<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 4402</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240523">May 23, 2024</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Benjamin Harrison National Recreation Area and Wilderness in the State of Indiana, and for other purposes.</official-title></form><legis-body><section id="id82A19C87BAFE4DDBA46140047FC769D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Benjamin Harrison National Recreation Area and Wilderness Establishment Act of 2024</short-title></quote>.</text></section><section id="id2eeead4c5c7446b384942c41031d7ef8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ida3cd8ba4deff4c9a99bb1dcad9907810"><enum>(1)</enum><header>Advisory committee</header><text>The term <term>Advisory Committee</term> means the advisory committee for the National Recreation Area established under section 4(a)(1).</text></paragraph><paragraph id="id0726591315404470830842b920a98605"><enum>(2)</enum><header>Management plan</header><text>The term <term>Management Plan</term> means the management plan for the National Recreation Area and Wilderness developed under section 4(b).</text></paragraph><paragraph id="idbe7bd91acc6f44b3b7d8a72eeecac387"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Benjamin Harrison National Recreation Area and Wilderness Establishment Act of 2023</quote> and dated March 27, 2024.</text></paragraph><paragraph id="id363b5248aa4447758b0ba8f76505c53a"><enum>(4)</enum><header>National recreation area</header><text>The term <term>National Recreation Area</term> means the Benjamin Harrison National Recreation Area established by section 3(a)(2).</text></paragraph><paragraph id="id0fe19b26113849d6853f0a5ebfc6bd9b"><enum>(5)</enum><header>National recreation area and wilderness</header><text>The term <term>National Recreation Area and Wilderness</term> means the Benjamin Harrison National Recreation Area and Wilderness established by section 3(a)(1).</text></paragraph><paragraph id="id6362a275484b4d06a888b5e0ea7b2cdb"><enum>(6)</enum><header>Nonwilderness corridor</header><text>The term <term>nonwilderness corridor</term> means the land 100 feet in width from either side of the centerline of the existing trails and roads, as depicted on the map as <quote>Non-Wilderness Corridor</quote>, which is not included as part of the <quote>Proposed Wilderness</quote>, as depicted on the map. </text></paragraph><paragraph id="idbcc26ea328464862abda8bd28f3482c7"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph><paragraph id="idde42df0ff8ff4570ae9af2d3cd5313ca"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means the State of Indiana.</text></paragraph><paragraph id="id09950d926783433a9412881cc1de6181"><enum>(9)</enum><header>Wilderness addition</header><text>The term <term>Wilderness addition</term> means the land added to the Charles C. Deam Wilderness by section 3(a)(3).</text></paragraph></section><section id="id64b1b663acc347b0b244a713a3a2d9a7"><enum>3.</enum><header>Benjamin Harrison National Recreation Area and Wilderness</header><subsection id="id8eebdb9f453e41fcb330fe68541f18a8"><enum>(a)</enum><header>Establishment</header><paragraph id="id0461778116d04e71a7dd93b9068b6abe"><enum>(1)</enum><header>In general</header><text>There is established in the State the Benjamin Harrison National Recreation Area and Wilderness as a subunit of the Hoosier National Forest, consisting of—</text><subparagraph id="idfdb9f2bb66bb44f9a97896fe8d0e6ef4"><enum>(A)</enum><text>the National Recreation Area; and</text></subparagraph><subparagraph id="id39a257a7036b45c1a9678624dc72dd58"><enum>(B)</enum><text>the Wilderness addition.</text></subparagraph></paragraph><paragraph id="id2bf9587b93454fcbbd30b393cdd5205f"><enum>(2)</enum><header>Benjamin harrison national recreation area</header><text>There is established in the State the Benjamin Harrison National Recreation Area, consisting of approximately 29,382 acres of National Forest System land depicted on the map as <quote>Proposed National Recreation Area (NRA)</quote>.</text></paragraph><paragraph id="ide7845ec71940441daf101c0ee201dc32"><enum>(3)</enum><header>Charles c. deam wilderness addition</header><text>The approximately 15,300 acres of National Forest System land in the State generally depicted on the map as <quote>Proposed Wilderness</quote> shall be added to and administered as part of the Charles C. Deam Wilderness in accordance with <external-xref legal-doc="public-law" parsable-cite="pl/97/384">Public Law 97–384</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1132">16 U.S.C. 1132</external-xref> note; 96 Stat. 1942), consisting of—</text><subparagraph id="id019c24b63c17478cbfbf5a56f19ffe9d"><enum>(A)</enum><text>the approximately 2,028.8 acres of National Forest System land in the State generally depicted on the map as the <quote>Deckard Ridge Units A, B, and C</quote>;</text></subparagraph><subparagraph id="id14a5686e84644ad2afd4efd2a6069230"><enum>(B)</enum><text>the approximately 2,633 acres of National Forest System land in the State generally depicted on the map as the <quote>Panther Creek Units A and B</quote>;</text></subparagraph><subparagraph id="idc781317116f647deb6a8951df1870b50"><enum>(C)</enum><text>the approximately 5,456.9 acres of National Forest System land in the State generally depicted on the map as the <quote>Nebo Ridge Units A, B, C, D, and E</quote>;</text></subparagraph><subparagraph id="idef3d817d99974894b4729a0978b60dfb"><enum>(D)</enum><text>the approximately 2,141.4 acres of National Forest System land in the State generally depicted on the map as the <quote>Browning Mountain Unit</quote>;</text></subparagraph><subparagraph id="id1b78c6fe44834d15b9cc3840a4560ef8"><enum>(E)</enum><text>the approximately 2,161.9 acres of National Forest System land in the State generally depicted on the map as the <quote>Hickory Ridge Units A, B, C, D, and E</quote>; and</text></subparagraph><subparagraph id="idcb1187dd01374528b3158e768e156053"><enum>(F)</enum><text>the approximately 878.3 acres of National Forest System land in the State generally depicted on the map as the <quote>Mose Ray Branch Unit</quote>.</text></subparagraph></paragraph><paragraph id="ide8a213d971df4e4f8e7b8f6d36b4c34b"><enum>(4)</enum><header>Availability of map</header><text>Not later than 30 days after the date of enactment of this Act, the Secretary shall file the map, and make the map available for public inspection, in the appropriate offices of the Forest Service.</text></paragraph></subsection><subsection id="id12ea7547853343189633eac555da22a0"><enum>(b)</enum><header>Administration</header><text>The Secretary shall manage—</text><paragraph id="id107ba01e547a4a7bab75c692b664fecd"><enum>(1)</enum><text>the Wilderness addition (other than the nonwilderness corridors) in a manner that is consistent with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></paragraph><paragraph id="id0471c3e4a63f4a1eb76a5781f55c3346"><enum>(2)</enum><text>the National Recreation Area in a manner that ensures—</text><subparagraph id="idd5d97c01e76442689f6f42b516e3ab43"><enum>(A)</enum><text>the protection of the water quality of the public water supply of Monroe Reservoir in the State in accordance with section 303(e)(1) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6542">16 U.S.C. 6542(e)(1)</external-xref>); and</text></subparagraph><subparagraph id="id7a7bfa68b6b0426cbc622d2a41c905eb"><enum>(B)</enum><text>the promotion of recreational opportunities in the National Recreation Area.</text></subparagraph></paragraph><paragraph id="id7a966afc5a2e4b959b5dbd9bad566a9c"><enum>(3)</enum><header>Hunting, fishing, and trapping</header><subparagraph id="id57bd15e66a78476199ec770099d6d8a4"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary shall allow hunting, fishing, and trapping in the National Recreation Area and Wilderness.</text></subparagraph><subparagraph id="id4f0aef2ae0d24dfe83175f4d03323728"><enum>(B)</enum><header>Limitations</header><text>The Secretary, in consultation with designees from the State Department of Natural Resources and the Corps of Engineers, may, for reasons of public safety, species enhancement, or management of a species listed as endangered or threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), designate areas in which, and establish seasons during which, no hunting, fishing, or trapping is permitted in the National Recreation Area and Wilderness.</text></subparagraph><subparagraph id="idde1abe2ddadc4717a4102a6be46bccd2"><enum>(C)</enum><header>Effect</header><text>Nothing in this Act affects the jurisdiction of the State with respect to fish and wildlife in the National Recreation Area and Wilderness.</text></subparagraph></paragraph><paragraph id="ide31b6274d84d4e1ab5c1996be9c6f348"><enum>(4)</enum><header>Recreation</header><subparagraph id="id471af3c23383461398a57805462352c9"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Secretary shall—</text><clause id="id079896a0ebce4230b08c3d46d985eca8"><enum>(i)</enum><text>in the National Recreation Area, continue to permit and provide for appropriate nonmotorized and motorized recreational uses, including hiking, viewing of nature and wildlife, camping, horseback riding, mountain biking, and other existing recreational uses; and</text></clause><clause id="id10eabed9b21f48e38abb37c36de73e9c"><enum>(ii)</enum><text>permit the nonmechanized recreational use of the Wilderness addition, in accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) within the boundary of the <quote>Proposed Wilderness</quote> indicated on the map.</text></clause></subparagraph><subparagraph id="idfca6181afc524ea08ccffb7fcf65e156"><enum>(B)</enum><header>Limitations</header><text>The Secretary, in consultation with designees from the State Department of Natural Resources and the Corps of Engineers, may designate zones in which, and establish periods during which, a recreational use shall not be permitted in the National Recreation Area and Wilderness under subparagraph (A) for reasons of public safety, species enhancement, or management of a species listed as endangered or threatened under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph><subparagraph id="id9cb5cf27a154486a947ff937107335c6"><enum>(C)</enum><header>Trail plan</header><text>Notwithstanding any provisions of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) or any other provision of law, the Secretary, in consultation with interested parties, shall establish a trail plan—</text><clause id="idff42f64107ca4caa85ae8a43e145589b"><enum>(i)</enum><text>to maintain existing mountain biking, hiking, and equestrian trails in the nonwilderness corridors; and</text></clause><clause id="idd3b93ca21b7b445ab1ac8d6dd6f6c065"><enum>(ii)</enum><text>to develop mountain biking, hiking, and equestrian trails in the National Recreation Area.</text></clause></subparagraph></paragraph><paragraph id="id0cf85970b68148c8bedf7c800639e07b"><enum>(5)</enum><header>Vegetation management</header><subparagraph id="id76b0abe0de4348c09f2341278c9c9243"><enum>(A)</enum><header>Wilderness addition</header><text>Consistent with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), timber removal or management shall not be permitted in the Wilderness addition, except as the Secretary determines to be necessary for public safety and management of diseases, as described in section 293.3 of title 36, Code of Federal Regulations (or a successor regulation).</text></subparagraph><subparagraph id="id0437804725714f918e56655acd5cb891"><enum>(B)</enum><header>National recreation area</header><text>Vegetation management within the National Recreation Area shall be consistent with—</text><clause id="id0981a9fb32d64b4294c6b23e1b021b70"><enum>(i)</enum><text>the Management Plan; and</text></clause><clause id="id51d28865f2fd4efcb1962be2b558758f"><enum>(ii)</enum><text>any applicable Forest Service land management plan.</text></clause></subparagraph></paragraph></subsection></section><section id="id6c58b8cdfec24b0cb51f17b1fcb09c36"><enum>4.</enum><header>National recreation area advisory committee; management plan</header><subsection id="id5f10a5da02064bdba7ca4a4d7518b782"><enum>(a)</enum><header>National recreation area federal advisory committee</header><paragraph id="idabfc31f469ef4650978b8b6b4af5b705"><enum>(1)</enum><header>Establishment</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall establish an advisory committee to advise the Secretary with respect to the management of the National Recreation Area.</text></paragraph><paragraph id="id439c6fa3a6a54103badc99a0a8d48478"><enum>(2)</enum><header>Membership</header><text>The Advisory Committee shall be composed of members appointed by the Secretary, from among—</text><subparagraph id="idd212a87f2629401aa4141a71fbf48f1f"><enum>(A)</enum><text>representatives of local government;</text></subparagraph><subparagraph id="id5c96959e6d1743fb9d6a75c50d62075f"><enum>(B)</enum><text>forest ecologists;</text></subparagraph><subparagraph id="id1841ed29f4564502a011c896cd8b24ee"><enum>(C)</enum><text>experts in dispersed recreation;</text></subparagraph><subparagraph id="id7da1568e40dc44e8b2ec8af75376a34f"><enum>(D)</enum><text>local residents who own or reside in property located not more than 2 miles from the boundary of the National Recreation Area;</text></subparagraph><subparagraph id="id1ba066be5b2e4060accad59c0d680d28"><enum>(E)</enum><text>representatives of conservation and outdoor recreation groups;</text></subparagraph><subparagraph id="id595849100b904f0495a3cd8cdc783c10"><enum>(F)</enum><text>consulting foresters;</text></subparagraph><subparagraph id="id9f647d565716431d90478a49e6f80cdf"><enum>(G)</enum><text>the Director of the State Department of Natural Resources (or designees);</text></subparagraph><subparagraph id="ida313b5ab4deb4bc5b0527794395f3c5f"><enum>(H)</enum><text>wildlife experts; and</text></subparagraph><subparagraph id="ida23827719ab9462eb6c4df9c8ef804dc"><enum>(I)</enum><text>designees from the Corps of Engineers.</text></subparagraph></paragraph></subsection><subsection id="idc517ce35b2ca4f7c9b6fab5a5d476cfc"><enum>(b)</enum><header>Management plan</header><paragraph id="idd566eecaaa734967a0190460f8885868"><enum>(1)</enum><header>In general</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall develop a comprehensive management plan for the long-term protection and management of the National Recreation Area.</text></paragraph><paragraph id="id17ce2279085c4de2ab1aece33bec9b10"><enum>(2)</enum><header>Requirements</header><text>The Management Plan shall—</text><subparagraph id="id0c00d9669f3b4ab2b5078816b94bef3a"><enum>(A)</enum><text>be developed—</text><clause id="id2454c165612c421f98b4aa6173c43c1a"><enum>(i)</enum><text>in consultation with the Advisory Committee;</text></clause><clause id="ida864bf370fae4a40bb97166833336367"><enum>(ii)</enum><text>after providing an opportunity for public comment; and</text></clause><clause id="ida286291db86f4139a9624aace4b4cb71"><enum>(iii)</enum><text>after engaging with interested or affected federally recognized Indian Tribes, other Federal agencies, and State and local governments, including the State Department of Natural Resources;</text></clause></subparagraph><subparagraph id="id492e6b9c35cb43db9430957e1d62f9a1"><enum>(B)</enum><text>address management issues associated with the National Recreation Area, including—</text><clause id="ide70319e9b9df4031ad9361f6597b0f05"><enum>(i)</enum><text>fires;</text></clause><clause id="id517d6d52f707449ba806095ee48ad18b"><enum>(ii)</enum><text>invasive species;</text></clause><clause id="ida148fd1cfe554f0c982ce39a64f9923e"><enum>(iii)</enum><text>the response to insect and disease infestations;</text></clause><clause id="ida719fff875f44f4fa2c2758d1ab310a1"><enum>(iv)</enum><text>measures needed to protect the public water supply provided by Monroe Reservoir;</text></clause><clause id="ide69fc39272f84214a57e998e9e7fa0f7"><enum>(v)</enum><text>the establishment, maintenance, and closure of camp sites, campgrounds, trails, and roadways; and</text></clause><clause id="id58459d0719354b1596535f8bcf3899b2"><enum>(vi)</enum><text>any other issues identified by the Advisory Committee; and</text></clause></subparagraph><subparagraph id="idd5444709d83947f4ae3399177f51bf3a"><enum>(C)</enum><text>include—</text><clause id="idcd89401b7b0a4d7cb9ef0d626af4de66"><enum>(i)</enum><text>measures to preserve and protect native and historical resources, flora, fauna, and recreational, scenic, and aesthetic values within the National Recreation Area; and</text></clause><clause id="id3e2baeaf4af64fe386f41fbe328006c2"><enum>(ii)</enum><text>measures to prevent degradation of the public water supply provided by Monroe Reservoir.</text></clause></subparagraph></paragraph></subsection></section><section id="idbbaf5729990d439ab791f4ffd09d75ff"><enum>5.</enum><header>Funding</header><subsection id="id3b54368fbbe34ad69b056c099f0aef41"><enum>(a)</enum><header>No additional funds</header><text>No additional funds are authorized to be appropriated to carry out this Act.</text></subsection><subsection id="id52f9eddbfa124480a23eb087dcff153b"><enum>(b)</enum><header>Use of existing funds</header><text>This Act shall be carried out using amounts otherwise made available to the Secretary.</text></subsection></section><section id="idf622d9ffab764157a3c99f2a34bc11b0"><enum>6.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act—</text><paragraph id="ide9d4c48ab937495890ce9d62731af404"><enum>(1)</enum><text>affects the Corps of Engineers use permits for flowage rights within the National Recreation Area and Wilderness established by the order entitled <quote>Joint Order Interchanging Administrative Jurisdiction of Department of the Army Lands and National Forest Lands</quote> (35 Fed. Reg. 10382 (June 25, 1970));</text></paragraph><paragraph id="idef213d9ecf0648a2b9bb36f1a4f5e239"><enum>(2)</enum><text>prevents the Corps of Engineers from carrying out the water control management plan of the Corps of Engineers within the National Recreation Area and Wilderness as described in the Corps of Engineers water control manual;</text></paragraph><paragraph id="idb9838f5f028640629710d50d758badb7"><enum>(3)</enum><text>prevents the Corps of Engineers from—</text><subparagraph id="ide784f20b273347bf8f600563e19dc690"><enum>(A)</enum><text>disposing of, or otherwise managing, real estate interests held by the Corps of Engineers as of the date of enactment of this Act; or</text></subparagraph><subparagraph id="id9ab1b9b604084e258af13d9eccb75973"><enum>(B)</enum><text>acquiring additional real estate interests required to support the operation or maintenance of Monroe Lake;</text></subparagraph></paragraph><paragraph id="id72a856963dd94542b691182105933677"><enum>(4)</enum><text>affects the use of motor vessels (as defined in section 2101 of title 46, United States Code) on Monroe Lake;</text></paragraph><paragraph id="id47e08be52ee44998830675418002a305"><enum>(5)</enum><text>results in the closure of any State or county roadway in the National Recreation Area and the nonwilderness corridors;</text></paragraph><paragraph id="idc48d65c9d528459fb4eec62781b00613"><enum>(6)</enum><text>precludes the ownership, use, or enjoyment of private land within the National Recreation Area and Wilderness;</text></paragraph><paragraph id="id77c052fb928e496d8c73c191e47f7a62"><enum>(7)</enum><text>otherwise affects access to private land or cemeteries within the National Recreation Area and Wilderness;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f8fa0779670432aa6727be33dcb20b6"><enum>(8)</enum><text display-inline="yes-display-inline">affects the access to land within the nonwilderness corridors and within 100 feet of the outer boundary of the Wilderness addition by any State or private entity or organization with a permit, special use authorization, or other right to access land within the Wilderness addition, as described in section 5(a) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1134">16 U.S.C. 1134(a)</external-xref>), for the purpose of maintaining infrastructure located within the Wilderness addition, including access by—</text><subparagraph id="id4abb361308c141c488c17cf9612ee72c"><enum>(A)</enum><text>the Smithville Telephone Company;</text></subparagraph><subparagraph id="idd762b4d97b4a459aa78e6c77817e0baf"><enum>(B)</enum><text>Jackson County Water Utility;</text></subparagraph><subparagraph id="id3a2ddc4476084ee7b2b39ca857459e49"><enum>(C)</enum><text>Jackson County Rural Electric;</text></subparagraph><subparagraph id="id45c937ca50c840308119c2ecd25931fb"><enum>(D)</enum><text>the ANR Pipeline Company;</text></subparagraph><subparagraph id="id0da77e1c2a1b41a99a1631eb99bb93dd"><enum>(E)</enum><text>the Monroe County commissioners;</text></subparagraph><subparagraph id="ide64c7f56668d408da7cb813717c3e2db"><enum>(F)</enum><text>Hoosier Trails Council, BSA; and</text></subparagraph><subparagraph id="ide6d1f0e719e74b70953949ae49681cbc"><enum>(G)</enum><text>the State Department of Natural Resources; or</text></subparagraph></paragraph><paragraph id="idedb58a52e8484224b31278e2497c77a4"><enum>(9)</enum><text>affects the access to land within the Wilderness addition by the State Department of Natural Resources or appropriate public safety officers with the use of motor vehicles, mechanized equipment, or motorboats for emergencies involving the health and safety of persons within the Wilderness addition, in accordance with section 4(c) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(c)</external-xref>). </text></paragraph></section></legis-body></bill>
