changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Death investigation</header><text display-inline="yes-display-inline">The term <term>death investigation</term> has the meaning determined by the Attorney General.</text></paragraph><paragraph id="id7b4fc0eb-ba86-4112-86a7-4e988b5ffbda" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Death investigation of interest to Indian Tribes</header><text display-inline="yes-display-inline">The term <term>death investigation of interest to Indian Tribes</term> means a case involving—</text><subparagraph id="id7165e458-b3e9-4d04-ba4e-4c3c423c8460" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a death investigation into the death of an Indian; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2912359f-6906-4acc-bfb9-513a9998ca56" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a death investigation of a person found on, in, or adjacent to Indian land or a Village.</text></subparagraph></paragraph><paragraph id="id6bcc2d5e-3a83-4bb8-a6ac-b63b0942e2c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Deputy Bureau Director of the Office of Justice Services of the Bureau of Indian Affairs.</text></paragraph><paragraph commented="no" id="idb2e436e6-7773-4393-934b-b72c7b7262b7" changed="not-changed" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Federal law enforcement agency</header><text display-inline="yes-display-inline">The term <term>Federal law enforcement agency</term> means the Office of Justice Services of the Bureau of Indian Affairs, the Federal Bureau of Investigation, and any other Federal law enforcement agency that—</text><subparagraph id="idd266879a-21ca-438e-a82e-33acd623d4c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">has jurisdiction over crimes in Indian country; or</text></subparagraph><subparagraph id="idce8e90cc-a9f0-4209-b528-9097965a3f92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">investigates missing persons cases of interest to Indian Tribes, death investigations of interest to Indian Tribes, unclaimed human remains cases of interest to Indian Tribes, or unidentified remains cases of interest to Indian Tribes.</text></subparagraph></paragraph><paragraph id="idfca59108-a6bd-40b3-b0e0-9a1e11e1e6b2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Indian</header><text display-inline="yes-display-inline">The term <term>Indian</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="id510b124c-5e1e-4057-904c-2992cdc24a9a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code.</text></paragraph><paragraph id="id3d5f4c87-03ef-46e0-9092-948932ce5680" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Indian land</header><text display-inline="yes-display-inline">The term <term>Indian land</term> has the meaning given the term <term>Indian lands</term> in section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>).</text></paragraph><paragraph id="id55dbb2db-ee86-49ea-955e-3843680e3490" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" id="ida239a848-ed8d-48fb-893c-811e497cf222" changed="not-changed" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Missing persons case of interest to Indian Tribes</header><text display-inline="yes-display-inline">The term <term>missing persons case of interest to Indian Tribes</term> means a case involving—</text><subparagraph commented="no" id="id909ec205-3494-4828-8cfb-9284f91f6fb7" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a missing Indian; or</text></subparagraph><subparagraph id="id22d624d4-6677-4b68-93c0-d0c904bee463" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a missing person whose last known location is believed to be on, in, or adjacent to Indian land or a Village.</text></subparagraph></paragraph><paragraph commented="no" id="iddbd18dcd-2cec-43fe-9129-a5f7281bdfda" changed="not-changed" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">National crime information databases</header><text display-inline="yes-display-inline">The term <term>national crime information databases</term> has the meaning given the term in section 534(f)(3) of title 28, United States Code.</text></paragraph><paragraph id="id76a24237-5bf2-4e7b-884a-be24d4d81f4c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Relevant Tribal organization</header><text display-inline="yes-display-inline">The term <term>relevant Tribal organization</term> means, as applicable—</text><subparagraph id="idf950bd2f-d778-4ade-a257-c9f0d7e9095e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a Tribal organization or an urban Indian organization; and</text></subparagraph><subparagraph id="idda4bc82b-31bf-4ee3-a43a-13a36f611c39" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a national or regional organization that—</text><clause id="ida84c0b4e-02a9-4600-aff7-a1969011fa34" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">represents a substantial Indian constituency; and</text></clause><clause id="id3dd674da-8e55-412b-bc5a-323c62e3212a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">has expertise in the fields of—</text><subclause id="idf6667922-9d6d-448c-a4d9-cfdb399f1f35" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">human trafficking of Indians;</text></subclause><subclause id="idd3b73cd6-f433-4e24-8fa3-58f54613681d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">human trafficking on Indian land or in a Village;</text></subclause><subclause id="idde1cf3a8-08f4-431b-bd2d-3a0f4a434e38" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text display-inline="yes-display-inline">violence against Indians;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id542f585fcc7d44c2b674920892702df3" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">missing or murdered Indigenous persons; or</text></subclause><subclause id="id629d8aa4-7a8a-465c-af63-a06e8cc73901" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(V)</enum><text display-inline="yes-display-inline">Tribal justice systems.</text></subclause></clause></subparagraph></paragraph><paragraph id="idb28d949d-528d-4410-bd57-4771c1229d29" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="idab42e44e-3ebf-4061-87da-f1c44152669d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(13)</enum><header display-inline="yes-display-inline">Sexual violence case of interest to Indian Tribes</header><text display-inline="yes-display-inline">The term <term>sexual violence case of interest to Indian Tribes</term> means a case involving an allegation of sexual violence (as defined in section 204(a) of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304(a)</external-xref>)).</text></paragraph><paragraph id="idb7bf681f-ecec-4eb2-985c-df95c1196c65" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header display-inline="yes-display-inline">Tribal justice official</header><text display-inline="yes-display-inline">The term <term>Tribal justice official</term> has the meaning given the term <term>tribal justice official</term> in section 2 of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2801">25 U.S.C. 2801</external-xref>).</text></paragraph><paragraph id="id0b62a889-530b-429c-acf1-98699d02d89c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(15)</enum><header display-inline="yes-display-inline">Tribal organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idd3ad0916-cea7-4b3c-8226-b6e98a4d4150" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(16)</enum><header display-inline="yes-display-inline">Unclaimed human remains case of interest to Indian Tribes</header><text display-inline="yes-display-inline">The term <term>unclaimed human remains case of interest to Indian Tribes</term> means a case involving—</text><subparagraph id="id19fb6133-b928-4896-a532-e5e650707094" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">unclaimed Indian remains identified by Federal, Tribal, State, or local law enforcement; or</text></subparagraph><subparagraph id="idd4fdab9f-1075-4507-972e-f39230a3cf97" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">unclaimed human remains found on, in, or adjacent to Indian land or a Village. </text></subparagraph></paragraph><paragraph id="idecf2fb5f-8117-4302-b1ae-4d35c61226c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(17)</enum><header display-inline="yes-display-inline">Unidentified remains case of interest to Indian Tribes</header><text display-inline="yes-display-inline">The term <term>unidentified remains case of interest to Indian Tribes</term> means a case involving—</text><subparagraph id="ide17fea48-8bdf-48dd-9420-c6440a526c27" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">unidentified Indian remains; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6da8bbd6-f942-49cd-8d1f-80600a9069d4" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">unidentified remains found on, in, or adjacent to Indian land or a Village.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f92bbda-24a8-4c51-bf74-8c2788995454" changed="not-changed"><enum>(18)</enum><header display-inline="yes-display-inline">Urban Indian organization</header><text display-inline="yes-display-inline">The term <term>urban Indian organization</term> has the meaning given the term in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a09d330-65f4-4fe9-b673-efbac3409454" changed="not-changed"><enum>(19)</enum><header display-inline="yes-display-inline">Village</header><text display-inline="yes-display-inline">The term <term>Village</term> means the Alaska Native Village Statistical Area covering all or any portion of a Native village (as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)), as depicted on the applicable Tribal Statistical Area Program Verification Map of the Bureau of the Census.</text></paragraph></section><title id="id32bee682-168d-45cc-8f6f-105e19951681" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Bridging agency data gaps</header><section id="idd252ab3f-6df8-4967-bf87-c2f46d8e7799" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">National Missing and Unidentified Persons System Tribal facilitator</header><subsection id="id822c3d6f-cce0-4da7-9e95-5c7d192a7e92" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The Attorney General shall appoint 1 or more Tribal facilitators for the National Missing and Unidentified Persons System.</text></subsection><subsection id="idc4316293-d68f-4827-8320-952798897e9f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The duties of a Tribal facilitator appointed under subsection (a) shall include—</text><paragraph id="id9fc3a20b-9c49-46c8-b294-2651bdfc0dc3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">coordinating the reporting of information relating to missing persons cases of interest to Indian Tribes, unclaimed human remains cases of interest to Indian Tribes, and unidentified remains cases of interest to Indian Tribes;</text></paragraph><paragraph id="id877747cc-e68b-49bc-b95a-14d0f0d5293a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">consulting and coordinating with Indian Tribes and relevant Tribal organizations to address the reporting, documentation, and tracking of missing persons cases of interest to Indian Tribes, unclaimed human remains cases of Interest to Indian Tribes, and unidentified remains cases of interest to Indian Tribes;</text></paragraph><paragraph id="id996300ad-55e4-4cc0-bf83-e243623548e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">developing working relationships, and maintaining communication, with Indian Tribes and relevant Tribal organizations;</text></paragraph><paragraph id="idc74e57f0-1adf-4d6d-80e0-fb333b073702" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">providing technical assistance and training to Indian Tribes and relevant Tribal organizations, victim service advocates, medical examiners, coroners, and Tribal justice officials regarding—</text><subparagraph id="id3866d9d5-a102-4208-b062-27862bc15cab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the gathering and reporting of information to the National Missing and Unidentified Persons System; and</text></subparagraph><subparagraph id="idbb29ff95-e88e-4ea2-aba5-ed490d5ce450" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">working with non-Tribal law enforcement agencies to encourage missing persons cases of interest to Indian Tribes, unclaimed human remains cases of interest to Indian Tribes, and unidentified remains cases of interest to Indian Tribes are reported to the National Missing and Unidentified Persons System;</text></subparagraph></paragraph><paragraph id="idd47cee8e-7546-4b0b-b4ab-3a92feb57e1e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">coordinating with the Office of Tribal Justice, the Office of Justice Services of the Bureau of Indian Affairs, the Executive Office for United States Attorneys, the Federal Bureau of Investigation, State law enforcement agencies, and the National Indian Country Training Initiative, as necessary; and</text></paragraph><paragraph id="id18b50bac-89e2-47db-b2d0-141e14664ad1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">conducting other training, information gathering, and outreach activities to improve resolution of missing persons cases of interest to Indian Tribes, unclaimed human remains cases of interest to Indian Tribes, and unidentified remains cases of interest to Indian Tribes.</text></paragraph></subsection><subsection id="idd6545a8d-ca7a-41cb-be8b-2191f69e500c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting and transparency</header><paragraph id="id16f97ea4-fba2-4b89-b27c-7480822c4a4f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Annual reports to Congress</header><text display-inline="yes-display-inline">During the 3-year-period beginning on the date of enactment of this Act, the Attorney General, acting through the Director of the National Institute of Justice, shall submit to the Committees on Indian Affairs, the Judiciary, and Appropriations of the Senate and the Committees on Natural Resources, the Judiciary, and Appropriations of the House of Representatives an annual report describing the activities and accomplishments of the Tribal facilitators appointed under subsection (a) during the 1-year period preceding the date of the report.</text></paragraph><paragraph id="id776977ef-a33d-4841-bf0a-f5696817c9ac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Public transparency</header><text display-inline="yes-display-inline">Annually, the Attorney General, acting through the Director of the National Institute of Justice, shall publish on a website publicly accessible information describing the activities and accomplishments of the Tribal facilitators appointed under subsection (a) during the 1-year period preceding the date of the publication.</text></paragraph></subsection></section><section id="idc2413c61-f5a2-425d-9057-1e646a2b56cb" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Report on Indian country law enforcement personnel resources and need</header><subsection id="id63d13d67-16a2-40c7-adc8-9e01f5f8abbb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Office of Justice Services of the Bureau of Indian Affairs</header><text display-inline="yes-display-inline">Section 3(c)(16) of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2802">25 U.S.C. 2802(c)(16)</external-xref>) is amended by striking subparagraph (C) and inserting the following:</text><quoted-block commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">public safety and emergency communications and technology needs, including equipment and internet capacity needs; and</text></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="id8f0dcb77-7016-4d84-a72f-e6b821002982" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Department of Justice</header><paragraph id="idbd17d3ab-d93f-4db9-969f-fd70360dd937" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of Department of Justice law enforcement agency</header><text display-inline="yes-display-inline">In this subsection, the term <term>Department of Justice law enforcement agency</term> means each of—</text><subparagraph id="idecef1228-59cf-464c-b625-f2e9da882e8c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text report</header><text display-inline="yes-display-inline">Each fiscal year, the Attorney General shall submit to the Committees on Indian Affairs, the Judiciary, and Appropriations of the Senate and the Committees on Natural Resources, the Judiciary, and Appropriations of the House of Representatives a report for that fiscal year that includes—</text><subparagraph id="idd9afa1cc-7766-4344-b6e7-d5e18c99f5a6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the number of full-time employees of each Department of Justice law enforcement agency that are assigned to work on criminal investigations and prosecutions in Indian country;</text></subparagraph><subparagraph id="id36ae5c6340144449943a1bac000e9c65" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the percentage of time the full-time employees, as identified under subparagraph (A), spend specifically working in Indian country;</text></subparagraph><subparagraph id="idc7c10ee6f89d4356b4ff949817b84593" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the turnover rate during the 5-year period preceding the report of full-time employees assigned to work on criminal investigations and prosecutions in Indian country;</text></subparagraph><subparagraph id="idae9ae6238f9b4a00a9fbc6d1f6894b2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the average years of experience at the Department of Justice of full-time employees assigned to work on criminal investigations and prosecutions in Indian country;</text></subparagraph><subparagraph id="id283a85ca2b4e4312b6e8101648d296cd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the number of vacant positions with responsibilities for criminal investigations and prosecutions in Indian country;</text></subparagraph><subparagraph id="idaefdf4304a544e47b5f4f5f3da0351ee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">an identification of expertise and skills necessary to achieve the strategic goals of the Department of Justice relating to public safety in Indian country;</text></subparagraph><subparagraph id="idbc1cc0b9338d40f0b64ce41cca36410e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">an estimate of the number of employees needed with specific skills and competencies to fulfill responsibilities assigned for criminal investigations and prosecutions in Indian country; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0cb63995c2db4c99b77e8f49ca8b3b4e" changed="not-changed"><enum>(H)</enum><text display-inline="yes-display-inline">a list of measures identified to indicate whether and how the Department of Justice plans to execute its hiring, retention, and training strategies.</text></subparagraph></paragraph><paragraph id="id25edd684-9e3c-4d85-82ec-6bd65ed41498" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">GAO study and report</header><subparagraph id="ida47707d8-1596-441d-8d74-6e519ff050a3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">Study</header><clause id="idf060c52e-5bca-4d6b-8879-1269d4b400ab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which the first annual report is submitted under paragraph (2), the Comptroller General of the United States shall conduct a review of unmet staffing identified by the Department of Justice law enforcement agencies tasked with work on criminal investigations and prosecutions in Indian country.</text></clause><clause id="ida4c02088-ea83-4dbe-8431-f2193869159d" conducting the study required under clause (i), the Comptroller General of the United States shall take into account the results of the most recent report, as of the date of enactment of this Act, relating to Indian country investigations and prosecutions prepared by the Attorney General pursuant to section 10(b) of the Indian Law Enforcement Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2809">25 U.S.C. 2809(b)</external-xref>).</text></clause></subparagraph><subparagraph id="id71c45807-8706-454a-99c5-1a3f8d4704a7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">On completion of the review under subparagraph (A), the Comptroller General of the United States shall submit to the Committees on Indian Affairs, the Judiciary, and Appropriations of the Senate and the Committees on Natural Resources, the Judiciary, and Appropriations of the House of Representatives a report that describes the results of the study, including, as appropriate, proposals for methods by which the Department of Justice can better measure its unmet staffing and other needs for Department of Justice law enforcement agencies tasked with work on criminal investigations and prosecutions in Indian country.</text></subparagraph></paragraph></subsection></section></title><title id="id40c8c7de-e4b9-49e4-99a6-25bf75ebe99c" style="OLC" changed="not-changed" commented="no" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Ensuring safety for Native communities</header><section id="idc33a4c5b-b8af-4506-9052-eb9990b98275" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Demonstration program on Bureau of Indian Affairs law enforcement employment background checks</header><subsection id="id91ae6e69-eb29-4713-b3bd-c74dea08b1c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of demonstration program</header><paragraph id="idf5ab67ed-6273-41f6-9b72-fb4b8c6f3d1f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish a demonstration program for the purpose of conducting or adjudicating, in coordination with the Director, personnel background investigations for applicants for law enforcement positions in the Bureau of Indian Affairs.</text></paragraph><paragraph id="id01e69c99-a76f-49a1-9210-6cb853d924ab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Background investigations and security clearance determinations</header><subparagraph id="id94fc9ee7-c0f5-463e-b897-b32be0eec5b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">BIA investigations</header><text display-inline="yes-display-inline">As part of the demonstration program established under paragraph (1), the Secretary may carry out a background investigation, security clearance determination, or both a background investigation and a security clearance determination for an applicant for a law enforcement position in the Bureau of Indian Affairs.</text></subparagraph><subparagraph id="id3a28310c-f45b-4f6e-80de-69c18ff49879" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Agreements</header><text display-inline="yes-display-inline">The Secretary may enter into a memorandum of agreement with a State or local government, Indian Tribe, or Tribal organization to develop steps to expedite the process of receiving and obtaining access to information pertinent to background investigation and security clearance determinations for use in the demonstration program.</text></subparagraph></paragraph><paragraph id="ided89e2e9-d19b-4b61-bbc7-657ceb5cfbe1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The demonstration program established under paragraph (1) shall terminate 5 years after the date of the commencement of the demonstration program.</text></paragraph></subsection><subsection id="id1e145dcf-26cf-4be9-8577-772edc6bb51a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Sufficiency</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a background investigation conducted or adjudicated by the Secretary pursuant to the demonstration program established under subsection (a)(1) that results in the granting of a security clearance to an applicant for a law enforcement position in the Bureau of Indian Affairs shall be sufficient to meet the applicable requirements of the Office of Personnel Management or other Federal agency for such investigations.</text></subsection><subsection id="id28ce7665-c220-4856-8578-849dacdc0a80" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which the demonstration program is established under subsection (a)(1), the Secretary shall submit to the Committees on Indian Affairs, the Judiciary, and Appropriations of the Senate and the Committees on Natural Resources, the Judiciary, and Appropriations of the House of Representatives a report on the demonstration program, which shall include a description of—</text><paragraph id="id04856f07-8cdb-4bbc-b1c6-b3fb5bbda7bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the demonstration program and any recommended changes or updates to the demonstration program, including whether the demonstration program should be reauthorized;</text></paragraph><paragraph id="id0b0bde31-4f8f-4cf4-9d1e-1fec6b5d15f7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the number of background investigations carried out under the demonstration program;</text></paragraph><paragraph id="ide4984041-5e6c-45d6-974a-35d837995b17" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the costs, including any cost savings, associated with the investigation and adjudication process under the demonstration program;</text></paragraph><paragraph id="id40a63264-7b14-4c1a-a23a-0146480ddcb0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the processing times for the investigation and adjudication processes under the demonstration program; and</text></paragraph><paragraph id="idbd776d8d-32ff-4d9d-bb55-a7754f69a4ef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">any other information that the Secretary determines to be relevant.</text></paragraph></subsection></section><section commented="no" id="idcdba112e-91de-4d62-af54-449456ee0367" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Missing or murdered response coordination grant program</header><subsection id="idf7dd760d-f8f7-4172-b593-d6f88abc7822" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of grant program</header><text display-inline="yes-display-inline">The Attorney General shall establish within the Office of Justice Programs a grant program under which the Attorney General shall make grants to eligible entities described in subsection (b) to carry out eligible activities described in subsection (c).</text></subsection><subsection commented="no" id="id32157f91-2349-4628-ad21-f1f07dbe0b22" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible entities</header><paragraph commented="no" id="id1ffcf805-9e40-4a0c-a254-dc3c7e1a572b" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the grant program established under subsection (a) an entity shall be—</text><subparagraph id="id204ad715-b74e-447e-9fa8-67cb779bfdd6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an Indian Tribe; </text></subparagraph><subparagraph commented="no" id="id3b10d06e-3d6f-454d-9c24-daa49a050ba8" changed="not-changed" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a relevant Tribal organization;</text></subparagraph><subparagraph commented="no" id="idd525f6b9-42be-4b15-8c65-1f1718b8e568" changed="not-changed" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a State, in consortium with—</text><clause commented="no" id="ide4f2c088-4165-40a8-98b7-d2d54027dfdd" changed="not-changed" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">1 or more Indian Tribes; and</text></clause><clause commented="no" id="idf9d1c16b-78f5-4eec-96ad-75b802e9294d" changed="not-changed" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">relevant Tribal organizations, if any;</text></clause></subparagraph><subparagraph id="id9f961e6b-8d98-4cf3-8b66-549c2f503490" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">a consortium of 2 or more Indian Tribes or relevant Tribal organizations; or</text></subparagraph><subparagraph id="id98caf192-60b1-4f22-a51a-660f107ed05c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">subject to paragraph (2), a consortium of 2 or more States in consortium with—</text><clause id="id8bcd0d3b-1cc0-4bc5-ae55-93bcd7cc10c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">1 or more Indian Tribes; and</text></clause><clause id="idb11a10ae-2567-40b1-941e-6dbdf43c1c96" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">relevant Tribal organizations, if any.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id02f44cfe-bfda-4349-9e49-4869061138b6" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">State eligibility</header><text display-inline="yes-display-inline">To be eligible under subparagraph (C) or (E) of paragraph (1), a State shall demonstrate to the satisfaction of the Attorney General that the State—</text><subparagraph commented="no" id="id0ec80fa2-cfd0-46f1-89c4-1420fa30dcc5" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idf372cef3-6f96-43be-9f79-f0352386912a" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">reports missing persons cases in the State to the national crime information databases; or</text></clause><clause commented="no" id="idd3231b4b-9437-49a8-a2ee-bd79fb8cf501" indent="up1" changed="not-changed" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">if not, has a plan to do so using a grant received under the grant program established under subsection (a); and</text></clause></subparagraph><subparagraph id="idecc2b823-2da6-469e-a46e-6efa3c549b1c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">if data sharing between the State and the Indian Tribes and relevant Tribal organizations with which the State is in consortium is part of the intended use of the grant received under the grant program established under subsection (a), has entered into a memorandum of understanding with each applicable Indian Tribe and relevant Tribal organization.</text></subparagraph></paragraph></subsection><subsection commented="no" id="iddd8837d1-8998-418d-a13e-31330e3938ef" changed="not-changed" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Eligible activities</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under the grant program established under subsection (a) may use the grant—</text><paragraph commented="no" id="iddffedf33-2826-490b-b8ab-814039050f48" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to establish a statewide or regional center—</text><subparagraph commented="no" id="idea7cfc39-6097-415e-acde-5cc1f31ddebc" changed="not-changed" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to document and track—</text><clause commented="no" id="id29fe51cc-0bb4-4ae7-88a2-425b5f59d2de" changed="not-changed" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">missing persons cases of interest to Indian Tribes;</text></clause><clause commented="no" id="id61faa5f2-d791-423a-8d49-fb8a9c23fd38" changed="not-changed" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">sexual violence cases of interest to Indian Tribes; and</text></clause><clause commented="no" id="id686c23c2-b7ed-4212-8124-2e80d79439c2" changed="not-changed" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">death investigations of interest to Indian Tribes; and</text></clause></subparagraph><subparagraph id="id8f1ee669-f8f1-49a0-b421-2e67625f126c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to input information regarding missing persons cases of interest to Indian Tribes, unclaimed human remains cases of interest to Indian Tribes, and unidentified remains cases of interest to Indian Tribes into the National Missing and Unidentified Persons System and the Missing Persons File in the National Crime Information Center; </text></subparagraph></paragraph><paragraph commented="no" id="id3e972037-880c-4f46-a67d-17e10341bc56" changed="not-changed" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to establish a State or regional commission to respond to, and to improve coordination between Federal law enforcement agencies, and Tribal, State, and local law enforcement agencies of the investigation of, missing persons cases of interest to Indian Tribes, sexual violence cases of interest to Indian Tribes, and death investigations of interest to Indian Tribes; and</text></paragraph><paragraph commented="no" id="id6ba96070-a1ca-4c07-977c-ee49c98d0d3f" changed="not-changed" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to document, develop, and disseminate resources for the coordination and improvement of the investigation of missing persons cases of interest to Indian Tribes, sexual violence cases of interest to Indian Tribes, and death investigations of interest to Indian Tribes, including to develop local or statewide rapid notification or communication systems for alerts and other information relating to those cases.</text></paragraph></subsection><subsection commented="no" id="id9cde82a0-e773-4cd6-aa3d-4a031a58c0df" changed="not-changed" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out the grant program established under subsection (a)(1) $1,000,000 for each of fiscal years 2025 through 2029.</text></subsection></section><section commented="no" id="idbeac5632-cf6e-49f8-b4fd-b24bb338eac2" changed="not-changed" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">GAO study on Federal law enforcement agency evidence collection, handling, and processing</header><subsection commented="no" id="idc2cbb581-77f3-409a-b400-73e741a9b957" changed="not-changed" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study—</text><paragraph referred to in paragraph (1);</text></paragraph><paragraph id="id842b49de-02f6-4f0e-9d22-ac789813475a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">on the views of law enforcement officials at the agencies referred to in paragraph (1) and their counterparts within the Offices of the United States Attorneys concerning any relationship between—</text><subparagraph id="idc7c9d331-b352-420f-b90d-3b161e96607e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the barriers identified under paragraph (2); and</text></subparagraph><subparagraph id="idf6e1f51c-11b0-4017-8f13-a0011ef7f4f3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">United States Attorneys declination rates due to insufficient evidence; and</text></subparagraph></paragraph><paragraph id="idacd5d2ad-fd8f-4a16-b123-551e86bb48d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">that includes a description of barriers to evidence collection, handling, response times, and processing identified and faced by—</text><subparagraph id="idcf067c1c-adfd-4c46-8ea4-5014f98cb70a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Tribal law enforcement agencies; and </text></subparagraph><subparagraph id="idb158b3a1-e04f-4b23-8841-ab75da6ee1d3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">State and local law enforcement agencies that exercise jurisdiction over Indian country.</text></subparagraph></paragraph></subsection><subsection commented="no" id="idf1473861-2df6-46b6-ab52-2e98d16bf91a" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committees on Indian Affairs, the Judiciary, and Appropriations of the Senate and the Committees on Natural Resources, the Judiciary, and Appropriations of the House of Representatives a report describing the results of the study conducted under subsection (a).</text></subsection></section><section id="idfb37d50f-720b-46b2-ad3b-ab1853a661c5" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Bureau of Indian Affairs and Tribal law enforcement officer counseling resources interdepartmental coordination</header><text display-inline="no-display-inline">The Secretary of Health and Human Services and the Attorney General shall coordinate with the Director—</text><paragraph id="id2e52d1d0-585d-45d5-9dc9-b98aac6a2208" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to ensure that Federal training materials and culturally appropriate mental health and wellness programs are locally or regionally available to law enforcement officers working for the Office of Justice Services of the Bureau of Indian Affairs or an Indian Tribe; and</text></paragraph><paragraph id="id895d5a30-0b9f-4283-85a1-4e2c31cc1d37" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to determine whether law enforcement agencies operated by the Office of Justice Services of the Bureau of Indian Affairs and Indian Tribes are eligible to receive services under—</text><subparagraph id="id26964e4e-7dad-40bc-ab60-6be882f26457" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Law Enforcement Assistance Program of Federal Occupational Health of the Department of Health and Human Services; or </text></subparagraph><subparagraph id="id279e5aae-585e-48bb-afd4-9f551310b40f" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">any other law enforcement assistance program targeted to meet the needs of law enforcement officers working for law enforcement agencies operated by the Federal Government or an Indian Tribe.</text></subparagraph></paragraph></section></title></legis-body><attestation><attestation-group><attestation-date date="20241216" chamber="Senate">Passed the Senate
