which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, and the Internal Revenue Code of 1986 to require that group health plans and health insurance issuers offering group or individual health insurance that provide coverage for mental health services and substance use disorder services provide such services without the imposition of cost-sharing from the diagnosis of pregnancy through the 1-year period following such pregnancy, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEBCBBE39C3D54838A42E71BA1AE5B500"><section section-type="section-one" id="HB7FA983DEB5741FC84774C24A29F31FF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mental Health and Making Access More Affordable Act of 2024</short-title></quote> or the <quote><short-title>Mental Health and MAMA Act of 2024</short-title></quote>.</text></section><section id="H33FE6295AF91409691BC92E0A847BB81"><enum>2.</enum><header>Cost-sharing with respect to mental health services and substance use disorder services for pregnant and postpartum individuals</header><subsection id="H438305AB272941D48951C3E2FE6566E9"><enum>(a)</enum><header>PHSA</header><paragraph id="H3BCCC87B643141D4ABB0A061C01DC3D9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Part D of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-111">42 U.S.C. 300gg–111 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF5468A27BF6E4F6FB9803BA5AC29F278"><section id="H008E05A5B3454D0581383F697A626E27"><enum>2799A–11.</enum><header>Cost-sharing requirements with respect to mental health services and substance use disorder services for pregnant and postpartum individuals</header><subsection id="H71683310A77C46288724394F4419482C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a group health plan or a health insurance issuer offering group or individual health insurance coverage that provides a benefit for mental health services or substance use disorder services (including such services which are telehealth services and are provided under such plan or coverage) with respect to plan years beginning on or after the date that is 2 years after the date of enactment of this section, the plan or coverage shall not impose any cost-sharing requirement for such services that are furnished by an in-network provider to a participant, beneficiary, or enrollee under the plan or coverage from the diagnosis of pregnancy (as defined by the Secretary) through the 1-year period beginning on the day after the last day of such pregnancy of such participant, beneficiary, or enrollee (or, in the case of an individual enrolled in such plan or coverage for a portion of such period, during such portion).</text></subsection><subsection id="HEA6481FA9B924392ACAB76604801A9DB"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H637CD19186984D0985AF18730D6DFA6E"><enum>(1)</enum><text>The terms <term>mental health services</term> and <term>substance use disorder services</term> have the meaning given such terms for purposes of section 2726. </text></paragraph><paragraph id="H48DCB2D1F8F74C8EA96F3B58C14BC168"><enum>(2)</enum><text>The term <term>telehealth service</term> means a service that is furnished through telehealth technologies (as defined in section 330I(a)). </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8D2D7CAC719840A5AD6CE9A204744F99"><enum>(2)</enum><header>Continuity of care</header><text display-inline="yes-display-inline">Section 2799A–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-113">42 U.S.C. 300gg–113</external-xref>) is amended—</text><subparagraph id="H0753BCCF222A4D36B98949B63945DB9E"><enum>(A)</enum><text>in subsection (a)(2)(C), by inserting <quote>, in the case of a continuing care patient described in subsection (b)(1)(D)(ii), the date on which such individual is no longer such a continuing care patient with respect to such provider or facility, or in the case of a continuing care patient described in subsection (b)(1) other than in subparagraph (D)(ii) of such subsection,</quote> after <quote>is provided and ending on</quote>; and </text></subparagraph><subparagraph id="HB3A758C5C840425296E1ECBBDEA76A47"><enum>(B)</enum><text>by amending subsection (b)(1)(D) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D80D23BD33A4704B8417552320CDA16"><subparagraph id="H938E1D9C337A465FACC9D67C73EBA901"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HBC5E52DB7F4246F1A54A6994F754DFFF"><enum>(i)</enum><text>is pregnant and undergoing a course of treatment for the pregnancy from the provider or facility; or</text></clause><clause commented="no" id="HF048DFD0F8EF44FE8985C26895684AB2" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H333C75AC7E8B4E9FA8727EE894ABD10E"><enum>(I)</enum><text>requires mental health services or substance use disorder services from a provider or facility following a pregnancy;</text></subclause><subclause commented="no" id="H2E39C57A5C094298A33DD44729D1349D" indent="up1"><enum>(II)</enum><text>received a course of mental health or substance use disorder treatment from such provider or facility while pregnant; and</text></subclause><subclause commented="no" id="H87B976226A3241669B921FD87070D13C" indent="up1"><enum>(III)</enum><text>the last day of such pregnancy occurred during the previous 1-year period; or</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HF466530CBBD04A76B2591EDC036949DA"><enum>(b)</enum><header>ERISA</header><paragraph id="H8D9A9E23900047C6BC04CA57457D76BA"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H352CB3C7C676473AAAACB43E1AFED12A"><section id="H2E10C7322C0443E78CAA8D407D23E202"><enum>726.</enum><header>Cost-sharing requirements with respect to mental health services and substance use disorder services for pregnant and postpartum individuals</header><subsection id="HD042C6C2D6F34066B81587B31EE81A63"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a group health plan or a health insurance issuer offering group health insurance coverage that provides a benefit for mental health services or substance use disorder services (including such services which are telehealth services and are provided under such plan or coverage) with respect to plan years beginning on or after the date that is 2 years after the date of enactment of this section, the plan or coverage shall not impose any cost-sharing requirement for such services that are furnished by an in-network provider to a participant or beneficiary under the plan or coverage from the diagnosis of pregnancy (as defined by the Secretary) through the 1-year period beginning on the day after the last day of such pregnancy of such participant or beneficiary (or, in the case of an individual enrolled in such plan or coverage for a portion of such period, during such portion).</text></subsection><subsection id="HF0846A361E7D46F3832AA7EFCE7584BB"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H67C973358DC746048CC915E09FA960BC"><enum>(1)</enum><text>The terms <term>mental health services</term> and <term>substance use disorder services</term> have the meaning given such terms for purposes of section 712.</text></paragraph><paragraph id="H2535998377B6437EAAE9A98811AA6FAB"><enum>(2)</enum><text>The term <term>telehealth service</term> means a service that is furnished through telehealth technologies (as defined in section 330I(a) of the Public Health Service Act).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H841FCECF3FB247AA8D2C7B5DC4802346"><enum>(2)</enum><header>Continuity of care</header><text>Section 718 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185g">29 U.S.C. 1185g</external-xref>) is amended—</text><subparagraph id="HC6A72C94032443A19BC5B653240958FE"><enum>(A)</enum><text>in subsection (a)(2)(C), by inserting <quote>, in the case of a continuing care patient described in subsection (b)(1)(D)(ii), the date on which such individual is no longer such a continuing care patient with respect to such provider or facility, or in the case of a continuing care patient described in subsection (b)(1) other than in subparagraph (D)(ii) of such subsection,</quote> after <quote>is provided and ending on</quote>; and</text></subparagraph><subparagraph id="H7C1EB981AB1542CFAE9498BFA06D53C6"><enum>(B)</enum><text>by amending subsection (b)(1)(D) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA27B77E291D94B5EBC726CBF5C4C7314"><subparagraph id="H521045FCDDFE43C0A6DFE78197361225"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HF1C9699AC2954BFC8DFFDBF600F6B1E4"><enum>(i)</enum><text display-inline="yes-display-inline">is pregnant and undergoing a course of treatment for the pregnancy from the provider or facility; or</text></clause><clause id="HBB440C17318D4D00923DE07103E51540" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H9B1A8F84EA4247CC8A6626C0C900680A"><enum>(I)</enum><text>requires mental health services or substance use disorder services from a provider or facility following a pregnancy;</text></subclause><subclause id="HCB1DA949516D4B47B91CAD1BE9E370ED" indent="up1"><enum>(II)</enum><text>received a course of mental health or substance use disorder treatment from such provider or facility while pregnant; and</text></subclause><subclause id="HC4208387E3444195A4D1F294F910D90E" indent="up1"><enum>(III)</enum><text>the last day of such pregnancy occurred during the previous 1-year period; or</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H94F6A1A283004F2CB03FF43A59BD1116"><enum>(3)</enum><header>Clerical amendment</header><text>The table of contents in section 1 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after the item relating to section 725 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF96F519808274B6F81BF1FBAE03F09FF"><toc><toc-entry bold="off" level="section">Sec. 726. Cost-sharing requirements with respect to mental health services and substance use disorder services for pregnant and postpartum individuals.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0B45DB2A4FAC4031B2C2770C47AE47A7"><enum>(c)</enum><header>IRC</header><paragraph id="H2514E180A598492281D2041AA0F766A3"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H98CCC49718FC48CEB4AB896FB17632CC"><section id="H5A5CCD162EF04D5F8D55966886FBB416"><enum>9826.</enum><header>Cost-sharing requirements with respect to mental health services and substance use disorder services for pregnant and postpartum individuals</header><subsection id="H06D1A45D71EE451B9739368A22B74541"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a group health plan that provides a benefit for mental health services or substance use disorder services (including such services which are telehealth services and are provided under such plan) with respect to plan years beginning on or after the date that is 2 years after the date of enactment of this section, the plan shall not impose any cost-sharing requirement for such services that are furnished by an in-network provider to a participant or beneficiary under the plan from the diagnosis of pregnancy (as defined by the Secretary) through the 1-year period beginning on the day after the last day of such pregnancy of such participant or beneficiary (or, in the case of an individual enrolled in such plan for a portion of such period, during such portion).</text></subsection><subsection id="H8846D1D316B34D62984AF740A3EFC5AC"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HCF01161C54B0442BA0280AE13E649CEF"><enum>(1)</enum><text>The terms <term>mental health services</term> and <term>substance use disorder services</term> have the meaning given such terms for purposes of section 9812.</text></paragraph><paragraph id="HFF7770018F1349579B35F5C958B53CBF"><enum>(2)</enum><text>The term <term>telehealth service</term> means a service that is furnished through telehealth technologies (as defined in section 330I(a) of the Public Health Service Act).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H210E445C101B461198326EAC541466E0"><enum>(2)</enum><header>Continuity of care</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9818">Section 9818</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph id="H43A8B40750F44537B95C5E4A60C164B9"><enum>(A)</enum><text>in subsection (a)(2)(C), by inserting <quote>, in the case of a continuing care patient described in subsection (b)(1)(D)(ii), the date on which such individual is no longer such a continuing care patient with respect to such provider or facility, or in the case of a continuing care patient described in subsection (b)(1) other than in subparagraph (D)(ii) of such subsection,</quote> after <quote>is provided and ending on</quote>; and</text></subparagraph><subparagraph id="H57F16EDBF8DE4BBFA1211C42BEA59847"><enum>(B)</enum><text>by amending subsection (b)(1)(D) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H939169243CF143BCA6C850B76A99224D"><subparagraph id="HB87946124CCF44A9B08E9BD2E04AF4A8"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H814126D83EE4451BBA44721534CEA077"><enum>(i)</enum><text>is pregnant and undergoing a course of treatment for the pregnancy from the provider or facility; or</text></clause><clause id="H8C2E9FB1EF7545B5ACBD9C806A4DB444" indent="up1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HDDECA891522047FDBB490DBE8BD52219"><enum>(I)</enum><text display-inline="yes-display-inline">requires mental health services or substance use disorder services from a provider or facility following a pregnancy;</text></subclause><subclause id="HAA4DCF2D93C54673868444115BCE35FD" indent="up1"><enum>(II)</enum><text>received a course of mental health or substance use disorder treatment from such provider or facility while pregnant; and</text></subclause><subclause id="HA6E17A1C8E16451F984B0688093E175C" indent="up1"><enum>(III)</enum><text>the last day of such pregnancy occurred during the previous 1-year period; or</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA3405FD4B3144DB4A1705614FB40B37C"><enum>(3)</enum><header>Clerical amendment</header><text>The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H115996A9E5564496B9DC26D696E1564F"><toc><toc-entry bold="off" level="section">Sec. 9826. Cost-sharing requirements with respect to mental health services and substance use disorder services for pregnant and postpartum individuals.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida7cecec218fc4023b4d7f63ca521d18e"><enum>(d)</enum><header>Effective date</header><text>The amendments made by subsections (a), (b), and (c) shall apply with respect to plan years beginning on or after the date that is 2 years after the date of enactment of this Act.</text></subsection><subsection id="HF0E8BB0DB08346DDA67C2B829B59A07B"><enum>(e)</enum><header>FEHBP</header><paragraph id="H54B7253F424A4C698E0DBEDA4E66CDC4"><enum>(1)</enum><header>In general</header><text>Section 8902(p) of title 5, United States Code, is amended—</text><subparagraph id="H06F392C35D9746C1BF4912B095CCC328"><enum>(A)</enum><text>by striking <quote>and 2799A–7</quote> and inserting <quote>2799A–7, and 2799A–11</quote>;</text></subparagraph><subparagraph id="HCBA37D26058D4CB492E9B9DE99ADFA6A"><enum>(B)</enum><text>by striking <quote>and 722</quote> and inserting <quote>722, and 726</quote>; and</text></subparagraph><subparagraph id="H207C04DED2694637BDB62A3AC645D2B0"><enum>(C)</enum><text>by striking <quote>and 9822</quote> and inserting <quote>9822, and 9826</quote>. </text></subparagraph></paragraph><paragraph id="H8D393C8E74764810819E9161C1CC4E53"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall apply with respect to contracts entered into or renewed for contract years beginning on or after the date that is 2 years after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
