<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 455</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230215">February 15, 2023</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> (for himself, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S346">Mr. Lee</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To terminate the requirement imposed by the Director of the Centers for Disease Control and Prevention for proof of COVID–19 vaccination for foreign travelers, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idbfa9b460784c4461923456d423c0f316" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Travel Freedom Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idc36d0ff76c4a434cb02a027b0251d303"><enum>2.</enum><header>Terminating CDC requirement for proof of COVID–19 vaccination for foreign travelers</header><subsection id="idD4A2963F491B4018BAC1CFBD5D4B1730"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, the air travel vaccination requirement for foreign travelers shall have no force or effect.</text></subsection><subsection id="idC4A6FBF833B54C5C9D89AABE4CCBC8DA"><enum>(b)</enum><header>Prohibition on funding</header><text>Beginning on the date of the enactment of this Act, no Federal funds may be used to administer, implement, or enforce the air travel vaccination requirement for foreign travelers.</text></subsection><subsection id="idE54250D8A3FF41B193CED566130F7E83"><enum>(c)</enum><header>Air travel vaccination requirement for foreign travelers</header><text>In this section, the term <term>air travel vaccination requirement for foreign travelers</term> refers to the requirement specified in—</text><paragraph id="id97F80ED110724946B6A7BDA23D97E21A"><enum>(1)</enum><text>the order issued by the Director of the Centers for Disease Control and Prevention entitled <quote>Amended Order Implementing Presidential Proclamation on Advancing the Safe Resumption of Global Travel During the COVID–19 Pandemic</quote> and published in the Federal Register on April 7, 2022 (87 Fed. Reg. 20405 et seq.) for proof of COVID–19 vaccination for air travelers who are covered individuals (as defined in such order); or</text></paragraph><paragraph id="id51EC599D687C478CB6D4D7856D9DD46F"><enum>(2)</enum><text>any successor or subsequent order of the Centers for Disease Control and Prevention requiring foreign persons traveling by air to show proof of COVID–19 vaccination as a condition on entering the United States. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idb10d32ce583846a28d2de992740f773f"><enum>3.</enum><header>Terminating requirement for proof of COVID–19 vaccination for foreign persons entering along United States-Canada border</header><subsection id="HC761258B82BB4AABB3E6E8015CDC41DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, the vaccination requirement for processing foreign travelers entering at land points of entry, including ferry terminals, along the United States-Canada border shall have no force or effect.</text></subsection><subsection id="H80194EA14E224E619F7BA9F978F9F5C5"><enum>(b)</enum><header>Prohibition on funding</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, no Federal funds may be used to administer, implement, or enforce the vaccination requirement for processing foreign travelers entering at land points of entry, including ferry terminals, along the United States-Canada border.</text></subsection><subsection id="H4281F40761F04F6C9033704364190614"><enum>(c)</enum><header>Vaccination requirement for foreign travelers entering along the United States-Canada border</header><text display-inline="yes-display-inline">In this section, the term <quote>vaccination requirement for processing foreign travelers entering at land points of entry, including ferry terminals, along the United States-Canada border</quote> refers to the requirement specified in—</text><paragraph id="H4B3C9D3AE2FE44679EC2CA26D924B8E1" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the decision issued by the Secretary of Homeland Security and the Commissioner for U.S. Customs and Border Protection entitled <quote>Notification of Temporary Travel Restrictions Applicable to Land Ports of Entry and Ferries Service Between the United States and Canada</quote> and published in the Federal Register on April 22, 2022 (87 Fed. Reg. 24048 et seq.) for proof of COVID–19 vaccination for travelers who are covered individuals (as defined in such order); or</text></paragraph><paragraph id="HDE8B06A57374415F8F6B5E0F26DB6649" display-inline="no-display-inline" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">any successor or subsequent order of the Secretary of Homeland Security or the Commissioner for U.S. Customs and Border Protection for the processing for entry into the United States foreign persons to show proof of COVID–19 vaccination as a condition on entering the United States, unless determined necessary by Congress.</text></paragraph></subsection></section></legis-body></bill>
