which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the establishment of an Operational Flexibility Grazing Management Program on land managed by the Bureau of Land Management, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Operational Flexibility Grazing Management Program Act</short-title></quote>.</text></section><section id="id5b90f505bf4f4202b5d1d4676f999cc8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb4f1950aa28542b59db1a8a28107b346"><enum>(1)</enum><header>Bureau</header><text>The term <term>Bureau</term> means the Bureau of Land Management.</text></paragraph><paragraph id="id4c3d5d768a5d4743b0046eef948c427f"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means land managed by the Bureau.</text></paragraph><paragraph id="id5cf873a54bd4474f9d2045312f0257c9"><enum>(3)</enum><header>Operational flexibility</header><text>The term <term>operational flexibility</term>, with respect to grazing on Federal land, means changes made to grazing management of an allotment or allotment area that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c5802793b1041318c1f1499e0b58e7a"><enum>(A)</enum><text display-inline="yes-display-inline">differ from—</text><clause commented="no" display-inline="no-display-inline" id="id3b6337a6f7854bbdb7255aecf848b8b2"><enum>(i)</enum><text display-inline="yes-display-inline">the terms and conditions of the applicable grazing permit or lease; or </text></clause><clause commented="no" display-inline="no-display-inline" id="ide74ae79472f8486a83f92c8609db6370"><enum>(ii)</enum><text display-inline="yes-display-inline">the administration of grazing on the applicable allotment or allotment area during the preceding year; or </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6575d993e06449bd97cff859d64af85f"><enum>(B)</enum><text display-inline="yes-display-inline">are based on emerging landscape conditions or producer needs.</text></subparagraph></paragraph><paragraph id="idb1a3f1cf63cc4ed29cf5ad657a67395f"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the Operational Flexibility Grazing Management Program authorized under section 3(a). </text></paragraph><paragraph id="id3b2622303d4c45189546ad9c673ddc00"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section id="idffdc0c5759ed473a84f4b14053b83d78"><enum>3.</enum><header>Operational Flexibility Grazing Management Program</header><subsection id="idd1156925610a4e568b68c52feb3a607d"><enum>(a)</enum><header>In general</header><text>The Secretary may carry out a grazing management program on Federal land, to be known as the <quote>Operational Flexibility Grazing Management Program</quote>, in accordance with applicable law (including regulations) and the memorandum entitled <quote>Bureau of Land Management Instruction Memorandum 2018–109</quote> (as in effect on September 30, 2021), to provide to authorized grazing permittees and lessees increased operational flexibility to improve the long-term ecological health of the Federal land.</text></subsection><subsection id="id6c29377ba39b4a36863a9dfc43a7c927"><enum>(b)</enum><header>Flexible grazing use alternative for a grazing permit or lease</header><paragraph id="idd0be1a8ed454472bbc247d54b35b430a"><enum>(1)</enum><header>In general</header><text>At the request of an authorized grazing permittee or lessee, for purposes of renewing a grazing permit or lease under the program, pursuant to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Secretary shall develop and authorize at least 1 alternative to provide operational flexibility in livestock grazing use to account for changing conditions. </text></paragraph><paragraph id="id6d3fcb3708244e73bc3a7dfd06607077"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall develop alternatives under paragraph (1) in consultation with—</text><subparagraph id="iddd35aa71f9c64d9cb7be625c9a98ccbf"><enum>(A)</enum><text>the authorized grazing permittee or lessee;</text></subparagraph><subparagraph id="id22c9a1520b134c2682d1bfaf0f9c5874"><enum>(B)</enum><text>affected Federal and State agencies;</text></subparagraph><subparagraph id="id948f945c64564367865e952ffb89cc34"><enum>(C)</enum><text>applicable Indian Tribes; and</text></subparagraph><subparagraph id="id19e584debec54b598aa3d20bfb64b075"><enum>(D)</enum><text>other landowners, permittees, or lessees in the affected allotment. </text></subparagraph></paragraph></subsection><subsection id="idc1a488a92ce14a269919718d9021b44f"><enum>(c)</enum><header>Implementation of interim operational flexibilities</header><text>At the request of an authorized grazing permittee or lessee, the Secretary shall, using new and existing data, allow a variance to the terms and conditions of the existing applicable grazing permit or lease for a period not to exceed the remaining term of the grazing permit or lease to address significant changes in weather, forage production, effects of fire, drought, market conditions, or other temporary conditions—</text><paragraph id="id2dd9c9b8c136450fa4df8fb9727e8d3c"><enum>(1)</enum><text>by adjusting the season of use, the beginning date of the period of use, the ending date of the period of use, or both the beginning date and ending date, the stocking level, water placement and transportation, and other necessary operational flexibilities, as applicable, under the grazing permit or lease, subject to the requirements that—</text><subparagraph id="idb31c37d672f140db85efdcaf1a6eba28"><enum>(A)</enum><text>unless otherwise specified in the appropriate allotment management plan or any other activity plan that is the functional equivalent to the appropriate allotment management plan under section 4120.2(a)(3) of title 43, Code of Federal Regulations (or a successor regulation), the applicable adjusted date of the season of use occurs—</text><clause id="id6e4a33002e6440abab3a61c3946a805c"><enum>(i)</enum><text>not earlier than 14 days before the beginning date specified in the applicable grazing permit or lease; and</text></clause><clause id="id36be29b0b1b547bfb709eb6896bbc662"><enum>(ii)</enum><text>not later than 14 days after the ending date specified in the applicable grazing permit or lease; and</text></clause></subparagraph><subparagraph id="id3ec73de20e514891beab1a800c717f2a"><enum>(B)</enum><text>the authorized grazing permittee or lessee provides notice of the adjustment to the Bureau not later than 2 business days before the date of adjustment; and</text></subparagraph></paragraph><paragraph id="id17f7a58f3fec4e31b2844d777c24d2f2"><enum>(2)</enum><text>by authorizing the immediate implementation and adoption of operational flexibilities in cases in which operational flexibilities are necessary to achieve ecological health, avoid immediate ecological degradation of the allotment or allotment area, or respond to an emerging management need.</text></paragraph></subsection><subsection id="id73f1d0dcbec74fc198aec6d2f3e3e268"><enum>(d)</enum><header>Monitoring plans</header><text>To monitor and evaluate outcomes from the use of operational flexibilities under the program, the Secretary, in coordination with grazing permittees and lessees, shall use—</text><paragraph commented="no" display-inline="no-display-inline" id="id1b6fc709565a49718ed7aa2e50791245"><enum>(1)</enum><text display-inline="yes-display-inline">cooperative rangeland monitoring plans that comply with any applicable monitoring requirements under the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) and any applicable Federal grazing regulations; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67faf48484dc4f94b78267189af02842"><enum>(2)</enum><text display-inline="yes-display-inline">rangeland health objectives.</text></paragraph></subsection><subsection id="id4b46e40f344d42fe99f40791bc32312b"><enum>(e)</enum><header>Reporting requirements; review</header><paragraph commented="no" display-inline="no-display-inline" id="idfaf5f7c241bc42ecb3bcfa82af1d5219"><enum>(1)</enum><header>Reporting requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="id2173343e7085402da769baecad2c5d37"><enum>(A)</enum><header display-inline="yes-display-inline">Annual reports</header><clause commented="no" display-inline="no-display-inline" id="id267a37a981dd4b769f17199205dfb188"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Annually, program staff shall submit to the Secretary a report on the program.</text></clause><clause commented="no" display-inline="no-display-inline" id="id21f77191a8ee4272b613e0c0be06fee3"><enum>(ii)</enum><header>Failure to submit</header><text display-inline="yes-display-inline">The failure of program staff to submit an annual report required under clause (i) shall not affect the ability of authorized grazing permittees or lessees to participate in the program.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2d42a0bada4040ea9471444ac813b5df"><enum>(B)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text>Not later than 3 years after the date of enactment of this Act and every 3 years thereafter, the Secretary shall submit to the appropriate committees of Congress a report that describes the use of operational flexibilities under the program and any associated information relating to ecological outcomes and land health standards under the program.</text></subparagraph></paragraph><paragraph id="idabe78d14a38640e3baff8708c2f51d49"><enum>(2)</enum><header>Review</header><subparagraph commented="no" display-inline="no-display-inline" id="id36b067b901a54a8bb01c5386d5b9c3e5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), not earlier than the date that is 8 years after the date of enactment of this Act, the Secretary shall conduct a review of the use of operational flexibilities under the program, including a review of ecological outcomes and other relevant outcomes under the program.</text></subparagraph><subparagraph id="id6cd1a6010ca746558b4cb05301d101b6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>No effect on grazing authorizations or use</header><text>The review of the program under subparagraph (A) shall not affect the existence, renewal, or termination of a grazing permit or lease entered into under the program. </text></subparagraph></paragraph></subsection><subsection id="id223c373b203d4677be1b56741d258eb1"><enum>(f)</enum><header>No effect on grazing preference or activities</header><text>Nothing in this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id8e807dcce9b544aa9042b1422c12b3c7"><enum>(1)</enum><text display-inline="yes-display-inline">affects grazing preferences or authorizations provided under the Act of June 28, 1934 (commonly known as the <quote>Taylor Grazing Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/43/315">43 U.S.C. 315 et seq.</external-xref>), the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>), or any other applicable Federal law;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf720793c0e84c0592c5ba19b62d8b7e"><enum>(2)</enum><text display-inline="yes-display-inline">requires grazing permittees or lessees to pursue operational flexibilities during the renewal, extension, or authorization of a new grazing permit or lease;</text></paragraph><paragraph id="id7d3b40a11e864452baf489bc632a39fd"><enum>(3)</enum><text>requires the Secretary to consider modifying or terminating any grazing activity, authorization, or use; or</text></paragraph><paragraph id="id2232529d2ed345b0b6ce31788e68397b"><enum>(4)</enum><text>precludes the Secretary from modifying or terminating an existing grazing permit or lease in accordance with applicable law (including regulations).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id637009d249184844b8981b2534c5aed0"><enum>(g)</enum><header>No termination of grazing permit or lease for use of operational flexibilities</header><text>The Secretary may not terminate or fail to renew an applicable grazing permit or lease for a violation of the applicable grazing permit or lease that is due to the use of an operational flexibility under the program.</text></subsection></section></legis-body></bill>
