which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to provide for an operational and training deferment for parents.</official-title></form><legis-body><section id="id5c5fc722f7384ff4b88daa6e92f1049e" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Families Support Act</short-title></quote>.</text></section><section id="id0b8a2c0a1efc498db5d33dc9e3af5d27"><enum>2.</enum><header>Operational and training deferment for parents</header><subsection commented="no" display-inline="no-display-inline" id="id69f8dcb9e79d42f795a509d0fdfae208"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/39">Chapter 39</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/674">section 674</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id4E0BBF9E94394C1A9DFDD316C0B6816D"><section id="ida914f3d8e62b41c7b663c17856e41730"><enum>675.<?LEXA-Enum 675.?></enum><header>Operational and training deferment for parents</header><subsection id="ida5fbaf38bc47446ebb5ae2910e152d10"><enum>(a)</enum><header>In general</header><text>A member of the Armed Forces who physically gives birth to a child (in this section referred to as a <quote>birthparent</quote>) shall receive a deferment, for a period of 365 days beginning on the date of the birth of the child, from all continuous duty events that are in excess of 1 normal duty day or shift, including from the following:</text><paragraph id="id1fefb53627074b1da5ede1d9768ee874"><enum>(1)</enum><text>Deployment.</text></paragraph><paragraph id="id555336dd00eb4dcd8d5ac0d6673651f7"><enum>(2)</enum><text>Mobilization.</text></paragraph><paragraph id="idb925fd8472024057a6c9516cb8d9a902"><enum>(3)</enum><text>Field training.</text></paragraph><paragraph id="id6fffffa054a7431f989368b98111d95e"><enum>(4)</enum><text>Combat Training Center program rotations.</text></paragraph><paragraph id="idb0b3156a22da4f17a7b7261d111c1930"><enum>(5)</enum><text>Collective training events away from the permanent duty station of the member.</text></paragraph><paragraph id="idcc29cd272af54e8a9365e8faf2c810ee"><enum>(6)</enum><text>Pre-mobilization training.</text></paragraph><paragraph id="idf7796909958f4be0973966833273a706"><enum>(7)</enum><text>Unit training assembly away from the permanent duty station of the member.</text></paragraph><paragraph id="idb48f1785446849d88fa10fe6eab99a96"><enum>(8)</enum><text>Temporary duty.</text></paragraph></subsection><subsection id="id2ea1b4eafcbb4f2586278f8c0f406b95"><enum>(b)</enum><header>Adoptions</header><paragraph commented="no" display-inline="no-display-inline" id="id8863d861773b4a7ab5b9c6783a954192"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A member of the Armed Forces who adopts a minor child or has a minor child placed with the member long term shall receive a deferment described in subsection (a) for a period of 365 days beginning on the date of the adoption or placement. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8333350f29f748fa81cacf0e807bf800"><enum>(2)</enum><header>Stepparent or sibling adoptions</header><text display-inline="yes-display-inline">Paragraph (1) does not apply in the case of the adoption of a child by, or placement of a child with, a stepparent or sibling of the child. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67fb18915e824310a90cf72e0067cc7e"><enum>(3)</enum><header>Surrogacy</header><text display-inline="yes-display-inline">If a member of the Armed Forces uses a surrogate to bear a child, and the member becomes the legal parent or guardian of the child, the member shall be treated as adopting the child for purposes of paragraph (1).</text></paragraph></subsection><subsection id="ida87e61a152c74b4ba3ff972d25c6f609"><enum>(c)</enum><header>Non-Birthparents</header><text>A member of the Armed Forces who is not the birthparent of a child shall receive a deferment described in subsection (a) if the deferment—</text><paragraph commented="no" display-inline="no-display-inline" id="idba84e360028947eb95208b5882577a03"><enum>(1)</enum><text display-inline="yes-display-inline">is necessary to ensure that at least one parent is home with the child for a period of 365 days beginning on the date of the birth of the child; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id656a5266beee428faf4858a850561257"><enum>(2)</enum><text display-inline="yes-display-inline">is approved by the special court-martial convening authority of the member specified in section 823.</text></paragraph></subsection><subsection id="ide63a49caa8e046e8aa28477dfeb169e4"><enum>(d)</enum><header>Dual-Military parents</header><text>A member of the Armed Forces who is the birthparent of a child and is married to or co-parenting with another member of the Armed Forces may transfer all or part of the 365-day deferment period under subsection (a) to the spouse or co-parent.</text></subsection><subsection id="ide4cbc4c557104a3cb4c2929087878e99"><enum>(e)</enum><header>Fertility treatments</header><paragraph commented="no" display-inline="no-display-inline" id="idc7233c0e10a94ac5929a1186674a227c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A member of the Armed Forces who receives, or whose spouse receives, a referral from a gynecologic surgeon or obstetrician to a healthcare provider with credentials in fertility treatment shall receive a deferment described in subsection (a) for a period of 365 days beginning on the date of the first appointment of the member or spouse, as applicable, with the healthcare provider.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6000e4845104db98257308abe0a98a9"><enum>(2)</enum><header>Extensions</header><text>A member described in paragraph (1) who receives, or whose spouse receives, assisted reproductive technology procedures is eligible for an extension of the deferment period described in subsection (a) for not more than an additional 365 days.</text></paragraph><paragraph id="idacfbeab216164a32a97612dd34c07715"><enum>(3)</enum><header>Conditions</header><subparagraph commented="no" display-inline="no-display-inline" id="id8054873a07824e8baa17393048210268"><enum>(A)</enum><header display-inline="yes-display-inline">Members assigned outside continental United States</header><text>A member assigned to a duty location outside the continental United States who requests a deferment under paragraph (1) shall also request an extension of the assignment of the member to that duty location if the deferment period would otherwise exceed the term of the assignment.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27e6ead14e90458e8452942351af3caf"><enum>(B)</enum><header>Members who have received relocation orders</header><text>A member who has orders for a temporary or permanent change of station pending—</text><clause commented="no" display-inline="no-display-inline" id="idce7d2f49d53f45a1b283007e84454108"><enum>(i)</enum><text display-inline="yes-display-inline">is not eligible for a deferment under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idcf99a62516494660a6e1a8db56a497bc"><enum>(ii)</enum><text>may be eligible for an extension under paragraph (2).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id572bc7e82cc04c8880576e42f7cc0b46"><enum>(C)</enum><header>Voluntary early termination of deferment</header><text>A member who receives a deferment under paragraph (1) or an extension of such a deferment under paragraph (2) may elect to end the deferment of the member before the expiration of the deferment.</text></subparagraph></paragraph></subsection><subsection id="id36a17c7b78994e0fb4307374f993b259"><enum>(f)</enum><header>Members in deployment deferment status</header><text>A member of the Armed Forces who is in a deployment deferment status on the date of the birth, adoption, or other event qualifying the member for a deferment under this section shall have the deployment deferment status of the member extended to a date that is not later than 365 days after the date of the birth, adoption, or other event, unless the member is eligible for an extension.</text></subsection><subsection id="ida093668032a4411992b758e0b5dfe784"><enum>(g)</enum><header>Waivers of deferment period</header><text>At any time, a member of the Armed Forces who receives a deferment under this section may waive any portion of the 365-day deferment period without ending the period early.</text></subsection><subsection id="id782fa765ed1140888e1bcd6c1eaaa919"><enum>(h)</enum><header>Reserves</header><text>Other than any rescheduled or excused absences relating to approved parental leave, this section does not exempt a member of a reserve component from attending—</text><paragraph commented="no" display-inline="no-display-inline" id="id941c61fe09b94267aee4e73de9d1c81d"><enum>(1)</enum><text display-inline="yes-display-inline">a unit training assembly at the permanent duty station of the member; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd815c7ed9af44b01a3dad185e8115182"><enum>(2)</enum><text display-inline="yes-display-inline">a medical readiness appointment; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7f1c6a08e1b24a2f8a7761182d428ffc"><enum>(3)</enum><text display-inline="yes-display-inline">annual training within commuting distance of the permanent duty station of the member.</text></paragraph></subsection><subsection id="id00fdc9b3cc0f4fe98db419214175ec62"><enum>(i)</enum><header>Extensions</header><paragraph commented="no" display-inline="no-display-inline" id="id7b0cae6148564f2d9b97c83c8790585d"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with prevailing medical guidance, a member of the Armed Forces who is still lactating after the end of the 365-day deferment period described in subsection (a) may be granted an extension of the deferment period and be excused from the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="idceaf846914444eedb56c81116477fbdc"><enum>(A)</enum><text display-inline="yes-display-inline">Deployment. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2346303cbbb4a8f8bf32b6d4a3a1912"><enum>(B)</enum><text display-inline="yes-display-inline">Mobilization. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8cbd0c564f8c43189bdd53f7b2ed39b8"><enum>(C)</enum><text display-inline="yes-display-inline">Combat Training Center program rotations. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc5322de423249bb9d11e71235f9dbca"><enum>(D)</enum><text display-inline="yes-display-inline">Any training events where lactation accommodations cannot be provided as described in subsection (j). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id83e11f2bfc2d4f60922874943cab76ae"><enum>(2)</enum><header>Term of extensions</header><text display-inline="yes-display-inline">Extensions under paragraph (1) for a member shall be granted in 90-day increments for such period as the member is lactating, for up to 730 days after the date of the birth of the child of the member. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9c52452f44c4a2883d8790da6e29f80"><enum>(3)</enum><header>Verification</header><text display-inline="yes-display-inline">The commander of a member seeking an extension under paragraph (1) may verify that the member is lactating through a healthcare provider of the member. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a0c4b8a04ae43628a24c7649dd1fa79"><enum>(4)</enum><header>Other duty</header><text display-inline="yes-display-inline">This subsection does not excuse a member described in paragraph (1) from any duty away from the permanent duty station of the member other than duty described in that paragraph and where lactation accommodations can be provided as described in subsection (j).</text></paragraph></subsection><subsection id="id5678dcacdb30473d8c86e8fb9f9a4623"><enum>(j)</enum><header>Lactation accommodations</header><paragraph commented="no" display-inline="no-display-inline" id="idb00360fc90bf4b6cac81d2654e04417a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The commander of a member who is lactating shall provide the member with lactation breaks and a designated lactation area, without regard to the amount of time that has elapsed after the birth of the child of the member or whether the child is beginning to eat solid foods.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2acc49780f6f46e7a9f2959bf076b2fe"><enum>(2)</enum><header>Lactation breaks</header><text display-inline="yes-display-inline">The commander of a member who is lactating shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfeae9beddaad4335bf4c9dd2ff814650"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that the member has adequate time to express milk and shall be aware that, in determining how much time is adequate, each member’s situation is unique; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd83e24c1fbd9475b9d09279448836594"><enum>(B)</enum><text display-inline="yes-display-inline">allow lactation breaks not less frequently than every 3 hours and for not less than 30 minutes for each break. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide897790f4b7f4730b5eb747e8586fe78"><enum>(3)</enum><header>Lactation areas</header><text display-inline="yes-display-inline">The commander of a member who is lactating shall designate a private space, other than a restroom, for the member to breastfeed or express milk that includes the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="id1ac26c78d3e54d2c8c9d960fda12d0c8"><enum>(A)</enum><text display-inline="yes-display-inline">Locking capabilities.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b393e44b45c4ac08b270d59c67ef195"><enum>(B)</enum><text display-inline="yes-display-inline">A place to sit. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07c60d533fce41e7b3213d50baecbd2c"><enum>(C)</enum><text display-inline="yes-display-inline">A flat surface (other than the floor) to place the pump on. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42836747ed634e5dabed320e4bacc7b5"><enum>(D)</enum><text display-inline="yes-display-inline">An electrical outlet. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b99e5b37ae84d2ba366a17d00d2e8f1"><enum>(E)</enum><text display-inline="yes-display-inline">A refrigerator to store expressed milk. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70b308a70cff43089207eeb07afa9831"><enum>(F)</enum><text display-inline="yes-display-inline">Access to a safe water source within reasonable distance from the lactation area.</text></subparagraph></paragraph></subsection><subsection id="id8534135ac4534f2fb7d911df9e7187a1" commented="no"><enum>(k)</enum><header>Waiver of deferments for war or national emergency</header><text>In time of war or during a national emergency declared by Congress or the President, the Secretary of Defense may waive the requirements of this section and terminate any deferments granted under this section before the declaration of the war or national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id49a1dc376e3c47ea95b3898286219a84"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 39 of such title is amended by inserting after the item relating to section 674 the following new item:</text><quoted-block style="OLC" id="id43694131-b699-4827-992b-b2280a1ede33"><toc><toc-entry level="section" idref="ida914f3d8e62b41c7b663c17856e41730">675.
