<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4490</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240611">June 11, 2024</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Workforce Innovation and Opportunity Act to increase the funds available to Governors for statewide youth workforce investment activities, and statewide adult and dislocated worker employment and training activities.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Advancement and Engagement Act</short-title></quote> or <quote><short-title>WAE Act</short-title></quote>.</text></section><section id="id88e3e3234a1e489284f025b2b393d01f"><enum>2.</enum><header>Governor's reserve funds</header><text display-inline="no-display-inline">Section 128(a)(1) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3163">29 U.S.C. 3163(a)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8e2440f2102f4aa0a3602809b63a4574"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Governor</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id564DA7DB23BB4F9EB8F23524E0E7F02B"><subparagraph commented="no" display-inline="no-display-inline" id="id94c4e39fa02d4e93a0a6cc26949d61fc"><enum>(A)</enum><header>Governor's reserve funds</header><text>The Governor</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2ee2f8d2e404eb4a93b40d8c178fd19"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>15 percent</quote> and inserting <quote>25 percent</quote>; and</text></paragraph><paragraph id="idf14d08308dff4aaa953a8bf3a7c7b8a1"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id9CA6B88358944E569A76014D4061C4CA"><subparagraph id="id71f968651b814ee6a13452d0d09e6036"><enum>(B)</enum><header>Portion for employer-based training</header><text>Except as otherwise provided in sections 116(f)(1)(B) and 129(a)(4)(A), if a sum reserved under subparagraph (A) from an allotted amount exceeds 15 percent of that allotted amount, the portion that exceeds 15 percent shall be used only for statewide employer-based training activities, notwithstanding sections 106(b)(7), 129(b), and 134(a).</text></subparagraph><subparagraph id="id73e5b65ff6324d488bb8a8671f34ce67"><enum>(C)</enum><header>Employer-based training activities</header><text>In this paragraph, the term <term>employer-based training activities</term> includes on-the-job training, customized training, or other employer-provided training activities. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
