which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a national human trafficking database at the Federal Bureau of Investigation, and to incentivize certain State law enforcement agencies to report data to the database.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Human Trafficking Database Act</short-title></quote>.</text></section><section id="id97d9051c89bf4c72bb2cb3a01c05a679"><enum>2.</enum><header>National human trafficking database</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64733E55AE2042AEA4375BE643B87A97"><part id="idcc78a81bada041d593307b3067aab34f" style="OLC"><enum>PP<?LEXA-Enum PP?></enum><header>National human trafficking database</header><section id="id4d2946a5e9734aed8afe82d617e68d0c"><enum>3061.</enum><header>National human trafficking database</header><subsection id="id2f7d03665a1a4b449aaff5d4cdd282c1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id1b4e1bb743b24945af612bc139189a6a"><enum>(1)</enum><header>Anti-human trafficking organization</header><text>The term <term>anti-human trafficking organization</term> means an organization whose main objective is to address and combat human trafficking, including by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idba9b5bba4fcd42678ae969e1b5ec8b2a"><enum>(A)</enum><text display-inline="yes-display-inline">supporting populations known to be at a higher risk of human trafficking;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda2308cdf11b4da9be9104213d045318"><enum>(B)</enum><text display-inline="yes-display-inline">raising awareness of human trafficking; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfea500af0d034034a54acd1b49bb2b28"><enum>(C)</enum><text display-inline="yes-display-inline">providing services to survivors of human trafficking.</text></subparagraph></paragraph><paragraph id="idcc775ed7217d4fd9ad7f5c9e2f89966a"><enum>(2)</enum><header>Covered State law enforcement agency</header><text>The term <term>covered State law enforcement agency</term> means a State bureau of investigation or equivalent State law enforcement agency.</text></paragraph><paragraph id="id82e73a7bfe2b44e1a010a4c6d1a8b917"><enum>(3)</enum><header>Director of the Bureau</header><text>The term <term>Director of the Bureau</term> means the Director of the Federal Bureau of Investigation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b311613cf564326873513da8acaa5af"><enum>(4)</enum><header>Director of the Office</header><text>The term <term>Director of the Office</term> means the Director of the Office for Victims of Crime.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8aa84b633ae4b74a36c2bb3bceb3ff3"><enum>(5)</enum><header>Human trafficking</header><text>The term <term>human trafficking</term> means labor trafficking or sex trafficking.</text></paragraph><paragraph id="id6c8c468f1ab944a197bab89fd57e287c"><enum>(6)</enum><header>Human trafficking risk assessment score</header><text>The term <term>human trafficking risk assessment score</term> means a score for a county that indicates the presence and prevalence of the known risk factors and vulnerabilities that human traffickers exploit, including the following criteria:</text><subparagraph id="id94074EAF2FC04E59A54322567196CC32"><enum>(A)</enum><text>The presence and prevalence of cases of labor trafficking or sex trafficking, specifically indicated by—</text><clause id="id710fc9c6a34f4172954502253ff1f5ed"><enum>(i)</enum><text>the number of prosecutions, arrests, or convictions for human trafficking;</text></clause><clause id="id9a4afdc3025d4565b9ddbf0eec8ec44d"><enum>(ii)</enum><text>aggregated and anonymized data from State-level human trafficking hotlines;</text></clause><clause id="idc99c97a904854c5a8b237bf357e9c85b"><enum>(iii)</enum><text>aggregated and anonymized data from State-level children’s services agencies; and</text></clause><clause id="id589d25a7c6274a89ab233c1419d3192b"><enum>(iv)</enum><text>aggregated and anonymized human trafficking data from the Missing and Murdered Unit of the Office of Justice Services of the Bureau of Indian Affairs.</text></clause></subparagraph><subparagraph id="idB6E0CE0B9DD94DBE9C93E84F20700E93"><enum>(B)</enum><text>The presence and prevalence of criminal activity known to be correlated with human trafficking, including crimes of drug distribution, sexual assault, and gang-related violence.</text></subparagraph><subparagraph id="idDDA688AF4F01415B9AEC895B93D400C8"><enum>(C)</enum><text>The number of survivors of human trafficking who have been served by nongovernmental human trafficking victim service organizations.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0298dcb83722433299bbaea06393ad61"><enum>(7)</enum><header>Labor trafficking</header><text display-inline="yes-display-inline">The term <term>labor trafficking</term> means conduct described in section 103(11)(B) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(11)(B)</external-xref>).</text></paragraph><paragraph id="id63137a0fb3604a2fbc3b2004eaf47e63"><enum>(8)</enum><header>Primary service</header><text>With respect to an anti-human trafficking organization, the term <term>primary service</term> means the essential function of the organization, which may be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3e32b6113d83472bb75ef2d3a50d6b76"><enum>(A)</enum><text display-inline="yes-display-inline">preventing human trafficking;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida64f9bafec6e47ca94bf42ca7b98804e"><enum>(B)</enum><text display-inline="yes-display-inline">identifying survivors of human trafficking;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5dcdfa0930bd45ceae57c2223838069b"><enum>(C)</enum><text display-inline="yes-display-inline">recovering survivors from human trafficking situations; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53212664307141059d3b4796cf83cccb"><enum>(D)</enum><text display-inline="yes-display-inline">providing support for survivors to exit human trafficking situations.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc91360f438364e91b50ac281514caf32"><enum>(9)</enum><header>Sex trafficking</header><text display-inline="yes-display-inline">The term <term>sex trafficking</term> has the meaning given the term in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>).</text></paragraph></subsection><subsection id="id56a38f08ac90413bb968544b1360823c"><enum>(b)</enum><header>Duties of Office for Victims of Crime</header><paragraph commented="no" display-inline="no-display-inline" id="id45f0f27953a04d87a8d2325c5548f12f"><enum>(1)</enum><header display-inline="yes-display-inline">Grants</header><subparagraph commented="no" display-inline="no-display-inline" id="id1565a1bce2294ad7bc4fe13cf0a8827f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>For each fiscal year for which amounts are made available to carry out this section, the Director of the Office shall award grants to covered State law enforcement agencies to collect and report to the Director of the Bureau human trafficking data, directly or by contract with a private or nonprofit organization with expertise and experience in the collection of human trafficking data, in accordance with subsection (c).</text></subparagraph><subparagraph id="idff7b6dd335a143cfb2b3bbe6bd9a96cd"><enum>(B)</enum><header>Application</header><text>A covered State law enforcement agency seeking a grant under this subsection shall submit an application to the Director of the Office at such time, in such manner, and containing such information as the Director of the Office may reasonably require.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6446c0113cd4a49b009024a97ae0dd4"><enum>(C)</enum><header display-inline="yes-display-inline">Grant condition</header><text>A covered State law enforcement agency may not receive a grant under subparagraph (A) unless the agency certifies to the Director of the Office that, not later than 180 days after the date on which the agency receives the grant, the agency will identify how the agency will collect or ensure the collection and reporting of human trafficking data described in subsection (c)(1)(A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f6ee6a1711a46738996540d49728c1c"><enum>(D)</enum><header>Use of grant</header><text display-inline="yes-display-inline">A covered State law enforcement agency may only use a grant received under subparagraph (A) to collect and report the data described in section (c)(1)(A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfbee6c44767b474088177cf85e624f6d"><enum>(2)</enum><header>Guidance for risk assessment score and use of grant funds</header><text>Not later than 180 days after the date of enactment of the <short-title>National Human Trafficking Database Act</short-title>, the Director of the Office shall issue guidance that includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9761222927394ffba1f17386a6bdb0aa"><enum>(A)</enum><text display-inline="yes-display-inline">the formula that a covered State law enforcement agency shall use to calculate the human trafficking risk assessment score for each county in the State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54fc2ef9699346c6b4bfc6b918190081"><enum>(B)</enum><text>goals and guidelines for the use of grants awarded under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="idd09de7f13d27489fb4a0f82a9521e4c6"><enum>(c)</enum><header>Database</header><paragraph commented="no" display-inline="no-display-inline" id="idd722b99590e34c72b3db6b1e09f97121"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><subparagraph id="id9e391f780d3b4f2c9850c1d2b7f7ae97"><enum>(A)</enum><header>Initial submission of State data</header><text>Not later than 1 year after the date of enactment of the <short-title>National Human Trafficking Database Act</short-title>, each covered State law enforcement agency that has received a grant under subsection (b)(1) shall report to the Director of the Bureau, for the most recently ended fiscal year (as of that date of enactment) for the State—</text><clause id="id9F13F9B02FA9449C86F84B1C85566636"><enum>(i)</enum><text>where such data is available—</text><subclause id="idD76A508DCD8E48F9A39D314850EA9909"><enum>(I)</enum><text>the human trafficking risk assessment index score for each county in the State;</text></subclause><subclause id="id6B246C73B8DE43CDA29A98FF166736F1"><enum>(II)</enum><text>the name and primary service of each anti-human trafficking organization operating in each county in the State; and</text></subclause><subclause id="id0D82FD7229DB479FB36AD20151C21658"><enum>(III)</enum><text>the total number of State-level human trafficking prosecutions, which the covered State law enforcement agency shall compile by collecting the necessary information from the prosecutor's office for each county in the State, categorized by sex, race, citizenship, and prior convictions; and</text></subclause></clause><clause id="id56E0DB5C96974A25935FDF96FF2556D4"><enum>(ii)</enum><text>if any data described in clause (i) is not available, a statement explaining why the data is not available.</text></clause></subparagraph><subparagraph id="ideb483311f9a34d45aab4845a9482b85b"><enum>(B)</enum><header>Establishment</header><text>Not later than 18 months after the date of enactment of the <short-title>National Human Trafficking Database Act</short-title>, the Director of the Bureau shall publish on the internet website of the Federal Bureau of Investigation a database that includes, for each State—</text><clause id="id551622e28b054954a664f84db34293fb"><enum>(i)</enum><text>the human trafficking risk assessment index score for each county in the State, as reported by the covered State law enforcement agency under subparagraph (A)(i)(I);</text></clause><clause id="ida9fa6675957146e698048430d886101d"><enum>(ii)</enum><text>the name and primary service of each anti-human trafficking organization operating in each county in the State, as reported by the covered State law enforcement agency under subparagraph (A)(i)(II);</text></clause><clause id="id01320ea6f726428f88f09d0a6c0a9936"><enum>(iii)</enum><text>the total number of State-level human trafficking prosecutions, as reported by the covered State law enforcement agency under subparagraph (A)(i)(III);</text></clause><clause id="idFA5C3927F1E8497AB02DCA2D598B12BE"><enum>(iv)</enum><text>any statement from the covered State law enforcement agency of the State described in subparagraph (A)(ii); and</text></clause><clause id="id556e800aac8d46f5a644e780c23c1f37" commented="no"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id3794c71249284e85a921a79d1d67a542"><enum>(I)</enum><text>except as provided in subclause (II)—</text><item commented="no" display-inline="no-display-inline" id="id5230dda403034bc0acf2834141a7044c" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">the 10 counties in the State with the highest human trafficking risk assessment index scores; and</text></item><item commented="no" display-inline="no-display-inline" indent="up1" id="idff4a2b843abd44648e790ccdc9e52d78"><enum>(bb)</enum><text display-inline="yes-display-inline">the 10 counties in the State with the lowest human trafficking risk assessment index scores; or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="idd3038dc0c4b0435697f59213573de143"><enum>(II)</enum><text display-inline="yes-display-inline">if the State has fewer than 20 counties, a list of the counties in the State, ranked by human trafficking risk assessment index score from highest to lowest.</text></subclause></clause></subparagraph><subparagraph id="id0f0554aa94c54dd99ad9df7b5c0c4dc8"><enum>(C)</enum><header>Collection of data about anti-human trafficking organizations</header><text>In carrying out subparagraph (A)(ii), a covered State law enforcement agency may coordinate with—</text><clause id="id4A779883797746A0827E3537A91761E5"><enum>(i)</enum><text>the Administration for Children and Families, in its capacity as the operator of the National Human Trafficking Hotline;</text></clause><clause id="id7E8286665742456FB0EFC524B80B1F7B"><enum>(ii)</enum><text>the Office for Victims of Crime; and</text></clause><clause id="idD5698A754FED4221B67E156A21D8AF5A"><enum>(iii)</enum><text>the Bureau of Justice Statistics.</text></clause></subparagraph></paragraph><paragraph id="id9e55e26bb1464ecfae3a2273eaaf60b1"><enum>(2)</enum><header>Administration</header><subparagraph id="id5ecbf987b85f4c469aead89726cb1772"><enum>(A)</enum><header>Submission of State data</header><text>Not later than 90 days after the last day of a fiscal year, beginning with fiscal year 2025, each covered State law enforcement agency that received a grant under subsection (b)(1) for that fiscal year shall report to the Director the data described in paragraph (1)(A) of this subsection (and any statement described in clause (ii) of that paragraph, if applicable) for that fiscal year for the State.</text></subparagraph><subparagraph id="id1051889e6ad94cd49871778f39b3ca29"><enum>(B)</enum><header>Updating database</header><text>Not later than 180 days after the last day of a fiscal year, beginning with fiscal year 2025, the Director of the Bureau shall update the database established under paragraph (1)(B) using the data provided by covered State law enforcement agencies for that fiscal year under paragraph (1)(A) (and including any statements described in clause (ii) of that paragraph, if applicable).</text></subparagraph></paragraph><paragraph id="id0c628db365f749c09b4d195864106c13"><enum>(3)</enum><header>Report</header><text>Not later than 180 days after the last day of a fiscal year, beginning with fiscal year 2025, the Director of the Bureau shall report to Congress the contents of the database established under paragraph (1)(B) for that fiscal year.</text></paragraph></subsection><subsection id="id06af5c482bb5426ab5ad7a3f6897955e"><enum>(d)</enum><header>Survivor confidentiality</header><text>In order to ensure the safety of adult, youth, and child survivors of human trafficking and their families, a covered State law enforcement agency that receives a grant under subsection (b)(1), in collecting and reporting data under this section, shall protect the confidentiality and privacy of those survivors and their families.</text></subsection><subsection id="id04cc9d9c50694419a612bdaa5d3656d7"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated—</text><paragraph id="idC771CA510A594B33BA33697CAB096C05"><enum>(1)</enum><text>$50,000,000 to the Director of the Office for each of fiscal years 2025 through 2028 to carry out subsection (b); and</text></paragraph><paragraph id="id8A8DD4908EE44272AE91710CC908526A"><enum>(2)</enum><text>$1,000,000 to the Director of the Bureau for each of fiscal years 2025 through 2028 to carry out subsection (c).</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
