting requirements are similar across Federal agencies, an application filed by an entity, if permitted by the entity, is shared across relevant agencies to avoid unnecessary duplication;</text></paragraph><paragraph id="id5dde03103e67485aa87bf71b4a155e92"><enum>(4)</enum><text>coordination of regular meetings of the relevant Federal agencies—</text><subparagraph id="id260ccee15d0645b5b595943069d08587"><enum>(A)</enum><text>to coordinate projects and processes; and</text></subparagraph><subparagraph id="idcd576ba3933c4301810635b446ede3e5"><enum>(B)</enum><text>to identify gaps in tools needed to support private sector investment in projects described in subsection (a), including in coordination with the Minerals Investment Network for Vital Energy Security and Transition (MINVEST); and</text></subparagraph></paragraph><paragraph id="id36a8e6d0d4af48e29cedfee89555a0cd"><enum>(5)</enum><text>a way for private sector entities to regularly engage with the relevant Federal agencies to identify potential gaps in United States support and tools for private industry attempting to invest in, operate, or secure critical material projects outside the United States.</text></paragraph></subsection><subsection id="id2e43c01474424911934a5bc6f783b4ad"><enum>(c)</enum><header>Report required</header><paragraph id="idff1f6291c6644c8cb5a09035c00216bd"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State shall submit to the appropriate committees of Congress a report on the plan required by subsection (a), including each elements required under subsection (b).</text></paragraph><paragraph id="id9033930e661b4cf4baf8ee0725fc1d0d"><enum>(2)</enum><header>Form</header><text>The report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection></section></title><title id="ide4f1ae06bdab4592bb09f160f44f5fe9"><enum>V</enum><header>Countering the People’s Republic of China’s efforts to manipulate critical material markets</header><section id="idf81220780d3948a3952e98f8b1df6fd0"><enum>501.</enum><header>Increased support for United States procurement of critical materials</header><subsection id="id891566dd34384472a93aefe7761a456b"><enum>(a)</enum><header>Report required</header><paragraph id="idd9c7b5e5bf154f249fe0d90a9704af8d"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate committees of Congress a report setting forth a plan of action for use of authorities, including a proposal for new or expanded authorities, to establish or enhance responsible domestic production and procurement capabilities, including through recycling, for critical materials and related materials.</text></paragraph><paragraph id="ide2bc7a45728241fd95da90b176bdac55"><enum>(2)</enum><header>Elements</header><text>The report required by paragraph (1) shall—</text><subparagraph id="idcc53c9b8d4a84d80b9dc3cc64ce62683"><enum>(A)</enum><text>include an identification of defense-critical end products that are reliant on rare earth elements and other critical materials for which domestic industrial capabilities are insufficient; </text></subparagraph><subparagraph id="id9933943e397c4499b8dd2d7da2c7cd2f"><enum>(B)</enum><text>detail how the plan of action—</text><clause id="idf28d15b06f444d8eaec518e3868f3385"><enum>(i)</enum><text>aligns with existing Federal critical materials strategies and recommendations, including those developed pursuant to applicable Executive orders and statutes, to produce a holistic response to address critical material supply chain risks; and</text></clause><clause id="id78ba33f75b8c42e1a195d23ee23695f9"><enum>(ii)</enum><text>coordinates Federal authorities and interagency efforts to implement such strategies and recommendations, including by identifying implementation challenges and authorities or resources needed to complete implementation and reduce United States critical materials supply chain vulnerability; and</text></clause></subparagraph><subparagraph id="idd6c45a15f9c44ff4960469341ae7875d"><enum>(C)</enum><text>include recommendations to minimize adverse environmental and social impacts from the activities described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="id9d8ebc41c5504f2ab5949fd4e13aa76e"><enum>(b)</enum><header>Domestic defined</header><text>In this section, the term <term>domestic</term>, with respect to production capabilities or procurement capabilities for critical materials and related materials, means—</text><paragraph id="idecbca3041f274fb48c24174cd65d9283"><enum>(1)</enum><text>the production of such materials in a country specified in the definition of <term>domestic source</term> in section 702 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4552">50 U.S.C. 4552</external-xref>); or</text></paragraph><paragraph id="id37b8de7726714ccf91e4cb7db4b866cb"><enum>(2)</enum><text>the procurement of such materials from a business concern described in that definition.</text></paragraph></subsection></section><section id="id02e3896315da40919531c0830a85092b"><enum>502.</enum><header>Report on imposition of duties on electromagnets, battery cells, electric storage batteries, and photovoltaic cells imported from certain countries</header><subsection commented="no" display-inline="no-display-inline" id="ida456aba2391b47bd9366b78bfe0b05c5"><enum>(a)</enum><header display-inline="yes-display-inline">Report required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of the Treasury shall submit to the appropriate committees of Congress a report assessing the imposition of a duty on each article described in subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb6692e082860418e84de55765285286a"><enum>(b)</enum><header>Articles described</header><text display-inline="yes-display-inline">An article described in this subsection is an article classified under any of the following headings or subheadings of the Harmonized Tariff Schedule of the United States:</text><paragraph id="ide901cbfbe3f74397aad4dac3838eb146"><enum>(1)</enum><text>8505.</text></paragraph><paragraph id="id10fb9f0b946f4103968dfa15dad6e6d3"><enum>(2)</enum><text>8506.</text></paragraph><paragraph id="idfdcff649cbbd42539ec68935bbde005d"><enum>(3)</enum><text>8507.</text></paragraph><paragraph id="id584ca83e599c41c5887d7a6398b78369"><enum>(4)</enum><text>8541.42.00.</text></paragraph><paragraph id="id3f849ff81dd74665a245066d2cb3a848"><enum>(5)</enum><text>8541.43.00.</text></paragraph></subsection><subsection id="idd52973430e1645f48a4046f5ef2f7b55"><enum>(c)</enum><header>Recommendations</header><text>The report required by subsection (a) shall include recommendations for—</text><paragraph commented="no" display-inline="no-display-inline" id="id82af94d62ce8481db1f4bbdd5dead804"><enum>(1)</enum><text display-inline="yes-display-inline">appropriate ranges for the rate of duty to be applied to an article described in subsection (b) that was produced or manufactured, or underwent final assembly, in a country other than—</text><subparagraph id="id734485bf9ecd4618a6dbb5acfce96bda"><enum>(A)</enum><text>an ally described in section 3(b)(2) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753(b)(2)</external-xref>);</text></subparagraph><subparagraph id="id122943a82c1a40888b00a7f7f5b85f3c"><enum>(B)</enum><text>a country designated by the President as a major non-NATO ally under section 517 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2321k">22 U.S.C. 2321k</external-xref>);</text></subparagraph><subparagraph id="id7d6ca3e1c72249d1ab9d6d9c80ae0c59"><enum>(C)</enum><text>Mexico, if the United States-Mexico-Canada Agreement, or a successor agreement, is in effect;</text></subparagraph><subparagraph id="id2d9032ba49a44dde9e0c856999cbe5f2"><enum>(D)</enum><text>Costa Rica, El Salvador, Guatemala, Honduras, and the Dominican Republic, if the Dominican Republic-Central America Free Trade Agreement, or a successor agreement, is in effect;</text></subparagraph><subparagraph id="id08278d20c6924f27b5c08e23b283d386"><enum>(E)</enum><text>Chile, if the United States-Chile Free Trade Agreement, or a successor agreement, is in effect; and</text></subparagraph><subparagraph id="id0503226422bb4efd82b3dd8d9248a5df"><enum>(F)</enum><text>India, for a period of 10 years beginning on the date of the enactment of this Act; and</text></subparagraph></paragraph><paragraph id="idfff5956fa94141c280c98f88e39ac0bd"><enum>(2)</enum><text>the appropriate rate of duty to be applied to an article described in subsection (b) that was produced or manufactured, or underwent final assembly, in the People’s Republic of China.</text></paragraph></subsection><subsection id="idd2c9aa2f04644518b9f59b7a54978edd"><enum>(d)</enum><header>Additional elements</header><text>The assessment required by subsection (a) shall include—</text><paragraph id="id6eb541335c914ee98dddcc381dbab971"><enum>(1)</enum><text>a plan for implementing duties on articles described in subsection (b) at the rates recommended under subsection (c); and</text></paragraph><paragraph id="idba954715d2004530adf4e9bd80a63a11"><enum>(2)</enum><text>an assessment of the risks and benefits of increasing the rates of duty on such articles over a period of time.</text></paragraph></subsection></section><section id="id43ad3765d4224f2ba9be36b7d023a685"><enum>503.</enum><header>Prohibition on provision of funds to foreign entities of concern</header><text display-inline="no-display-inline">None of the funds authorized to be appropriated to carry out this Act may be provided to a foreign entity of concern.</text></section></title><title id="id046e211a47a546489544f8ecdd9f9c24"><enum>VI</enum><header>Workforce development efforts</header><section id="ida132baeea8ab4b9c95baff156a65c7e8"><enum>601.</enum><header>Workforce development initiative</header><text display-inline="no-display-inline">As soon as practicable, after the date of the enactment of this Act, the Secretary of State shall establish an initiative under which the Secretary works with the Secretary of Labor, the Director of the National Science Foundation, the Critical Minerals Subcommittee of the National Science and Technology Council, the private sector, institutions of higher education, and workforce training entities to incentivize and expand participation in graduate, undergraduate, and vocational programs, and to develop workforce training programs and apprenticeships, relating to advanced critical material mining, separation, processing, recycling, metallurgy, and advanced equipment maintenance capabilities. </text></section></title></legis-body></bill>
