which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the Alternatives to Detention program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9637A7BE2B144A25ACF6CE24B0DECAC7"><section section-type="section-one" id="HF49AA4F5880D45ED887A3503C8BD081D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reshape Alternatives to Detention Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id61f134cc4d3649e9bcc1c4ec38f5f9ca"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id430203231b7c46a78f75562566026d29"><enum>(1)</enum><header>In general</header><text>Any term used in this Act that is used in the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) shall have the meaning given such term in section 101(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27699390dad54306a9971b6a66385cff"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section><section id="H1ED377B95CEC425B8AD705CE3950118B"><enum>3.</enum><header>Termination of certain alternatives to detention</header><subsection id="HA4EA300491EE471897E20779AB7BF3BB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date of the enactment of this Act, the Secretary shall terminate each of the following programs carried out as part of the Alternatives to Detention program of the Department of Homeland Security:</text><paragraph id="HD56DCD93947F42A58EF64EA077C6072B"><enum>(1)</enum><text>The Case Management Pilot program.</text></paragraph><paragraph id="HA579548EB8AA4281AFD74A9456527389"><enum>(2)</enum><text>The Young Adult Case Management program.</text></paragraph></subsection><subsection id="H2C91A20410AC4D5FB984B7FEC8226395"><enum>(b)</enum><header>No similar programs</header><text display-inline="yes-display-inline">In the case of a program referred to in paragraph (1) or (2) of subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="id724f38a396ec4d34b02c48ca4d70e137"><enum>(1)</enum><text display-inline="yes-display-inline">no substantially similar program may be established or carried out; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida776e1d7b7ee4844991377799ef4b62f"><enum>(2)</enum><text display-inline="yes-display-inline">no funds may be made available for such a program.</text></paragraph></subsection><subsection id="HC4A6B2D6CC8D4AD788B87CEAB13E20A7"><enum>(c)</enum><header>Reprogramming of funds</header><text display-inline="yes-display-inline">Any amount made available in advance in an appropriations Act for a program referred to in paragraph (1) or (2) of subsection (a) shall be made available to the Secretary to increase the number of detention beds at immigration detention facilities.</text></subsection><subsection id="H4C6AAA4329164E5A9AA204C0BE8313E8"><enum>(d)</enum><header>Placement in detention</header><text display-inline="yes-display-inline">The Secretary shall take such steps as may be necessary to promptly detain each individual who has been released into the United States as part of a program referred to in paragraph (1) or (2) of subsection (a). </text></subsection></section><section id="HB7D2D1E8887F4CCA8D9DDE5A976EE4C6"><enum>4.</enum><header>Limitation on participation in Alternatives to Detention</header><text display-inline="no-display-inline">No alien may be released as part of any program under the Alternatives to Detention program unless all detention beds available to the Secretary have been filled.</text></section><section id="HF2F063DC019B40F785AAEC8DF249B642"><enum>5.</enum><header>Clarification of U.S. Immigration and Customs Enforcement authority over certain aliens</header><text display-inline="no-display-inline">Nothing in this Act or any other Act may be construed to impose a limitation on the authority of U.S. Immigration and Customs Enforcement over an alien who is a participant in a program under the Alternatives to Detention program, including with respect to an action of the Office for Civil Rights and Civil Liberties of the Department of Homeland Security.</text></section><section id="H7C27200C63F5465B97DC79A9D010423F"><enum>6.</enum><header>GPS tracking of certain aliens</header><text display-inline="no-display-inline">Each alien on the nondetained docket of an immigration court shall be enrolled in the Alternatives to Detention program, with mandatory GPS monitoring—</text><paragraph commented="no" display-inline="no-display-inline" id="idfc913c29a36144ddb21fd5daaa2dfc69"><enum>(1)</enum><text display-inline="yes-display-inline">for the duration of all applicable immigration proceedings, including any appeal; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida428cb1c31a94e04828059aca2505e0f"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an alien who is ordered removed from the United States, until removal.</text></paragraph></section><section id="H988F6C1ACBBF4A06B2148906D379FD0E"><enum>7.</enum><header>Mandatory inclusion of certain aliens in the Family Expedited Removal Management program</header><subsection commented="no" display-inline="no-display-inline" id="id162da6acbda046f8831d7fc3c9a39211"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An alien described in subsection (b) shall be required to participate in the Family Expedited Removal Management program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfb3f418aa14c40f0b674b6955199ff07"><enum>(b)</enum><header>Alien described</header><text display-inline="yes-display-inline">An alien described in this subsection is—</text><paragraph commented="no" display-inline="no-display-inline" id="idf928dbfe952a4048b3d65a7950126740"><enum>(1)</enum><text display-inline="yes-display-inline">an alien who, as a member of a family unit—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide90d803c745a4cc4914eb600c73c8f62"><enum>(A)</enum><text display-inline="yes-display-inline">entered or attempted to enter the United States at any time or place other than as designated by an immigration officer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b7f24a24e294fff8cb4ba80e45ec46b"><enum>(B)</enum><text display-inline="yes-display-inline">eluded examination or inspection by an immigration officer; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbc4bd98d8d4f4a4191c079517b170ae5"><enum>(C)</enum><text display-inline="yes-display-inline">attempted to enter, or obtained entry to the United States, by a false or misleading representation or the concealment of a material fact; and </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00427e2842d74118816544726f074a4f"><enum>(2)</enum><text display-inline="yes-display-inline">an alien who is a member of such family unit. </text></paragraph></subsection></section><section id="H630558D1F96149AC841530C6F6C0B202"><enum>8.</enum><header>Notice of violation</header><text display-inline="no-display-inline">On each occasion on which an alien participating in the Alternatives to Detention program violates a condition of such participation and, as a result of such violation, becomes eligible for detention, the Secretary shall immediately—</text><paragraph commented="no" display-inline="no-display-inline" id="id4e4a9f49c93948208793cb05f1e0e69b"><enum>(1)</enum><text display-inline="yes-display-inline">publish notice of such alien's eligibility for detention on the website of the Department of Homeland Security; and <italic></italic></text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf00cf969e0e8413b83c128c89258cec5"><enum>(2)</enum><text display-inline="yes-display-inline">transmit such notice to all relevant law enforcement agencies in the vicinity of the alien’s last known whereabouts.</text></paragraph></section><section id="HEF613440E9344717AAB4774413F27DA9"><enum>9.</enum><header>Effect of residence in, relocation to, sanctuary jurisdiction</header><subsection commented="no" display-inline="no-display-inline" id="id0caba067c3374e2ca87bf10cdabf7292"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An alien shall be ineligible to participate in the Alternatives to Detention program if the alien resides or seeks to reside in a location described in subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id230fcf955dcc49e1a6d360933a429bf3"><enum>(b)</enum><header>Change of residence</header><text>The Secretary shall immediately detain an alien who, without notifying the Secretary, changes residence to a location described in subsection (c). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd2e9d05530da4efaba37779d1e92afcf"><enum>(c)</enum><header>Location described</header><text display-inline="yes-display-inline">A location described in this subsection is a State or political subdivision of a State that has in effect a law, ordinance, policy, or practice that prohibits or restricts any government entity or official from—</text><paragraph id="id21359D26A1124620BB46069ACE3A20CA"><enum>(1)</enum><text>sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity information regarding the citizenship or immigration status (lawful or unlawful) of any individual; or </text></paragraph><paragraph id="idF965E91F2D284E538BBEEFB155B16839" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>complying with a request lawfully made by the Secretary under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 or 1357) to comply with a detainer for, or notify of the release of, an alien.</text></paragraph></subsection></section><section display-inline="no-display-inline" section-type="subsequent-section" id="H54A6C23C4EF44DA5B5FAC948F369C6F8"><enum>10.</enum><header>Check-in required for participants in Intensive Supervision Appearance Program</header><subsection id="HD39D30D8A468431280B78699764B4419"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the date of the enactment of this Act, the Secretary shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id4e9779670bff4c43b8353a7529827b37"><enum>(1)</enum><text display-inline="yes-display-inline">require each covered alien—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf4950b182e88427caca4887124036a4a"><enum>(A)</enum><text display-inline="yes-display-inline">to participate in the Intensive Supervision Appearance Program, which shall include—</text><clause commented="no" display-inline="no-display-inline" id="id2dd6c9e28f974e9eb3194fae01551edc"><enum>(i)</enum><text display-inline="yes-display-inline">GPS monitoring, including through use of ankle-worn GPS and wrist-worn GPS; </text></clause><clause commented="no" display-inline="no-display-inline" id="idfa1d95bf60d54e998e6e7127c062e7a5"><enum>(ii)</enum><text display-inline="yes-display-inline">telephonic reporting, including reporting by voice recognition; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idee6c0342e7714b6d9ee72aac9db63cfb"><enum>(iii)</enum><text display-inline="yes-display-inline">home visits; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide245969f655d42f292739e8ef083805f"><enum>(B)</enum><text>to check in with the Secretary not later than 14 days after the issuance of the notice required by paragraph (2); and </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19a56e927e7f4d9fb864714c03cab938"><enum>(2)</enum><text display-inline="yes-display-inline">in a manner the Secretary considers appropriate, issue to each covered alien a notice of such requirements. </text></paragraph></subsection><subsection id="H293E672F279644DAB39E0C7F68DE4D7B"><enum>(b)</enum><header>Penalty</header><paragraph id="HC2874FF6BF0846DE86D127D9CE18A941"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if a covered alien fails to check in with the Secretary as required by subsection (a), the Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idae3bcb42236145d0bf64ee7cd0f447ef"><enum>(A)</enum><text display-inline="yes-display-inline">revoke the bond or parole under section 236(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(a)</external-xref>), pursuant to which the alien was originally released and eligible for participation in the Intensive Supervision Appearance Program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a165c41fb3f496c89e2cbe4d95583b0"><enum>(B)</enum><text display-inline="yes-display-inline">re-arrest the alien under the original warrant; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50cd535a52414e5ca65084cdd6ddd150"><enum>(C)</enum><text display-inline="yes-display-inline">detain the alien.</text></subparagraph></paragraph><paragraph id="H0C3020332630442E8F8A60D5146DDAE5"><enum>(2)</enum><header>Removal proceedings</header><subparagraph id="H01E2A8016E5A4B6399B895685522E949"><enum>(A)</enum><header>In general</header><text>The applicable immigration judge shall advance on the docket of the immigration court, and expedite to the greatest extent possible, the disposition of the removal proceedings of an alien who is re-arrested and detained under paragraph (1). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91ef1b4409e94222bf261f14c2dffa8e"><enum>(B)</enum><header>Removal order</header><text display-inline="yes-display-inline">If the immigration judge determines that such alien is subject to removal from the United States, the immigration judge shall enter an administrative order of removal.</text></subparagraph><subparagraph id="H81D331915FFF4F6498E3FD49CD1E89D4"><enum>(C)</enum><header>Appeals</header><clause commented="no" display-inline="no-display-inline" id="ida6684d32511a4c4e95d6ccfdfee1838a"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 7 days after the date on which an immigration judge enters an administrative order of removal under subparagraph (B), an alien may appeal such order to the Board of Immigration Appeals. </text></clause><clause commented="no" display-inline="no-display-inline" id="ida9bcce22dbd643fa9dac6c82558344ef"><enum>(ii)</enum><header>Hearing</header><text display-inline="yes-display-inline">Not later than 7 days after an appeal under clause (i) is filed, the Board of Immigration Appeals shall conduct a hearing on the appeal. </text></clause><clause commented="no" display-inline="no-display-inline" id="id332c3e8d1baa45fa9780eb45c9eb9b7b"><enum>(iii)</enum><header>Decision</header><text display-inline="yes-display-inline">Not later than 7 days after the date on which a hearing is conducted under clause (ii), the Board of Immigration Appeals shall issue a decision. </text></clause><clause commented="no" display-inline="no-display-inline" id="idc7dd3addfda949de9fab84d69d5fd99e"><enum>(iv)</enum><header>Removal</header><text display-inline="yes-display-inline">If the Board of Immigration Appeals issues a final administrative order of removal, the alien concerned shall be removed from the United States not later than 7 days after the date on which such order of removal is issued. </text></clause></subparagraph></paragraph></subsection><subsection id="H9D82A397CDBB48079AA12BD1C697541D"><enum>(c)</enum><header>Report</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary shall submit to Congress a report on the number and percentage of covered aliens who have checked in with the Secretary as required under subsection (a). </text></subsection><subsection id="idcb5c7abcf3d84de29e2e316c8848593a" commented="no"><enum>(d)</enum><header>Covered alien defined</header><text>In this section, the term <term>covered alien</term> means an alien who is present in the United States and enrolled in the Intensive Supervision Appearance Program on the date of the enactment of this Act.</text></subsection></section><section id="H83753DE6042A49BEAAE4CA8E303E1312"><enum>11.</enum><header>Requirement to submit biometric information</header><subsection id="HD0C7E89CF962465BB685C8E4F069A664"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall require an alien arriving in the United States to submit biometric information to the Secretary as a condition of eligibility for participation in the Alternatives to Detention program.</text></subsection><subsection id="H363CFD1DA0B2451994137967BC0CE520"><enum>(b)</enum><header>Interoperability and information matching</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent practicable, that any biometric information collected pursuant to subsection (a) is stored in a manner that is interoperable with, and allows matching against, other Federal, State, and local law enforcement databases that store biometric information of known or suspected terrorists or identify visa holders who violate the terms of their visas.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id6de56554ecde41eba2368c08c8562640"><enum>12.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed to absolve the Secretary of the duty to detain and remove aliens consistent with the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>). </text></section></legis-body></bill>
