which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Radiation Exposure Compensation Act to revise the definition of <quote>affected area</quote> and extend the period in which compensation may be provided, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Downwinders Act</short-title></quote>.</text></section><section id="id326124D3F40D42E99D0450F3AEE251FA"><enum>2.</enum><header>Amendments to the Radiation Exposure Compensation Act</header><subsection id="id9B82614384CD495981A261C3059ADC92"><enum>(a)</enum><header>Affected areas</header><text>Section 4 of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><paragraph id="id2B9CABEE3DC345489573D42498132260"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idA2EEF4C0E4924DBC8D188775BF058C28"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id8433367DB4D34497B95B867F90E1E2EF"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="idEB0C6FDAFAE041668C15117A7B5CBD7C"><enum>(I)</enum><text>in clause (i)—</text><item id="idC44838DCC05B4822AF98AED2118AF2EB"><enum>(aa)</enum><text>in subclause (II), by striking <quote>; or</quote> and inserting a semicolon;</text></item><item id="id6B1C1C55D2DF430897C0F305F535B33E"><enum>(bb)</enum><text>by redesignating subclause (III) as subclause (IV); and</text></item><item id="id88642DB88F0945AA8C2159799623E547"><enum>(cc)</enum><text>by inserting after subclause (II) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCE5D525E24C140DAB81F1A81ED4F5E89"><subclause id="id30DD04DF18FD41089C939BB09957591D"><enum>(III)</enum><text>was physically present in the affected area described in subsection (b)(1)(D) for the period beginning on July 16, 1945, and ending on August 16, 1945; or</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause id="idC20E8BACD54F47E1BCC0854C429FD880"><enum>(II)</enum><text>in clause (ii)(I), by striking <quote>physical presence described in subclause (I) or (II) of clause (i) or onsite participation described in clause (i)(III)</quote> and inserting <quote>physical presence described in subclause (I), (II), or (III) of clause (i) or onsite participation described in clause (i)(IV)</quote>; and</text></subclause></clause><clause id="id4767C59BD87E4159AB705FF59E233529"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause commented="no" id="id1684E7C6DAE042DAAFD3926346D1D5F6"><enum>(I)</enum><text> in clause (i), by striking <quote>subclause (I) or (II) of subparagraph (A)(i)</quote> and inserting <quote>subclause (I), (II), or (III) of subparagraph (A)(i)</quote>; and</text></subclause><subclause commented="no" id="id6BE4DDCAFA8C45548449E28D5407AB19"><enum>(II)</enum><text>in clause (ii), by striking <quote>subclause (III)</quote> and inserting <quote>subclause (IV)</quote>;</text></subclause></clause></subparagraph><subparagraph id="id72A6B8562F7442939F36E72E359B7B40"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id3D8FE2B742DC487D84F123C06295141C"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>, or</quote> and inserting a comma;</text></clause><clause id="id28ED155BDD1D4645A01E0B7A0BF57B13"><enum>(ii)</enum><text>by redesignating subparagraph (C) as subparagraph (D); </text></clause><clause id="id4A45D969B88B487287BB6536E5871899"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96FE0A55C011473DAD072BD8F0884ED9"><subparagraph id="id51F390B0DA174E1A9799DF630119054C"><enum>(C)</enum><text>was physically present in the affected area described in subsection (b)(1)(D) for the period beginning on July 16, 1945, and ending on August 16, 1945, or</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id8022AFEC84D34572AFFFA5202CEC8605"><enum>(iv)</enum><text>in the matter following subparagraph (D), as so redesignated, by striking <quote>subparagraph (A) or (B)</quote> and all that follows through <quote>subparagraph (C)</quote> and inserting <quote>subparagraph (A), (B), or (C)) or $75,000 (in the case of an individual described in subparagraph (D)</quote>; </text></clause></subparagraph></paragraph><paragraph id="id4077B22EF7AC43AA9F67C030756C655C"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="idE42544CD76A943E7B2854C3BAE44CBDA"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>in the State</quote> and all that follows through <quote>Piute</quote> and inserting <quote>the State of Utah</quote>;</text></subparagraph><subparagraph id="id1CDDD5FF6215465EB5BAF9BAA96B6047"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="id45460C28E8924F8B9AC9292BFAB62C84"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEE966518A7BA4B3C90A10EFE86F7F73B"><subparagraph id="idAD9A77DA66824A3E92228A9DFCBC941D"><enum>(D)</enum><text>with respect to a claim by an individual under subsection (a)(1)(A)(i)(III) or subsection (a)(2)(C), only the counties of Bernalillo, Chaves, Guadalupe, Lincoln, Sandoval, San Miguel, Santa Fe, Socorro, Torrance, and Valencia in the State of New Mexico; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id7055AFE71420442F92DB28AF094A2731"><enum>(b)</enum><header>Extension of period of compensation</header><paragraph id="id1D154FE0E33D46CE8B65C0B06556A4F8"><enum>(1)</enum><header>Termination of fund</header><text>Section 3(d) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><subparagraph id="id2272469392C64047B2A802ABF29DF91F"><enum>(A)</enum><text>in the first sentence, by striking <quote>2 years after the date of enactment of the RECA Extension Act of 2022</quote> and inserting <quote>8 years after the date of enactment of the <short-title>Downwinders Act</short-title></quote>; and</text></subparagraph><subparagraph id="idAF54CFD5393D422CAA2C9CFD945761ED"><enum>(B)</enum><text>in the second sentence, by striking <quote>2-year period</quote> and inserting <quote>8-year period</quote>. </text></subparagraph></paragraph><paragraph id="id1DE8CA1F1F5D43E2B66545208DB379DF"><enum>(2)</enum><header>Eligibility</header><text>Section 8(a) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended by striking <quote>2 years after the date of enactment of the RECA Extension Act of 2022</quote> and inserting <quote>8 years after the date of enactment of the <short-title>Downwinders Act</short-title></quote>.</text></paragraph></subsection><subsection id="id5305F1E3817E4B6295C73A97C7C23EE4"><enum>(c)</enum><header>Claims relating to Manhattan Project Waste</header><text display-inline="yes-display-inline">The Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended by inserting after section 5 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id99497FF73DB84A2DBDBBC06E5EE53787"><section id="id97c426f294824ffd9973aef8a6557945"><enum>5A.</enum><header>Claims relating to manhattan project waste</header><subsection id="id021e11a42d6d49b3a9658763c1378d5f"><enum>(a)</enum><header>In general</header><text>A claimant shall receive compensation for a claim made under this Act, as described in subsection (b) or (c), if—</text><paragraph id="ide5ae7855143a4bfdb831778f92627580"><enum>(1)</enum><text>a claim for compensation is filed with the Attorney General—</text><subparagraph id="id483fba2e331241019ce76026033c4a98"><enum>(A)</enum><text>by an individual described in paragraph (2); or</text></subparagraph><subparagraph id="idb14cd0e45ba44b19b29b699bb7d39830"><enum>(B)</enum><text>on behalf of that individual by an authorized agent of that individual, if the individual is deceased or incapacitated, such as—</text><clause id="id575990d7448449d5a2c96e0a5a671ce3"><enum>(i)</enum><text>an executor of estate of that individual; or</text></clause><clause id="ida2735503cbdf42a9ae0b1cf11c7c62a0"><enum>(ii)</enum><text>a legal guardian or conservator of that individual;</text></clause></subparagraph></paragraph><paragraph id="id9a6c379b3f724aa3bc51961460e75170"><enum>(2)</enum><text>that individual, or if applicable, an authorized agent of that individual, demonstrates that the individual—</text><subparagraph id="id41c6b6d8c7204779b48e5ee5b4650f3c"><enum>(A)</enum><text>was physically present in an affected area for a period of at least 2 years after January 1, 1949; and</text></subparagraph><subparagraph id="idfecfea38c9ca4adfb248aecc5cc4b37f"><enum>(B)</enum><text>contracted a specified disease after such period of physical presence;</text></subparagraph></paragraph><paragraph id="id3bdbf6fb63344834a9fa3e87b621dd8b"><enum>(3)</enum><text>the Attorney General certifies that the identity of that individual, and if applicable, the authorized agent of that individual, is not fraudulent or otherwise misrepresented; and</text></paragraph><paragraph id="id1914cd31bdf24d13bd6dde34a8450fc9"><enum>(4)</enum><text>the Attorney General determines that the claimant has satisfied the applicable requirements of this Act.</text></paragraph></subsection><subsection id="id138ec42c096242f5a1c1486ec27a40a9"><enum>(b)</enum><header>Losses available to living affected individuals</header><paragraph id="idc40fedbfded1449d922f75f55084347f"><enum>(1)</enum><header>In general</header><text>In the event of a claim qualifying for compensation under subsection (a) that is submitted to the Attorney General to be eligible for compensation under this section at a time when the individual described in subsection (a)(2) is living, the amount of compensation under this section shall be in an amount that is the greater of $50,000 or the total amount of compensation for which the individual is eligible under paragraph (2).</text></paragraph><paragraph id="id0a80257536d64c05ad88886ee20419ee"><enum>(2)</enum><header>Losses due to medical expenses</header><text>A claimant described in paragraph (1) shall be eligible to receive, upon submission of contemporaneous written medical records, reports, or billing statements created by or at the direction of a licensed medical professional who provided contemporaneous medical care to the claimant, additional compensation in the amount of all documented out-of-pocket medical expenses incurred as a result of the specified disease suffered by that claimant, such as any medical expenses not covered, paid for, or reimbursed through—</text><subparagraph id="idf9be7d94f643485099336f721204c63a"><enum>(A)</enum><text>any public or private health insurance;</text></subparagraph><subparagraph id="id9fe813f787994d9dbb52a315f9306d72"><enum>(B)</enum><text>any employee health insurance;</text></subparagraph><subparagraph id="id5b88e360d6c64ff0b3ad5137c60fa531"><enum>(C)</enum><text>any workers’ compensation program; or</text></subparagraph><subparagraph id="ida6fd45f1abfe4143815f13f6119bf0cc"><enum>(D)</enum><text>any other public, private, or employee health program or benefit.</text></subparagraph></paragraph></subsection><subsection id="idbc7d67c2c2d849c6bbeba84b46c07944"><enum>(c)</enum><header>Payments to beneficiaries of deceased individuals</header><text>In the event that an individual described in subsection (a)(2) who qualifies for compensation under subsection (a) is deceased at the time of submission of the claim—</text><paragraph id="id9f7395d4b3b147f686c368535ade8c22"><enum>(1)</enum><text>a surviving spouse may, upon submission of a claim and records sufficient to satisfy the requirements of subsection (a) with respect to the deceased individual, receive compensation in the amount of $25,000; or</text></paragraph><paragraph id="ide945922b697d4552b755a8b2c664325f"><enum>(2)</enum><text>in the event that there is no surviving spouse, the surviving children, minor or otherwise, of the deceased individual may, upon submission of a claim and records sufficient to satisfy the requirements of subsection (a) with respect to the deceased individual, receive compensation in the total amount of $25,000, paid in equal shares to each surviving child.</text></paragraph></subsection><subsection id="id0b4f9b25da474e0d9d02d27eaff7b51d"><enum>(d)</enum><header>Affected area</header><text>For purposes of this section, the term <term>affected area</term> means the ZIP Codes in the State of Missouri of 63031, 63033, 63034, 63042, 63045, 63074, 63114, 63135, 63138, 63044, 63121, 63140, 63145, 63147, 63102, 63304, 63134, 63043, 63341, 63368, and 63367.</text></subsection><subsection id="id030249a74f384ad1ad7fd15f3489b00a"><enum>(e)</enum><header>Specified disease</header><text>For purposes of this section, the term <term>specified disease</term> means any of the following:</text><paragraph id="id6ffaff8f97ff4feaa71586dee3a2dc5d"><enum>(1)</enum><text>Any leukemia, other than chronic lymphocytic leukemia, provided that the initial exposure occurred after the age of 20 and the onset of the disease was at least 2 years after first exposure.</text></paragraph><paragraph id="idc1b02352dc814a159bb8a2524a67e626"><enum>(2)</enum><text>Any of the following diseases, provided that the onset was at least 2 years after the initial exposure:</text><subparagraph id="id185655e0ea9b4b11a7667479dfce2601"><enum>(A)</enum><text>Multiple myeloma.</text></subparagraph><subparagraph id="id99b2a9d2e37748088b82099a591efe7d"><enum>(B)</enum><text>Lymphoma, other than Hodgkin’s disease.</text></subparagraph><subparagraph id="id9fb66c5644c1490bab3778a11c71bdb0"><enum>(C)</enum><text>Primary cancer of the—</text><clause id="id24f37af8b1c044a1abf290f752616acb"><enum>(i)</enum><text>thyroid;</text></clause><clause id="idd68fba046701438ca635be9b98d0e34e"><enum>(ii)</enum><text>male or female breast;</text></clause><clause id="id349b261b599740699aa440aefa6be575"><enum>(iii)</enum><text>esophagus;</text></clause><clause id="ide2c01c71b8ce4498966e143e518fc581"><enum>(iv)</enum><text>stomach;</text></clause><clause id="idd289fc2335fa4243b3a6123e505a1303"><enum>(v)</enum><text>pharynx;</text></clause><clause id="id0a242583dca14c61b3e63a949d1387c0"><enum>(vi)</enum><text>small intestine;</text></clause><clause id="ideabb007e940b455b86ff04b2e1f7779f"><enum>(vii)</enum><text>pancreas;</text></clause><clause id="idec58550414d043d0b18ea638b9d94f55"><enum>(viii)</enum><text>bile ducts;</text></clause><clause id="idea025a90f92c475d8d4dfd60d6148176"><enum>(ix)</enum><text>gall bladder;</text></clause><clause id="idbe5b9569339a45cf8a30341dd303409b"><enum>(x)</enum><text>salivary gland;</text></clause><clause id="id9c24d03918e047f4af84a5c74f338335"><enum>(xi)</enum><text>urinary bladder;</text></clause><clause id="idf70931a69b454aec876d83428f3d102e"><enum>(xii)</enum><text>brain;</text></clause><clause id="id07ec3baccf524a70beda99a6233084a5"><enum>(xiii)</enum><text>colon;</text></clause><clause id="id5d2642aa8b994deca2c10e0651c2edae"><enum>(xiv)</enum><text>ovary;</text></clause><clause id="id7c787f9fd82f4a118fe9c1342ef1f752"><enum>(xv)</enum><text>bone;</text></clause><clause id="idf808623266404a598a17378840880a8b"><enum>(xvi)</enum><text>renal;</text></clause><clause id="id4dea057b857841efaa68f2e086b2d26b"><enum>(xvii)</enum><text>liver, except if cirrhosis or hepatitis B is indicated; or</text></clause><clause id="id85fc88f097814484a5cf6435c9cbfa8c"><enum>(xviii)</enum><text>lung.</text></clause></subparagraph></paragraph></subsection><subsection id="idca133e20cf4e4141863b14a27e7848a4"><enum>(f)</enum><header>Physical presence</header><paragraph id="idcc5ec72e86544e20a2957ef10e6d971d"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the Attorney General shall not determine that a claimant has satisfied the requirements of subsection (a) unless demonstrated by submission of—</text><subparagraph id="id4237adfa44964178aae12572f10d7080"><enum>(A)</enum><text>contemporaneous written residential documentation and at least 1 additional employer-issued or government-issued document or record that the claimant, for at least 2 years after January 1, 1949, was physically present in an affected area; or</text></subparagraph><subparagraph id="id9fbd3fe594ec461fb87c8007d5c44af1"><enum>(B)</enum><text>other documentation determined by the Attorney General to demonstrate that the claimant, for at least 2 years after January 1, 1949, was physically present in an affected area.</text></subparagraph></paragraph><paragraph id="idec9204f8b09349b88666c3d9c581920a"><enum>(2)</enum><header>Types of physical presence</header><text>For purposes of determining physical presence under this section, a claimant shall be considered to have been physically present in an affected area if—</text><subparagraph id="idcc7ef62d9ffe486a9c8625623f11daaf"><enum>(A)</enum><text>the claimant’s primary residence was in the affected area;</text></subparagraph><subparagraph id="idbe4013d7c79f48798fffccfecd507686"><enum>(B)</enum><text>the claimant’s place of employment was in the affected area; or</text></subparagraph><subparagraph id="id9d43a444a2394d1182cdb7337ccb3b2c"><enum>(C)</enum><text>the claimant attended school in the affected area.</text></subparagraph></paragraph></subsection><subsection id="id8e4e7284e0c049f18a33ec28a826c162"><enum>(g)</enum><header>Disease contraction in affected areas</header><text>For purposes of this section, the Attorney General shall not determine that a claimant has satisfied the requirements of subsection (a) unless the claimant submits—</text><paragraph id="id27b367347c8c4c9aa55fdc6953856709"><enum>(1)</enum><text>written medical records or reports created by or at the direction of a licensed medical professional, created contemporaneously with the provision of medical care to the claimant, that the claimant, after a period of physical presence in an affected area, contracted a specified disease; or</text></paragraph><paragraph id="id6d577d576808485c8b705654a8e11db3"><enum>(2)</enum><text>other documentation determined by the Attorney General to demonstrate that the claimant contracted a specified disease after a period of physical presence in an affected area.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id607B83A85AB84B5997E3240CBCA55666"><enum>(d)</enum><header>Conforming amendments</header><text>Section 6 of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>) is amended—</text><paragraph id="id236653A6FA57407B8AC19BB3A96749AC"><enum>(1)</enum><text>in subsection (b)(2)(C), by striking <quote>section 4(a)(2)(C)</quote> and inserting <quote>section 4(a)(2)(D)</quote>;</text></paragraph><paragraph id="idB191AF5BBBAF4739BD494C71A9393B42"><enum>(2)</enum><text>in subsection (c)(2)—</text><subparagraph id="idBD9C83CD9B1D44A88E1E59B03732516B"><enum>(A)</enum><text>in subparagraph (A)—</text><clause commented="no" id="idCFEE79D3DBA145409D960969B87F08CA"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>; and</text></clause><clause commented="no" id="idE24FFE68EDF942D287682D02F62A2243"><enum>(ii)</enum><text>in clause (i), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>; and</text></clause></subparagraph><subparagraph id="idB1320F4C19E04C84830915B784B414D1"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>section 4(a)(2)(C)</quote> and inserting <quote>section 4(a)(2)(D)</quote>; and</text></subparagraph></paragraph><paragraph id="idD61451F55D5D41BEA121C4BEDF097F2C" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>in subsection (e), by striking <quote>subsection (a)(1), (a)(2)(A), or (a)(2)(B) of section 4</quote> and inserting <quote>subsection (a)(1), (a)(2)(A), (a)(2)(B), or (a)(2)(C) of section 4</quote>.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id994461b6e47c4f8e9a23e5996e553357"><enum>3.</enum><header display-inline="yes-display-inline">Study on counties affected by radiation fall-out due to open air nuclear testing conducted in Nevada and New Mexico</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of Energy, shall conduct a research study and report to Congress on which counties were affected by radiation fall-out due to open air nuclear testing conducted in Nevada and New Mexico, as identified using evidence-based analysis.</text></section></legis-body></bill>
