and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require covered platforms to remove nonconsensual intimate visual depictions, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tools to Address Known Exploitation by Immobilizing Technological Deepfakes on Websites and Networks Act</short-title></quote> or the <quote><short-title>TAKE IT DOWN Act</short-title></quote>.</text></section><section id="id265555EE2535466E85F77FFF4B4FE23F"><enum>2.</enum><header>Criminal prohibition on intentional disclosure of nonconsensual intimate visual depictions</header><subsection commented="no" display-inline="no-display-inline" id="id8BDC5671AF4A4CD6820C973DEA46A871"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id94168D5282E848B49260108228D9BA5E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEDA51566818B484DA84231F75E932933"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id4E57A26D2D3A426995B06FC49C1C1EB8"><subsection commented="no" display-inline="no-display-inline" id="id54BF368ACAB34BD8B5FF85B42266C687"><enum>(h)</enum><header display-inline="yes-display-inline">Intentional disclosure of nonconsensual intimate visual depictions</header><paragraph commented="no" display-inline="no-display-inline" id="idA36E319ED21B489885553E4A0D1334ED"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id849D32BB9CEC413A84AC750E802274B2"><enum>(A)</enum><header display-inline="yes-display-inline">Consent</header><text>The term <term>consent</term> means an affirmative, conscious, and voluntary authorization made by an individual free from force, fraud, duress, misrepresentation, or coercion.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1230C43078FB4451917675C9FDA86B73"><enum>(B)</enum><header>Deepfake</header><text>The term <term>deepfake</term> means a video or image that is generated or substantially modified using machine-learning techniques or any other computer-generated or machine-generated means to falsely depict an individual’s appearance or conduct within an intimate visual depiction.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F32BE65ACF84EBB849718A0C662F70E"><enum>(C)</enum><header>Identifiable individual</header><clause commented="no" display-inline="no-display-inline" id="idEA715FAD9BE5459EB1E49224631DF469"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>identifiable individual</term> means an individual—</text><subclause commented="no" display-inline="no-display-inline" id="idB644CC3D609B48B1B5C57FB24FE1BE78"><enum>(I)</enum><text display-inline="yes-display-inline">who appears in whole or in part in an intimate visual depiction; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id548755F701FE426AB0C5DA5D84D257E4"><enum>(II)</enum><text>whose face, likeness, or other distinguishing characteristic (including a unique birthmark or other recognizable feature) is displayed in connection with such intimate visual depiction.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idAEE6FBAE657C4FC394CA486B4EEEEDA3"><enum>(ii)</enum><header>Appears</header><text>For purposes of clause (i), an individual appears in an intimate visual depiction if—</text><subclause commented="no" display-inline="no-display-inline" id="idAFED32DB20AF4530AC9DD676235AF36A"><enum>(I)</enum><text display-inline="yes-display-inline">the individual is actually the individual identified in the intimate visual depiction; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8FC30D4539764161AE47CBE5294096F4"><enum>(II)</enum><text>a deepfake of the individual is used to realistically depict the individual such that a reasonable person would believe the individual is actually depicted in the intimate visual depiction.</text></subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id9CAF9E5A81FF4FD3B8C9C15E715B4808"><enum>(D)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> has the meaning given the term in section 230.</text></subparagraph><subparagraph id="idE946FA7637914C2F88ACBEDF472397DB" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header>Intimate visual depiction</header><text>The term <term>intimate visual depiction</term> has the meaning given such term in section 1309 of the Consolidated Appropriations Act, 2022 (<external-xref legal-doc="usc" parsable-cite="usc/15/6851">15 U.S.C. 6851</external-xref>).</text></subparagraph><subparagraph id="id1450afa98f60485297d01be4e877275c"><enum>(F)</enum><header>Minor</header><text>The term <term>minor</term> means any individual under the age of 18 years. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B9B1FAF332E4F85A218F1C4FC379268"><enum>(2)</enum><header>Offense</header><subparagraph id="idc16c5ab7c0e04efca6a2d096974085c4"><enum>(A)</enum><header>Involving adults</header><text>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish an intimate visual depiction of an identifiable individual who is not a minor if—</text><clause id="id9f35adc4a66249178e9b49c16909645b"><enum>(i)</enum><text>the intimate visual depiction was obtained or created under circumstances in which the person knew or reasonably should have known the identifiable individual had a reasonable expectation of privacy;</text></clause><clause id="idf7f9617565b14d069113770872d9e2b6"><enum>(ii)</enum><text>what is depicted was not voluntarily exposed by the identifiable individual in a public or commercial setting;</text></clause><clause id="idcb27855b61ea4d7e99d41b1671d507fc"><enum>(iii)</enum><text>what is depicted is not a matter of public concern; and</text></clause><clause id="id5a27721fb4f44a0eb055851af6923284"><enum>(iv)</enum><text>publication of the intimate visual depiction—</text><subclause id="idd2c2ffb3b506492885b27f4a71d5f722"><enum>(I)</enum><text>is intended to cause harm; or</text></subclause><subclause id="id1391344c0a244bbdb003529b730a6e68"><enum>(II)</enum><text>causes harm, including psychological, financial, or reputational harm, to the identifiable individual.</text></subclause></clause></subparagraph><subparagraph id="idd752a8a665ed48089de7f82a4ef4b134"><enum>(B)</enum><header>Involving minors</header><text>Except as provided in subparagraph (C), it shall be unlawful for any person, in interstate or foreign commerce, to use an interactive computer service to knowingly publish an intimate visual depiction of an identifiable individual who is a minor with intent to—</text><clause id="idAF1E0B6FB4A84F7691B8A8B968D842DC"><enum>(i)</enum><text>abuse, humiliate, harass, or degrade the minor; or</text></clause><clause id="id7F8963ACC1F344D2B25035538AC3239E"><enum>(ii)</enum><text>arouse or gratify the sexual desire of any person.</text></clause></subparagraph><subparagraph id="id85B2714759A946988660DD8A8FC46A6A"><enum>(C)</enum><header>Exceptions</header><text>Subparagraphs (A) and (B) shall not apply to—</text><clause id="ideb1722227d574f69b6996b57e5e09849"><enum>(i)</enum><text>a lawfully authorized investigative, protective, or intelligence activity of—</text><subclause id="id92A06ADE97344464B0EECF79E74ED86F"><enum>(I)</enum><text>a law enforcement agency of the United States, a State, or a political subdivision of a State; or</text></subclause><subclause id="idD696E4636B7B47F39457AFA10B756B14"><enum>(II)</enum><text>an intelligence agency of the United States;</text></subclause></clause><clause id="idB85871F8BF8E4EE789BA029B5B327357"><enum>(ii)</enum><text>a disclosure made reasonably and in good faith—</text><subclause commented="no" display-inline="no-display-inline" id="id2649D7C74907422581C54459FABE08FC"><enum>(I)</enum><text display-inline="yes-display-inline">to a law enforcement officer or agency;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1C6F09330C854B2F98B1D13D3AB9A857"><enum>(II)</enum><text display-inline="yes-display-inline">as part of a document production or filing associated with a legal proceeding;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC19FE3D04B884A4CB7462B5E8402FA2E"><enum>(III)</enum><text display-inline="yes-display-inline">as part of medical education, diagnosis, or treatment or for a legitimate medical, scientific, or education purpose; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id209CD6A540B948A0A8F856E68BFE84B8"><enum>(IV)</enum><text display-inline="yes-display-inline">in the reporting of unlawful content or unsolicited or unwelcome conduct or in pursuance of a legal, professional, or other lawful obligation; or</text></subclause><subclause id="id163b1216f2e44f76b5b23e7c5e4b74f6"><enum>(V)</enum><text>to seek support or help with respect to the receipt of an unsolicited intimate visual depiction; </text></subclause></clause><clause id="idA4C5CA1FA963498CAEF6E3530762217F"><enum>(iii)</enum><text>a disclosure reasonably intended to assist the identifiable individual; or</text></clause><clause id="idb3a2a26136c94650b5d5f08d3b080872"><enum>(iv)</enum><text>a person who possesses or publishes an intimate visual depiction of himself or herself engaged in nudity or sexually explicit conduct (as that term is defined in section 2256(2)(A) of title 18, United States Code). </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4883BF4FA1884B58B28261A14BD5EB7B"><enum>(3)</enum><header>Penalties</header><subparagraph commented="no" display-inline="no-display-inline" id="id2b9ab630d1e245ed8a9b7d91679de747"><enum>(A)</enum><header>Offenses involving adults</header><text display-inline="yes-display-inline">Any person who violates paragraph (2)(A) shall be fined under title 18, United States Code, imprisoned not more than 2 years, or both.</text></subparagraph><subparagraph id="id3c32b37dddfc4a6288f1375cc10313c7"><enum>(B)</enum><header>Offenses involving minors</header><text>Any person who violates paragraph (2)(B) shall be fined under title 18, United States Code, imprisoned not more than 3 years, or both.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD66634ACD9604BA291F6DFC941B700E8"><enum>(4)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">For purposes of paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4C95A960B3FF4393A32A2CD939F03CB1"><enum>(A)</enum><text display-inline="yes-display-inline">the fact that the identifiable individual provided consent for the creation of the intimate visual depiction shall not establish that the individual provided consent for the publication of the intimate visual depiction; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC54465574EDD4C49B52803DE57D0B899"><enum>(B)</enum><text display-inline="yes-display-inline">the fact that the identifiable individual disclosed the intimate visual depiction to another individual shall not establish that the identifiable individual provided consent for the publication of the intimate visual depiction by the person alleged to have violated paragraph (2).</text></subparagraph></paragraph><paragraph id="id7edc72ac9e234aed9ac0bdead4eb6096"><enum>(5)</enum><header>Threats</header><text>Any person who intentionally threatens to commit an offense under paragraph (2) for the purpose of intimidation, coercion, extortion, or to create mental distress shall be punished as provided in paragraph (3).</text></paragraph><paragraph id="id523cfd06c5a3488b94a8e0aa768fa057"><enum>(6)</enum><header>Forfeiture</header><subparagraph id="id7788335d60c44035a37026de2b25dd0d"><enum>(A)</enum><header>In general</header><text>The court, in imposing a sentence on any person convicted of a violation of subparagraph (2), shall order, in addition to any other sentence imposed and irrespective of any provision of State law, that the person forfeit to the United States—</text><clause id="id4fe306f7851f4f8cbd5ee61ac4545fd7"><enum>(i)</enum><text>any material distributed in violation of that paragraph;</text></clause><clause id="idbd8a137aba2240288beb76070ba5b7b0"><enum>(ii)</enum><text>the person’s interest in property, real or personal, constituting or derived from any gross proceeds of the violation, or any property traceable to such property, obtained or retained directly or indirectly as a result of the violation; and</text></clause><clause id="id59533f3994164151ba6d1f855f867fae"><enum>(iii)</enum><text>any personal property of the person used, or intended to be used, in any manner or part, to commit or to facilitate the commission of the violation.</text></clause></subparagraph><subparagraph id="id84e50db7f6724530ac2bf04e2592d0ee"><enum>(B)</enum><header>Procedures</header><text>Section 413 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/853">21 U.S.C. 853</external-xref>), with the exception of subsections (a) and (d), shall apply to the criminal forfeiture of property under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id09fa88ce677b4873bcb43961fed1765e"><enum>(7)</enum><header>Restitution</header><text>The court shall order restitution for an offense under paragraph (2) in the same manner as under section 2264 of title 18, United States Code.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id77771FE6F6D343639FD06D8E2AB43911" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Defenses</header><text>Section 223(e)(1) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223(e)(1)</external-xref>) is amended by striking <quote>or (d)</quote> and inserting <quote>, (d), or (h)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida0a818b0810a4df98261aed0844e90af"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendment</header><text>Subsection (i) of section 223 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>), as so redesignated by subsection (a), is amended by inserting <quote><header-in-text style="OLC" level="subsection">Definitions</header-in-text>.—</quote> before <quote>For purposes of this section</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id24b791be36384039afb34ea7496492e4"><enum>3.</enum><header>Notice and removal of nonconsensual intimate visual depictions</header><subsection commented="no" display-inline="no-display-inline" id="id1ba1c38736d74a448abf43e526b863e8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="no-display-inline" id="id385dd9328ae149a8bb918304f3fdf4ee"><enum>(1)</enum><header display-inline="yes-display-inline">Notice and removal process</header><subparagraph commented="no" display-inline="no-display-inline" id="idf98f80b4744049848bc88f4391f94ebe"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, a covered platform shall establish a process whereby an identifiable individual (or an authorized representative of such individual) may—</text><clause commented="no" display-inline="no-display-inline" id="id328ddbeaabf94218a6693f318b0c63e9"><enum>(i)</enum><text display-inline="yes-display-inline">notify the covered platform of an intimate visual depiction published on the covered platform that—</text><subclause commented="no" display-inline="no-display-inline" id="idb19af7a6c0b74eba916768c7c80431cc"><enum>(I)</enum><text display-inline="yes-display-inline">includes a depiction of the identifiable individual; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0ae7c7b647d74d2bbc680abcb6a077ed"><enum>(II)</enum><text>was published without the consent of the identifiable individual; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idcf9f910ae1d64019853ac03860f77670"><enum>(ii)</enum><text>submit a request for the covered platform to remove such intimate visual depiction.</text></clause></subparagraph><subparagraph id="idc73faf77c5b8455c95e2ce3df419bae1"><enum>(B)</enum><header>Requirements</header><text>A notification and request for removal of an intimate visual depiction submitted under the process established under subparagraph (A) shall include, in writing—</text><clause commented="no" display-inline="no-display-inline" id="id6dd1c7bb2bbb4d91873316942c85db94"><enum>(i)</enum><text>a physical or electronic signature of the identifiable individual (or an authorized representative of such individual); </text></clause><clause commented="no" display-inline="no-display-inline" id="id53948726ef1c4a6baf5cf48c374162c0"><enum>(ii)</enum><text display-inline="yes-display-inline">an identification of the intimate visual depiction of the identifiable individual; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id42cb6c256a394dedbc65b8ba48bdafa4"><enum>(iii)</enum><text>a brief statement that the identifiable individual has a good faith belief that any intimate visual depiction identified under clause (ii) is not consensual, including any relevant information for the covered platform to determine the intimate visual depiction was published without the consent of the identifiable individual.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id467d66a06dcc4c7f872e22fbba25ded5"><enum>(2)</enum><header>Notice of process</header><text>A covered platform shall provide on the platform a clear and conspicuous notice of the notice and removal process established under paragraph (1)(A).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03536e7fd41b403395db4aa21b258328"><enum>(3)</enum><header>Removal of nonconsensual intimate visual depictions</header><text>Upon receiving a valid removal request from an identifiable individual (or an authorized representative of such individual) using the process described in paragraph (1)(A)(ii), a covered platform shall remove the intimate visual depiction and make reasonable efforts to remove any identical copies of such depiction as soon as possible, but not later than 48 hours after receiving such request.</text></paragraph><paragraph id="id97c68f846a5f4f079df736512daabc2d"><enum>(4)</enum><header>Limitation on liability</header><text>A covered platform shall not be liable for any claim based on the covered platform’s good faith disabling of access to, or removal of, material claimed to be a nonconsensual intimate visual depiction based on facts or circumstances from which the unlawful publishing of an intimate visual depiction is apparent, regardless of whether the intimate visual depiction is ultimately determined to be unlawful or not. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idef48a8b78bc443afa070ac0766f9c34f"><enum>(b)</enum><header display-inline="yes-display-inline">Enforcement by the Commission</header><paragraph id="id93decb1663434bbb9086e60a31bc7b97"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section shall be treated as a violation of a rule defining an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id73ecb500e3834725a9b241de6cd40a52"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="idfb3db28f4e4947228acc2213e7228c08"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (D), the Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="idc57740a2cbf141ff943ff14906a706ff"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person who violates this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="ideccfb248f17a45beae25357331a51f4b"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subparagraph><subparagraph id="idbf7ca84a64f1454f96f138a06fe21235"><enum>(D)</enum><header>Scope of jurisdiction</header><text>Notwithstanding sections 4, 5(a)(2), or 6 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>, 45(a)(2), 46), or any jurisdictional limitation of the Commission, the Commission shall also enforce this section in the same manner provided in subparagraph (A), with respect to organizations that are not organized to carry on business for their own profit or that of their members.</text></subparagraph></paragraph></subsection></section><section id="ida08fcd942b384a3daa6b9a17a04b1f56"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id8d741cc698ea48ed8937509ae4bf503f"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce6d6ab81b134bb9a47e7c259071fbf2"><enum>(2)</enum><header>Consent; deepfake; identifiable individual; intimate visual depiction</header><text>The terms <term>consent</term>, <term>deepfake</term>, <term>identifiable individual</term>, <term>intimate visual depiction</term>, and <term>minor</term> have the meaning given such terms in section 223(h) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223</external-xref>), as added by section 2.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id556095d6299e4b7ab751bc34d1251cd1"><enum>(3)</enum><header>Covered platform</header><subparagraph commented="no" display-inline="no-display-inline" id="id991275e3124e4f58960b6b4569198fc6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>covered platform</term> means a website, online service, online application, or mobile application that—</text><clause commented="no" display-inline="no-display-inline" id="idfa9fa0ca9a324a758e2e6bb31b977e84"><enum>(i)</enum><text display-inline="yes-display-inline">serves the public; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbc882e6900f6438a822b7fdad15dfda3"><enum>(ii)</enum><text display-inline="yes-display-inline">primarily provides a forum for user-generated content, including messages, videos, images, games, and audio files.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide8e1479dba0443b7848f90943018469f"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered platform</term> shall not include the following:</text><clause id="id92702b5e26cc4f80bac06771ee53da7f"><enum>(i)</enum><text>A provider of broadband internet access service (as described in section 8.1(b) of title 47, Code of Federal Regulations, or successor regulation).</text></clause><clause id="id098e8e020bed476eb7f8e57f6ba4ae71"><enum>(ii)</enum><text>Electronic mail.</text></clause><clause id="id792abe0f7cb3469d916f6d452a51f52e"><enum>(iii)</enum><text>An online service, application, or website—</text><subclause id="id8934ad83ec6f4d7c83234076cbe8ce5d"><enum>(I)</enum><text>that consists primarily of content that is not user generated but is preselected by the provider of such online service, application, or website; and</text></subclause><subclause id="id0d650272262d4417b8ce6830ddaf7f1b"><enum>(II)</enum><text>for which any chat, comment, or interactive functionality is incidental to, directly related to, or dependent on the provision of the content described in subclause (I).</text></subclause></clause></subparagraph></paragraph></section></legis-body></bill>
