which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to provide education assistance to public safety officers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Educational and Career Opportunities for Public Safety Act of 2024</short-title></quote> or the <quote><short-title>EdCOPS Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb7121ab9cfab492a853b1787024c65ee"><enum>2.</enum><header>Public safety officer education assistance program</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idFE32312DBCBF42D7AC92257122E9F58D"><part id="idd28b21569b114be6802787a0921784be" style="OLC"><enum>PP<?LEXA-Enum PP?></enum><header>Public safety officer education assistance program</header><section id="ID47E2C12C0CBC4EE88EADF2196F975C16"><enum>3061.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this part is to improve recruitment and retention of public safety officers employed by State, local, tribal, and regional law enforcement agencies by providing assistance for the pursuit of a program of higher education.</text></section><section id="id7c2c34a426ea46769b172bd35cb12c9b"><enum>3062.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="ided25b1d051254d389f82abbc5e46eed8"><enum>(1)</enum><header>Child</header><text>The term <term>child</term> means a natural, illegitimate, or adopted child or stepchild of an eligible public safety officer. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7556894a36964240a5fe4b40f83a3098"><enum>(2)</enum><header>Educational institution; program of education</header><text>The terms <term>educational institution</term> and <term>program of education</term> have the meanings given the terms in section 1217.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66052a62fd9a47b79f2b05d3fe79e505"><enum>(3)</enum><header>Eligible public safety officer</header><text>The term <term>eligible public safety officer</term> means a public safety officer that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id584830ec58f74e80b98a2dfb63110068"><enum>(A)</enum><text display-inline="yes-display-inline">has served as a public safety officer for not less than 8 years for a single employer prior to the date of submission of an application under section 3064; and</text></subparagraph><subparagraph id="id5a7d636f03b74ef388e406688664e363"><enum>(B)</enum><text>commits to serving as a public safety officer with the employer described in subparagraph (A) during the 4-year period following the date of submission of an application under section 3064.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41113f9baa5b4f09899ae486c817ce1c"><enum>(4)</enum><header display-inline="yes-display-inline">Public safety officer</header><text>The term <term>public safety officer</term> has the meaning given the term in section 1204. </text></paragraph></section><section id="ID487E73819127402A9EABA04B82C26007"><enum>3063.</enum><header>Basic eligibility</header><subsection id="ID4BE5CB5EBE6C48859FE0AF4A88CF90EB"><enum>(a)</enum><header>Benefits</header><paragraph commented="no" display-inline="no-display-inline" id="ida05f0cd3cddb45228a54d9f825a90ec5"><enum>(1)</enum><header>In general</header><text>The Attorney General shall provide financial assistance to a person who attends a program of education and is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id940b55bf3b82492fa63f76f16f973730"><enum>(A)</enum><text>an eligible public safety officer; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7d68d6306ce419e9dcf45688ecce723"><enum>(B)</enum><text>a child of an eligible public safety officer to whom an eligible public safety officer transfers eligibility for financial assistance in accordance with paragraph (4)(A).</text></subparagraph></paragraph><paragraph id="id242670cecd5b4e659593747847ab0ddf"><enum>(2)</enum><header>Form and amount</header><text>Except as provided in paragraph (3), financial assistance under this part shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd4e855930f254ef287ea70b885252f41"><enum>(A)</enum><text display-inline="yes-display-inline">consist of direct payments to a person described in paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41935db78b154f89bc9601f8f5a9de2d"><enum>(B)</enum><text display-inline="yes-display-inline">be computed on the basis set forth in section 3532 of title 38, United States Code.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6a52c27fbcc4284bb129e6379f37a24"><enum>(3)</enum><header>Reduction</header><text>The financial assistance referred to in paragraph (2) shall be reduced by the amount, if any, determined under section 3065(b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide14065dd42034f758639c6593f5de4b1"><enum>(4)</enum><header>Transfer of assistance</header><subparagraph commented="no" display-inline="no-display-inline" id="idc4c6106bc07f408aa5cb60a9af23efae"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible public safety officer may elect to transfer eligibility for part or all of the financial assistance for which the eligible public safety officer is eligible under this part to an individual described in paragraph (1)(B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4a099cf7c374a80b3423843b2f74629"><enum>(B)</enum><header>Approval</header><text>An eligible public safety officer shall approve the receipt of financial assistance under this part by a person who is not the eligible public safety officer.</text></subparagraph></paragraph></subsection><subsection id="IDEF8BA54C5F424087BB631B6ABCC55FDD"><enum>(b)</enum><header>Duration of benefits</header><text>The Attorney General may not provide financial assistance under this part to a person for a period in excess of 45 months of full-time education or training or a proportional period of time for a part-time program.</text></subsection><subsection id="ID104FB44A85974C14BE50C99F7F955CD0"><enum>(c)</enum><header>Age limitation for children</header><text>The Attorney General may not provide financial assistance under this part to a child of an eligible public safety officer after the date of the 27th birthday of the child.</text></subsection></section><section id="ID18CF5126B1184457A4A8606717FF1EFC"><enum>3064.</enum><header>Applications; approval</header><subsection id="IDD503B366EFA14E5BB8F75DD45DFA9BDA"><enum>(a)</enum><header>Application</header><text>A person seeking assistance under this part shall submit to the Attorney General an application in such form and containing such information as the Attorney General reasonably may require.</text></subsection><subsection id="IDA660E6591A2E4515B65BC6310D48B871"><enum>(b)</enum><header>Approval</header><text>The Attorney General shall approve an application for assistance under this part unless the Attorney General finds that—</text><paragraph id="ID4DB2375C4AFD46AD86D2499F4D47BA9C"><enum>(1)</enum><text>the person is not eligible for, is no longer eligible for, or is not entitled to the assistance for which application is made;</text></paragraph><paragraph id="ID61199A0A909E421C837B0700F7D07124" commented="no"><enum>(2)</enum><text>the person's selected educational institution fails to meet a requirement established in a regulation implementing this part for eligibility;</text></paragraph><paragraph id="IDCECECD0AAEB44FEF97635BE547D69F3C" commented="no"><enum>(3)</enum><text>the person's enrollment in or pursuit of the educational program selected would fail to meet the criteria in a regulation implementing this part for programs; or</text></paragraph><paragraph id="ID2D957EED3CB84AE5B916FB2DFC8E2F7E"><enum>(4)</enum><text>the person already is qualified by previous education or training for the educational, professional, or vocational objective for which the educational program is offered.</text></paragraph></subsection><subsection id="ID75C78A615102498B85D5BF4B66C2FAF3"><enum>(c)</enum><header>Notification</header><text>The Attorney General shall notify a person applying for assistance under this part of approval or disapproval of the application in writing.</text></subsection></section><section id="IDB662FE8FBE2F4CD2BF73EC05D6FB648E"><enum>3065.</enum><header>Regulations</header><subsection id="IDF7142FEBEF0E499F91669DC6EAA3CB94"><enum>(a)</enum><header>In general</header><text>The Attorney General may promulgate reasonable and necessary regulations to implement this part.</text></subsection><subsection id="IDE2F3C4E0D4A84C67AEC8FEBFA6186C39"><enum>(b)</enum><header>Sliding scale</header><text>Notwithstanding section 3064(b), the Attorney General shall issue regulations regarding the use of a sliding scale based on financial need to ensure that a person eligible to receive financial assistance under this part who is in financial need receives priority in receiving funds under this part.</text></subsection></section><section id="ID479DF15F983F4A42A4DB0BADFAEB4914"><enum>3066.</enum><header>Discontinuation for unsatisfactory conduct or progress</header><text display-inline="no-display-inline">The Attorney General may discontinue assistance under this part to a person if the Attorney General finds that, according to the regularly prescribed standards and practices of an educational institution attended by the person, the person fails to maintain satisfactory progress as described in section 484(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(c)</external-xref>).</text></section><section id="ID1825C4F3059C49EEA754C7BFF0830304"><enum>3067.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this part such sums as may be necessary.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
