which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To codify the existing Outdoor Recreation Legacy Partnership Program of the National Park Service, and for other purposes.</official-title></form><legis-body changed="not-changed"><section id="S1" section-type="section-one" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Outdoors for All Act</short-title></quote>. </text></section><section id="id1DF732A5A2E74C5389888575626AB6A7" changed="not-changed"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9C0DFB0A620B489B94C30D20901BA11B" changed="not-changed"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that represents or otherwise serves a qualifying area.</text></paragraph><paragraph id="id2f2b87d8541b4f84b5b5e12aa03052bd" changed="not-changed"><enum>(2)</enum><header>Eligible nonprofit organization</header><text>The term <term>eligible nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such code. </text></paragraph><paragraph id="id77019da7290e4c6f9311cc35f799229d" changed="not-changed"><enum>(3)</enum><header>Entity</header><text>The term <term>entity</term> means—</text><subparagraph id="id727e2c1775614d03bfa57b68e4876ec4" changed="not-changed"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="idef8d2964524743829daeffc01081e0c7" changed="not-changed"><enum>(B)</enum><text>a political subdivision of a State, including—</text><clause id="ida3f39f4d5e8a49b68713c438c65efc92" changed="not-changed"><enum>(i)</enum><text>a city; </text></clause><clause id="id364b16d9efc143ca9a5039eb63513309" changed="not-changed"><enum>(ii)</enum><text>a county; and</text></clause><clause id="id6D0267E0CC6C400186E493BC6E20C2B5" changed="not-changed"><enum>(iii)</enum><text>a special purpose district that manages open space, including a park district; and</text></clause></subparagraph><subparagraph id="id03e7b1af90c645fa8ea44dcba4520eae" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(C)</enum><text>an Indian Tribe, urban Indian organization, or Alaska Native or Native Hawaiian community or organization. </text></subparagraph></paragraph><paragraph id="id7D5AE81A5AFA4DF3B8ACD71DF0F3476B"><enum>(4)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="idacbb36979e3c493f803e04c9794971fc" changed="not-changed"><enum>(5)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with an annual household equal to, or less than, the greater of—</text><subparagraph id="id3ff1f63a872f400ca6fd065e48dca086" changed="not-changed"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="id1ef21638dcc94acfbe1fa7cf809a5325" changed="not-changed"><enum>(B)</enum><text>an amount equal to 200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="idc20dfb50e5fe4ea08bc9376c83413647" changed="not-changed"><enum>(6)</enum><header>Outdoor recreation legacy partnership program</header><text>The term <term>Outdoor Recreation Legacy Partnership Program</term> means the program established under section 3(a).</text></paragraph><paragraph id="id35fa39c2658a4878a915481f3fe2ade5" changed="not-changed"><enum>(7)</enum><header>Qualifying Area</header><text>The term <term>qualifying area</term> means—</text><subparagraph id="idff8081796bfc474fb01c2cc7b792e774" changed="not-changed"><enum>(A)</enum><text>an urbanized area or urban cluster that has a population of 25,000 or more in the most recent census;</text></subparagraph><subparagraph id="id7bea156226134915b5979130a709b3a3" changed="not-changed"><enum>(B)</enum><text>2 or more adjacent urban clusters with a combined population of 25,000 or more in the most recent census; or </text></subparagraph><subparagraph id="idB91582F09A154F2E954F9FD57BF21B65" changed="not-changed"><enum>(C)</enum><text>an area administered by an Indian Tribe or an Alaska Native or Native Hawaiian community organization.</text></subparagraph></paragraph><paragraph id="ida9742531-68d7-4e47-a121-b65b9144f970" changed="not-changed"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph><paragraph id="id175B704835324A42B0FFB9E289EB428A" changed="not-changed"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, and each territory of the United States. </text></paragraph></section><section id="id1956ce9f11b44a9f9e7197a74c3b663a" changed="not-changed"><enum>3.</enum><header>Grants authorized</header><subsection id="idbe3e64bcaf844c689388d448259cc0e0" changed="not-changed"><enum>(a)</enum><header>Establishment of program</header><paragraph id="id734A6D90B0F9498AADBBED56A9AA3D9A" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an outdoor recreation legacy partnership program under which the Secretary may award grants to eligible entities for projects—</text><subparagraph id="idf83421d8d9304647b9e41c2d98951755" changed="not-changed"><enum>(A)</enum><text>to acquire land and water for parks and other outdoor recreation purposes in qualifying areas; and</text></subparagraph><subparagraph id="idc78b55f61d034543bf7e41df8d1d856e" changed="not-changed"><enum>(B)</enum><text>to develop new or renovate existing outdoor recreation facilities that provide outdoor recreation opportunities to the public in qualifying areas.</text></subparagraph></paragraph><paragraph id="id46A3F092A6164646B88A819295C2CCF5" changed="not-changed"><enum>(2)</enum><header>Priority</header><text>In awarding grants to eligible entities under paragraph (1), the Secretary shall give priority to projects that—</text><subparagraph id="id0e0c55dbd588421ca01608d83c92a103" changed="not-changed"><enum>(A)</enum><text>create or significantly enhance access to park and recreational opportunities in an urban neighborhood or community;</text></subparagraph><subparagraph id="id8b5a371bbdda417aa1b24e852da03b6b" changed="not-changed"><enum>(B)</enum><text>engage and empower underserved communities and youth;</text></subparagraph><subparagraph id="idca4a67aa6b9c451dabbd3d44fd9fab92" changed="not-changed"><enum>(C)</enum><text>provide employment or job training opportunities for youth or underserved communities;</text></subparagraph><subparagraph id="id6ee771474c4a46fe9a217256ba927a89" changed="not-changed"><enum>(D)</enum><text>establish or expand public-private partnerships, with a focus on leveraging resources; and</text></subparagraph><subparagraph id="id517718e9be694557b3fb0da5ab86afcd" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(E)</enum><text>take advantage of coordination among various levels of government. </text></subparagraph></paragraph></subsection><subsection id="id0709929ab4ac4fca93b1e43811a8da41" changed="not-changed"><enum>(b)</enum><header>Matching requirement</header><paragraph id="id82f825de34c94b2797b2aadbe41cb981" changed="not-changed"><enum>(1)</enum><header>In general</header><text>As a condition of receiving a grant under subsection (a), an eligible entity shall provide matching funds in the form of cash or an in-kind contribution in an amount equal to not less than 100 percent of the amounts made available under the grant.</text></paragraph><paragraph id="idb616b87bdd74475fb7853d9496a785cf" changed="not-changed"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive all or part of the matching requirement under paragraph (1) if the Secretary determines that—</text><subparagraph id="id4ddb482be6ce4a0e8bae3811f8205154" changed="not-changed"><enum>(A)</enum><text>no reasonable means are available through which the eligible entity can meet the matching requirement; and</text></subparagraph><subparagraph id="idf5d33a88708d4cf39d7e511045ae7101" changed="not-changed"><enum>(B)</enum><text>the probable benefit of the project outweighs the public interest in the matching requirement.</text></subparagraph></paragraph><paragraph id="id501216f80c27446b9443cfba6a674927" changed="not-changed"><enum>(3)</enum><header>Administrative expenses</header><text>Not more than 10 percent of funds provided to an eligible entity under a grant awarded under subsection (a) may be used for administrative expenses.</text></paragraph></subsection><subsection id="id910752f3b4314e6385b6fc3b2c5c108b" changed="not-changed"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">In awarding grants to eligible entities under subsection (a), the Secretary shall consider the extent to which a project would—</text><paragraph id="id15af81e8e08e4f64b41d5ec6051bd55f" changed="not-changed"><enum>(1)</enum><text>provide recreation opportunities in underserved communities in which access to parks is not adequate to meet local needs;</text></paragraph><paragraph id="id1f09b182fc9440308870b63481f87c3d" changed="not-changed"><enum>(2)</enum><text>provide opportunities for outdoor recreation and public land volunteerism;</text></paragraph><paragraph id="ida1813923339c42b3b19127dd29db963e" changed="not-changed"><enum>(3)</enum><text>support innovative or cost-effective ways to enhance parks and other recreation—</text><subparagraph id="idBADB15C09A7B452DAB38E3BDE6945DA6" changed="not-changed"><enum>(A)</enum><text>opportunities; or</text></subparagraph><subparagraph id="idBF6F36243F4643E98A8F2F21B98C2BC6" changed="not-changed"><enum>(B)</enum><text>delivery of services;</text></subparagraph></paragraph><paragraph id="ide47fbf2e706643aea23d3783605fd9ad" changed="not-changed"><enum>(4)</enum><text> support park and recreation programming provided by cities, including cooperative agreements with community-based eligible nonprofit organizations;</text></paragraph><paragraph id="ide0bace3368524e84acaeb393cdba580c" changed="not-changed"><enum>(5)</enum><text>develop Native American event sites and cultural gathering spaces; and</text></paragraph><paragraph id="id036b6c5872b24d26af47a793eee9ea19" changed="not-changed"><enum>(6)</enum><text>provide benefits such as community resilience, reduction of urban heat islands, enhanced water or air quality, or habitat for fish or wildlife.</text></paragraph></subsection><subsection id="ide0051f1694564277a34411eb5a3416ad" changed="not-changed"><enum>(d)</enum><header>Eligible uses</header><paragraph id="id2efd868e97c2466cbe0153ab76a0791d" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a grant recipient may use a grant awarded under subsection (a) for a project described in paragraph (1) or (2) of that subsection.</text></paragraph><paragraph id="id45186657a854492eb825b0e3148d0761" changed="not-changed"><enum>(2)</enum><header>Limitations on use</header><text>A grant recipient may not use grant funds for—</text><subparagraph id="id605feb683e594ce0974e4ad3036c5019" changed="not-changed"><enum>(A)</enum><text>incidental costs related to land acquisition, including appraisal and titling;</text></subparagraph><subparagraph id="id428517f3110240b18dc6eb8a00769eb2" changed="not-changed"><enum>(B)</enum><text>operation and maintenance activities;</text></subparagraph><subparagraph id="iddb6dc975790f4ea5963403673f011bbc" changed="not-changed"><enum>(C)</enum><text>facilities that support semiprofessional or professional athletics;</text></subparagraph><subparagraph id="id64d2555e0bc74269a54a77ca104d56cf" changed="not-changed"><enum>(D)</enum><text>indoor facilities, such as recreation centers or facilities that support primarily non-outdoor purposes; or</text></subparagraph><subparagraph id="id733e3db9767842f7887c69cf59722356" changed="not-changed"><enum>(E)</enum><text>acquisition of land or interests in land that restrict access to specific persons.</text></subparagraph></paragraph></subsection></section><section id="idccdef2cb23a04a3fb8fe3ae8446ac07f" changed="not-changed"><enum>4.</enum><header>Review and evaluation requirements</header><text display-inline="no-display-inline">In carrying out the Outdoor Recreation Legacy Partnership Program, the Secretary shall—</text><paragraph id="ida7b3bcbb4263496bbad09731806a8335" changed="not-changed"><enum>(1)</enum><text>conduct an initial screening and technical review of applications received; </text></paragraph><paragraph id="id8c9996d6be4d4526933bc7d588fbe8e3" changed="not-changed"><enum>(2)</enum><text>evaluate and score all qualifying applications; and</text></paragraph><paragraph id="id6f028cfcde1541478ed8e72b165d6a79" changed="not-changed"><enum>(3)</enum><text>provide culturally and linguistically appropriate information to eligible entities (including low-income communities and eligible entities serving low-income communities) on—</text><subparagraph id="id6F923647A1794B94B919AE94568EA0C0" changed="not-changed"><enum>(A)</enum><text>the opportunity to apply for grants under this Act;</text></subparagraph><subparagraph id="id39120C3EF4FA4D0DABAC67377C5F8753" changed="not-changed"><enum>(B)</enum><text>the application procedures by which eligible entities may apply for grants under this Act; and</text></subparagraph><subparagraph id="id194EE7CD9B2545219BABDCF4D9818D05" changed="not-changed"><enum>(C)</enum><text>eligible uses for grants under this Act.</text></subparagraph></paragraph></section><section id="id4c07a4a25cef4782950d3fb64c0e335e" changed="not-changed"><enum>5.</enum><header>Reporting</header><subsection id="id0aec7b3e74344f48960bafc869bb1d30" changed="not-changed"><enum>(a)</enum><header>Annual reports</header><text>Not later than 30 days after the last day of each report period, each State lead agency that receives a grant under this Act shall annually submit to the Secretary performance and financial reports that—</text><paragraph id="id735aa88392b847d7a8f1537a88cc5565" changed="not-changed"><enum>(1)</enum><text>summarize project activities conducted during the report period; and</text></paragraph><paragraph id="id3401b931593b4cf8ab4832385312bf63" changed="not-changed"><enum>(2)</enum><text>provide the status of the project.</text></paragraph></subsection><subsection id="id76b25fe56a544548ba57c5fb4832fa9e" changed="not-changed"><enum>(b)</enum><header>Final reports</header><text>Not later than 90 days after the earlier of the date of expiration of a project period or the completion of a project, each State lead agency that receives a grant under this Act shall submit to the Secretary a final report containing such information as the Secretary may require. </text></subsection></section></legis-body></bill>
