which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide relief for employees of the Federal Deposit Insurance Corporation who were subjected to discrimination, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FDIC Discrimination Relief Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide0be8f1a399b4beb94fa9dead54fb7cc"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph display-inline="no-display-inline" commented="no" id="id33DBA965EE914BE2B8E57B7E6F37996B"><enum>(1)</enum><header>Applicable time period</header><text>The term <term>applicable time period</term> means—</text><subparagraph display-inline="no-display-inline" commented="no" id="idCF439308F4CE4878857936F391414F3B"><enum>(A)</enum><text>with respect to covered laws described in subparagraphs (A) through (D) of paragraph (3), the period beginning January 1, 2015, and ending December 31, 2023; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idD27F4B395C8B4226975B1931A9A22408"><enum>(B)</enum><text>with respect to the Pregnant Workers Fairness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000gg">42 U.S.C. 2000gg et seq.</external-xref>), the period beginning on the effective date of that Act and ending on December 31, 2023.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id81085C57F95B477FB9053D5BFF32147E"><enum>(2)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means an individual employed at the Federal Deposit Insurance Corporation for not less than 30 days during the period beginning January 1, 2015, and ending December 31, 2023.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idCFF03ACDE22A43049DE68A6EEAC93697"><enum>(3)</enum><header>Covered law</header><text>The term <term>covered law</term> means:</text><subparagraph id="id280CC9B8C1C849D9A8A292B7B54DD69C"><enum>(A)</enum><text>Section 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>).</text></subparagraph><subparagraph id="id0722083B18674003AEA5C9310E0A9786"><enum>(B)</enum><text>Section 15 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/633a">29 U.S.C. 633a</external-xref>).</text></subparagraph><subparagraph id="id89F4BC57D30B464C88E35BB2F29F81C1"><enum>(C)</enum><text>Section 501 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10490454f5ad4b89b64b74be5d61bf38"><enum>(D)</enum><text display-inline="yes-display-inline">Title II of the Genetic Information Nondiscrimination Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ff">42 U.S.C. 2000ff et seq.</external-xref>).</text></subparagraph><subparagraph id="idB95523385E814587944ABE0BA9DD58CC" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>The Pregnant Workers Fairness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000gg">42 U.S.C. 2000gg et seq.</external-xref>). </text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idDF3087072F2A46D98E3035E431A6EDDE"><enum>3.</enum><header>Administrative remedies; statute of limitations</header><subsection commented="no" display-inline="no-display-inline" id="idBF8A433F18C84608B95DA7C4A7E17412"><enum>(a)</enum><header>Exhaustion of administrative remedies not required</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a covered employee shall not be required to exhaust administrative remedies before bringing a civil action under a covered law to obtain appropriate relief for a violation of a covered law that occurred during the applicable time period.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9E282EBF54C145189DF9E4425ED1282A"><enum>(b)</enum><header>Extension of statute of limitations</header><paragraph commented="no" display-inline="no-display-inline" id="id7429346B9A954220B5E10194ACFE095B"><enum>(1)</enum><header>Civil action</header><text display-inline="yes-display-inline">Notwithstanding any other applicable statute of limitations for a covered law, on a date that is not later than 1 year after the date of enactment of this Act, a covered employee may bring a civil action to obtain appropriate relief for a violation of a covered law that occurred during the applicable time period. Subject to subsection (a), the applicable procedures and remedies for a covered law shall apply. </text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id46AF56DF34C44FF5801EBC3FFB78181F"><enum>(2)</enum><header>Administrative remedies</header><text>Notwithstanding any other provision of law, on a date that is not later than 180 days after the date of enactment of this Act, a covered employee may pursue administrative remedies to obtain appropriate relief for a violation of a covered law that occurred during the applicable time period. The statute of limitations for a civil action will be tolled while a covered employee pursues such administrative remedies.</text></paragraph></subsection></section><section id="ida33e26dd043643d4a8fe7492e9786c32"><enum>4.</enum><header>Federal civil action relating to discrimination</header><subsection id="idc9cf8a76f18b4992a312757fb2101340"><enum>(a)</enum><header>In general</header><text>A covered employee may bring a civil action in the United States District Court for the District of Columbia or a district court of the United States of appropriate jurisdiction to obtain appropriate relief for a violation of a covered law that occurred during the applicable time period. Nothing in this section shall impair any party’s right to a trial by jury. </text></subsection><subsection id="id5b6c2ae245274bf1af148f41ff85fce9"><enum>(b)</enum><header>Immunity limitation</header><text>The United States may not assert any claim to immunity in an action by a covered employee to obtain appropriate relief for a violation of a covered law that occurred during the applicable time period.</text></subsection><subsection id="id460b02baf7644b4999c805bd42ec4d10"><enum>(c)</enum><header>Remedies and attorney fees</header><text>In addition to any other remedies authorized under an applicable covered law, in any civil action commenced pursuant to this Act, the court, in its discretion, may allow the prevailing party, other than the United States, a reasonable attorney's fee, and the United States shall be liable for the foregoing the same as a private individual.</text></subsection><subsection id="id4c6a8221a8aa41a8b8733c945b515bb3"><enum>(d)</enum><header>Res judicata</header><paragraph id="id329D3F278B054C86B9A85A614A2EE64E"><enum>(1)</enum><header>In General</header><text>If a covered employee brought a civil action in a district court of the United States for a claim of a violation of a covered law, and a circumstance described in paragraph (2) resulted, that decision on that claim (including any relief awarded) shall be final. </text></paragraph><paragraph id="id94092EE87259472AB6B41C1919751A5B"><enum>(2)</enum><header>Applicable circumstances</header><text>A decision on a claim shall be final in accordance with paragraph (1) if the claim—</text><subparagraph id="idE23FEA17ADB7489CABD349ADC30523E2"><enum>(A)</enum><text>was decided on the merits; </text></subparagraph><subparagraph id="id504D44673D6B47B9BBD807E2A05ADC53"><enum>(B)</enum><text>was litigated but dismissed for failure to state a claim; or </text></subparagraph><subparagraph id="id1A24BE810F9943FEBE8C576CE42FECA9"><enum>(C)</enum><text>would be barred due to an out of court settlement relating to that claim.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
