<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CHIPS Training in America Act of 2024</short-title></quote>.</text></section> <section id="id5f36dcb36c8a4374964dba63dfcb4007"><enum>2.</enum><header>Authorization for the creating helpful incentives to produce semiconductors (CHIPS) for America workforce and education fund</header><text display-inline="no-display-inline">Section 102(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (commonly known as the <quote>CHIPS and Science Act of 2022</quote>) is amended—</text>
<paragraph id="idb6aeee5f4867413fb4701e6cc8ed2b7d"><enum>(1)</enum><text>in paragraph (1)—</text> <subparagraph id="idC4326311FBBF4B6896BADEBBFA0C645C"><enum>(A)</enum><text>by inserting <quote>, in consultation with the Department of Commerce,</quote> after <quote>National Science Foundation</quote>; and</text></subparagraph>
<subparagraph id="id11EE15EDFD5F41E7BD0EC90931F45E44"><enum>(B)</enum><text>by inserting <quote>, including establishment and maintenance of a single publicly accessible online clearinghouse of microelectronics education and workforce development information</quote> before the period at the end of the paragraph;</text></subparagraph></paragraph> <paragraph id="idea39b87634d44b33914b95a3b2ec7160"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (6); and </text></paragraph>
<paragraph id="id12990DB587244117ADD16BABB9DBAA66"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idCA7BCCBD333A44E2AA31434F6CB10238"> <paragraph id="idbac5c72e01bd45de8ccdcb160e64c544"><enum>(3)</enum><header>Evaluation</header><text>Not later than 90 days after the date of enactment of the <short-title>CHIPS Training in America Act of 2024</short-title>, the Director of the National Science Foundation shall establish key performance indicators to measure and monitor the impact of Fund allocations on growing the microelectronics workforce.</text></paragraph>
<paragraph id="id26aca8c8e47a4a309e20207f0c45a0d3"><enum>(4)</enum><header>Workforce goals</header>
<subparagraph id="id6254167ce115470e8589901766bd9920"><enum>(A)</enum><header>Goals established</header><text>Not later than 90 days after the date of enactment of the <short-title>CHIPS Training in America Act of 2024</short-title>, the Director of the National Science Foundation and the Secretary of Commerce shall jointly develop quantitative goals for growing the domestic semiconductor workforce.</text></subparagraph> <subparagraph id="idaee665db9b1447b8b0584800f6213c35" commented="no"><enum>(B)</enum><header>Submission of goals</header><text>Such goals shall be submitted to—</text>
<clause commented="no" id="id47ED6AA9562F4678862B6CA6D4A5FE4B"><enum>(i)</enum><text>the Committee on Appropriations of the Senate, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></clause> <clause commented="no" id="id8C09E7F56FD248EABB6EBB2AE1824BBD"><enum>(ii)</enum><text>the Committee on Appropriations of the House of Representatives, the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Education and the Workforce of the House of Representatives.</text></clause></subparagraph></paragraph>
<paragraph commented="no" id="id5B6C50A34D1C41859E623ADEFAC59B0D"><enum>(5)</enum><header>National Semiconductor Technology Center</header><text>In this subsection, the term <term>National Semiconductor Technology Center</term> means the entity established under section 9906(c) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4656">15 U.S.C. 4656(c)</external-xref>). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="ideb1b175cb2ae41039bcc967aa51aea8f"><enum>3.</enum><header>Authorization of national semiconductor technology center activities</header><text display-inline="no-display-inline">Section 9906(c)(2) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4656">15 U.S.C. 4656(c)(2)</external-xref>) is amended— </text>
<paragraph id="id8e085cd0e2804d9596daf7381eda97ac"><enum>(1)</enum><text>in subparagraph (C)—</text> <subparagraph id="idd06e61e1025141c98db2720aad98ab10"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> after the semicolon;</text></subparagraph>
<subparagraph id="id0b4285d1d4bc463f953d2d6585b34667"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> <subparagraph id="ida68167f59761458c9c902de5920df723"><enum>(C)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="id71451C0DB5AA42EB8D5298F6E94F62B8">
<clause id="id425b1271875c4e03b9e51dade775b9a4"><enum>(iii)</enum><text>the development of competency-based degree, credentialing, and certificate frameworks to increase standardization within semiconductor and microelectronics workforce development programs.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="iddfc0259123a2420facea2c2d0e1b4dd2"><enum>(2)</enum><text>by inserting the following after subparagraph (C):</text>

<subparagraph id="id578dd620852a49ec807bb4ac169216bf"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="idFAF39C7A892B4B4B8957EC2245F64456"><enum>(i)</enum><text>Subject to clause (ii), in coordination with the National Science Foundation, assist in the management and maintenance of the single publicly accessible online clearinghouse authorized in section 102(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>.</text></clause> <clause id="id35D6013B85D94C0ABAC0E7E6A9E7A392" indent="up1"><enum>(ii)</enum><text>If the National Science Foundation and the National Semiconductor Technology Center agree, the National Semiconductor Technology Center may take over primary management and maintenance of such single publicly accessible online clearinghouse, with support from the National Science Foundation.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="id898871c6461c489788a37a819d052770"><enum>4.</enum><header>National strategy on microelectronics workforce</header><text display-inline="no-display-inline">Section 9906(a) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4656">15 U.S.C. 4656(a)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="idcc741d96c71b43a2a324130508c16fde"><enum>(1)</enum><text>in paragraph (2)—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idb13fd1cdeed24129ac8b59c3c2cf237c"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (I) as subparagraph (J); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id55719bd8d2484f228f9ed02fe5f299bf"><enum>(B)</enum><text>by inserting after subparagraph (H) the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="id3ffba2e2f7e349d38da00395867e0e84"><enum>(I)</enum><text>For purposes of the duties described in subparagraph (D) of paragraph (3) only, the Secretary of Labor, the Secretary of Education, and the Secretary of Veterans Affairs.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ida2b155d210114bc7b53f15417314201d"><enum>(2)</enum><text>in paragraph (3), by inserting after subparagraph (C) the following: </text>

<subparagraph id="id9d42b07790464fea926e3005a8322be3"><enum>(D)</enum><header>National strategy on microelectronics workforce</header>
<clause id="id514e2a838fdd4fcfb77e84769cc99999"><enum>(i)</enum><header>In general</header>
<subclause id="idcbd3ab8c007540a28786e8115c5dba6a"><enum>(I)</enum><header>National strategy on microelectronics workforce development</header><text>Not later than 1 year after the date of enactment of the <short-title>CHIPS Training in America Act of 2024</short-title>, in consultation with appropriate stakeholders in the microelectronics industry, relevant researchers or experts at institutions of higher education, economic development organizations, and other apposite stakeholders, the Subcommittee shall develop a 5-year national strategy on microelectronics workforce development.</text></subclause> <subclause id="id1b034b016a524726b65285c0be8c8b00" commented="no"><enum>(II)</enum><header>Additional Subcommittee members</header><text>For the purposes of this subparagraph only such Subcommittee shall also include the Secretary of Labor, the Secretary of Education, and the Secretary of Veterans Affairs.</text></subclause></clause>
<clause id="id53db991b26804428b262c1bbb16f7017"><enum>(ii)</enum><header>Elements</header><text>The strategy developed under this subparagraph shall—</text> <subclause id="id29bfd886e082486aad8b720be54b7055"><enum>(I)</enum><text>specify and prioritize annual and long-term objectives, including the role of each agency in supporting programs and activities designed to meet the objectives, to ensure a robust, skilled domestic microelectronics workforce;</text></subclause>
<subclause id="id73284d0fd28b485f892727cf6ffe11ec"><enum>(II)</enum><text>specify the common metrics that will be used to assess progress toward achieving the objectives;</text></subclause> <subclause id="ide3f4f2a13c654bb9ab108c12dc963344"><enum>(III)</enum><text>describe the roles of and means of coordination with elementary and secondary, and postsecondary, education systems in achieving the objectives;</text></subclause>
<subclause id="idb6ba9d1a33fe449b9aec4840cca5c640"><enum>(IV)</enum><text>describe how Federal funding will be used to support the strategy’s microelectronics workforce initiatives;</text></subclause> <subclause id="id5604066999c64dfe81bf7d39a9627099"><enum>(V)</enum><text>describe the approaches to be taken by each participating agency to assess the effectiveness of the agency’s microelectronics workforce programs and activities;</text></subclause>
<subclause id="id2BDF99B4BD3A413CA225D52800AFB8A8"><enum>(VI)</enum><text>describe how objectives outlined in the strategic plan will align with investments made using funds from divisions A and B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (commonly known as the <quote>CHIPS and Science Act of 2022</quote>); </text></subclause> <subclause id="id19c09c9802654406b5f07bfc72f536fc"><enum>(VII)</enum><text>describe how objectives outlined in the strategic plan will align with the objectives of the 5-year STEM education strategic plan required under section 101 of the America COMPETES Reauthorization Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/6621">42 U.S.C. 6621</external-xref>);</text></subclause>
<subclause id="id46075f5159cb47108a535b94d5b28c1f"><enum>(VIII)</enum><text>describe how objectives outlined in the strategic plan will align with the objectives of the national strategy on microelectronics research, as required under subparagraph (A), as applicable; and</text></subclause> <subclause id="id893fc2dea1724fb3ad338515d5604436"><enum>(IX)</enum><text>be made publicly available through the online clearinghouse authorized in section 102(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>.</text></subclause></clause>
<clause id="id343fd03c545c456f80b52ff311b133d6" commented="no"><enum>(iii)</enum><header>Fostering coordination of workforce programs</header><text>The Subcommittee shall coordinate programs and activities of Federal agencies relating to microelectronics workforce development, and ensure such programs and activities are consistent with the strategy required under this subparagraph. </text></clause> <clause id="id6941cac59a9a476d9ea54931dd542adf"><enum>(iv)</enum><header>Reporting and updates</header><text>Not less frequently than once every 5 years, the Subcommittee shall—</text>
<subclause id="idDEC4CB0F284C487E87A39834B01DEEB2"><enum>(I)</enum><text>update the strategy under this subparagraph; </text></subclause> <subclause id="id814520F7F50D41678F44EB67CEBCA916"><enum>(II)</enum><text>submit the revised strategy to the appropriate committees of Congress; and </text></subclause>
<subclause id="id50BDFE567A244BCFB9C202354166E0FE"><enum>(III)</enum><text>make such strategy publicly available through the online clearinghouse authorized in section 102(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id95f6514bb2a84394bf588e36096bb08c"><enum>5.</enum><header>Grant program for education related to semiconductor manufacturing and related industries</header><text display-inline="no-display-inline">Division H of title XCIX of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651 et seq.</external-xref>) is amended by inserting after section 9906 the following:</text>

<section id="id2b5be2b2365e48449ee10c6d6429fd81"><enum>9906A.</enum><header>Workforce Development Activities</header>
<subsection id="id3f6473395662439b98d6b02358cc59c2" commented="no"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="ide8b6fd57d640443ab97dc3df0913bb0b"><enum>(1)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id94c892d4f2684ddf873e71744227fb8f"><enum>(A)</enum><text display-inline="yes-display-inline">an institution of higher education, as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>), at which the highest degree predominantly awarded to students is not a baccalaureate degree or higher degree; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id8ae56137d1f74939b197557a4045f004"><enum>(B)</enum><text display-inline="yes-display-inline">a postsecondary vocational institution, as defined in section 102(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(c)</external-xref>); and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id1e13b05417034d8eb61a1a60b940b740"><enum>(C)</enum><text display-inline="yes-display-inline">an area career and technical education school, as defined in subparagraphs (A) or (B) of section 3(3) of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302(3)</external-xref>).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idbce7746a0ce74af5934508477d3cf198"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id0a25a6b7c7d9444ea693c810f1c1ca70"><enum>(A)</enum><text display-inline="yes-display-inline">includes—</text> <clause commented="no" display-inline="no-display-inline" id="ide41d157606df46499a450429906c37b4"><enum>(i)</enum><text display-inline="yes-display-inline">an eligible institution; </text></clause>
<clause commented="no" display-inline="no-display-inline" id="id4af160a3bdf942509a0f94d7b238427f"><enum>(ii)</enum><text display-inline="yes-display-inline">a covered entity; and </text></clause> <clause commented="no" display-inline="no-display-inline" id="ida9775b4079f94b318891415fdc9bc911"><enum>(iii)</enum><text display-inline="yes-display-inline">a State, Indian Tribe, or political subdivision thereof; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id67cfd2a540264a848a40c7530cd23852"><enum>(B)</enum><text>may include other entities.</text></subparagraph></paragraph> <paragraph display-inline="no-display-inline" commented="no" id="idD426A928721849EEB7D387F141DE212E"><enum>(3)</enum><header>National Semiconductor Technology Center</header><text>The term <term>National Semiconductor Technology Center</term> means the entity established under section 9906(c).</text></paragraph></subsection>
<subsection id="id90672f9db4b34ebb94cd12d2b64951ef"><enum>(b)</enum><header>Grants authorized</header><text>The National Semiconductor Technology Center shall make awards, on a competitive basis, to eligible partnerships to establish or expand workforce development and academic programs offered by an eligible institution (which may include short-term programs or non-credit programs offered by that eligible institution), related to semiconductor manufacturing and related equipment, materials, advanced packaging, microelectronics, computer science, engineering, and related industries. </text></subsection> <subsection id="id9fd584af4c5c433eba0e57fad9e96b0a"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible partnership desiring a grant under this section shall submit an application to the National Semiconductor Technology Center at such time, in such manner, and containing such information as the National Semiconductor Technology Center may require. The application shall require—</text>
<paragraph id="idede23980c7aa467a9e1fe999072f3829"><enum>(1)</enum><text>a description of the eligible partnership;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id7fc2261d7963450ab8fff0f117154416"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the workforce needs that will be addressed through the activities funded by the grant; </text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idfbe1528b7a644145b7705d2d83d72c2d"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the eligible partnership’s strategy to sustain such activities after the grant period; </text></paragraph> <paragraph id="id222e7580f23e4880904329f5ebce0448"><enum>(4)</enum><text>a description of how the eligible partnership will recruit and retain individuals with barriers to employment (as defined in section 3 of the Workforce Innovation and Opportunity Act definition (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)) in programs that receive grant funding; and</text></paragraph>
<paragraph id="idf17a777ff07b45a68c193140e981ad43"><enum>(5)</enum><text>a description of how programs supported by grants under this subsection align with the workforce pathways and credential frameworks established by the National Semiconductor Technology Center or the National Science Foundation. </text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id446b182631124cad99aa5436fa89273a"><enum>(d)</enum><header>Selection</header><text>In selecting eligible partnerships to receive a grant under this section, the National Semiconductor Technology Center shall give priority to eligible partnerships located in areas with growing microelectronics ecosystems, as determined by the National Semiconductor Technology Center, that serve or intend to serve as members of broader sectoral partnerships and coordinate with State and local workforce development boards (as established under sections 101 and 107 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/29/3122">29 U.S.C. 3122</external-xref>)), respectively.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id01d3b02afd7140bd90e86524c7e683ff"><enum>(e)</enum><header>Amount; duration</header>
<paragraph commented="no" display-inline="no-display-inline" id="id12688d1720c54cd8a20954e123b2f1c7"><enum>(1)</enum><header display-inline="yes-display-inline">Amount</header><text>A grant awarded under this section shall be for an amount equal to or less than $7,000,000.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id6e6021b77ae44cf687c08a1a4b4e4888"><enum>(2)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period not to exceed 5 years.</text></paragraph></subsection>
<subsection id="id1994259cfb4245e486a1b5a467a4d7d7"><enum>(f)</enum><header>Federal cost share</header>
<paragraph id="idf6f6397195494694beacf463110792de"><enum>(1)</enum><header>Maximum Federal share</header><text>The Federal share of the costs of a grant under this section shall not exceed 50 percent of such costs.</text></paragraph> <paragraph id="idee9c7ae37740421da30d4cbed9098d98"><enum>(2)</enum><header>Required worker and community investments</header><text>Non-Federal costs contributed by a covered entity under this section shall be considered as part of an eligible entity’s commitments to worker and community investments as required under section 9902(a)(2)(B)(ii)(II). </text></paragraph></subsection>
<subsection id="id20ad9b170944495cbf6ba9e0a9bf9984"><enum>(g)</enum><header>Report</header>
<paragraph commented="no" display-inline="no-display-inline" id="id365469bc7c0e4632b97475d9c97af68b"><enum>(1)</enum><header display-inline="yes-display-inline">Report to the National Semiconductor Technology Center</header><text>Each eligible partnership receiving a grant under this section shall prepare and submit an annual report to the National Semiconductor Technology Center that contains information about each of the following with respect to individuals participating in a program funded by a grant under this section: </text> <subparagraph commented="no" display-inline="no-display-inline" id="iddab04047cd654ffca2750882b8f3ae2a"><enum>(A)</enum><text display-inline="yes-display-inline">The total number of participants, disaggregated by sex, race, and ethnicity. </text></subparagraph>

<section id="id437c4ab58eba480b865775d97d21ffc2"><enum>6.</enum><header>Prohibition on additional microelectronics education and workforce clearinghouse</header><text display-inline="no-display-inline">A Federal agency shall not establish a microelectronics education and workforce clearinghouse that is duplicative or alternative to the online clearinghouse authorized in section 102(d) of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (commonly known as the <quote>CHIPS and Science Act of 2022</quote>).</text></section> </legis-body> </bill>
