which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To enhance the effectiveness of the Shadow Wolves Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Shadow Wolves Improvement Act</short-title></quote>.</text></section><section id="id76d6120cf105438b9b03cda4b0933246"><enum>2.</enum><header>Enhancing the effectiveness of the Shadow Wolves Program</header><subsection commented="no" display-inline="no-display-inline" id="idc19a01ed890044e789dba79850f04724"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle D of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/251">6 U.S.C. 251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF4ECC88829BD4F6D8CC60A01BB8F1E15"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id62e58e7e3fd54f3b9d3deeb8ad95dfb3"><enum>447.</enum><header>Shadow Wolves Program</header><subsection commented="no" display-inline="no-display-inline" id="id17407bbcdb8142528a7bc21ec17a093f"><enum>(a)</enum><header display-inline="yes-display-inline">Mission and goals</header><text display-inline="yes-display-inline">The Director of U.S. Immigration and Customs Enforcement (referred to in this section as the <quote>Director</quote>), in coordination with appropriate representatives of partnering Tribal governments, including the Tohono O'odham Nation, shall specify the mission and goals of the Shadow Wolves Program. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbb9af5726fd64ae3b2b90c1309cd66c2"><enum>(b)</enum><header>Staffing</header><text display-inline="yes-display-inline">The Director shall determine—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ad4092f099345e99e951eb20235caa9"><enum>(1)</enum><text display-inline="yes-display-inline">the number of special agents needed to staff the Shadow Wolves Program nationally; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id809f9e6563dd4c4b99fa7a21107c7e44"><enum>(2)</enum><text display-inline="yes-display-inline">the knowledge, skills, and abilities that such special agents shall be required to possess.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idff63998b27464aaaba6e73f82d8f23f0"><enum>(c)</enum><header>Strategy</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of the <short-title>Shadow Wolves Improvement Act</short-title>, the Director, in consultation with appropriate representatives of partnering Tribal governments, including the Tohono O'odham Nation, shall update the strategy required under section 3 of the Shadow Wolves Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/113">Public Law 117–113</external-xref>) by adding—</text><paragraph commented="no" display-inline="no-display-inline" id="id3189e2671c534e0f844f8a06375ba460"><enum>(1)</enum><text display-inline="yes-display-inline">measurable objectives to achieve the retention and recruitment of law enforcement officers, and the expansion goals set forth in the strategy; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c046238673d44e7905ba0c869d32265"><enum>(2)</enum><text display-inline="yes-display-inline">a timeline for achieving such goals; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2606b6284b1142c5874338ba33dbe653"><enum>(3)</enum><text display-inline="yes-display-inline">milestones for recruiting qualified special agents for the Shadow Wolves Program to meet the target identified in the staffing needs assessment required under subsection (b)(1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd7e439bed18340a490c760b326b029b8"><enum>(d)</enum><header>Provision of information</header><text display-inline="yes-display-inline">The Director shall provide, to each GS–1801 Tactical Officer who is employed as a Shadow Wolf by Homeland Security Investigations as of the date of the enactment of the <short-title>Shadow Wolves Improvement Act</short-title>, written information that will help them make an informed decision about reclassifying as a special agent, including—</text><paragraph commented="no" display-inline="no-display-inline" id="idf950cd186dad4d67bb9c053708ef63ff"><enum>(1)</enum><text display-inline="yes-display-inline">individualized information regarding how reclassification would affect pay, including changes to overtime pay, and retirement compensation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc0dd7f6201014af19e44e2815a209e72"><enum>(2)</enum><text display-inline="yes-display-inline">steps such members are required to complete to be reclassified as special agents, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5adef0ad06d841849511e627bd723711"><enum>(A)</enum><text display-inline="yes-display-inline">whether they must meet training requirements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1622b046e4da44f587304ec753df6ea1"><enum>(B)</enum><text display-inline="yes-display-inline">a description of those requirements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c0eed12bddc4d919f12471b21336c1b"><enum>(C)</enum><text display-inline="yes-display-inline">whether they are exempt from physical fitness, medical, or polygraph examinations; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9926a89e0e904782b540f1d22f06693d"><enum>(D)</enum><text display-inline="yes-display-inline">whether they are eligible for overtime pay during such training; and </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27a5335b938849dfb8903712b63af6d7"><enum>(3)</enum><text display-inline="yes-display-inline">any other relevant information that the Director believes would help such members make an informed decision regarding such classification. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida9631e717f254fb5a809af3ea7772d11"><enum>(e)</enum><header>Succession plan</header><text display-inline="yes-display-inline">The Director shall develop a plan for the timely recruitment of qualified individuals to fill vacant special agent positions in the Shadow Wolves Program that will result from anticipated retirements. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb27199331b5b4dfa81c238e051be5453"><enum>(f)</enum><header>Program expansion</header><text display-inline="yes-display-inline">The Director shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id058822585c464f8e80968279c95efabb"><enum>(1)</enum><text display-inline="yes-display-inline">develop criteria for evaluating and selecting additional tribal lands on which additional Shadow Wolves units could be located, including the amount of additional funding necessary and potential sources for such funding; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04260086d9654a8198a523c38b7758f6"><enum>(2)</enum><text>in developing such criteria, give consideration to tribal lands located in proximity to existing facilities that provide Federal law enforcement training.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id280c9bf2beff49cfa4f627121542915b"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by inserting after the item relating to section 446 the following:</text><quoted-block style="OLC" id="id6ead56da-737a-4a1e-9a43-c5dbd6fa58da"><toc><toc-entry level="section" idref="id62e58e7e3fd54f3b9d3deeb8ad95dfb3">Sec. 447. Shadow Wolves Program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id8f00ec24d072498fb2ad17c63e525800"><enum>3.</enum><header>Report to Congress on implementation of Shadow Wolves Program enhancements</header><subsection id="id2afac98605f648baa52be7c5721e43d6"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8b1319ec14424b98b03aca1079df23cd" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of U.S. Immigration and Customs Enforcement. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8ed582884ab4ce99ab0fc2061cfaf8c"><enum>(2)</enum><header>Relevant congressional committees</header><text display-inline="yes-display-inline">The term <term>relevant congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id24db247cb8cb4da2a7e49e13ba7dccbb"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76702eb92ff74033bcdb18df3771129c"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34c98e354afd4b88afcd1e21f61e1dd3"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph id="id460342a6afd740f896be58e19600b92b" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id80498add500c41548681aa4549aa48eb"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director shall submit a report to the relevant congressional committees that describes the progress that has been made towards the full implementation of—</text><paragraph commented="no" display-inline="no-display-inline" id="idd84cc9d3c9d5476889f3c7c7d5930956"><enum>(1)</enum><text display-inline="yes-display-inline">section 447 of the Homeland Security Act of 2002, as added by section 2, including required coordination with appropriate representatives of the Tohono O’odham Nation and other partnering Tribal governments to specify the mission and goals of the Shadow Wolves Program, which shall include tracking, interdiction, and investigation; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ae6eca791f343cc81c47682b76d8b4b"><enum>(2)</enum><text>section 2(4) of the Shadow Wolves Enhancement Act, as added by section 4.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idad50353890aa44298424e0ccaf078e4e"><enum>4.</enum><header>Conversion of experienced Shadow Wolves to career appointment in the competitive service</header><text display-inline="no-display-inline">Section 2 of the Shadow Wolves Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/113">Public Law 117–113</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcea0fa916ee24c73b4ed0f48cbeb00a0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee5814bee2954b9d9f37844d100b7b4e"><enum>(2)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6011355d77b44cd09cfb68e073ca67f7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id678307462B044DF588030460DA4FB828"><paragraph id="id8bb2ed641a3f4ceebbafa4e0cc1d9928"><enum>(4)</enum><text>to noncompetitively convert Shadow Wolves, after their successful completion of three years as Shadow Wolves, regardless of location assigned, from the excepted service to career or career conditional appointments in the competitive service.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
