<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4689</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240711" legis-day="20240710">July 11 (legislative day, July 10), 2024</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To remove aliens who fail to comply with a release order, to enroll all aliens on the ICE nondetained docket in the Alternatives to Detention program with continuous GPS monitoring, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA60F49A6689F4B58BA6B8C65B7FD2357"><section section-type="section-one" id="H5BEDABB619D24C808B94B01F73BAA497"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for Jocelyn Act</short-title></quote>.</text></section><section id="HB7D2D1E8887F4CCA8D9DDE5A976EE4C6"><enum>2.</enum><header>Limitation on participation in Alternatives to Detention</header><text display-inline="no-display-inline">No alien may be released as part of any program under the Alternatives to Detention program unless—</text><paragraph id="idBF828BB20AA54E4C8254BA4343864F6E"><enum>(1)</enum><text display-inline="yes-display-inline">all detention beds available to the Secretary have been filled;</text></paragraph><paragraph id="idA6104BC8A2534B20AD0A39C7768643C6"><enum>(2)</enum><text>there exists no available option to hold aliens in detention; and</text></paragraph><paragraph id="id92d37fd376f9405d9c7942852a91e6d9"><enum>(3)</enum><text>the Secretary of Homeland Security has exercised and exhausted all reasonable efforts to hold aliens in detention. </text></paragraph></section><section id="H7C27200C63F5465B97DC79A9D010423F"><enum>3.</enum><header>GPS tracking and curfew requirements for certain aliens</header><text display-inline="no-display-inline">Each alien on U.S. Immigration and Customs Enforcement’s nondetained docket shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d3d43853b614f558f53d191e8920b35"><enum>(1)</enum><text display-inline="yes-display-inline">enrolled in the Alternatives to Detention program;</text></paragraph><paragraph id="idecb2f5f0b67a46a5aaccbb61f7e78813"><enum>(2)</enum><text>continuously subject to GPS monitoring— </text><subparagraph commented="no" display-inline="no-display-inline" id="idfc913c29a36144ddb21fd5daaa2dfc69"><enum>(A)</enum><text display-inline="yes-display-inline">for the duration of all applicable immigration proceedings, including any appeal; and</text></subparagraph><subparagraph id="ida428cb1c31a94e04828059aca2505e0f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an alien who is ordered removed from the United States, until removal; and </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id985739EAB8894FD99F57E92F13CBB25C"><enum>(3)</enum><text>required to stay in their Alternatives to Detention-compliant home address between the hours of 10:00 p.m. to 5:00 a.m. </text></paragraph></section><section id="H79B554501CF94A7086BA2097BF197C8E"><enum>4.</enum><header>Removal of aliens who fail to comply with release order</header><text display-inline="no-display-inline">Section 240(b)(5) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(b)(5)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8FB8E09E34384D57A9096C646012F69B"><subparagraph id="H459C180ECDBC483894625D07FF1C9295"><enum>(F)</enum><header>Failure to comply with release order</header><text display-inline="yes-display-inline">If an immigration officer submits an affidavit to an immigration judge stating that an alien failed to comply with a condition of release under section 236(a), such alien shall be ordered removed in absentia.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ida37543c0b2984ef0a1c8b3dc7eaead21"><enum>5.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the application of such provision to any person or circumstance is held by a Federal court to be unconstitutional, the remainder of this Act and the application of such provisions to any other person or circumstance shall not be affected.</text></section></legis-body></bill>
