which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve connections between the Department of Agriculture and national and homeland security agencies, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agriculture and National Security Act of 2024</short-title></quote>.</text></section><section id="idfa56621493c94cc892daa6cb748fad99"><enum>2.</enum><header>Sense of Congress relating to agriculture and national security</header><text display-inline="no-display-inline">It is the sense of Congress that there are increasingly robust Federal activities to address homeland security vulnerabilities across the food and agriculture sector, including with regard to agriculture and food defense, critical infrastructure, emergency management, and catastrophic events, but additional efforts are needed to identify national security vulnerabilities related to food and agriculture, particularly with regard to emerging technologies.</text></section><section id="id036bf2d0a71346c29bd0fc814c51731f"><enum>3.</enum><header>National security</header><subsection id="id680cf91038a64d478198192c5a5d4288"><enum>(a)</enum><header>In general</header><text>In recognition that food and agriculture are critical to the national security of the United States, the Secretary of Agriculture (referred to in this Act as the <quote>Secretary</quote>) shall prioritize national security in addition to homeland security in the Department of Agriculture (referred to in this Act as the <quote>Department</quote>), including by increasing the number of staff at the Department with security clearances and access to classified systems and networks.</text></subsection><subsection id="iddafb33d802b4490ea370a8ddc3ee65ec"><enum>(b)</enum><header>Senior Advisor for National Security</header><paragraph id="id710e783e68834c80b25dcac780fb88a2"><enum>(1)</enum><header>Appointment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall—</text><subparagraph id="idcaf3dbe11a9e40e58860a3fb8c808ddb"><enum>(A)</enum><text>establish within the Office of the Secretary the position of Senior Advisor for National Security (referred to in this Act as the <quote>Senior Advisor</quote>); and</text></subparagraph><subparagraph id="ida2151f20eae7451d8b7a1426e1485c40"><enum>(B)</enum><text>appoint an individual to the position of Senior Advisor.</text></subparagraph></paragraph><paragraph id="id7b869d11d2314b68bdcccc0961ea6e2f"><enum>(2)</enum><header>Duties</header><text>The Senior Advisor shall, in coordination with and complementary to the duties of the Office of Homeland Security of the Department—</text><subparagraph id="id7256adf480f8417a914a089351e0f52a"><enum>(A)</enum><text>serve as the principal advisor to the Secretary on national security;</text></subparagraph><subparagraph id="id18a08d57c0db4e51afa6c23259280467"><enum>(B)</enum><text>act as the primary liaison on behalf of the Department with the National Security Council and other Federal departments and agencies in activities relating to national security;</text></subparagraph><subparagraph id="idf8048597f9ea4ac6a8c02ade4433baa7"><enum>(C)</enum><text>coordinate national security activities across the Department, including to ensure that national security concerns are integrated into the homeland security activities of the Department wherever appropriate; and</text></subparagraph><subparagraph id="id1e427108f4cc4d5f8f28f21e875f4c86"><enum>(D)</enum><text>communicate with stakeholders to identify national security vulnerabilities and risk mitigation strategies relevant to food and agriculture.</text></subparagraph></paragraph></subsection><subsection id="id176772d1a4ef42c2a0c8edad903206c7"><enum>(c)</enum><header>Interagency coordination</header><text>Section 221(e) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id268f716eff964925bd41b64d9f153f20"><paragraph id="id0ad4a6b08cb54c03ac74112b29ed77d3"><enum>(3)</enum><header>Detailees authorized</header><text>The Secretary may provide detailees to, and accept and employ personnel detailed from, defense, national and homeland security, law enforcement, and intelligence agencies, with or without reimbursement, to improve information sharing, vulnerability identification, and risk mitigation related to food and agriculture.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id2d06208787fa48e29f94dc2826ac48ea"><enum>(d)</enum><header>Biennial reports</header><text>Section 221 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA171AD2E9488421AA0FAD02BDE3A44F6"><subsection id="iddbe86b3da1454ec38fca3c29d3a19fcc"><enum>(f)</enum><header>Biennial reports</header><text>Not later than 180 days after the date of enactment of this Act, and not less frequently than once every 2 years thereafter, the Secretary shall submit to Congress and the National Security Council a report that includes—</text><paragraph id="idb5784ce3f9ac4fcdb269419f1cd23b2a"><enum>(1)</enum><text>from the perspective of the Department, an assessment of any gaps or limitations in national security efforts related to food and agriculture in the United States, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id84EC6688AB054FCC97572D42F8FD8810"><enum>(A)</enum><text display-inline="yes-display-inline">influence of foreign state-owned enterprise; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9603F189C53A4F4C8837C82C729751FE"><enum>(B)</enum><text display-inline="yes-display-inline">control of and access to agricultural data; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7F59A43CEAE94F619175DDA196ECB6F5"><enum>(C)</enum><text display-inline="yes-display-inline">foreign acquisition of intellectual property, agricultural assets, and land; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F808471CDCC43BD8718401CBF3F29B3"><enum>(D)</enum><text display-inline="yes-display-inline">agricultural input shortages and dependence on foreign-sourced inputs; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65DBBE01EB484710A43E1EA3F6528F65"><enum>(E)</enum><text display-inline="yes-display-inline">supply chain and trade disruptions; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D1989B30C41452BBD2CA1BC6EA0E406"><enum>(F)</enum><text display-inline="yes-display-inline">science and technology cooperation; </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id09132A8BCB374FEBBAB4DED386B1F100"><enum>(G)</enum><text>cybersecurity and artificial intelligence;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81947CB5291C4C18A25F4FAB2EC5EEBC"><enum>(H)</enum><text display-inline="yes-display-inline">unequal investments in research, development, and scale-up; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id467FE76923A54F2F97A23A32E316977B"><enum>(I)</enum><text display-inline="yes-display-inline">incongruent regulatory policies; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id039E6E76CAEB4CCD819CE4E3386F4101"><enum>(J)</enum><text display-inline="yes-display-inline">other vulnerabilities throughout the food and agriculture sector, particularly with regard to emerging technologies;</text></subparagraph></paragraph><paragraph id="id19a474b6042c411c92d3a404000d2121"><enum>(2)</enum><text>the actions taken by the Secretary to address any gaps or limitations identified under paragraph (1), including through interagency coordination, threat information sharing, and stakeholder outreach;</text></paragraph><paragraph id="id9c752d60f1d84a2387c72de3fc398e5e"><enum>(3)</enum><text>policy recommendations, including recommendations for executive actions and legislative proposals—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf77163bc93ef4918a40f3c6902a4f6f7"><enum>(A)</enum><text display-inline="yes-display-inline">to reduce any gaps or limitations identified under paragraph (1); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7b6cde64487416d93f426041bfa4943"><enum>(B)</enum><text display-inline="yes-display-inline">to address any identified vulnerabilities with respect to the gaps or limitations identified under paragraph (1); and</text></subparagraph></paragraph><paragraph id="id76cc59da21f54b1b872eca2a8787c90e"><enum>(4)</enum><text>resources the Department requires to address current and future national security vulnerabilities related to food and agriculture. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
