which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Job Corps program under subtitle C of title I of the Workforce Innovation and Opportunity Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Job Corps for the Next Generation Act</short-title></quote>.</text></section><section id="id0e68c8285eb64435abb786267f00200d"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">Section 141 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3191">29 U.S.C. 3191</external-xref>) is amended by striking <quote>centers</quote> each place the term appears and inserting <quote>campuses</quote>.</text></section><section id="id9d58274a9bab4dfb96754d221af2a02d"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 142 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3192">29 U.S.C. 3192</external-xref>) is amended—</text><paragraph id="idf42e12d0197643fab6638987d1742721"><enum>(1)</enum><text>in paragraphs (1), (7), (8), and (10), by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></paragraph><paragraph id="id2321caa6e5f24e7f94d5ea68a5804980"><enum>(2)</enum><text>in the paragraph heading of paragraph (7), by striking <quote><header-in-text style="OLC" level="paragraph">center</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">campus</header-in-text></quote>.</text></paragraph></section><section id="id5faa9bc73dc74f2c9f0abf1e94def17f"><enum>4.</enum><header>Individuals eligible for the Job Corps</header><text display-inline="no-display-inline">Section 144 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3194">29 U.S.C. 3194</external-xref>) is amended—</text><paragraph id="id71aa202bd1644c2e987b0a1170ce6bf2"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id81b96b9687cf46608ca034966981cfb9"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idd7a098e3a91943e39c1b220815527f40"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>21</quote> and inserting <quote>24</quote>;</text></clause><clause id="id862c37cd01b048b48f1657d1bfe67dee"><enum>(ii)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbbd3b2741ec84d9e81952cdcba7d2424"><subparagraph id="idd4cf02146a2d4a5b87b706811db64d8f"><enum>(A)</enum><text>an individual who is age 16 or 17 shall be eligible only upon an individual determination by the director of a Job Corps campus that such individual meets the criteria described in subparagraph (A) or (B) of section 145(b)(1); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id87277db2e49c485f8a8d539a2a88c855"><enum>(iii)</enum><text>in subparagraph (B), by striking <quote>either</quote>; and</text></clause></subparagraph><subparagraph id="id707cdbcef66f429580e2d6eb74d4c4d2"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idad230089011941c4a76878c911ef3b3c"><paragraph id="id96bcc8c7ac60420cb5774973a7b65c98"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc4934153e571488dbbad4d6c07009e1e"><enum>(A)</enum><text>a low-income individual, as defined in subsection (h) of section 402A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-11">20 U.S.C. 1070a–11</external-xref>), as determined using procedures similar to the procedures described in subsection (e) of such section; or</text></subparagraph><subparagraph id="id8e48f8173e364982a42f037d20ac9f9e" indent="up1"><enum>(B)</enum><text>a resident of a qualified opportunity zone, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/1400Z">section 1400Z–1(a)</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id222ed7985b944c069b30b2761126e95b"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb71ea30449fb403e94d7d6b20809b4b6"><enum>(A)</enum><text display-inline="yes-display-inline">in the subsection heading, by inserting <quote><header-in-text style="OLC" level="subsection">and certain other members of the Armed Forces</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">Veterans</header-in-text></quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d594a905ee34ba29a21a851adf48f18"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by inserting <quote>or a member of the Armed Forces eligible for preseparation counseling through the Transition Assistance Program under section 1142 of title 10, United States Code,</quote> after <quote>a veteran</quote>; and</text></subparagraph></paragraph><paragraph id="id5092c13ef5fb425c80bf3da126b96719"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb541dd1e0c794f3791dfdb91be9c73db"><subsection id="id07076a7c6c23465891a110a42d753b10"><enum>(c)</enum><header>Special rule for homeless and foster youth</header><paragraph commented="no" display-inline="no-display-inline" id="id3449022148154e3aa52a1500da3f80a7"><enum>(1)</enum><header>Homeless children and youth</header><text display-inline="yes-display-inline">In determining whether an individual is eligible to enroll for services under this subtitle on the basis of being a homeless child or youth, as described in subsection (a)(3)(C), the individual making the determination shall use a process that complies with the process requirements that apply to financial aid administrators under section 479D(a) of the Higher Education Act of 1965.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50a4cc5cf2c34dc799317e2519329540"><enum>(2)</enum><header>Individuals in foster care</header><text>In determining whether an individual is eligible to enroll for services under this subtitle on the basis of being an individual in foster care or who was in foster care, as described in subsection (a)(3)(C), the individual making the determination shall use a process that complies with the process requirements that apply to financial aid administrators under section 479D(b) of the Higher Education Act of 1965.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="id556652dfbd8841ce9eceb48418c4925d"><enum>5.</enum><header>Recruitment, screening, selection, and assignment of enrollees</header><text display-inline="no-display-inline">Section 145 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3195">29 U.S.C. 3195</external-xref>) is amended—</text><paragraph id="idf1177db33cfb48f99d891e230d584723"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id5cddce2c8d37481ca0ffb64b6388d0f7"><enum>(A)</enum><text>in paragraph (2)(A), by striking <quote>and the results received within 45 days after the enrollees enroll in the Job Corps</quote> and inserting <quote>after enrollees first arrive at a Job Corps campus for the purpose of assessing the need for substance abuse intervention or behavioral counseling</quote>; </text></subparagraph><subparagraph id="ide400c2e3a8d14dc091b8db204889fe15"><enum>(B)</enum><text>in paragraph (5), by striking the last sentence; and</text></subparagraph><subparagraph id="id970fe959ac6f4b5cb5b8cecd00f5424c"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81e7cbcdc7bf433d9700e01307238b2f"><paragraph id="id850c30121b8b40429d3118b10e9b01cc"><enum>(6)</enum><header>No wrong door</header><text>The Secretary shall establish standards and procedures under this subsection to assist applicable one-stop centers and other entities with which the Secretary has entered into agreements under paragraph (3) in streamlining application processes, in order to allow an applicant to express interest in and begin the application processes for the Job Corps program and for the YouthBuild program under section 171 and youth workforce investment activities under chapter 2 of subtitle B.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idfea0d604613d4dd89a8eeb586d004e08"><enum>(2)</enum><text>in subsections (b), (c), and (d)—</text><subparagraph id="ide9f2f763f5404b0eb1e05333e3bc54eb"><enum>(A)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></subparagraph><subparagraph id="ideb223067632c48219e652c7efffd3a8c"><enum>(B)</enum><text>by striking <quote>centers</quote> each place the term appears and inserting <quote>campuses</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id233464da1c5a457fb1dd66c5e38f496e"><enum>6.</enum><header>Enrollment</header><text display-inline="no-display-inline">Section 146(b)(3) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3196">29 U.S.C. 3196(b)(3)</external-xref>) is amended by striking <quote>Center</quote> and inserting <quote>Campus</quote>. </text></section><section id="idac264f31b5d5452f819d8dbbb0a15c44"><enum>7.</enum><header>Job Corps campuses</header><text display-inline="no-display-inline">Section 147 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3197">29 U.S.C. 3197</external-xref>) is amended—</text><paragraph id="id9c9a9943ce2f40869774fceb920b2ad6"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">campuses</header-in-text></quote>;</text></paragraph><paragraph id="id8aa4823b0027471fac8210536e44a41d"><enum>(2)</enum><text>in subsection (a)— </text><subparagraph id="idb5cdcc53ac0c4a11aa295e642e9df90a"><enum>(A)</enum><text>in paragraph (1), by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; </text></subparagraph><subparagraph id="id706218fcdf3542f585fe968fdceb335b"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id9c0c3c49f81648acb7ba66dd31a18597"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></clause><clause id="idf8272ea579274f77a81a5c13e20af8da"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idab02a4df958d45d8a1e0f1747375f38e"><subparagraph id="idbf5dfea65f9c488c8b1d4c22c5186dd4"><enum>(B)</enum><header>Considerations</header><clause id="idff69b2502f4742bc833aff1a5644e252"><enum>(i)</enum><header>Student outcomes</header><text>In selecting an entity to operate a Job Corps campus, the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="id6bea340f9c894daf9fd7f16b632df2e5"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to entities with previous experience in Job Corps campus operations or the provision of youth workforce activities under chapter 2 of subtitle B, consider a numeric metric of past achievement on the primary indicators of performance for eligible youth described in section 116(b)(2)(A)(ii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb72dd09aec78462ba9e2d2fba2bbee09"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to entities without such previous experience in Job Corps campus operations or youth workforce activities, consider a comparable alternative metric, developed and published by the Secretary, that allows such entities to demonstrate their past effectiveness based on such primary indicators of performance for eligible youth.</text></subclause></clause><clause id="id89aa531049f443de86c047baefaf09df"><enum>(ii)</enum><header>Providers</header><text>In selecting a service provider for a Job Corps campus, the Secretary shall—</text><subclause commented="no" display-inline="no-display-inline" id="id9e7fa547cb114f98a7e6bb5d3570b1ab"><enum>(I)</enum><text display-inline="yes-display-inline">consider—</text><item commented="no" display-inline="no-display-inline" id="id74972eeead0a4a338b7a41d670d193d6"><enum>(aa)</enum><text display-inline="yes-display-inline">with respect to entities with previous experience in providing services to a Job Corps campus, the metric described in clause (i)(I); and</text></item><item commented="no" display-inline="no-display-inline" id="id10488bab5ce84c19bedaabd090e205d4"><enum>(bb)</enum><text display-inline="yes-display-inline">with respect to entities without such previous experience, the metric described in clause (i)(II); and</text></item></subclause><subclause id="id08c105a7ee6b420cb43ebdd25590e5f3"><enum>(II)</enum><text>in determining the type of contract, give a preference to cost-type contracts with performance incentives.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idfd1f3c848b954456a0816f7932f8007b"><enum>(C)</enum><text>in paragraph (3)—</text><clause commented="no" display-inline="no-display-inline" id="id67e2441b55554579a2ab98c300f28240"><enum>(i)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>;</text></clause><clause id="idc221610b9fe44c61941d58cffc5bfc4f"><enum>(ii)</enum><text>in subparagraph (A), by inserting <quote>high-skill, high-wage, or</quote> before <quote>in-demand</quote>;</text></clause><clause id="id3d2891aaf835472694afa832786fbdb6"><enum>(iii)</enum><text>in subparagraph (D), by inserting <quote>including agreements to provide off-campus work-based learning opportunities aligned with the career and technical education provided to enrollees,</quote> after <quote>is located,</quote>;</text></clause><clause id="idc8546158d9a748b8ad31ab4e3d4fc7c0"><enum>(iv)</enum><text>by redesignating subparagraphs (E), (F), (G), (H), (I), (J), and (K) as subparagraphs (F), (G), (H), (I), (J), (K), and (L), respectively; and</text></clause><clause id="idc3019883d01b48b5be00dedd8df4dbf5"><enum>(v)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddf838a28d5eb4b5b8a7bf14642ae5f27"><subparagraph id="id244b315821f246569cf78fec8b925401"><enum>(E)</enum><text>A description of the demonstrated record of effectiveness the entity and its partners have in providing a safe learning and residential environment for individuals eligible to enroll in the Job Corps.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idd8c0014af16c420ebc32888da7fbc7d0"><enum>(3)</enum><text>in subsection (b)—</text><subparagraph id="id051f5a99f2764481ab4b176857875469"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">campuses</header-in-text></quote>;</text></subparagraph><subparagraph id="ide35d6d28ec8447cb978be64ef3017e23"><enum>(B)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>;</text></subparagraph><subparagraph id="idc5cc200dd0a8484fb6c437c798dfdcd2"><enum>(C)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id32173e9a8e44460dbb9c9daa30399736"><paragraph id="id7c5c808aae994cf6a285132a491d43a5"><enum>(2)</enum><header>High performance</header><text>An entity shall be considered to be an operator of a high-performing campus if the Job Corps campus operated by the entity was ranked among the top 25 percent of Job Corps campuses, excluding Civilian Conservation Campuses described in subsection (d), for the 2 most recent preceding program years.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3b509a37fb054df6a1c2842f004f100c"><enum>(D)</enum><text>by striking paragraph (3);</text></subparagraph></paragraph><paragraph id="ide0efec11e5144ef586bba9a3dc8517b5"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="ideb3edcb263cf4be6ad15f6772e8c9764"><enum>(A)</enum><text>by striking <quote>centers</quote> and inserting <quote>campuses</quote>; and</text></subparagraph><subparagraph id="idaab3edf3ca3c4eda8bb59fce88618021"><enum>(B)</enum><text>by striking <quote>20 percent</quote> and inserting <quote>30 percent</quote>;</text></subparagraph></paragraph><paragraph id="idfafd50c62111414b9c6b33f44f1fe3e5"><enum>(5)</enum><text>in subsection (d)—</text><subparagraph id="id2cd4b42ecf034d56a194211c0994753b" commented="no"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">campuses</header-in-text></quote>; </text></subparagraph><subparagraph id="id7caf2c1a95b9454e8c5c1d60a6b8dc80" commented="no"><enum>(B)</enum><text>by striking <quote>centers</quote> each place the term appears and inserting <quote>campuses</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2221382bbd85482981ae44e68243d430"><enum>(C)</enum><text>by striking <quote>Centers</quote> each place the term appears and inserting <quote>Campuses</quote>;</text></subparagraph></paragraph><paragraph id="id7fd8238d1f814500b0dd369367608850"><enum>(6)</enum><text>in subsection (e)(1), by striking <quote>centers</quote> and inserting <quote>campuses</quote>;</text></paragraph><paragraph id="idd6bd4d421dbf4c14b34f3eb41c73f154"><enum>(7)</enum><text>in subsection (f), by striking <quote>2-year period</quote> and inserting <quote>4-year period</quote>; and</text></paragraph><paragraph id="id350fefea269a4326afc59849dcc7c422"><enum>(8)</enum><text>in subsection (g)—</text><subparagraph id="id685bdadd94ab4243aba52176321e0ad7"><enum>(A)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></subparagraph><subparagraph id="id4ae48724d68647ac82f358c552a57d3e"><enum>(B)</enum><text>in paragraph (1), by striking <quote>or if a second program year is not available</quote> and all that follows through the end and inserting <quote>such campus has been ranked in the lowest 10 percent of Job Corps campuses.</quote>.</text></subparagraph></paragraph></section><section id="id426edf1f5103474bbb63dbb6a637ee5b"><enum>8.</enum><header>Program activities</header><text display-inline="no-display-inline">Section 148 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3198">29 U.S.C. 3198</external-xref>) is amended—</text><paragraph id="id4b9eae21adf5489bb6f9931c16ef9fa0"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id207230a94027458d8a9f3131c018d82b"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">campuses</header-in-text></quote>; </text></subparagraph><subparagraph id="idacb3e17d69614ea0a44b363faa9b9d4c"><enum>(B)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></subparagraph><subparagraph id="id23db951eefce4ba28cca1dc37aff67e7"><enum>(C)</enum><text>in paragraph (2), by striking <quote>, on completion of their enrollment</quote>;</text></subparagraph></paragraph><paragraph id="id75c247d192de49e489200957c84482ef"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idf28e4bc8211444f2b35e2b9329f1766a"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id88ca153509ab4ecdbbe16fee86fa720b"><enum>(i)</enum><text>by striking <quote>the eligible providers</quote> and inserting <quote>any eligible provider</quote>; and</text></clause><clause id="idd6ec8f828da34c85acfb1c6c9eb40a21"><enum>(ii)</enum><text>by inserting <quote>if the training services are aligned with the career and technical education an enrollee has completed</quote> after <quote>under section 122</quote>; and</text></clause></subparagraph><subparagraph id="id2ff58cd082c143fb90b9888ebb39664f"><enum>(B)</enum><text>in paragraph (2), by striking <quote>centers</quote> and inserting <quote>campuses</quote>; </text></subparagraph></paragraph><paragraph id="id2cb2d9ef7f564c4cb5608447e7fe3c08"><enum>(3)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; </text></paragraph><paragraph id="id26c2e09a1c2d4228bf44939d492bf6f4"><enum>(4)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8decf03cff904b97bedd6942ac480d9f"><subsection id="idba78abd9dfb4421bbd3166718f713ce3"><enum>(d)</enum><header>Job Corps career pathways and apprenticeships</header><paragraph id="idc6d5f36fd03e4a39904b20558d565650"><enum>(1)</enum><header>Career pathways for strategic national importance positions</header><subparagraph commented="no" display-inline="no-display-inline" id="id1f2880fe38a94e48be85076ebea431bd"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall work with the heads of Federal agencies including, at a minimum, the Secretary of Agriculture, the Secretary of Defense, and the Secretary of Veterans Affairs, to create career pathways for Job Corps enrollees into positions of strategic national importance for which the relevant Federal agencies or their suppliers are struggling with hiring.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id865bbedcbb1c4edb889223317ab795f2"><enum>(B)</enum><header>Appointment</header><text display-inline="yes-display-inline">The head of a Federal agency establishing a career pathway described in subparagraph (A) may appoint, without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code (other than sections 3303 and 3328 of such title), a Job Corps enrollee enrolled in a relevant career pathway program directly to any such position for which the candidate meets Office of Personnel Management qualification standards.</text></subparagraph></paragraph><paragraph id="id283070ecf40945fd98e2b9e06d9592cf"><enum>(2)</enum><header>Apprenticeships</header><text>A Job Corps campus may serve as a pre-apprenticeship or apprenticeship education and training provider, intermediary, partner, or sponsor.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="id5dd4b783bedf4b308ce3e652dd6d5ab2"><enum>(5)</enum><text>in subsection (f), as redesignated by paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd9431b7fd2a4dd8a0ae8924e6a78bbe"><enum>(A)</enum><text>by striking <quote>centers</quote> and inserting <quote>campuses</quote>; and</text></subparagraph><subparagraph id="id28fb4d75000e4da99c07c6e6de00c53a" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>provide</quote> and inserting <quote>encourage Job Corps operators to provide</quote>.</text></subparagraph></paragraph></section><section id="idd250d2c0a7ff4a188222117d7c4ca00c"><enum>9.</enum><header>Transition support</header><text display-inline="no-display-inline">Section 150 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3200">29 U.S.C. 3200</external-xref>) is amended—</text><paragraph id="id98d47a37bda44dd2bdbbde34025d239f"><enum>(1)</enum><text>in subsection (a), by striking <quote>centers</quote> and inserting <quote>campuses</quote>; </text></paragraph><paragraph id="iddad28ab94b5b46e782cc933d8cb5dc30"><enum>(2)</enum><text>in subsection (c), by striking <quote>3 months</quote> and inserting <quote>12 months</quote>; and</text></paragraph><paragraph id="id0d2dfab5c9174177a1d22b9839403845"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc991c1663a5f45f4a866f805f1a7203e"><subsection id="ida92d6f42818744dfb465e9d86535816a"><enum>(d)</enum><header>Period of transition</header><text>Notwithstanding the requirements of section 146(b), a Job Corps graduate may remain an enrollee and a resident of a Job Corps campus for not more than 1 month after graduation as such graduate transitions into independent living and employment, if such graduate received written approval from the director of the Job Corps campus to remain such a resident.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id234774a838634e3cb3ec9a2d05825454"><enum>10.</enum><header>Operations</header><text display-inline="no-display-inline">Section 151 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3201">29 U.S.C. 3201</external-xref>) is amended—</text><paragraph id="idfb758be11bd34b469b4da7e11c6dacb8"><enum>(1)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></paragraph><paragraph id="id8fced74869714d7a8f5762b1d172e53e"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96516b206dd042d09fc656aaad47cbcd"><subsection id="idc65bd3facd9f4273b3f28c25348cb316"><enum>(d)</enum><header>Local authority</header><paragraph id="idb3679ed2fdaf4891996ebacc335dfff1"><enum>(1)</enum><header>In general</header><text>Subject to the limitations of the budget approved by the Secretary for a Job Corps campus and notwithstanding subsections (a) and (b), the operator of a Job Corps campus shall have the authority, without prior approval from the Secretary, to—</text><subparagraph id="id414eb63c4a12459e8279c493571880fd"><enum>(A)</enum><text>determine how and when learning is delivered and what tools, such as a learning management system, are employed for that purpose;</text></subparagraph><subparagraph id="id5a6124306e9346d1b9e29f0c6cdb3f46"><enum>(B)</enum><text>determine the appropriate policy and protocols with respect to enrollees leaving the campus and employers and other guests visiting the campus, and the need for fencing or other security measures around the campus;</text></subparagraph><subparagraph id="iddd87942912c642dfb1137b73436d5b67"><enum>(C)</enum><text>hire staff and provide staff professional development;</text></subparagraph><subparagraph id="idfd33bca9c06d497c94fae78d306276af"><enum>(D)</enum><text>set terms and enter into agreements with Federal, State, or local educational partners, such as secondary schools, institutions of higher education, child development centers, units of Junior Reserves' Officer Training Corps programs established under section 2031 of title 10, United States Code, or employers; and</text></subparagraph><subparagraph id="id6acdccdb600c456d9795140304d5e172"><enum>(E)</enum><text>engage with and educate stakeholders about Job Corps operations and activities.</text></subparagraph></paragraph><paragraph id="id54251b897d0240c7810e2264eee0f451"><enum>(2)</enum><header>Limitation of liability</header><text>In the case of an agreement described in paragraph (1)(D) that does not involve the Job Corps operator providing monetary compensation to the entity involved in such agreement from the funds made available under this subtitle, such agreement shall not be considered a subcontract (as defined in section 8701 of title 41, United States Code).</text></paragraph></subsection><subsection id="idc35abe65b80f42009c44e0576041368b"><enum>(e)</enum><header>Prior notice</header><text>Prior to making a change to the agreement described in section 147(a) or an operating plan described in this section, the Secretary shall solicit from the operators of the Job Corps campuses information on any operational costs the operators expect to result from such change.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="idb46f397a8f1c4e859050c4d133c39b4d"><enum>11.</enum><header>Standards of conduct</header><text display-inline="no-display-inline">Section 152 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3202">29 U.S.C. 3202</external-xref>) is amended—</text><paragraph id="id25f8c8ea9d744ca88a19b1d16a4cd8a5"><enum>(1)</enum><text>by striking <quote>centers</quote> each place the term appears and inserting <quote>campuses</quote>;</text></paragraph><paragraph id="ide30a04d19e8f4d5c80927e30c7e9ae2a"><enum>(2)</enum><text>in subsection (a), by striking the last sentence and inserting <quote>As part of the operating plan required under section 151(a), the director of each Job Corps campus shall develop and implement a behavior management plan consistent with the standards of conduct and subject to the approval of the Secretary.</quote>;</text></paragraph><paragraph id="idf54de9c37a154d0fae992596001de281"><enum>(3)</enum><text>by striking paragraph (2) of subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7f5c519c676c42938680d1ad6ed09568"><paragraph id="idcef2b94958774ada897c89dd5a3eca9a"><enum>(2)</enum><header>Disciplinary policy</header><text>The standards of conduct required under subsection (a) shall include a disciplinary policy that requires the automatic dismissal of an enrollee that has committed an act of violence or illegal activity.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id46e0b4fc943849798edeece46fddce38"><enum>(4)</enum><text>by amending subsection (c) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1d9a20032fb345e1afa0c70b29680fa8"><subsection id="iddb5df17df7e347fc94b3d7575f33dc08"><enum>(c)</enum><header>Appeal process; law enforcement agreements</header><paragraph id="id8a2fcda5700a4c869565e6223ce32226"><enum>(1)</enum><header>Enrollee appeals</header><text>A disciplinary measure taken by a director under this section shall be subject to expeditious appeal in accordance with procedures established by the Secretary.</text></paragraph><paragraph id="idf211b434be3845a58894edee3c4e1bf1"><enum>(2)</enum><header>Director appeals</header><subparagraph id="idba19cdf20c8e467ea9921a6c53b9da27"><enum>(A)</enum><header>In general</header><text>The Secretary shall establish an appeals process under which the director of a Job Corps campus may submit a request that an enrollee who has engaged in an activity that is a violation of the guidelines established pursuant to subsection (b)(2) remain enrolled in the program, but be subject to other disciplinary actions.</text></subparagraph><subparagraph id="id5a7b480e0b9e4181ae3feee0163e1f66"><enum>(B)</enum><header>Contents</header><text>A request under subparagraph (A) shall include—</text><clause id="id974746c15ba24929987fb83833ccc8ee"><enum>(i)</enum><text>a signed certification from the director attesting that, in the belief of the director, the continued enrollment of such enrollee would not impact the safety or learning environment of the campus; and</text></clause><clause id="ide62a836ba4614c5395d85ea563c99ca9"><enum>(ii)</enum><text>the behavioral records of such enrollee.</text></clause></subparagraph><subparagraph id="id6532c2b3687a436aabd17e6a084d9ed5"><enum>(C)</enum><header>Timeline</header><text>The Secretary shall review such appeal and either approve or deny the appeal by not later than 30 days after receiving such appeal.</text></subparagraph></paragraph><paragraph id="id573a241f8e3f4865af45f7b9841e86fd"><enum>(3)</enum><header>Law enforcement agreements</header><text>The director of each Job Corps campus shall, to the extent practicable, enter into an agreement with the relevant local law enforcement agency with jurisdiction regarding procedures for the reporting and investigation of potentially illegal activity on the Job Corps campus.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id681c892888b94eecad3a1d91ac92ad0a"><enum>12.</enum><header>Community participation</header><text display-inline="no-display-inline">Section 153 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3203">29 U.S.C. 3203</external-xref>) is amended—</text><paragraph id="ida5a7294451f347d2b7760635a8884d6a"><enum>(1)</enum><text>in the subsection heading of subsection (c), by striking <quote><header-in-text style="OLC" level="subsection">New centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">New campuses</header-in-text></quote>;</text></paragraph><paragraph id="id04f00afcd9674750ab4a66135c92a3bb"><enum>(2)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></paragraph><paragraph id="id027f0a7736f640b6b30612c9b86d2908"><enum>(3)</enum><text>in subsection (a), by striking <quote>centers</quote> and inserting <quote>campuses</quote>.</text></paragraph></section><section id="idc984ab68f9a941288be52770249cb800"><enum>13.</enum><header>Workforce councils</header><text display-inline="no-display-inline">Section 154 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3204">29 U.S.C. 3204</external-xref>) is amended—</text><paragraph id="id42c1d2f363054b1fb0a553bd042ce676"><enum>(1)</enum><text>by striking <quote>center</quote> each place the term appears and inserting <quote>campus</quote>; and</text></paragraph><paragraph id="id7fbbe6acc8ce40d89e38edb245fd65a3"><enum>(2)</enum><text>in the subsection heading of subsection (d), by striking <quote><header-in-text style="OLC" level="subsection">New centers</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">New campuses</header-in-text></quote>.</text></paragraph></section><section id="idd26d0375357c42b99790ded0a04e7088"><enum>14.</enum><header>Advisory committees</header><text display-inline="no-display-inline">Section 155 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3205">29 U.S.C. 3205</external-xref>) is amended—</text><paragraph id="id3434331ab36144ee9dfd3781bafa99b1"><enum>(1)</enum><text>by striking <quote>center</quote> and inserting <quote>campus</quote>; and</text></paragraph><paragraph id="idba2085e0f7854ea8864fb45d5183fdd2"><enum>(2)</enum><text>by striking <quote>centers</quote> and inserting <quote>campuses</quote>.</text></paragraph></section><section id="ide490d98efd0b4e1e837f731d45b58bbe"><enum>15.</enum><header>Experimental projects and technical assistance</header><text display-inline="no-display-inline">Section 156(b) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3206">29 U.S.C. 3206(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id0e55751dba0a4868b097ac6daba6663a"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>section 162</quote> and inserting <quote>section 161</quote>;</text></paragraph><paragraph id="id59bdb6d2c78448a4b43729ac7290c1ac"><enum>(2)</enum><text>in paragraph (1), by striking <quote>centers</quote> and inserting <quote>campuses</quote>;
