which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To limit the consideration of marijuana use when making an employment suitability or security clearance determination, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dismantling Outdated Obstacles and Barriers to Individual Employment Act of 2024</short-title></quote> or the <quote><short-title>DOOBIE Act of 2024</short-title></quote>.</text></section><section id="idd154d29caca74de6aad9960ca8602b6d"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id128014dea84e4237ad350c836838f7cc"><enum>(1)</enum><header>Executive agency</header><text display-inline="yes-display-inline">The term <term>executive agency</term> has the meaning given the term <term>Executive agency</term> in section 105 of title 5, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2AB7DF767F644494AEA0FB31D2363E8F"><enum>(2)</enum><header>Fitness</header><text display-inline="yes-display-inline">The term <term>fitness</term> has the meaning given the term in section 1.3 of Executive Order 13467 (<external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref> note; relating to reforming processes related to suitability for Government employment, fitness for contractor employees, and eligibility for access to classified national security information).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7eb7fbe63cb45eeb67c114d53821c52"><enum>(3)</enum><header display-inline="yes-display-inline">Marijuana</header><text>The term <term>marijuana</term> has the meaning given that term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1090210e1c14c73936e44f9a3372a66"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Personnel Management. </text></paragraph><paragraph id="id687c28c5ef974adc83d41c06f5a2def0"><enum>(5)</enum><header>Suitability determination</header><text>The term <term>suitability determination</term> has the meaning given that term in section 731.101 of title 5, Code of Federal Regulations, or any successor thereto.</text></paragraph></section><section id="id0c25bde66f034fb3835193457ed08381"><enum>3.</enum><header>Limitation on adverse suitability determinations based on marijuana use</header><text display-inline="no-display-inline">Notwithstanding any other law, rule, or regulation, the Office, or an agency to which the Office has delegated authority, may not base a suitability determination with respect to an individual solely on the past use of marijuana by the individual.</text></section><section id="idcb312293be7e40c09abd6891040eb908"><enum>4.</enum><header>Limitation on adverse security clearances and suitability determinations for covered persons based on marijuana use</header><text display-inline="no-display-inline">Section 3002 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3343">50 U.S.C. 3343</external-xref>) is amended—</text><paragraph id="id14ccd125f05e4daeb463e74a8612d02f"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide8245ccdda3343e0856d3066eba45e5b"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)— </text><clause commented="no" display-inline="no-display-inline" id="id42b2763faa214fe6aea5bd0361949c65"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>term <term>controlled substance</term> has</quote> and inserting the following: “term ‘controlled substance’—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3C2DC147DA14C579AB78FDCBE84855F"><subparagraph commented="no" display-inline="no-display-inline" id="id7ffbce10202e4c3cae839fb6d78bf642"><enum>(A)</enum><text display-inline="yes-display-inline">has</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id882d98f6c12a45d08db91f1b9c0d87bd"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb78ce19335d24d84bc996003a9dcc803"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEC11D80EEFB5433C9579C04F44A79427"><subparagraph commented="no" display-inline="no-display-inline" id="idfc17e8e953e548df9b1953e1329f8dd6"><enum>(B)</enum><text>notwithstanding such section 102, does not include marijuana.</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4286bf548804c8ab99d6dcfdcfe70b9"><enum>(B)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9542ea8e590340e98de25a1f048e4390"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDFC171F90FB046C5B0771D330F450E9E"><paragraph commented="no" display-inline="no-display-inline" id="idf7e9d189da2b43d59ece30f8b3215e2b"><enum>(3)</enum><header>Marijuana</header><text display-inline="yes-display-inline">The term <term>marijuana</term> has the meaning given that term in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd423812bc2964131a611b16761a1de95"><enum>(D)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idA72524504F7241CA91A43740BFF1F296"><paragraph id="idA7EA9B1E293B410C9C763A0FA17D0514"><enum>(6)</enum><header>Suitability determination</header><text>The term <term>suitability determination</term> has the meaning given that term in section 731.101 of title 5, Code of Federal Regulations, or any successor thereto. </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81fe70ea33f34120acc7a6ee5c7772f5"><enum>(2)</enum><text>by adding at end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6586a89ce14e464faadcd6c6c7d5ee12"><subsection id="id8fb9797ea2094f4386fcfdbdc4c4a645"><enum>(e)</enum><header>Limitation on adverse security clearance and suitability determination based on marijuana use</header><text>Notwithstanding any other law, rule, or regulation—</text><paragraph id="id5d54c01daaf5468aba5ea9c3c419eab9"><enum>(1)</enum><text>the head of a Federal agency may not base a determination that a covered person is ineligible for a security clearance solely on the past use of marijuana by the covered person; and</text></paragraph><paragraph id="id38a7431cb18248b4be7af47948b99dbf"><enum>(2)</enum><text>the Office of Personnel Management, or an agency to which the Office of Personnel Management has delegated authority, may not base a suitability determination with respect to a covered person solely on the past use of marijuana by the covered person.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id3a16d0714895498a977f64acf6d4b078" commented="no"><enum>5.</enum><header>Limitation on adverse fitness determinations based on marijuana use</header><text display-inline="no-display-inline"> The determination of the fitness of an individual for employment in the civil service may not be based solely on the past use of marijuana by the individual.</text></section><section id="idcdac0b79340a41e8b4aeadecccbaa94a"><enum>6.</enum><header>Limitation on adverse credentialing determinations based on marijuana use</header><text display-inline="no-display-inline"> The Office, in carrying out functions described in section 2.5(c) of Executive Order 13467 (<external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref> note; relating to reforming processes related to suitability for Government employment, fitness for contractor employees, and eligibility for access to classified national security information), shall prohibit unfavorable determinations of eligibility of an individual for a personal identity verification credential based solely on the past use of marijuana by the individual.</text></section><section id="idef2b3b0d942f4cf595f53017b79e040c"><enum>7.</enum><header>Guidance for agencies</header><text display-inline="no-display-inline">The Office and the Office of the Director of National Intelligence shall— </text><paragraph commented="no" display-inline="no-display-inline" id="idac5bf3115a4343a0884dbb21b290ea6e"><enum>(1)</enum><text display-inline="yes-display-inline">assist executive agencies in implementing this Act and the amendments made by this Act; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideb4974072aac447c905b217088acece4"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the regulations and guidance of the Office and the Office of the Director of National Intelligence align with this Act and the amendments made by this Act.</text></paragraph></section></legis-body></bill>
