which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Commissioner for U.S. Customs and Border Protection to assess current efforts to respond to hazardous weather and water events at or near United States borders and, to the extent such efforts may be improved, to develop a hazardous weather and water events preparedness and response strategy, and for other purposes.</official-title></form><legis-body><section id="ide368a1629da74444a9c85ecbb4f04af7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Weather Resiliency Act of 2024</short-title></quote>.</text></section><section id="id04461a07dd7049a6a4cf8149d42fb558"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idde8b884912804c34b97c1800192736b3"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id68ad158841a44197857a7da283810e4d"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcc58d47f4e6d4e14840cabe4c9081e76"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5e16da4f5875495bac3b3764f40eef07"><enum>(2)</enum><header display-inline="yes-display-inline">Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner for U.S. Customs and Border Protection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida8dad91a7cd14e7790c18e766aba0d47"><enum>(3)</enum><header display-inline="yes-display-inline">Hazardous weather and water events</header><text>The term <term>hazardous weather and water events</term> means weather and weather-related water events that have a high risk of endangering life or causing significant damage to property, including—</text><subparagraph id="id44ef786961744959b757c7c6df3e7601"><enum>(A)</enum><text>severe storms, such as hurricanes and short-fused, small-scale hazardous weather or hydrologic events produced by thunderstorms, including large hail, damaging winds, tornadoes, and flash floods;</text></subparagraph><subparagraph id="id04b27e06a7944fe8bed996fa4489ea29"><enum>(B)</enum><text>winter storms, such as freezing or frozen precipitation (including freezing rain, sleet, and snow), or combined effects of freezing or frozen precipitation and strong winds; and</text></subparagraph><subparagraph id="ida84e11c5363842f4aa2db36c0108a2e1"><enum>(C)</enum><text>other weather hazards, such as extreme heat or cold, wildfire, drought, dense fog, damaging winds, earthquakes, tsunamis, river flooding, and lakeshore flooding. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0358a429de0a488988d9ba320ad69cfc"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="id88170132665f407e8048990426d5a440"><enum>3.</enum><header>Assessment of impacts of hazardous weather and water events on U.S. Customs and Border Protection personnel, technology, and infrastructure</header><subsection commented="no" display-inline="no-display-inline" id="id7d3ad98aaf7f473a85525e7535e89195"><enum>(a)</enum><header display-inline="yes-display-inline">Assessment</header><text>The Commissioner shall conduct an assessment of the impacts that hazardous weather and water events, occurring during the 5-year period immediately preceding the date of the enactment of this Act, have had on—</text><paragraph id="id190632151c5745ef90213c9c4ddd0f88"><enum>(1)</enum><text>the effectiveness by which U.S. Customs and Border Protection has carried out the duties as set forth in section 411(c) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211(c)</external-xref>); </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3943b877e5104775b63429854c597f36"><enum>(2)</enum><text display-inline="yes-display-inline">the health, safety, and well being of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id737d3a6f78e245c7ba6390f28dc9dfed"><enum>(A)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection personnel; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7be0e8d2d1ec446e805d9e2bc23677dd"><enum>(B)</enum><text display-inline="yes-display-inline">individuals being inspected by U.S. Customs and Border Protection;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf50e3432fdfb492aa5ebec529a9aadda"><enum>(3)</enum><text display-inline="yes-display-inline">the ability of U.S. Customs and Border Protection to maintain the integrity and operability of border security technology, infrastructure, vehicles, and other significant real or personal property owned or operated by U.S. Customs and Border Protection; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb77d45ebeea640a3abcb8a4d71b8c0ef"><enum>(4)</enum><text>the effectiveness of agent and officer uniforms and the uniform distribution platform in ensuring agent and officer safety and comfort during such events. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id57a3613a522e4acda41b9e99c3ba1133"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall submit a report to the appropriate congressional committees that—</text><paragraph commented="no" display-inline="no-display-inline" id="idae46c71ff86e4223a591872a4e899523"><enum>(1)</enum><text display-inline="yes-display-inline">contains the results of the assessment conducted by the Commissioner pursuant to subsection (a); and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaaa7620b08ea4368b16ac48b2e908c50"><enum>(2)</enum><text display-inline="yes-display-inline">describes the efforts of the Secretary and the Commissioner to respond to and otherwise address the impacts of the hazardous weather and water events referred to in subsection (a).</text></paragraph></subsection></section><section id="id21c988c69a484b7393ec5d32f374dcbe"><enum>4.</enum><header>Strategy to address impacts of hazardous weather and water events</header><subsection commented="no" display-inline="no-display-inline" id="idafd9afe7da5440f6a815a9ad9f941434"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the appropriate congressional committees a strategy for mitigating the impacts of hazardous weather and water events on—</text><paragraph id="id3938db6ab85d4d65acbf61f90e2b719a"><enum>(1)</enum><text>the effectiveness by which U.S. Customs and Border Protection carries out its statutory duties, as prescribed under section 411 of the <short-title>Homeland Security Act of 2002</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211</external-xref>);</text></paragraph><paragraph id="id6a70e2835ecc420ca719246c4ba5edae"><enum>(2)</enum><text>the health, safety, and well-being of—</text><subparagraph id="idafdf511a825e41939836fbb8d5fe9c46"><enum>(A)</enum><text>U.S. Customs and Border Protection personnel; and</text></subparagraph><subparagraph id="idffd5668f27644a4baf037b2ce3c1596c"><enum>(B)</enum><text>individuals being inspected by U.S. Customs and Border Protection; and</text></subparagraph></paragraph><paragraph id="id73c16a0760a84802ab649afeee16349b"><enum>(3)</enum><text>the ability of U.S. Customs and Border Protection to maintain the integrity and operability of border security technology, infrastructure, vehicles, and other significant real or personal property owned or operated by U.S. Customs and Border Protection. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5087914a165a43039495757ca80bb355"><enum>(b)</enum><header>Consultation</header><paragraph id="idcc8e51a13ced4d819b98303cab8c1977"><enum>(1)</enum><header>In general</header><text>While developing and implementing the strategy required under subsection (a), the Secretary, in addition to consulting with appropriate officials of the Department of Homeland Security, and except as provided in paragraph (2)—</text><subparagraph id="id53b233d01e0c44d8a1b834b8f4ba7f6a"><enum>(A)</enum><text>shall consult and engage with, at a minimum—</text><clause id="id2e48fa7924c94271bd4a144da6d3a129"><enum>(i)</enum><text>the Administrator of the National Oceanic and Atmospheric Administration;</text></clause><clause commented="no" display-inline="no-display-inline" id="id400eb018971043bfbab637b9e0b81811"><enum>(ii)</enum><text display-inline="yes-display-inline">the Administrator of the General Services Administration;</text></clause><clause id="id7b10fbe527c8411d845cfcf4ccff14e4"><enum>(iii)</enum><text>the Secretary of Health and Human Services; </text></clause><clause commented="no" display-inline="no-display-inline" id="id7fea603d29cd42cba0c1504cc5eba373"><enum>(iv)</enum><text display-inline="yes-display-inline">Governors of States with an international border;</text></clause><clause id="id1da1524e82a1417fa93a249e6fb1c4ca"><enum>(v)</enum><text>Tribal governments whose official territory is within 50 miles of the southern or northern border of the United States; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id670f848e8b27410cab45ef5e9cdacbbd"><enum>(vi)</enum><text>representative organizations representing U.S. Customs and Border Protection personnel, including Border Patrol agents; and </text></clause></subparagraph><subparagraph id="id31210ef6da3f40efa410809ff0846f96"><enum>(B)</enum><text>may consult with nongovernmental experts, including experts in the fields of—</text><clause id="id492ea484bf224e23b499e1c05e8acb97"><enum>(i)</enum><text>meteorology;</text></clause><clause id="id4797c28343fb493897c9532b8d447351"><enum>(ii)</enum><text>public health; and</text></clause><clause id="id31919e44d1b54882a71e6753ae5a4c19"><enum>(iii)</enum><text>infrastructure and technology weather resiliency. </text></clause></subparagraph></paragraph><paragraph id="id7f37bf7e03354def840283934cbd345e"><enum>(2)</enum><header>Nonapplicability of federal advisory committee act</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code (commonly referred to as the <quote>Federal Advisory Committee Act</quote>), shall not apply to any consultation authorized under paragraph (1)(B).</text></paragraph></subsection><subsection id="idf5e75b2ed99e41f9abd5df4596e0d4dd"><enum>(c)</enum><header>Cost-Benefit analysis</header><text>The strategy required under subsection (a) shall include a cost-benefit analysis of implementing such strategy. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc28199ced19e447b95625e5fbdcf1145"><enum>(d)</enum><header display-inline="yes-display-inline">Implementation</header><paragraph id="idc7d922cc66e44c5fbb3596ea0a2e3a72"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the strategy required under subsection (a) is submitted to the appropriate congressional committees, the Secretary shall commence the implementation of such strategy.</text></paragraph><paragraph id="idf3ad420409c743279de1b388e948dbc0"><enum>(2)</enum><header>Semiannual report</header><text>Not later than 180 days after the commencement of the implementation of the strategy pursuant to paragraph (1), and semiannually thereafter for the following 5 years, the Secretary shall submit a report to the appropriate congressional committees that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idac2e9d10e34c47218d542478dbf93f25"><enum>(A)</enum><text display-inline="yes-display-inline">describes the efforts of the Department of Homeland Security to implement the strategy and the progress made as a result of such efforts;</text></subparagraph><subparagraph id="ida1832f33010049dab290f7362353bb9a"><enum>(B)</enum><text>includes any recommendations for mitigating the impacts of hazardous weather and water events and the extent to which such recommendations were implemented; and</text></subparagraph><subparagraph id="idcf8930fe9b7f4e8a994df6ced34973ce"><enum>(C)</enum><text>assesses the resources and cost necessary for U.S. Customs and Border Protection to implement such recommendations, with a focus on effectively carrying out its statutory duties.</text></subparagraph></paragraph></subsection><subsection id="id9d147aa9cf6a49188e1d24860c73850c"><enum>(e)</enum><header>Limitation</header><text>Nothing in the strategy developed pursuant to subsection (a) may conflict with any provision of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1001">8 U.S.C. 1001 et seq.</external-xref>). </text></subsection></section><section id="id849cdfca0012460ca3b70bf2a3601960"><enum>5.</enum><header>Safety protocols to protect U.S. Customs and Border Protection personnel, technology, and infrastructure</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Commissioner shall establish safety protocols and procedures to mitigate the impact of hazardous weather and water events on the ability of U.S. Customs and Border Protection—</text><paragraph commented="no" display-inline="no-display-inline" id="ide469894f6cef4fb5835c7a219bd05147"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out its statutory duties;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a21ecc0fa4e4c9f82a5ffb3271b1636"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure the health, safety, and well being of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbd26b73c415040dca2e823743a0f3553"><enum>(A)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection personnel; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddab3d56398e2485c9fe84bd0e5b44771"><enum>(B)</enum><text display-inline="yes-display-inline">individuals being inspected by U.S. Customs and Border Protection; and</text></subparagraph></paragraph><paragraph id="id49d8fa0694af4943b7464d11cd24cda2"><enum>(3)</enum><text>to maintain the integrity and operability of border security technology, infrastructure, vehicles, and other significant real or personal property owned or operated by U.S. Customs and Border Protection.</text></paragraph></section></legis-body></bill>
