<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4492</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240611">June 11, 2024</action-date><action-desc><sponsor name-id="S357">Mrs. Fischer</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the transparency of Amtrak operations, and for other purposes.</official-title></form><legis-body><section id="id84a95c5d1fde4218a8142878cc41f5dc" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amtrak Transparency Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="ide773b4c848a74d8ca02874adacb5b6f6"><enum>2.</enum><header display-inline="yes-display-inline">Board of Directors meetings</header><text display-inline="no-display-inline">Section 24302 of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1c00a4b66d964fc0989ed539f843bc66"><enum>(1)</enum><text>in subsection (a)(6), by striking <quote>in an open meeting</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea22bc2c4e00462ba60b98ef0d52b86b"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (e) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id246663B246CC41BDB7CDA5B715B97094"><subsection id="idCB520FDD21FB4BA5B2E9D350678E1C52"><enum>(e)</enum><header>Meetings</header><paragraph id="id524CB5A104504D48BEA7218272566214"><enum>(1)</enum><header>Quorum</header><text>A majority of the members serving on the Board who are eligible to vote shall constitute a quorum for doing business.</text></paragraph><paragraph id="id6C95C3F3630D4DD5B81A8FA5D1AD3F22"><enum>(2)</enum><header>Notice; open meetings</header><subparagraph commented="no" display-inline="no-display-inline" id="id6dbf031bc79542fd9cf360b8596b7302"><enum>(A)</enum><header>Notice</header><text display-inline="yes-display-inline">Not later than 30 days before convening any meeting of the Board, the Board shall post, on a publicly accessible website, an announcement of the meeting that includes the anticipated agenda for the meeting.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f5ab0c4ca084b82a20d6a7b872aaf95"><enum>(B)</enum><header>Open meetings</header><text display-inline="yes-display-inline">All meetings of the Board shall comply with the requirements set forth in section 552b of title 5.</text></subparagraph></paragraph><paragraph id="id0EE12C875B954C43ADA7C7A944B69FF0"><enum>(3)</enum><header>Annual meeting with States</header><text>Not less frequently than annually, the Board shall convene a meeting to which the head of the Department of Transportation of each State traversed by a long-distance route or State-supported route, or the designee of such State official, shall be invited to participate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id73AC3E871874408A8CA5BA101BF577D7"><enum>3.</enum><header>Discretionary bonus disclosure requirement</header><text display-inline="no-display-inline">Section 24303(b) of title 49, United States Code, is amended by striking <quote>The preceding sentence</quote> and inserting <quote>Amtrak shall publicly disclose the amount of each discretionary bonus paid to any officer or non-bargaining unit employee. The 2 preceding sentences</quote>.</text></section><section id="id2039866AC8064F54A6563CA9E74D9A98"><enum>4.</enum><header>Disclosure of vendor agreements</header><text display-inline="no-display-inline">Section 24315(h) of title 49, United States Code, is amended by adding at the end the following: <quote>Upon request, Amtrak shall disclose to a State or the State-Amtrak Intercity Passenger Rail Committee, any vendor agreement valued at not less than $250,000 for services procured to implement a service on a State-supported route.</quote>.</text></section></legis-body></bill>
