which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to expand the prohibition on destruction of veterans' memorials to include other memorials and to establish mandatory minimum sentences for violations of that prohibition.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving Treasured Artifacts Through Uniformed Enforcement Act</short-title></quote> or <quote><short-title>STATUE Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf76b5093b3054e22ab779bf94ff2def1"><enum>2.</enum><header>Amendments</header><subsection commented="no" display-inline="no-display-inline" id="id9073482d93b84a36ba569b252232d96b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 1369 of title 18, United States Code, is amended to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7CE31565B688407797A0C26D1A656E17"><section id="idbd395851bc7f4c4f94804641a1f8dfe3"><enum>1369.</enum><header>Destruction of memorials</header><subsection commented="no" display-inline="no-display-inline" id="idaa74e821995246c7b9a99587a1f1b4c6"><enum>(a)</enum><header>Prohibition</header><text>It shall be unlawful for any person, in a circumstance described in subsection (b), to willfully injure or destroy, or attempt to injure or destroy, a structure, plaque, statue, or other monument on public property.</text></subsection><subsection id="id6ca0c1c6b4524db6919c531f244a1e55"><enum>(b)</enum><header>Circumstances</header><text>A circumstance described in this subsection is that—</text><paragraph id="idb10c5853e94c4d41aca5b60ae9af2bbe"><enum>(1)</enum><text>in committing the offense described in subsection (a), the defendant travels or causes another to travel in interstate or foreign commerce, or uses the mail or an instrumentality of interstate or foreign commerce; or</text></paragraph><paragraph id="id367c013c7b40445d9cf8c88bb7caf24c"><enum>(2)</enum><text>the structure, plaque, statue, or other monument described in subsection (a) is located on property owned by, or under the jurisdiction of, the Federal Government.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf19b364872a24d938f397c20ec43524c"><enum>(c)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who violates subsection (a) shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="id9c57e434d0ba437297a2ee6ad9824ec9"><enum>(1)</enum><text>fined—</text><subparagraph commented="no" display-inline="no-display-inline" id="id61ea61f66b1e4c8fbd82ce796c9b660d"><enum>(A)</enum><text display-inline="yes-display-inline">not less than the greater of—</text><clause commented="no" display-inline="no-display-inline" id="idbb2e5496c679449eae003eef90b9840a"><enum>(i)</enum><text display-inline="yes-display-inline">$1,000; or </text></clause><clause commented="no" display-inline="no-display-inline" id="iddcd453656e9346ff8bae3158526857b2"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of damage to the structure, plaque, statue, or other monument described in subsection (a); and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id45c589676ced43bdbfa85f2e39f2e4d7"><enum>(B)</enum><text>not more than the applicable maximum amount under this title; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c22abf79b0d40adb0ee37a4e33f2a4b"><enum>(2)</enum><text display-inline="yes-display-inline">imprisoned—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7ab69ea0570449e7b6918e8bd5baa7eb"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 5 years; and</text></subparagraph><subparagraph id="id422bbc1cb5e44baf952954432c601abe"><enum>(B)</enum><text>not more than 10 years.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id914702ad05a044bca65eceef2ca7b0e0"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/65">chapter 65</external-xref> of title 18, United States Code, is amended by striking the item relating to section 1369 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id595B5F2CE01B4885B28DB740BBF25290"><toc><toc-entry level="section" bold="off">1369. Destruction of memorials.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
