<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4519</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240612">June 12, 2024</action-date><action-desc><sponsor name-id="S411">Mr. Marshall</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require implementation of primary indicators of performance for certain programs of workforce investment activities.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expedited Performance Indicator Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id491af675c797429ca6d93a1d45027098"><enum>2.</enum><header>Implementation of primary indicators of performance</header><subsection commented="no" display-inline="no-display-inline" id="id9b4d8ccbd2c747139f4279b96939cb93"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary of Labor (referred to in this Act as the <quote>Secretary</quote>) shall fully implement the requirements of section 116 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>), for programs described in subclauses (I) through (III) of subsection (b)(3)(A)(ii) of that section 116 (referred to in this Act as <quote>covered programs</quote>), including—</text><paragraph commented="no" display-inline="no-display-inline" id="id8495e89a116044b9b937d5a643cd89d3"><enum>(1)</enum><text display-inline="yes-display-inline">finalizing the objective statistical model described in subsection (b)(3)(A)(viii) of that section 116, and using the model to calculate State adjusted levels of performance under subsection (b)(3) of that section 116, for covered programs; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a6ce8eb956a4df4b0c28dbaa41a8653"><enum>(2)</enum><text display-inline="yes-display-inline">establishing performance accountability measures, and applying reporting and evaluation requirements, and sanctions, under that section 116 for covered programs.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida8587d37ecda42c09ae0a8e2fb20bcbc"><enum>(b)</enum><header>Inapplicability of transition provisions</header><text>Nothing in section 503 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3343">29 U.S.C. 3343</external-xref>) shall be construed to permit any delay in, or any reduction in the scope of, the full implementation described in subsection (a). </text></subsection></section><section id="id6c7f724bd7314b99aef0e8c10269d540"><enum>3.</enum><header>Information and technical assistance</header><subsection commented="no" display-inline="no-display-inline" id="idcacc44af248f4f29af6c223c46dcd8b1"><enum>(a)</enum><header>Meetings</header><text>Not later than 1 month after the Secretary publishes a notice in the Federal Register that the full implementation described in section 2(a) is complete, the Secretary shall hold monthly meetings with State boards to provide information and technical assistance concerning the performance accountability measures established in accordance with section 2, and related requirements for States under section 116 of the Workforce Innovation and Opportunity Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0579305f09504a488b3382439770f63d"><enum>(b)</enum><header>Continuation</header><text>The Secretary shall continue the monthly meetings with a State board until the Secretary determines that the State has received the information and technical assistance necessary to carry out the State's requirements under that section 116.</text></subsection></section></legis-body></bill>
